As you can see the ditches that exist on the site appear to have drained the property according to the contractor's consultant. I am offering your office to accompany the Corps, NCDOT, DWR, and Balfour Beatty's consultant on a site visit to verify the current conditions of the site. I know it's not much lead time but this visit would need to occur within the next three weeks, no later than Sept 20. Please advise if you would like to accompany us during this site visit. Once the site visit has occurred the Corps will need to make a verification decision as the client needs to procure more borrow to complete the on-going project. Further, an AJD, a proffered individual permit (and all terms and conditions contained therein), or individual permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to make an official determination whether geographic jurisdiction exists over aquatic resources in the review area, or to provide an official delineation of jurisdictional aquatic resources in the review area, the Corps will provide an AJD to accomplish that result, as soon as is practicable.
