Dear Ms. Thompson and Mr. Wojoski,
On behalf of the City of Kinston, we are requesting authorization from the USACE to use NWP 12
for 0.277 acres of temporary impacts to jurisdictional ditches for construction of the Smithfield
Way Gravity Sewer Extension project, located along Smithfield Way in Kinston, Lenoir County.
We are also requesting an NCDWR 401 WQC for the referenced impacts.
The project area is ±4.0 acres in size and is located along Smithfield Way, beginning at an existing
manhole at Enterprise Drive (Lat: 35.270992°N; ‐77.669623°W), and running east along the north
side of Smithfield Way to an existing manhole north of the Parrott Dickerson pump station (Lat:
35.270598°N; Long: ‐77.661794°W). The proposed sewer expansion is located within a new
utility easement acquired by the City of Kinston.
The project is located in the Neuse River basin and drains to Falling Creek. The Water Quality
Classification for Falling Creek is C;Sw;NSW, and the Stream Index Number is: 27‐77. The
cataloging unit for the site is 030202020206.
Proposed Project
The purpose of the proposed project is to construct a gravity sewer line to reroute flow from the
existing sewer line along Enterprise Blvd that currently flows to the Oliver Glass to the Parrott
Dickerson lift station which has available capacity. The Oliver Glass lift station which is currently
over capacity, and rerouting flow to the Parrot Dickerson lift station will alleviate the potential for
line failure and SSOs.
The proposed project consists of the construction of 2,360 lf of 18" PVC gravity sewer line and
145 lf of 8" PVC service line. The proposed sewer line will connect to the existing gravity sewer
line along Enterprise Blvd which currently flows to the Oliver Glass lift station and reroute a
portion of the flow to the Parrott Dickerson lift station which has excess available capacity.
The sewer line will be located within a utility easement acquired by the City of Kinston. NCDOT
required that the sewer line and easement be located outside of the ROW for Smithfield Way.

The majority of the sewer line will be installed via trench and backfill methods, and traditional
commercial construction equipment will be used. The sewer line will be installed via jack and bore
beneath the railroad and Ditch 2 & 3.
Project History
WithersRavenel conducted a delineation of the project area in May 2020. There are no wetlands
or streams within the project area. The only features present are man‐made ditches, for which
jurisdiction was conceded. A PJD Request Packet has been attached to this application. However,
we are not requesting issuance of a PJD in conjunction with issuance of the NWP 12.
WithersRavenel coordinated via email with Emily Thompson with the USACE regarding the current
jurisdictional status of the onsite ditches. Due to time constraints, WithersRavenel decided to
move forward with conceding the ditches as jurisdictional and moving forward with permitting of
the impacts.
WithersRavenel submitted a Buffer Determination Request via email to Chris Pullinger with
NCDWR on 7/6/2020. As of the date of this application WithersRavenel has not received any
correspondence from Mr. Pullinger. Based on previous experience with man‐made jurisdictional
ditches not being subject to Neuse River Riparian Buffers, WithersRavenel does not believe that
the jurisdictional ditches within the project area should be subject to buffers. Therefore, we are
requesting confirmation that the ditches within the project area are not subject to Neuse River
Riparian Buffers in conjunction with issuance of the 401 WQC. A copy of the Buffer
Determination Request submitted to Mr. Pullinger has been attached to this application.
Proposed Impacts
The proposed impacts consist of 0.277 acres (12,076 sf) of temporary jurisdictional ditch impacts
for installation of the proposed gravity sewer line.
Avoidance and Minimization
The proposed impacts have been minimized to only temporary impacts to jurisdictional ditches.
Impacts could not be avoided, as the sewer line must be located within the easement that the City
of Kinston was able to acquire from private property owners and must be located outside of the
ROW of Smithfield Way per NCDOT requirements.
Impacts have been minimized by using jack and bore to install the sewer line beneath the railroad
and Ditch 2 & 3.
During construction, coffer dams will be installed upstream and downstream of the construction
area, and flow will be pumped around the construction area so that work can be completed in the
dry.
Upon completion of installation of the sewer line, the ditches will be restored to pre‐construction
grades/contours and stabilized with biodegradable matting and seeded to provide temporary

stabilization. All coffer dams and inlet protection will be removed once the disturbed areas are
sufficiently vegetated and stabilized.
Mitigation
The proposed project will result in temporary impacts to jurisdictional ditches, and therefore
mitigation is not required.
The current request is for 0.277 acres (12,076 sf) of temporary jurisdictional ditch impacts (see
the attached maps and PCN for details).

be located within the easement that the City of Kinston was able to acquire from private property owners, and must be located outside of the ROW of
Smithfield Way per NCDOT requirements.

WR reviewed the NC Natural Heritage Program database, located at http://www.ncnhp.org/web/nhp/home, as well as NCNHP GIS data to identify if
there were any known occurrences of endangered species on or near the proposed project. The review of the NCNHP data did not identify any recent
occurrences of federally listed threatened or endangered species or critical habitat on the subject property or within 1.0 miles of the project, see
attached NCNHP project review letter. Furthermore, site reviews did not identify any potential habitat for any federally protected species known to
occur in Lenoir County. Therefore, the proposed project will have No Effect on federally protected species.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
Based on the project area mapped with your request, a query of the NCNHP database indicates that
there are no records for rare species, important natural communities, natural areas, and/or
conservation/managed areas within the proposed project boundary. Please note that although there
may be no documentation of natural heritage elements within the project boundary, it does not
imply or confirm their absence; the area may not have been surveyed. The results of this query
should not be substituted for field surveys where suitable habitat exists. In the event that rare
species are found within the project area, please contact the NCNHP so that we may update our
records.
The attached ‘Potential Occurrences’ table summarizes rare species and natural communities that

Bald and Golden Eagle Protection Act (BGPA)_
In the July 9, 2007 Federal Register( 72:37346-37372), the bald eagle was declared recovered, and removed (de-
listed) from the Federal List of Threatened and Endangered wildlife. This delisting took effect August 8,2007.
After delisting, the Bald and Golden Eagle Protection Act (Eagle Act) (16 U.S.C. 668-668d) becomes the
primary law protecting bald eagles. The Eagle Act prohibits take of bald and golden eagles and provides a
statutory definition of "take" that includes "disturb". The USFWS has developed National Bald Eagle
Management Guidelines to provide guidance to land managers, landowners, and others as to how to avoid

Threatened due to similarity of appearance(T(S/A))_
In the November 4, 1997 Federal Register (55822-55825), the northern population of the bog turtle (from New
York south to Maryland) was listed as T (threatened), and the southern population (from Virginia south to
Georgia) was listed as T(S/A) (threatened due to similarity of appearance). The T(S/A) designation bans the
collection and interstate and international commercial trade of bog turtles from the southern population. The
T(S/A) designation has no effect on land management activities by private landowners in North Carolina, part of
the southern population of the species. In addition to its official status as T(S/A), the U.S. Fish and Wildlife
Service considers the southern population of the bog turtle as a Federal species of concern due to habitat loss.
Definitions of Record Status:
Current - Based on NC Natural Heritage Program information, this taxon is considered to be extant in the
county.
Historical - Based on NC Natural Heritage Program information, this taxon is considered to be historical in the
county, meaning that all recorded occurrences are either extirpated, have not been found in recent surveys, or
have not been surveyed recently enough to be confident they are still present.
Obscure - the date and/or location of observation is uncertain.
Incidental/migrant - the species was observed outside of its normal range or habitat.
Probable/potential - the species is considered likely to occur in this county based on the proximity of known
records (in adjacent counties), the presence of potentially suitable habitat, or both.
