Dear Mr. Highley:
On July 22, 2004 a moratorium on the issuance of sewer line permits was placed on the White
Oak Estates WWTP per the authority of 15A NCAC 2H .0223, which specifies that prior to
exceeding 80% of their hydraulic treatment capacity, facilities must submit an approvable
engineering evaluation of their future wastewater needs before permits for sewer line extensions
may be issued. Monitoring data submitted for the White Oak Estates WWTP showed the facility
operated with an average annual flow of 0.099 MGD during 2003.
This annual average flow was evaluated against the WWTP's design capacity as was
documented in the Division of Water Quality's computer records, which was listed as 0.12
MGD. The evaluation indicated the facility was operating at 82.5% of its design capacity and
led to imposition of a moratorium pursuant to the rule. However, information provided your
consulting engineer, Parker & Associates, Inc., has indicated an expansion of the facility (to 0.22
MGD) was completed during the early months of 2003. Unfortunately, a copy of the engineer's
certification of.project completion was not received in our central office and our computer files
were not updated to reflect the expansion. Because of this record deficiency, the moratorium
was honestly, but erroneously imposed.
In light of these findings, I hereby retract the moratorium on the issuance of sewer line permits
placed on the White Oak Estates WWTP. I have directed my staff to remove the record of its
issuance from the Division's hard copy and computer files, so you should experience no further
impediment if you require a new sewer line permit for this system.

Please find the enclosed Engineer's Certification and start-up inspection letter from Pat Durrett that was
forwarded to our officd by Tim Stewart with Parker & Associates.
Based on this information, it appears that the facility should have a permitted and as -built treatment
capacity that are the same and larger than that shown in BIMS provided the Unit is OK with the
statements on the certification. The Limits page in BIMS will need to be updated to drop the lower flow
and parameters limits. -
If this expansion is complete, then the current sewer moratorium that was issued in July 2004 for
average flow in calendar year 2003 will need to be rescinded by the Central Office as soon as possible.
If our office can be of any further assistance to correct this issue, then please feel free to contact Linda

Mark,
I was talking with Eddie Baldwin, the manager of the facility for CWS,
today and he was surprised to learn that the facility was raider a sewer
moratorium that was imposed in July 2004 based on a flow limit of 120K.
He stated that the facility has had its new 1 OOK unit on-line since
mid-2003 when they assumed ownership. Our office conducted a start-up
inspection in Feb. 2003 and found a few items that needed to addressed
prior to activation of the new 100K unit.
The permit that was issued in July 2002 granted the expansion flow from
120K to 220K that would become active with the submittal of the
engineer's certification, which we don't have a copy of the ATC. The
permit that was re -issued to CWS in Sept. 2003 had the same info.
However, BIMS shows both the permitted and as -built flow as 120K and no
ATC date is shown.
Has the permitting unit received the certification as we do not have a
copy of one in our files? Tf so, then we need to update DIMS with the
flow info and delete/inactivate the old monitoring requirements/limits.
If not, then Parker & Associates needs to submit this, but to whom?
Lastly, we will need to rescind the sewer moratorium once the permit
issue has been resolved.

I have changed the Permitted & As -Built flow to 220K under the Details 2 Tab for
NCO031577 in BIMS since this is all I can do. Now someone in permitting needs to
remove the appropriate limits from the Outfall for DMR's. An updated permit should
be issued to CWS reflecting the change along with a letter retracting the sewer
moratorium ASAP.
I am issuing the sewer permit.

Dear Mr. Goodrich;
I, Timothy M. Stewart, as a duly registered Professional Engineer in the State of North
Carolina, having been authorized to observe the construction of the 100.000 GPD Additions to
White Oak Estates WWTP - Permit # NCO031577 a2yroval dated July 22, 1997 hereby state that
due care and diligence was used in the observation of the project construction such that the
construction was observed to have been built within substantial compliance and intent of
approved plans, and specification, with the following exceptions. .
A different manufacturer's WWTP was installed instead of the one designed, therefore,
the foot print of the plant changed. The volumes of the tanks did not change. The chlorination
facility was tied to the existing plant's facility, instead -of constructing a separate facility, as
designed. The phosphorus removal facility was tied to the existing plant facility, instead of
constructing a separate facility, as designed. The flow equalization and tertiary filter blowers
were installed as one blower each, instead of two each, and its air lines were tied to the air header
of the mairi plant to serve as the emergency backup supply. All of the changes were approved by
the Engineer and the Owner. A copy of the As -Built Record Drawings are being forwarded to the
Wilmington Regional Office of DWQ and to the Owner for their records.

This letter is written in response to your request to allow wastewater to be Introduced Into the new
treatment unit at the subject facility. An Inspection was performed on January 22, 2003. Several Items
of concern that were required to be addressed prior to the Introduction of the wastewater.
It is the understanding of this writer, that both you and the operator are satisfied that the list of
Items to be addressed have been completed. This being the case, and your certification of completion
being on file, you may begin full operation of the facility.
