This project will require the replacement of two (2) wet cross lines as shown below: 1) Replace existing 30'x 30" CMP at station 9+84 with a 40'x 30" CMP. 2) Replace existing 50'x 48" CMP at station 10+20 with a 60'x 48" CMP. Miscellaneous rip-rap impacts will total 20 linear feet or less. New stream impacts = 401n. feet. The wet crossing at station 9+84 carries an unnamed tributary to Benbo Branch. The wet crossing at station 10+20 carries Benbo Branch (Class: C). No Threatened or Endangered Species (or their critical habitat) will be impacted by this project. The total project length is approximately 0.3 miles. Due to the proposed work, we are requesting a 404 Nationwide Permit #14. Since this is an existing roadway, the minor modifications proposed in this application should not remove or degrade existing water quality uses. By utilizing the erosion control measures outlined in the attachments to this application, downstream water quality standards will be protected. Any widening of the existing roadway will be directed away from any adjacent creek whenever possible with minimum fill placed in any buffer area. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The existing; roadway must be widened to achieve an acceptable section width, thus increasing- public safety. The existing pipes must be replaced for the same reason. By utilizing the erosion control measures as shown in the attached drawings, adverse impacts to streams in the area will be minimized. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater. than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.ne.us/ncwetlands/strmgide.html. 1. SRI 396, Daisy Place Road 2 June 25, 2001 I 2. If concrete will be used, work must be accomplished so that wet concrete does not contact stream water. This will lessen the chance of altering the stream's water chemistry and causing a fish kill. 3. Heavy equipment should be operated from the bank rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 4. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds (15A NCAC 4B .0024). 5. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 5 days of ground disturbing activities to provide long-term erosion control. We encourage NCDOT to utilize onsite vegetation and materials for streambank stabilization when practicable. 6. Instream activities are prohibited during the redbreast sunfish and small mouth bass spawning season of May 1 through July 15 to prevent off-site sedimentation from impacting fish eggs and fry downstream of the site. TO: Steve Lund, USACOE Asheville Field Office FROM: Ron Linville, Regional Coordinator Habitat Conservation Program DATE: June 25, 2001 SUBJECT: North Carolina Department of Transportation (NCDOT), SR1396, Daisy Place Road, Unnamed Tributaries to Benbo Branch, Caldwell County These comments are provided in accordance with the provisions of the Fish and = . Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the'North Carolina Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25). The NCDOT proposes to grade, drain, base, and pave the existing roadway. Station 9+84 will require replacing 30' of 30" CUT with 40' of 30" CMP. Station 10+20 will require... replacing 50' of 48" CMP with 60' of 48" CUT. The Johns River supports various state and federal listed species. A direct or indirect impact to any listed species is a concern. Sediment and siltation impacts must be limited in order to protect aquatic species downstream. The area of impacts should be surveyed, if not already accomplished, for any listed species prior to construction. If any species are found, NCDOT should coordinate a resolution with the NCWRC and the USFWS. Providing no listed species are present in the area of direct impacts, we will not object to the project provided the following conditions are implemented: 1. The CMPs should be designed and constructed large enough so that they can be installed approximately one foot below streambed grade so that all waters can flow through without freefalling or damming on either end during low flow conditions to maintain aquatic life passage. The dimension, pattern, and profile of the stream above and below the CMPs should not be modified by widening the stream channel or reducing the depth of the stream.
