APPROVAL of 401 Water Quality Certification with Additional Conditions: MODIFICATION

Dear Mr. Slaughter:
You have our approval, in accordance with the attached conditions and those listed below, to impact an
additional 40 linear feet of an unnamed tributary to the Yadkin River. Previous impacts of 40 linear feet
to one UT of Yadkin River and Bailey Camp Creek were authorized initially in a Water Quality
Certification issued on April 11, 2001. These impacts are unavoidable in order to improve SR 1500
(Blackberry Road) in Caldwell County. The project should be constructed in accordance with your
application dated September 5, 2002 (received September 10, 2002). After reviewing your application,
we have decided that this fill is covered by General Water Quality Certification No. 3375 corresponding
to the U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you should acquire any
other federal, state or local permits before you proceed with your project including (but not limited to)
Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval
will expire with the accompanying 404 permit unless otherwise specified in the Water Quality
Certification.
This approval is valid solely for the purpose and design described in your application (unless modified
below). Should your project change, you must notify the DWQ and submit a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter, and is
thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in
the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
1. NCDOT shall implement Best Management Practices for the Protection of Surface Waters (NCDOT
March 1997) and adhere to Sedimentation and Erosion Control Guidelines for Sensitive Watersheds
(15A NCAC 413 .0124) prior to any ground-disturbing activities to minimize impacts to downstream
aquatic resources.
2. If deemed applicable by the NC Wildlife Resources Commission, in-stream work and land
disturbance within the 25-foot wide buffer zone are prohibited during the trout spawning season of
October 15 through April 15, or other conditions as determined by NCWRC, to protect the egg and
fry stages of trout from sedimentation during construction.
3. Where practicable, storm water should be directed to buffer areas or retention basins and must not be
routed directly into streams. Mowing of existing vegetated buffers is strongly discouraged, so that
they may be utilized for storm water sheet flow.
4. All work shall be performed during low flow conditions.

5. All mechanized equipment operated near surface waters must be regularly inspected and maintained
to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic
materials.
6. Riparian vegetation must be reestablished within the construction limits of the project by the end of
the growing season following completion of construction.
7. NCDOT is encouraged, to use existing on-site vegetation and materials for stream bank stabilization
and to minimize the use of rip rap.
8. The pipes required for this project shall be installed in such a manner that the original stream profile
is not altered (i.e. the depth of the channel must not be reduced by a widening of the streambed).
Existing stream dimensions (including the pattern and profile) are to be maintained above and below
locations of each culvert. The culvert shall be designed and installed to allow for fish and other
wildlife movement as well as prevent headcutting of the streams. If any of the existing pipes are
perched, they shall be removed and replaced, and installed correctly.
9. NCDOT must submit a plan for written DWQ approval to address any headcutting that will occur as a
result of this project.
10. Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be planted
when practical. If rip-rap is necessary, it must be limited to the stream bank above the high water
mark. Rip rap shall not be placed in the stream bottom.
11: The presence of equipment in the channels must be minimized. Under no circumstances must rock,
sand or other materials be dredged from the wetted stream channel under authorization of this permit,
except in the immediate vicinity of the culverts.
12. Upon completion of the project, the NCDOT shall complete and return the enclosed
"Certificate of Completion" form to notify NCDWQ when all work included in the §401
Certification has been completed. The responsible party shall complete the attached form
and return it to the 401/Wetlands Unit of the NC Division of Water Quality upon
completion of the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

As you may recall, a compliance inspection of the subject road was conducted on. August 13,
2002. At that time we looked into the possibility of widening the driveway running through the
property of Mr. Reece McLean on the south side of SR 1500 adjacent to station 71+00. At the
time of the field inspection a pipe extension of 20-feet was agreeable. Therefore, in addition to
the previously authorized impacts associated with this project we are requesting written
authorization to extend Mr McT ean's driveway pipe by 20 et. Upon written authorization,
waste material from the project will be placed over the extension, thus increasing the width of said
driveway.
Miscellaneous rip-rap impacts will total 20 linear feet or less. New stream impacts = 40 In. feet.
Construction of this proposed modification will require impacts to waters of the United States in
the Yadkin River Basin. The above noted wet cross line adjacent to station 71+00 carries an
unnamed tributary to the Yadkin River (Class: C, Trout). The Division 11 Environmental Officer
reviewed this project for the presence of threatened and endangered species on August 13, 2002
and reviewed the project area on ArcView. The subject project will have no effect on. any
federally listed endangered plant or animal species. Historic compliance work will be scheduled
and concurrence with the State Historic Preservation Office will be obtained if required.
Since this is an existing driveway, the minor modifications proposed in this application should not

appropriate BMPs will be used during construction.
Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control
measures, a marked county map and a marked topography map.
By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with
the North Carolina Wildlife Resources Commission comment directly to you concerning the 404
Nationwide Permit application with a copy sent to me.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial.
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration

Dear Mr. Slaughter:
You have our approval, in accordance with the attached conditions and those listed below, to impact 40
linear feet of an unnamed tributary to the Yadkin River and Bailey Camp Creek in order to improve SR
1500 (Blackberry Road) and place three wet pipes in Caldwell County. The project should be constructed
in accordance with your application dated 13 February 2001. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification No. 3289 corresponding to the
U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you should acquire any other
federal, state or local permits before you proceed with your project including (but not limited to)
Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval
will expire with the accompanying 404 permit unless otherwise specified in the Water Quality
Certification. , .
This approval is valid solely for the purpose and design described in your application (unless modified
below). Should your project change, you must notify the DWQ and submit a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter, and is
thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in
the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
1. In-stream work and land disturbance within the 25-foot wide buffer zone are prohibited during the
trout spawning season of October 15 through April 15, or as otherwise determined by the North
Carolina Wildlife Resources Commission, to protect the egg and fry stages of trout from
sedimentation during construction.
2. Storm water should be directed to buffer areas or retention basins and should not be routed directly
into streams.
3. Sedimentation and Erosion Control Guidelines for Sensitive Watersheds (15A NCAC 4B .0024) must
be implemented prior to any ground-disturbing activities to minimize impacts to downstream aquatic
resources. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 5
days of ground-disturbing activities to provide long term erosion control.
4. The culvert required for this project shall be installed in such a manner that the original stream profile
is not altered (i.e. the depth of the channel should not be reduced by a widening of the streambed).
Existing stream dimensions are to be maintained above and below locations of culvert extensions.
5. All work shall be performed during low flow conditions.

6. All mechanized equipment operated near surface waters should be regularly inspected and maintained
to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic
materials.
7. The presence of equipment in the channels must be minimized. Under no circumstances should rock,
sand or other materials be dredged from the wetted stream channel under authorization of this permit,
except in the immediate vicinity of the culverts.
8. Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for storm
water sheet flow.
9. Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be planted
when practical. If necessary, rip-rap should be limited to the stream bank below the high water mark,
and vegetation should be used for stabilization above high water.
10. Rock silt screens at culvert outlets should be removed .at project completion.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a
hearing, send a written petition which conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C.
27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.

These comments are provided in accordance with the provisions of the Fish and
Wildlife Coordination. Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the North
Carolina Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25). The
NCDOT proposes to grade, drain, base, and pave the referenced road. Three pipes are to
be replaced at Stations 32+05 (Bailey Creek) and 68+50 and 129+80 (UTs Yadkin
River). An excellent wild brook trout population populates Bailey Creek. Rainbow and
brown trout are found in this area of the Yadkin River.
We do not object to the project provided that the following conditions are
implemented:
Pipes less than 36" in diameter should be sized and placed on grade or lower.
Pipes 36" and larger should be sized and placed approximately 1' below
streambed grade. These placements should insure all waters flow through
uninterrupted and without freefalling or damming on either end during low
flow conditions to maintain aquatic life and fish passage. The dimension,
pattern, and profile of the streams above and below the pipes should not be
modified by widening the stream channel or reducing the depth of the stream.
2. If concrete will be used, work must be accomplished so that wet concrete does
not contact stream water. This will lessen the chance of altering the stream's
water chemistry and causing a fish kill.

APPROVAL of 401 Water Quality Certification with Additional Conditions

Dear Mr. Slaughter:
You have our approval, in accordance with the attached conditions and those listed below, to impact 40
linear feet of an unnamed tributary to the Yadkin River and Bailey Camp Creek in order to improve SR
1500 (Blackberry Road) and place three wet pipes in Caldwell County. The project should be constructed
in accordance with your application dated 13 February 2001. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification No. 3289 corresponding to the
U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you should acquire any other
federal, state or local permits before you proceed with your project including (but not limited to)
Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval
will expire with the accompanying 404 permit unless otherwise specified in the Water Quality
Certification.
This approval is valid solely for the purpose and design described in your application (unless modified
below). Should your project change, you must notify the DWQ and submit a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter, and is
thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in
the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
1. In-stream work and land disturbance within the 25-foot wide buffer zone are prohibited during the
_ _ trout spawning season of October 1 5-through April 15, or as otherwise determined by the North
Carolina Wildlife Resources Commission, to protect the egg and fry stages of trout from
sedimentation during construction.
2. Storm water should be directed to buffer areas or retention basins and should not be routed directly
into streams.
3. Sedimentation and Erosion Control Guidelines for Sensitive Watersheds (15A NCAC 4B .0024) must
be implemented prior to any ground-disturbing activities to minimize impacts to downstream aquatic
resources. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 5
days of ground-disturbing activities to provide long term erosion control.
4. The culvert required for this project shall be installed in such a manner that the original stream profile
is not altered (i.e. the depth of the channel should not be reduced by a widening of the streambed).
Existing stream dimensions are to be maintained above and below locations of culvert extensions.
5. All work shall be performed during low flow conditions.

6. All mechanized equipment operated near surface waters should be regularly inspected and maintained
to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic
materials.
7. The presence of equipment in the channels must be minimized. Under no circumstances should rock,
sand or other materials be dredged from the wetted stream channel under authorization of this permit,
except in the immediate vicinity of the culverts.
8. Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for storm
water sheet flow.
9. Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be planted
when practical. If necessary, rip-rap should be limited to the stream bank below the high water mark,
and vegetation should be used for stabilization above high water.
10. Rock silt screens at culvert outlets should be removed at project completion.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a
hearing, send a written petition which conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C.
27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Dear Mr. Lund:
The NC Department of Transportation is scheduled to grade, drain, base, and pave primarily
along the existing roadway of SR 1500 (Blackberry Road) in Caldwell County. We are proposing
to replace three (3) wet pipes that cross the existing roadway. The stream crossing at station
32+05 carries Bailey Camp Creek (Class C trout). The stream crossings at stations 68+50 and
129+80 carry unnamed tributaries to the Yadkin River (Class C trout). In addition, the pipe at
station 129+80 will require the installation of a concrete headwall on the inlet end of the new
pipe.
Any widening of the existing roadway will be directed away from any adjacent creek whenever
possible with minimum fill placed in the buffer area. The total project length is 2.46 miles. Due
to the proposed work, we are requesting a 404 Nationwide Permit #14.
Attached is a Preconstruction Notification Form, plan sheet with proposed erosion control
measures, pipe crossing information, roadway typical section, a marked county map and a marked
topography map.

zone of unnamed tributaries to the Yadkin River (Class C Trout). It is requested that Mr. Ron

Dear Mr. Lund:
The NC Department of Transportation is scheduled to grade, drain, base, and pave primarily
along the existing roadway of SR 1500 (Blackberry Road) in Caldwell County. We are proposing
to replace three (3) wet pipes that cross the existing roadway. The stream crossing at station
32+05 carries Bailey Camp Creek (Class C trout). The stream crossings at stations 68+50 and
129+80 carry unnamed tributaries to the Yadkin River (Class C trout). In addition, the pipe at
station 129+80 will require the installation of a concrete headwall on the inlet end of the new
pipe.
Any widening of the existing roadway will be directed away from any adjacent creek whenever
possible with minimum fill placed in the buffer area. The total project length is 2.46 miles. Due
to the proposed work, we are requesting a 404 Nationwide Permit #14.
Attached is a Preconstruction Notification Form, plan sheet with proposed erosion control
measures, pipe crossing information, roadway typical section, a marked county map and a marked
topography map.
By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with
the North Carolina Wildlife Resources Commission comment directly to you concerning the 404
Nationwide Permit application with a copy sent to me.

A request will be made on this project for a temporary encroachment into the trout water buffer
zone of unnamed tributaries to the Yadkin River (Class C Trout). It is requested that Mr. Ron
Linville comment directly to me concerning the trout water buffer zone encroachment.
