Tom,
I apologize for the delay in my response. I just received Coastal Land Design's purpose and need information, for the
secondary access drive (see attached). It is important to note, but was not clearly stated in the engineer's statement, the
proposed crossing will be the primary access for the Applicant, family, friends and smaller delivery services, such as pizza
delivery. The existing drive will only be used for larger delivery services, such as Fed Ex or UPS, reducing the number of
trips through the Oak Street community, an issue that was brought up many times during the projects Special Use
Permit process.
Based on the engineer's comments, it is of my opinion that the proposed plan is the only practicable alternative.

Mrs. Dana Lutheran,
Referencing your 6/17/2020 NWP# 18 request, you submitted for the Department of the Army (DA) authorization to
discharge fill material into approximately 1,050 square feet of jurisdictional waters of the U.S. for the construction of
new access to property.
Based on our review of the plans provided in the application and the Corps site visit on 7/23/2020 we believe that the
location of the new access with impacts to jurisdictional waters on the property could be avoidable by utilizing the
existing access. The Corps is moving to denial on your proposal, in its present form, does not comply with the conditions
of avoidance to waters of the US. As discussed with you, our recommendation is to utilize existing access on the
property. By avoiding impacts to Waters of the U.S. and utilizing the available access a permit from the Corps will not be
required.
