We issue this permit pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency (EPA) dated October 15, 2007, or as subsequently amended. Division's Analysis of Colonial Pipeline Company (CPC) Data - The Division applied EPA's mandated Reasonable Potential Analysis (RPA) to CPC's monitoring databases for both Total Suspended Solids (TSS) and Turbidity at each outfall. Both databases show reasonable potential to exceed their respective surface water -quality standard at eight (8) of nine (9) outfalls. Consequently to protect water quality, the Division must maintain an increased monitoring frequency and limit each parameter, as reflected in the draft permit, consistent with permits statewide. While your permit does not currently require instream monitoring, it may be prudent to collect upstream and downstream samples if possible for comparison to end -of -pipe values. Changes to the Draft Permit — The Division hereby acknowledges CPC's written comments on the draft permit (received via email from John W. Culbreath, March 18, 2011), noting concerns about TSS vs. Turbidity, and we offer this response. The Division's review of effluent data from bulk - storage sites similar to CPC (from 1989 through 2005) revealed a potential to violate the respective surface water -quality standards for both TSS and Turbidity. We subsequently required, and continue to require, monitoring of both parameters in these permits statewide. We have therefore made no changes to your draft permit with regard to TSS/Turbidity. Chances to Your Previous Permit - Based on our evaluation of your monitoring data submitted during the previous permit cycle, the Division has added permit limits for Benzene, Toluene, Turbidity, and Total Phenolic Compounds. You must comply with these limits at the outfalls spgcified [see section A. (L) and related footnotes]. For your convenience we have added parameter codes for each required analytical method. Finally, the Division has updated your facility description specifying nine (9) outfalls and their locations (see Supplement to Cover Sheet), as clarified during the renewal draft review. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within thirty (30) days after receiving this letter. Your request must take the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes, and you must file it with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699- 6714. Unless such a demand is made, this permit shall be final and binding. This permit is not transferable except after notifying the Division of Water Quality. Flow shall be monitored with each discharge event. During periods of no flow, the Permittee shall submit a signed, monthly Discharge Monitoring Report (DMR) indicating "No discharge." Flow may be monitored using any one of four methods: a) measure flow continuously; b). calculate flow [see section A. (3.) Rational Equation] based on total rainfall per unit area draining to the outfall; exclude built -upon areas (best method for facilities with large runoff -collection ponds); c) estimate flow at 20-minute intervals during the entire discharge event'or d) report flow based on discharge pump logs.. 2. TSS/Oil and Grease — Where possible, the grab sample for oil and grease should be skimmed from the surface of a quiescent (calm water) zone. 3. Turbidity — Effluent shall not cause receiving stream turbidity to exceed 50 NTU. If receiving stream background turbidity exceeds 50 NTU, effluent shall not cause this background value to increase. 4. Permit limit applies to Outfall 009 only. 5. Permit limit applies to Outfall 10 only. 6. Acute Toxicity (Fathead Minnow, 24-hour static test), annual samples to be collected concurrently with Benzene, Toluene, Ethyl Benzene, and Xylene (BTEX) samples [see Special Condition A. (2.)]. Conditions a. The Permittee shall discharge no floating solids or foam visible in other than trace amounts. — - b: The Permittee shall discharge no tank solids, tank bottom water, or the rag layer. c. Following hydrostatic testing (tank or pipe), the Permittee shall discharge no test -water without documenting that benzene concentration do not exceed 1.19 µg/I, and toluene concentrations do not exceed 11 µg/L. Permit NCO031038 A. (2.) -ACUTE TOXICITY MONITORING- Pass/Fail (ANNUAL) The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24-hour static test. Effluent samples for self -monitoring purposes must be obtained below all waste treatment. The permittee will conduct one test annually, with the annual period beginning in January of the calendar year of the effective date of the permit. The annualust requirement must be performed and reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this date. Toxicity testing will be performed on the next discharge event for the annual test requirement. The parameter code for this test is T s _ y AE6C. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the appropriate parameter code. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re- opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. „P&mit,NC0031038 A. FLOW MEASUREMENT RATIONAL The Rational Equation: Q=KUCIA, where: Q = flow (peak flow rate (cfs or m3/sec) Ku = units conversation factor = 1.008 for U.S. standard units (usually ignored because it is so close to 1), or 0:278 for SI units C = dimensionless runoff coefficient for the watershed, loosely defined as the ratio of runoff to rainfall I intensity of rainfall taken from the intensity -duration -frequency curves for the specified design return period at the time of concentration, tc (in/h or mm/h). tc = time of concentration (time after the beginning of rainfall excess when all portions of the drainage basin are contributing simultaneously to flow at the outlet). A = area of tributary watershed (acres or km2) The rational equation is used to calculate the runoff from a region, given: • the runoff coefficient which accounts for infiltration and other potential losses in the region, • the rainfall intensity to the region, • the time it takes for runoff to travel from the region's upper reaches to its outlet, and the region's drainage area. Considering the Previous Permit: For the 2005 permit cycle, DWQ determined that the Permittee's upstream neighbors (including bulk -storage facilities) do in fact, contribute to the stormwater runoff to tributaries lateral to Colonial's property perimeter and to the settling pond at Colonial's downstream boundary (see map). Therefore, these lateral receiving streams and the down -stream pond were deemed waters of the state (influent not wholly controlled by the Permittee). Each of nine (9) Colonial outfalls was therefore determined to require individual monitoring at its point of discharge. DWQ "phased" the 2005 permit to allow the Permittee a compliance period after which they were required to switch from sampling the pond only to sampling and reporting each individual Outfall (Phase 1 ending — Phase II beginning March 1, 2008). Monitoring data indicate that the Permittee complied with this requirement. Total Phenols: Because the compliance record shows some confusion in 2006-2007 regarding the correct test method, the permit and cover letter will clarify that this facility shall report Total Phenolic Compounds (BIMS parameter code 32730) instead of Phenol (singular). Future compliance shall be evaluated relative to the permit limit/stream standard 300 µg/L (discharge under "zero flow" conditions) for Permittees who do not chlorinate their effluent but discharge to waterbodies classified water supply (WS), in accord with statewide permitting guidance for phenols (NPDES Memorandum December 15, 2010). Reasonable Potential Analysis (RPA): This renewal includes an RPA conducted on the monitoring database noted above and on earlier data for the total monitoring period January 2006 through December 2010. These data are reported for nine (9) outfalls specified and recorded in BIMS as Outfalls 002 through 010. Databases show reasonable potential (RP) for Total Suspended Solids (TSS) at 8 of 9 outfalls (exception Outfall 004). Likewise, databases show (RP) for Turbidity at 8 of 9 outfalls (exception Outfall 003). TSS is already limited at all outfalls (previous permit). For simplicity of monitoring and tracking, the Division shall also require Turbidity at all outfalls, monitoring required Monthly [decision based on BPJ]. Outfall 009 data show RP for Total Phenolic Compounds. Outfall 010 data show RP for both Benzene and Toluene; no other outfalls show RP for these parameters (see attached Analytical Summary — RPA Results). Therefore, the limits for these parameter shall apply to these specific outfalls only, as designated by footnotes [see permit Section A.(1.)]. Compliance History: BIMS records show multiple permit "reporting" violations, but few have resulted in Notices of Violation (NOVs). These did not proceed to assessed civil penalties. Minor "reporting" violations identified as BIMS errors relating to parameters no longer required by the Permittee, or were identified as "results submitted out of sequence." These are demarked in BIMS by the Mooresville Regional Office (MRO) with the response "No action-BPJ" [best professional judgment]. However, NOVs were issued for a TSS permit limit (45 mg/L) violation exceeded by 49 % at Outfall 003 (July 2008). The Permittee also exceeded its Benzene limit (1.19 µg/L) at Outfall 010 by 295% in November 2009 and again in December 2009 by 824%. These violations also resulted in NOVs but they were not assessed penalties. No violations have been recorded since December 2009. Toxicity Testing History: Toxicity Testing was performed by the Permittee at all 9 outfalls as they entered the environment — no changes recommended. Acute Toxicity annual results were reported in the first quarter of the last 3 years (2008, 2009, and 2010); all indicate "pass" @ 100% effluent concentrations (see attach tox data summary). Renewal Summary: For renewal DWQ updated the facility map, facility description, and added parameter codes to the Effluent Table, A. (1.), considering the Division's established Permitting Guidance for fuel hydrocarbon bulk -storage facilities statewide. As required by current RPA results and the Division's best professional judgment (BPJ), monitoring and permit limits will be required according to following: Changes to Permit Limits and Monitoring Parameter Permit Limit Comments Eight (8) of nine (9) outfalls show reasonable potential. Culbreath (CPC's Environmental Specialist) provided written comments on the draft permit via email (March 18, 2011), noting concerns about TSS and Turbidity. He asked NOT to alter the previous permit. Joe presented the Permittee's arguments in Staff Meeting and the response was negative. We noted in the final cover letter that databases for both parameters show reasonable potential to exceed their respective surface water -quality standard at eight (8) of nine (9) outfalls (see attached RPA Summary) — request denied. Updates for Final Permit — addressed Permittee's comments on draft permit RE: TSS vs. Turbidity; updated LAT/LONG numbers to reflect degrees only (according to latest convention); updated outfall locations to reflect point of contact with the receiving -stream environment. The Limit also refers to Footnote 3 which states the following: "Turbidity— Effluent shall not cause receiving stream turbidity to exceed 50 NTU. If receiving stream background exceeds 50 NTU, effluent shall not cause this background value to increase." Our current permit does not impose a Daily Maximum Limit, but includes this same footnote. In our experience, turbidity is sometimes used as a surrogate measure for solids (suspended and/or dissolved), since it can be measured in the field using a properly -calibrated meter, as well as in the laboratory. However, since turbidity is a measure of light scatter, values can be a measure of naturally -occurring conditions (e.g. healthy phytoplankton communities, chemical reactions between rainwater and local soils, etc.) rather than conditions caused by a traditional pollutant. The existing and draft permits contain Daily Maximum Limits for total suspended solids at each outfall. We believe these limits have and will continue to effectively address and limit potential impacts from onsite operational activities. Because of both of these considerations, we believe that setting a daily maximum limit for turbidity is not appropriate. Therefore, Colonial respectfully requests that the existing permit provisions for turbidity be continued through the next permit cycle. This would include the removal of the 50 NTU Daily Maximum Discharge Limit, changing the frequency to quarterly, and maintaining compliance with the Footnote 3 condition. In order to facilitate compliance with Footnote 3, Colonial proposes to add stream turbidity background samples to be collected upstream of Outfall 009 for the east channel discharges, and upstream of Outfall 002 for the west channel discharges. If you believe there are more appropriate upstream/downstream locations, we are also open to discussing those different sampling locations to provide the Department with quarterly watershed turbidity measures. Doing so would provide the Department with the assurance that CPC discharges are not causing or contributing to downstream impacts, while providing CPC and the Department the flexibility to account for and better understand naturally -occurring variability within the watershed over the next permit cycle. Page 5 of 5 C-MI 10108 CPColonial Pipeline Company SLUDGE MANAGEMENT PLAN — CHARLOTTE DELIVERY FACILITY Colonial's .treatment -works .for-stormwater -runoff at the -Charlotte-Delivery-Facility-consists-of one oil / water separator (Manifold Yard Outfall-MYO) and a retention pond which acts as a sedimentation basin and an emergency oil / water separator for the Tank Secondary Containment Areas (TSACs) and the MYO. The oil / water separator has been designed to capture any refined petroleum products that may be present in the wastewater flowing through the separator. All refined petroleum products that accumulate in the oil / water separator are returned to Colonial's pipeline system. The oil / water separator is equipped with high level alarms for both product and water. These alarms are tested annually to ensure proper operation. Sludge accumulates on the oil / water separator floor, and the sludge accumulation rate is such that it needs to be removed approximately once every two years. Since influent to the oil / water separator is minimal during dry weather, cleaning can be scheduled so that flow bypassing is unnecessary. After the oil / water separator is cleaned, the sludge is transported to a licensed waste disposal facility by a permitted waste transporter. An appropriate transporter and disposal facility are selected just prior to cleaning. Although sediment accumulates at the bottom of the facility retention pond, it accumulates at a rate such that the pond seldom needs to be dredged. If the retention pond is dredged in the future, Colonial will contact the North Carolina Department of Environment and Natural Resources concerning disposal of the dredged material. John W.
