Authorizing development in Brunswick County at adj. to the AIWW, 1683 Rabbit Trail SW,
Ocean Isle Beach as requested in the permittee's letter dated dated received in
Wilmington on 10/23/09, including the attached workplan drawing (1), dated faxed 10/21/09
This permit, issued on February 9. 2010 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this minor modification authorizes the reconfigured docking facility, all
as expressly and specifically set forth in the attached workplan drawing. No other additional structures,
whether floating or stationary, or any additional boat slips, shall become a permanent part of this docking
facility without permit modification. No non-water dependent uses of structures shall be conducted on, in
or over public trust waters without permit modification.
2) The reconfigured docking facility and associated structures shall have a minimum setback distance of 15
feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is
determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line
that intersects with the shore at the point where the upland property line meets the water's edge.
3) The reconfigure docking facility shall not extend more than 1/a of the width of the waterbody, as measured
from the waterward edge of the marsh on both sides of the AIWW immediately in front of the project site.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.

3) In order to insure to compliance with conditions No. 2 and 3 of this minor modification, an as built
survey showing the location and dimensions of the constructed structure, the distance across the
waterbody as measured from the waterward edge of the Coastal Wetlands on both sides of the AIWW
immediately in from of the project site, and the distance to the neighboring riparian corridors, shall be
performed on the facility, and copies of the survey shall be provided to the Division of Coastal
Management, within 60 days of completion of construction.
4) This minor modification shall be attached to the original Permit No. 173-07, which was issued on 11/8/07
and the amend permit of 9/9/09, and copies of all documents shall be readily available on site when
Division personnel inspect the project for compliance.
5) All conditions and stipulations of the active permit remain in force under this minor modification unless
specifically altered herein.
NOTE: The expiration date of this permit has been extended in accordance with Session Law 2009-406.

Provosed Modification of Mike Owen's Pier Proiect
Permit # 173-07 Issued on November 8, 2007
My client Mike Owen, the current owner of 1683 Rabbit Trail Road in Ocean Isle, would like to
rearrange the Tee Head configuration of his pier. He would like to move his sitting area to the 1/4
rule pier head line with a ramp in front of the sitting area coming off of a 4 X 4 platform from the
East side going down toward the West side of the dock onto the 8 X 16 floating dock which is
also to the 1/4 rule pier head line on the West side of his sitting area. He would like to enlarge his
sitting area to a 12 ft. 6 in. X 12 ft. 6 in. from a 10 X 10. On the East side at the gazebo Mr.
Owen would like to install a 2 pole elevator lift for a small boat. Since his floating dock will be
against the gazebo, he will not be creating a third slip.
