Dear Mr. Leigh:
The Division of Water Quality (the Division) hereby issues the attached NPDES permit for the
subject facility. We issue this permit pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated October 15, 2007, or as subsequently amended.
Changes to Your Previous Permit. The Division understands that you have made no significant
alterations to your facilities during the previous permit cycle. We have therefore made minimal
changes to your permit by updating your facility map, your treatment -component description, and
have added parameter codes to effluent monitoring pages for your convenience [see Supplement to
Cover Sheet and § A. (L) through A. (6.)]. We have also added monitoring for Naphthalene to
evaluate heaver hydrocarbons such as oily waste, fuel oil, and diesel fuel indicated by your renewal
application.
Changes to the Permit Draft. We have revised the Special Condition for MTBE to include rationale
for future compliance. Future compliance for MTBE will be evaluated based on your data's
reasonable potential to exceed 19µg/L (or as subsequently revised), in accord with requirements
statewide for discharges to Water Supply (WS) waters. Secondly, industrial dischargers are no
longer required to apply for Authorization to Construct facility modifications, however the Division
does require you to report the details of significant treatment -system or discharge -system
modifications within 30 days of beginning or ending construction, whichever occurs earlier [see
permit § A. (9.)]. We have also corrected the parameter code for TSS (from CO556 to CO530)
included in error in permit § A. (L) through §A. (6.)].

For Renewal, the Division has replaced Phenol (single compound) with Total Recoverable
Phenolics (parameter code 32730); to be monitored Monthly (no limit) at all outfalls, consistent
with permits statewide discharging to waters classified Water Supply (WS) who do not chlorinate
their effluent.
Concerning Instream Monitoring [pond upstream & downstream], the following table summarizes
volunteer monitoring and reporting of recent data, including coincidental concentrations reported
for April and June. To better evaluate instream conditions, the monitoring and reporting frequency
has been revised from Variable to Monthly and Quarterly depending on the parameter [see permit
§ A. (6.)]. As usual, non -discharge months shall be reported as "no flow" on monthly Discharge
Monitoring Reports (DMRs).

Compliance with Units of Measure. Review of your past data for the parameter Phenol indicates
some discrepancy in reported units -of -measure [i.e., milligrams -per -liter verses micrograms -per -
liter (mg/L vs. µg/L)]. It is required by your permit to employ the most sensitive NC -approved test
method practically and technologically available (see permit, § D, Part 4, 13). For future reporting,
please revise your monthly Discharge Monitoring Report forms (DMRs) to reflect µg/L for the
replacement parameter Total Recoverable Phenolics. Please note that you may choose either US
EPA test Method 420.1 (colorimetric) or US EPA Method 420.4 (automated colorimetric) to
comply with this permit condition. The current test sensitivity or Practical Quantitation Level
(PQL) for these test methods should be reported on the order of < I Opg/L, if not detected.
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within
thirty (30) days after receiving this letter. Your request must take the form of a written petition
conforming to Chapter 150B of the North Carolina General Statutes, and you must file it with the
office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714.
Unless such a demand is made, this permit shall be final and binding.

Colonial Pipeline Company
411 Gallimore Dairy Road
Guilford County
to receiving waters designated as an unnamed tributary (UT) of East Fork Deep River within the Cape
Fear River Basin in accordance with effluent limitations, monitoring requirements, and other
conditions set forth in Parts I, II, III and IV hereof.
This permit shall become effective March 1, 2012.
This permit and authorization to discharge shall expire at midnight on August 31, 2016.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under
the permit conditions, requirements, terms, and provisions included herein.
Colonial Pipeline Company
is hereby authorized to:
1. continue to operate an existing Surface -Water Pollution Prevention System to treat stormwater,
slab wash -down water, calibration water [Prover-loopTm or similar], and hydrostatic tank -testing
water in proximity to above -ground storage tanks (ASTs) and appurtenant piping where surface
bulk -storage of petroleum hydrocarbon fuels exceeds one (1) million gallons, utilizing
• diked areas, (secondary -containment for ASTs, gravity -drained)
• diked areas (secondary -containment in support of soil
remediation land -farming, gravity -drained)
• ponds, oil/water separators
• control valves, hand -operated, normally closed (a point -source discharge)
located at the Colonial Pipeline Company, 411 Gallimore Dairy Road, Greensboro, Guilford
County, in six (6) areas of activity specified as

A. (6.) RECEIVING STREAM - SAMPLING AND MONITORING REQUIREMENTS
Beginning on the effective date of the permit and lasting until expiration, the Permittee shall collect
instream samples and provide analyses as needed to evaluate potential impact to local Waters of the
State in proximity to the existing Water Pollution Prevention System. Such instream sampling shall
be monitored by the Permittee, as specified below.

A. (7.) MTBE MONITORING
Based on data submitted, the Division has designated the monitoring frequency for Methyl Tertiary Butyl
Either (MTBE) to Quarterly at all outfalls (except upstream and downstream sampling). If MTBE is detected
by NC -certified test methods (current PQL < 1 µg/L) at any of 5 outfalls, the Permittee shall immediately
increase monitoring and reporting to Monthly at that outfall. Subsequently, the Permittee shall submit to the
Division an MTBE Action Plan to identify sources of MTBE contamination and its proposed remediation.
This Action Plan, with findings and recommendations, is due within 180 days of first detection.
The Division will establish future compliance to the permit by evaluating the MTBE database for its
reasonable potential to exceed 19µg/L (or other, as subsequently revised) currently required for discharges to
surface waters classified Water Supply (WS).

A. (8.) ACUTE TOXICITY MONITORING (ANNUAL)
The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24-hour
static test. Effluent samples for self -monitoring purposes must be obtained below all waste treatment. The
Permittee will conduct one test annually, with the annual period beginning in January of the calendar year of
the effective date of the permit. The annual test requirement must be performed and reported by June 30. If no
discharge occurs by June 30, notification will be made to the Division by this date. Toxicity testing will be
performed on the next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit condition
will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the
appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than
30 days after the end of the reporting period for which the report is made. Test data shall be complete and
accurate and include all supporting chemical/physical measurements performed in association with the
toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be
measured and reported if chlorine is employed for disinfection of the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and
modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will require
immediate follow-up testing to be completed no later than the last day of the month following the month of the
initial monitoring..
A. (9.) MODIFICATIONS TO TREATMENT SYSTEM / DISPOSAL SYSTEM
In the event the Permittee modifies its treatment or disposal system, as described in this permit (see
Supplement to Cover Sheet), the Permittee shall provide written notification to the Division of Water Quality

Introduction - Colonial Pipeline Company (herein referred to as Colonial Pipeline or the
Pennittee) requires a National Pollutant Discharge Elimination System (NPDES) permit to dispose
treated wastewater to the surface waters of the state. The Permittee's 5-year NPDES permit has
expired and they have requested renewal from the Division of Water Quality (the Division). This
Fact Sheet summarizes background information and rationale used by the Division's NPDES Unit
to determine permit limits and conditions.
Facility Description and Background - Colonial Pipeline operates the Colonial Pipeline
Greensboro Terminal, a petroleum pipeline -distribution and surface bulk -storage facility in
Guilford County. This facility distributes product by pipeline only — no trucking -loading racks. This
facility is permitted to discharge stormwater runoff from their existing Water -Pollution Control
System, to include slab wash -down water, Prover-100pTM (or similar) calibration water, and
hydrostatic tank -testing water, via Outfalls 001 through 005. This system consists of gravity -
drained diked, secondary -containment structures and other manmade confinements, soil-
remediation landfarm. The system utilizes ponds, oil/water separators, and discharge control valves
(hand -operated, normally closed) servicing specific areas identified in Table 2.

Each of the above -permitted outfalls discharge to a pond (-12 acre) centrally located on the
Colonial Pipeline property straddling an unnamed tributary (UT) to East Fork Deep River. Earlier
permit cycles referred to pond effluent as permitted Outfall 006. However, with reissuance
beginning in 2001 this pond was reclassified Waters of the State, because:
1. the Permittee does not control the entire stormwater recharge area to the pond, as required
for onsite "effluent channels" [12A NCAN 02B.0228(1)], and
2. the pond receives effluent from several NPDES permitted dischargers upstream.
Therefore the Division re -defined pond monitoring and sampling as the "Downstream Sampling
Point," and assigned regular monitoring (no permit limits). Considering the potential for
unauthorized releases upstream, the Division also judged it prudent to monitor upstream (see
Upstream Sample Point). While it is appropriate for the Permittee to pump and use pond water for
hydrostatic tank testing and other permit -stated uses, it is not appropriate to return these wastes to
Waters of the State without first sampling, analyzing, treating as necessary, and reporting effluent
contents in accord with this permit. /J
Waste Load Allocation (WLA) - The Division reviewed the WLA completed in May 1991 and
developed effluent limits and monitoring requirements. The Division judges these limits and
monitoring requirements to be appropriate for this renewal with the exception of additions and
deletions listed below (see Renewal Summary by Outfall).
Verifying Existing Stream Conditions - This facility discharges to an unnamed tributary (UT) of
East Fork Deep River, a Class WS-IV* stream within the Cape Fear River Basin. East Fork Deep
River is not listed as an impaired waterbody [does not appear on page 10 of 115, North Carolina's
303(d) list, 2010 DRAFT].

Compliance Review
Discharge Monitoring Reports (DMR) -- Effluent Data Review. DMRs were reviewed from
February 2007 through July 2011. Discharges from Outfall 001 through 005 occurred episodically —
non -discharge months were reported as "no flow." Benzene and Toluene exceeded permit limits for
Outfalls 003 and 004. Total Suspended Solids (TSS) levels exceeded permit limits at Outfalls 001
and 002 (see Renewal Summary).
Notices of Violation (NOVs). - The facility was issued Notices of violation (NOVs) (08Aug2008)
at Outfalls 003 and 004 for a single -event limit violation for Benzene. No other NOVs or civil
penalty assessments were issued during this compliance period.
Whole Effluent Toxicity (WET) Test - The facility has passed its annual acute toxicity test at all
outfalls for the past sixteen years (1996 through 2011).
Renewal Strategy
The permit was renewed in accord with the Surface Water Protection Section's document entitled
"NPDES Permitting Requirements for Petroleum Bulk Storage: Surface Storage Greater than One
Million Gallons — 2005 Permitting Strategy." This document addresses permitting for surface bulk -
storage of petroleum fuel hydrocarbons at facilities exceeding one (1) million gallons. These
storage facilities may not be permitted under North Carolina Stormwater Regulations because of the
volume of fuel, and because their discharge stormwater and other maintenance wastes is confined
by secondary containment utilizing hand -operated, control valves, normally closed (a point -source
discharge).
Reasonable Potential Analyses (RPA). The Division conducted the EPA -mandated RPA on
Colonial Pipeline's reported database (January 2007 through August 2011). The RPA was applied
separately to each individual outfall. RPA results and permitting decisions per outfall are .
summarized below (see Renewal Summary below). If a parameters were not detected (ND) above
levels of concern, the Division did not run the RPA. The RPA compares the "allowable
concentration" (based on water quality standard or criteria) against the "maximum predicted"
concentration based on data submitted.
Phenol Monitoring — Past and Future. When combined with chlorine, phenols can cause taste
and odor problems in drinking water and can also taint fish tissues. Therefore the Division has
historically monitored phenol discharges to surface waters classified Water Supply (WS). The
Division's previous Permitting Strategy (2005) required phenol [single compound], but future.
impact to WS waters will be evaluated as Total Phenolic Compounds, in accord with revised
permitting guidance (December 15, 2010). Because the Permittee has reported Phenol (single
compound), it follows that there are no data for this renewal to evaluate Total Phenolic Compounds.
Therefore beginning with this permit cycle, future compliance review will evaluate detected levels
of Total Phenolic Compounds for their reasonable potential to exceed 3001tg/L (or other, as
subsequently revised). 1 .

MTBE Monitoring History. Because MTBE was previously detected at all outfalls (2006) prior
to last renewal, the Division required monitoring Monthly at Outfalls 003, 004, and 005, and
required the Permittee to submit an MTBE Reduction Plan. This plan was received by the Division
on August 31, 2007, and was implemented by the Permittee. For this compliance cycle, MTBE was
not detected (ND) at any outfall, but was reported once at the Downstream sample point (1.3µg/L).
Revisions to the MTBE Monitoring Plan. Based on a revised criterion of 19µg/L MTBE for
surface waters classified Water Supply (WS), the Division has revised the MTBE Special Condition
for this renewal [see.petmit § A. (7.)]. Therefore, future compliance review will evaluate detected
levels of MTBE for their reasonable potential to exceed 19µg/L (or other, as subsequently revised).

* Note Non -Compliant Phenol Units: The Division understands that the currently accepted
practical quantitation level (PQL) for Phenol is < 10 µg/L. However, the Permittee regularly reports
analytical results and/or lab -test PQLs for Phenol in milligrams per liter (mg/L) instead of
microgram per liter (µg/L). Such results are orders of magnitude less sensitive than testing required
by this permit -a permit violation (REF: permit Section D. Part 4,13]. The Permittee will be
admonished to verify and correct units of measure on all monthly Discharge Monitoring Report
(DMR) forms, and to employ in future the most sensitive NC state -approved analytical method
available.
For renewal, in accord with revised permitting guidance for phenols [DWQ Planning: Connie
Brower, et.al. December 15, 2010], the Division will replace Phenol (parameter code 34694) with
Total Recoverable Phenolics [parameter code 32730]. The Division will evaluate future compliance
relative to 300µg/L, or other as subsequently amended.

We have a total of five (5) outfalls at this facility that mainly treat storm water through oil/water separators and/or retention ponds and
basins. Other than storm water, we sporadically generate wastewater from equipment wash down slabs, hydrostatic test water, and
prover -loop calibration water. Our operation does not generate sludge and/or solids and, therefore, we do not have a sludge
management plan. I have included a copy of our watershed runoff— effluent flow with this application.

This facility discharges stormwater runoff, slab wash -down Water, prover -loop (or similar)
