On behalf of Dominion Energy North Carolina (DENC), S&ME, Inc. (S&ME) hereby submits this Pre-
Construction Notification (PCN) Application (PCN) for impacts to waters of the U.S. in accordance with
Nationwide Permit (NWP) No. 13. DENC plans to conduct bank stabilization activities to repair eroding
portions of their existing Line T01/M021 natural gas transmission pipeline easement at the point where it
crosses the Broad River.
As proposed, the work will be performed in accordance with the applicable conditions of Nationwide
Permit (NWP) No. 13 and General Water Quality Certification (WQC) No. 4134. However, submission of
this PCN to the US Army Corps of Engineers (USACE) is required because installation of the boulder toe
installation may exceed an average of one cubic yard per running foot, as measured along the length of
the treated bank, below the plane of the ordinary high water mark.
Pre-construction written approval from the North Carolina Division of Water Resources (NCDWR) is also
required because the project will incorporate turf reinforcement matting on portions of the slope, and
therefore may not comply with General Condition No. 7. Additional information related to the need for
the reinforcement matting, which will be limited to areas above the bank full level, is provided herein.

Project Background
The project area is located along the Broad River, west of Jim Dobbins Road and east of Ken Miller Road in
Rutherford County, NC (35.276377°N, -81.985626°W). More specifically, the site consists of a portion of DENC’s
T01/M201 natural gas transmission pipeline easement, adjacent to Rutherford County PIN No. 1506899614
(Figure 1). The existing easement is abutted on either side by undeveloped woodland, and no existing
aboveground structures are present. The project area is located in the Upper Broad River Basin (HUC 03050105).
Review of the Rutherfordton South, NC US Geological Survey (USGS) Topographic Map (Figure 2) depicts the
project area as forested land. Soils mapped within the project area (Figure 3) are limited to Pacolet sandy loam
(Typic Kanhapludults) and Buncombe loamy sand. Neither of these soils are classified as hydric.
A new 20-inch diameter natural gas transmission pipeline (T01) was installed in the easement in 2017 (SAW-2016-
00773/NCDWR No. 15-0994) and the portion of an adjacent, pre-existing 8-inch diameter pipeline (M201) that
was located beneath the river was replaced in 2020. Both T01 and the replacement segment of M201 were
installed beneath the river by horizontal directional drill (HDD). The project area is within the permitted limits of
disturbance associated with NCDEQ Project ID: RUTHE-2020-009.
Over the course of performing routine inspections of the easement, and later during installation of the M201
pipeline, areas of active bank erosion were observed along both banks of the portion of the river within the
existing easement (see photographs included in the information submitted with the online PCN). To help reduce
further erosion and protect the existing transmission lines, DENC is proposing to stabilize the eroding areas on
both banks of the river using natural materials to the extent practicable.
Jurisdictional Areas
The portion of the Broad River located within the project area was previously delineated by S&ME in connection
with the T01B Replacement Project. The delineation was conducted utilizing currently accepted methods for
wetland determination, as set forth in the 1987 Corps of Engineers Wetlands Delineation Manual and the
corresponding Eastern Mountain and Piedmont Region USACE Regional Supplement Guide. A Request for
Preliminary Jurisdictional Determination (Pre-JD) package was provided to the USACE on October 14, 2016.
Representatives of the USACE (David Brown and Steve Kichefski) and NCDWR (Kevin Mitchell) visited the project
site on November 17, 2016 to approve the original delineation and verify the location/classification of affected
features.

The project area was re-assessed by S&ME in April 2020 to confirm the findings of the previous delineation. The
site visit confirmed that aside from the Broad River itself, no additional jurisdictional features were identified
within the project area.
Description of the Proposed Work
The project area consists of DENC’s existing permanent easement along with temporary workspace previously
acquired and used in connection with the T01/M228 pipeline installations. Other than pipeline markers, no
existing aboveground structures are present. The bank stabilization project will temporarily affect approximately
75 linear feet of stream bank, including the affected banks within the existing easement, and 10 to 12 feet on
either side of the easement where it is necessary to tie the proposed streambank grade back into the existing
grade outside of the easement.
The bank stabilization will consist of installation of boulder toe protection at the base of the existing banks,
followed by re-establishment of a bank full bench and grading to soften the existing slopes. An aqua barrier or
similar coffer dam will first be installed within the river along the toe of the bank to provide a suitably dry work
area for the boulder toe installation.
Live staking will be incorporated above the boulder toe. Above the lives takes, the bank will be sloped at a 2H:1V
grade, and a second bench (upper berm) will be incorporated to further soften the slope.
Because of the confined easement width, site grades flatter than 2H:1V could not be incorporated without
significant grading and tree removal outside of the existing easement. Therefore, re-graded portions of the
streambank above the bank full level will be stabilized with Green Armor turf reinforcement matting. Based on
geotechnical exploration and slope stability analysis conducted by S&ME, it was determined that the existing
banks consist of alluvium (very loose to loose, poorly graded sand and silt) to a depth of approximately eight feet.
The analysis concluded that safe inclinations without the use of rip-rap could be achieved are 1.75H:1V to 2H:1V,
but that turf reinforcement matting should be employed in the design due to anticipated overland flow and
associated erosion potential.
Incorporation of the Green Armor turf matting will provide rapid slope stabilization and will allow integration of
the native riparian seed mix. Although the matting is synthetic, the material does not consist of laminated or
stitched layers. Rather, its three-dimensional structure will provide an open matrix that will be hydraulically infilled
with high performance flexible growth media to bond the soil and seed and accelerate growth. No material
consisting of netting or stitching has been incorporated into the design.
As indicated, only minor grading will be required outside of the existing easement to tie the proposed streambank
stabilization grades back into the existing grade. The stabilization design and associated grading are depicted on
the construction drawings that accompany this PCN.
Normal flow and circulation patterns of the Broad River will not be permanently altered as a result of the
proposed stabilization project. Following stream bank stabilization, any temporarily affected areas will be restored
to original grades and contours, matted, and seeded with a riparian seed mix.
The project area is within the permitted limits of disturbance associated with NCDEQ Project ID: RUTHE-2020-009.
A modification to that approved Erosion & Sediment Control Plan will be submitted along with a floodplain
development permit application.

Protected Species
We understand that the USACE will determine compliance with applicable sections of the Endangered Species Act
(ESA) of 1973 (16 USC 1531-1543). The project site was initially reviewed in 2016 as part of a larger area subject to
a Protected Species Assessment conducted by S&ME in connection with the T01B Replacement Project. Results of
the assessment were provided to the FWS in an October 31, 2016 report that concluded the proposed project was
unlikely to adversely affect populations of federally-protected flora and fauna listed above or their critical habitat.
Following USFWS review report, the agency responded with a November 7, 2015 letter stating that they concurred
with S&ME’s findings. It was concluded that the requirements of Section 7 of the Act had been fulfilled. Both the
aforementioned report and FWS concurrence letter for that project can be provided upon your request.
As an update, S&ME submitted a request for information to the North Carolina Natural Heritage Program
(NCNHP). The NCNHP responded with an August 28, 2020 report that listed natural areas and protected species
with documented occurrences within one mile of the project area. Although several rare state-listed species have
been historically recorded, the report identified no occurrences of federally-protected species within one mile of
the site.
S&ME also consulted the FWS Information for Planning and Consulting (IPaC) system for a list of species that are
known or expected to be near the assessment area. The IPac report identified the following species as having
potential for direct or indirect affected by activities in the assessment area:
Indiana Bat
Status: Federally-listed Endangered
Biological Determination: No Effect
The Indiana bat is a small bat with a wingspan of about 9 to 11 inches and fur that is dark-brown to black. During
winter, the bat hibernates in humid caves or other similar structures (e.g., abandoned mines) that provide stable
temperatures between 32° F and 50° F. After hibernation, they migrate to their summer habitat in wooded areas
where they usually roost under the loose tree bark of dead or dying trees. During summer, males roost alone or in
small groups, while females roost in larger groups of up to 100 bats or more. They also forage in or along the
edges of forested areas.
Based on S&ME’s previous experience, Indiana bat is listed as a current occurrence for Rutherford County, but the
only record of this species is at the town of Bat Cave, which is not proximate to the project site. Accordingly, no
further action for Indiana bat should be required.
Northern Long-eared Bat
Status: Federally-Listed Threatened
Biological Determination: No Effect
The northern long-eared bat (Myotis septentrionalis) is a medium-sized bat about three to 3.7 inches in length but
with a wingspan of 9 to 10 inches. This bat generally is associated with old-growth forests composed of trees 100
years old or older. It relies on intact interior forest habitat, with low edge-to-interior ratios. Relevant late-
successional forest features include a high percentage of old trees, uneven forest structure (resulting in
multilayered vertical structure), single and multiple tree-fall gaps, standing snags, and woody debris.

Foraging occurs within forests, along forest edges, over forest clearings, and occasionally over ponds. Eleven
individuals (10 males, 1 female) tagged with chemical lights observed during the summer in Missouri, foraged
almost exclusively among the trees of hillside and ridge forests, rather than utilizing floodplain and riparian
forests; frequently foraging occurred within one to three meters of the ground. Foraging bats doubled back
frequently and only slowly moved out of the observation area. In Iowa, females were found primarily foraging in
mature deciduous uplands with adjacent deep ravines and in a disturbed riparian area with an adjacent floodplain
and agricultural lands.
Hibernation occurs primarily in caves, mines, and tunnels, typically those with large passages and entrances,
relatively constant and cool temperatures, high humidity, and no air currents. Hibernators frequently roost in
crevices, drill holes, and similar sites where they may be overlooked during surveys, but roosting in the open is not
uncommon. A lack of suitable hibernacula may prevent occupancy of areas that otherwise have adequate habitat.
The project as proposed should not have a significant effect on northern long-eared bat because the work will
take place primarily within an existing utility corridor that is already cleared of woody vegetation.
Dwarf Flowered Heartleaf
Status: Federally-Listed Threatened
Biological Determination: May Affect, Not Likely to Adversely Affect
Dwarf-flowered heartleaf is an evergreen, perennial herb in the birthwort family. It is distinguished from other
members in the genus by the small size of the flowers. Varying flowering periods are provided in the available
literature; Radford et al. (1968) indicate April to early May (1968), Weakley indicates March to June (2006), and the
USFWS indicates the optimal survey window to be March to May (2006). The leaves are dark green, sometimes
with silvery or gray mottling. Frequently, the tip of the leaf has a small indentation. The flowers are borne near the
ground surface, often under leaf litter, and are brownish to greenish in color. The habitat of dwarf-flowered
heartleaf is open deciduous woods, along streambanks, often on Pacolet, Madison, or Musella soils.
The wooded areas adjacent to the project corridor contain potentially-suitable habitat for this species. However,
no individuals of this species were previously observed in this area, and the proposed project will take place
largely within an existing utility easement. As such, this project it is not anticipated that this project will adversely
affect populations of this species.
Small Whorled Pogonia
Status: Federally-Listed Threatened
Biological Determination: May Affect, Not Likely to Adversely Affect
Small whorled pogonia (Isotria medeoloides) is a member of the orchid family. According to the USFWS species
description, it usually has a single grayish-green stem that grows about 10 inches tall when in flower and about 14
inches when bearing fruit. The leaves are arranged in a whorl near the top of the stem and beneath the flower. The
leaves are grayish-green, somewhat oblong and one to 3.5 inches long. The greenish-yellow flowers are about 0.5
to one inch long and appear in May or June. The fruit, an upright ellipsoid capsule, appears later in the year.
This species grows in older hardwood stands of beech, birch, maple, oak, and hickory that have an open
understory. Sometimes it grows in stands of softwoods such as hemlock. It prefers acidic soils with a thick layer of
dead leaves, often on slopes near small streams, and often occurs on flats or slope bases near canopy breaks.
Other orchids such as Cypripedium acaule, Goodyera tesselata, G. pubescens, Corallorhiza maculata, C. odontorhiza,
and Triphora trianthophora frequently occur with I. medeoloides. Although most of the above-mentioned

herbaceous species are quite common in a variety of habitats, they can serve as indicators of I. medeoloides when
they occur together in abundance. These ferns, clubmosses, evergreen forbs, and orchids characterize the plant
community found on acidic, sloping, fragipan soils.
No individuals of this species were previously observed in this area, and the proposed project will take place
largely within an existing utility easement. As such, this project it is not anticipated that this project will adversely
affect populations of this species.
White Irisette
Status: Federally-Listed Endangered
Biological Determination: May Affect, Not Likely to Adversely Affect
White irisette (Sisyrinchium dichotomum) is a perennial herb with winged, branching stems, four to eight inches
tall, rising above basal clumps of blue-green, grass-like leaves. Tiny white flowers bloom at the ends of the stems
from late May through July. The white flowers and dichotomous branching pattern distinguish it from similar
species. The plant flowers and fruits from late May to July, and a relatively small number of seeds are produced.
This species inhabits rich, basic soils in clearings and near the edges of upland woods where the canopy cover is
thin, often in places where the humus or mineral soil layers have been exposed by downslope runoff, which has
removed the litter layer from the soil's surface. In the past, the thin canopy cover (and possibly the thin litter layer
as well) was maintained by periodic fires and by native grazing animals. Now, most populations are in artificially
disturbed areas, such as power line and road easements.
No individuals of this species were previously observed in this area, and the proposed project will take place
largely within an existing utility easement. As such, this project it is not anticipated that this project will adversely
affect populations of this species.
Rock Gnome Lichen
Status: Federally-Listed Endangered
Biological Determination: No Effect
Rock gnome lichen (Gymnoderma lineare) is one of two lichens on the federal list of threatened and endangered
species, and the only member of the genus Gymnoderma to live in North America. Rock gnome lichen occurs in
dense colonies of narrow strap-like lobes that are about 0.04 inch across and generally one to two centimeters
(cm) long. These lobes are blue gray on the terminal upper surface, and generally shiny white on the lower surface,
grading to black near the base. The fruiting bodies are born on the tips of these lobes, are black, and have been
found from July through September. The primary means of propagation appears to be asexual, with colonies
spreading clonally.
This species occurs on shady or moss-covered rock. Further, it is found in areas of high humidity, either on high-
elevation cliffs, where it is frequently bathed in fog, or in deep river gorges at lower elevations. It is primarily
limited to vertical rock faces, where seepage water from forest soils above flows at (and only at) very wet times,
and large stream side boulders, where it receives a moderate amount of light, but not high-intensity solar
radiation. It is threatened by habitat change, especially due to loss of Fraser fir forests and by heavy recreational
use of its habitat.
Suitable habitat for rock gnome lichen was not observed in the project area, and the project is unlikely to affect
populations of this species.

Historic and Archaeological Resources
The project site was assessed in 2016 as part of a larger area subject to a Phase I Archaeological Assessment
conducted by S&ME in connection with the T01B Replacement Project (NC State Historic Preservation Office
[SHPO] Project No. ER 16-0551). Results of the assessment were provided to SHPO in an October 2016 report. The
closest site identified during the assessment (Site 31PL102/102**) was a small nineteenth through twentieth
century artifact scatter and prehistoric lithic scatter located approximately 230 feet west of Ken Miller Road. This
site was recommended ineligible for inclusion on the National Historic Registry. SHPO concurred with the findings
of S&ME’s report in a January 17, 2017 letter. Accordingly, this project should not affect historic, cultural or
archaeological resources. Both the aforementioned Phase I report and SHPO concurrence letter for that project
can be provided upon your request.
Avoidance and Minimization
To minimize impacts to waters of the U.S., DENC has proposed to limit the space within which the work will be
conducted to the existing easement and adjacent workspace necessary to tie the stabilized banks back to existing
grade. Additionally, construction equipment operating near the river will be limited to that necessary for bank
stabilization activities. Installation of the rock toe protection will be conducted in a dry work space by utilizing a
suitable coffer dam and dewatering the work area along the bank.
The project design incorporated measures to limit the amount of streambank disturbance to less than 150 lf. The
resultant design and proposed impacts are considered the minimum amount necessary to safely provide long-
term stabilization to the eroding streambank and protect the important underground infrastructure.
The project has designed to incorporate appropriate erosion and sediment control practices outlined in the most
recent version of the "North Carolina Erosion and Sedimentation Control Planning and Design Manual” and
approved by NCDENR prior to construction. DENC will hold a pre-construction meeting with the contractor to
review the design and conditions of the applicable permits.
As proposed, the project will comply with applicable conditions of NWP No. 13 and WQC No. 4134. As proposed,
the project will not result in detrimental changes in pre-construction elevation contours or affect dimension,
pattern or profile of the affected stream beyond the proposed stabilization footprint.
Because the project will result in permanent impacts to less than 150 lf of stream bank, and there will be no
wetland impacts, we do not anticipate that purchase of wetland mitigation credit will be required.

woodland, and no existing aboveground structures are present. Review of the Rutherfordton South, NC US Geological Survey (USGS) Topographic Map depicts the project area as
forested land. Soils mapped within the project area are limited to Pacolet sandy loam (Typic Kanhapludults) and Buncombe loamy sand. Neither of these soils are classified as hydric.
A new20-inch diameter natural gas transmission pipeline (T01) was installed in the easement in 2017, and the portion of an adjacent, pre-existing 8-inch diameter pipeline (M201) that
was located beneath the river was replaced in 2020. Both T01 and the replacement segment of M201 were installed beneath the river by horizontal directional drill (HDD). The project
area is within the permitted limits of disturbance associated with NCDEQ Project ID: RUTHE-2020-009.
Over the course of performing routine inspections of the easement, and later during installation of the M201 pipeline, areas of active bank erosion were observed along both banks of
the portion of the river within the existing easement.

The purpose of the project is to repair erosion and provide long term stabilization to banks of the Broad River located within DENC's natural gas transmission pipeline easement.
41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
The bank stabilization will consist of installation of boulder toe protection at the base of the existing banks, followed by re-establishment of a bank full bench and grading to soften the
existing slopes. An aqua barrier or similar coffer dam will first be installed within the river along the toe of the bank to provide a suitably dry work area for the boulder toe installation.
Live staking will be incorporated above the boulder toe. Above the lives takes, the bank will be sloped at a 2HA V grade, and a second bench (upper berm) Will be incorporated to
further soften the slope.
Because of the confined easement width, site grades flatter than 2H:1 V could not be incorporated without significant grading and tree removal outside of the existing easement.
Therefore, re -graded portions of the streambank above the bank full level will be stabilized with Green Armor turf reinforcement matting. Based on geotechnical exploration and slope
stability analysis conducted by S&ME, it was determined that the existing banks consist of alluvium (very loose to loose, poorly graded sand and silt) to a depth of approximately eight
feet. The analysis concluded that safe inclinations without the use of rip -rap could be achieved are 1.75H:1V to 2H:1V, but that turf reinforcement matting should be employed in the
design due to anticipated overland flow and associated erosion potential.
Incorporation of the Green Armor turf matting will provide rapid slope stabilization and will allow integration of the native riparian seed mix Although the matting is synthetic, the material
does not consist of laminated or stitched layers. Rather, its three-dimensional structure will provide an open matrix that will be hydraulically infilled with high performance flexible growth
media to bond the soil and seed and accelerate growth. No material consisting of netting or stitching has been incorporated into the design.
As indicated, only minor grading will be required outside of the existing easement to tie the proposed streambank stabilization grades back into the existing grade. The stabilization
design and associated grading are depicted on the construction drawings that accompany this PCN.
Normal flow and circulation patterns of the Broad River will not be permanently altered as a result of the proposed stabilization project. Following stream bank stabilization, any
temporarily affected areas will be restored to original grades and contours, matted, and seeded with a riparian seed mix

Mitchell) visited the project site on November 17, 2016 to approve the original delineation and verify the location/classification of affected features.
The project area was re -assessed by S&ME in April 2020 to confirm the findings of the previous delineation. The site visit confirmed that aside from the Broad River itself, no additional
jurisdictional features were identified within the project area.

impacts are considered the minimum amount necessary to safely provide long-term stabilization to the eroding streambank and protect the important

New information based on updated surveys, changes in the abundance and distribution of
species, changed habitat conditions, or other factors could require modifications of these lists.
Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the Act,
the accuracy of the species lists should be verified after 90 days. This verification can be
completed formally or informally as desired. The Service recommends that verification be
completed by visiting the ECOS-IPaC website or the AFO website (the AFO website dates each
county list with the day of the most recent update/change) at regular intervals during project
planning and implementation for updates to species lists and information. An updated list may be
requested through the ECOS-IPaC system by completing the same process used to receive the
enclosed list or by going to the AFO website.
The purpose of the Act is to provide a means whereby threatened and endangered species and the
ecosystems upon which they depend may be conserved. Under sections 7(a)(1) and 7(a)(2) of the
Act and its implementing regulations (50 CFR 402 et seq.), Federal agencies are required to
utilize their authorities to carry out programs for the conservation of threatened and endangered
species and to determine whether projects may affect threatened and endangered species and/or
designated critical habitat.
A Biological Assessment is required for construction projects (or other undertakings having
similar physical impacts) that are major Federal actions significantly affecting the quality of the
human environment as defined in the National Environmental Policy Act (42 U.S.C. 4332(2)
(c)). For projects other than major construction activities, the Service suggests that a Biological
Evaluation similar to a Biological Assessment be prepared to determine whether the project may
affect listed or proposed species and/or designated or proposed critical habitat. Recommended
contents of a Biological Assessment are described at 50 CFR 402.12 and on our office's website
at https://www.fws.gov/asheville/htmls/project_review/assessment_guidance.html.
If a Federal agency (or their non-federal representative) determines, based on the Biological
Assessment or Biological Evaluation, that listed species and/or designated critical habitat may be
affected by the proposed project, the agency is required to consult with the Service pursuant to
50 CFR 402. In addition, the Service recommends that candidate species, proposed species, and
proposed critical habitat be addressed within the consultation. More information on the
regulations and procedures for section 7 consultation, including the role of permit or license
applicants, can be found in the "Endangered Species Consultation Handbook" at: http://

Though the bald eagle is no longer protected under the Endangered Species Act, please be aware
that bald and golden eagles are protected under the Bald and Golden Eagle Protection Act (16

Certain birds are protected under the Migratory Bird Treaty Act and the Bald and Golden Eagle
Protection Act .
Any person or organization who plans or conducts activities that may result in impacts to
migratory birds, eagles, and their habitats should follow appropriate regulations and consider
implementing appropriate conservation measures, as described below.

FAQ “Proper Interpretation and Use of Your Migratory Bird Report” before using or attempting
to interpret this report.
Probability of Presence ()
Each green bar represents the bird's relative probability of presence in the 10km grid cell(s) your
project overlaps during a particular week of the year. (A year is represented as 12 4-week
months.) A taller bar indicates a higher probability of species presence. The survey effort (see
below) can be used to establish a level of confidence in the presence score. One can have higher
confidence in the presence score if the corresponding survey effort is also high.
How is the probability of presence score calculated? The calculation is done in three steps:
The probability of presence for each week is calculated as the number of survey events in
the week where the species was detected divided by the total number of survey events for
that week. For example, if in week 12 there were 20 survey events and the Spotted Towhee
was found in 5 of them, the probability of presence of the Spotted Towhee in week 12 is
0.25.
To properly present the pattern of presence across the year, the relative probability of
presence is calculated. This is the probability of presence divided by the maximum
probability of presence across all weeks. For example, imagine the probability of presence
in week 20 for the Spotted Towhee is 0.05, and that the probability of presence at week 12
(0.25) is the maximum of any week of the year. The relative probability of presence on
week 12 is 0.25/0.25 = 1; at week 20 it is 0.05/0.25 = 0.2.
The relative probability of presence calculated in the previous step undergoes a statistical
conversion so that all possible values fall between 0 and 10, inclusive. This is the
probability of presence score.
Breeding Season ()
Yellow bars denote a very liberal estimate of the time-frame inside which the bird breeds across
its entire range. If there are no yellow bars shown for a bird, it does not breed in your project
area.
Survey Effort ()
Vertical black lines superimposed on probability of presence bars indicate the number of surveys
performed for that species in the 10km grid cell(s) your project area overlaps. The number of
surveys is expressed as a range, for example, 33 to 64 surveys.
No Data ()
A week is marked as having no data if there were no survey events for that week.
Survey Timeframe
Surveys from only the last 10 years are used in order to ensure delivery of currently relevant
information. The exception to this is areas off the Atlantic coast, where bird returns are based on
all years of available data, since data in these areas is currently much more sparse.

Nationwide Conservation Measures describes measures that can help avoid and minimize
impacts to all birds at any location year round. Implementation of these measures is particularly
important when birds are most likely to occur in the project area. When birds may be breeding in
the area, identifying the locations of any active nests and avoiding their destruction is a very
helpful impact minimization measure. To see when birds are most likely to occur and be breeding
in your project area, view the Probability of Presence Summary. Additional measures and/or
permits may be advisable depending on the type of activity you are conducting and the type of
infrastructure or bird species present on your project site.
What does IPaC use to generate the migratory birds potentially occurring in my specified
location?
The Migratory Bird Resource List is comprised of USFWS Birds of Conservation Concern
(BCC) and other species that may warrant special attention in your project location.
The migratory bird list generated for your project is derived from data provided by the Avian
Knowledge Network (AKN). The AKN data is based on a growing collection of survey, banding,
and citizen science datasets and is queried and filtered to return a list of those birds reported as
occurring in the 10km grid cell(s) which your project intersects, and that have been identified as
warranting special attention because they are a BCC species in that area, an eagle (Eagle Act
requirements may apply), or a species that has a particular vulnerability to offshore activities or
development.

The probability of presence graphs associated with your migratory bird list are based on data
provided by the Avian Knowledge Network (AKN). This data is derived from a growing

Probability of presence data is continuously being updated as new and better information
becomes available. To learn more about how the probability of presence graphs are produced and

How do I know if a bird is breeding, wintering, migrating or present year-round in my
project area?
To see what part of a particular bird's range your project area falls within (i.e. breeding,
wintering, migrating or year-round), you may refer to the following resources: The Cornell Lab
of Ornithology All About Birds Bird Guide, or (if you are unsuccessful in locating the bird of
interest there), the Cornell Lab of Ornithology Neotropical Birds guide. If a bird on your
migratory bird species list has a breeding season associated with it, if that bird does occur in your
project area, there may be nests present at some point within the timeframe specified. If "Breeds
elsewhere" is indicated, then the bird likely does not breed in your project area.
What are the levels of concern for migratory birds?
Migratory birds delivered through IPaC fall into the following distinct categories of concern:
"BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern
throughout their range anywhere within the USA (including Hawaii, the Pacific Islands,
Puerto Rico, and the Virgin Islands);
"BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation
Regions (BCRs) in the continental USA; and
"Non-BCC - Vulnerable" birds are not BCC species in your project area, but appear on
your list either because of the Eagle Act requirements (for eagles) or (for non-eagles)
potential susceptibilities in offshore areas from certain types of development or activities
(e.g. offshore energy development or longline fishing).
Although it is important to try to avoid and minimize impacts to all birds, efforts should be made,
in particular, to avoid and minimize impacts to the birds on this list, especially eagles and BCC
species of rangewide concern. For more information on conservation measures you can
implement to help avoid and minimize migratory bird impacts and requirements for eagles,
please see the FAQs for these topics.

model results files underlying the portal maps through the NOAA NCCOS Integrative Statistical
Modeling and Predictive Mapping of Marine Bird Distributions and Abundance on the Atlantic
Outer Continental Shelf project webpage.
Bird tracking data can also provide additional details about occurrence and habitat use
throughout the year, including migration. Models relying on survey data may not include this

What if I have eagles on my list?
If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid
violating the Eagle Act should such impacts occur.
Proper Interpretation and Use of Your Migratory Bird Report
The migratory bird list generated is not a list of all birds in your project area, only a subset of
birds of priority concern. To learn more about how your list is generated, and see options for
identifying what other birds may be in your project area, please see the FAQ “What does IPaC
use to generate the migratory birds potentially occurring in my specified location”. Please be
aware this report provides the “probability of presence” of birds within the 10 km grid cell(s) that
overlap your project; not your exact project footprint. On the graphs provided, please also look
carefully at the survey effort (indicated by the black vertical bar) and for the existence of the “no
data” indicator (a red horizontal bar). A high survey effort is the key component. If the survey
effort is high, then the probability of presence score can be viewed as more dependable. In
contrast, a low survey effort bar or no data bar means a lack of data and, therefore, a lack of
certainty about presence of the species. This list is not perfect; it is simply a starting point for
identifying what birds of concern have the potential to be in your project area, when they might
be there, and if they might be breeding (which means nests might be present). The list helps you
know what to look for to confirm presence, and helps guide you in knowing when to implement
conservation measures to avoid or minimize potential impacts from your project activities,

THE FLOODPLAIN ENCROACHMENT DEPICTED IS FOR THE DOMINION ENERGY NORTH CAROLINA BROAD RIVER BANK
STABILIZATION PROJECT. THE SITE COMPRISES A MAINTAINED CROSS-COUNTRY NATURAL GAS EASEMENT OWNED BY
DOMINION ENERGY NORTH CAROLINA AND ADJACENT PROPERTIES IN RUTHERFORD COUNTY, NORTH CAROLINA.
CONSTRUCTION ACTIVITIES WITHIN THE FEMA ZONE AE 100-YEAR FLOODPLAIN OF THE BROAD RIVER INCLUDE THE
INSTALLATION OF ROCK TOE STABILIZATION ALONG A SEGMENT OF THE RIVER AS WELL AS GRADING ALONG THE RIVER
BANKS TO REPAIR EXISTING EROSION AND STABILIZE THE BANKS.
THE PROPOSED STABILIZATION PROJECT IS ADJACENT TO RUTHERFORD COUNTY PIN #'s: 1517100649 AND 1506899614.
NO EXISTING STRUCTURES ARE PRESENT AND NO STRUCTURES, BEYOND THE PROPOSED ROCK TOE STABILIZATION
MEASURES, ARE PROPOSED WITHIN THE PROJECT AREA. NO PROPOSED PAVEMENT AREAS, STORAGE AREAS, FILL
MATERIALS, OR DRAINAGE FACILITIES ARE ANTICIPATED. IMPACTS TO THE FLOODPLAIN ARE ANTICIPATED TO BE
PERMANENT IN NATURE. FOLLOWING STREAM BANK STABILIZATION, THE IMPACTED AREA WILL BE MATTED AND
HYDRO-SEEDED WITH A RIPARIAN SEED MIX IN ORDER TO RESTORE AREA TO PRE-CONSTRUCTION VEGETATION.
THE BOUNDARY OF THE FEMA ZONE AE 100-YEAR FLOODPLAIN ARE SHOWN ON THE ABOVE PLAN VIEW. THE

2.MAKE ANY NECESSARY REPAIRS IMMEDIATELY.
3.REMOVE ACCUMULATED SEDIMENT OVER 1/2 THE HEIGHT OF THE
COMPOST FILTER SOCK AND ANY DEBRIS. THE COMPOST SOCK MUST
BE REPLACED IF CLOGGED OR TORN.
4.IF PONDING BECOMES EXCESSIVE, THE SOCK MAY NEED TO BE
REPLACED WITH ONE OF A LARGER DIAMETER OR A DIFFERENT
MEASURE. THE SOCK NEEDS TO BE REINSTALLED IF UNDERMINED OR
DISLODGED.
5.THE COMPOST FILTER SOCK SHALL BE REGULARLY INSPECTED UNTIL
LAND DISTURBANCE IS COMPLETE AND THE AREA ABOVE THE
MEASURE HAS BEEN PERMANENTLY STABILIZED.
6.REMOVE ALL COMPOST FILTER SOCK MATERIALS AND UNSTABLE
SEDIMENT DEPOSITS AND RETURN THE AREA TO GRADE AND
STABILIZE IT AFTER THE CONTRIBUTING DRAINAGE AREA HAS BEEN
PROPERLY STABILIZED.

SEWN WITH HIGH STRENGTH, DOUBLE STITCHED "J" TYPE SEAMS. THEY SHALL BE
CAPABLE OF TRAPPING PARTICLES LARGER THAN 150 MICRONS. HIGH VOLUME FILTER
BAGS SHALL BE MADE FROM WOVEN GEOTEXTILES THAT MEET THE FOLLOWING
STANDARDS:
2.FILTER BAGS SHALL BE REPLACED WHEN THEY REACH CAPACITY. SPARE BAGS SHALL BE
KEPT AVAILABLE FOR REPLACEMENT OF THOSE THAT HAVE FAILED OR ARE FILLED. ALL
BAGS SHALL BE WITHIN THE APPROVED LIMITS OF DISTURBANCE. DISCHARGE TO
APPROPRIATE EROSION AND SEDIMENTATION CONTROL MEASURE.
3.FILTER BAGS SHALL NOT BE PLACED ON SLOPES GREATER THAN 5% WITHOUT
APPROPRIATE STABILITY MEASURES. PLACE FILTER BAGS ON EXISTING WELL VEGETATED
AREAS. IF DISCHARGE LOCATION IS BARE SOIL PLACE FILTER BAG ON GEOTEXTILE
FABRIC.
4.THE PUMP DISCHARGE HOSE SHALL BE INSERTED INTO THE BAGS IN THE MANNER
SPECIFIED BY THE MANUFACTURER AND SECURELY CLAMPED. A PIECE OF PVC PIPE IS
RECOMMENDED FOR THIS PURPOSE.
5.THE PUMPING RATE SHALL BE NO GREATER THAN 750 GPM OR 1/2 THE MAXIMUM
SPECIFIED BY THE MANUFACTURER, WHICHEVER IS LESS. PUMP INTAKES SHALL BE
FLOATING AND SCREENED.
6.FILTER BAGS SHALL BE INSPECTED DAILY FOR CAPACITY AND RIPS. IF ANY PROBLEM IS
DETECTED, PUMPING SHALL CEASE IMMEDIATELY AND NOT RESUME UNTIL THE
PROBLEM IS CORRECTED.
7.WATER PUMPED OUT OF TRENCH SHALL NOT BE DISCHARGED INTO WATERWAYS.
WATER SHALL BE DISCHARGED INTO A FILTER BAG OR DEWATERING STRUCTURE
LOCATED IN A WELL VEGETATED AREA AT LEAST 50-FEET AWAY FROM A STREAM OR
WETLAND.

1.PREPARE SOIL BEFORE INSTALLING ROLLED EROSION CONTROL
PRODUCTS (RECPS), INCLUDING ANY NECESSARY APPLICATION OF
LIME, FERTILIZER, AND SEED.
2.BEGIN AT THE TOP OF THE SLOPE BY ANCHORING THE RECPS IN A
6-IN. DEEP X 6-IN. WIDE TRENCH WITH APPROXIMATELY 12-IN. OF
RECPS EXTENDED BEYOND THE UP-SLOPE PORTION OF THE
TRENCH. ANCHOR THE RECPS WITH A ROW OF STAPLES/STAKES
APPROXIMATELY 12-IN. APART IN THE BOTTOM OF THE TRENCH.
BACKFILL AND COMPACT THE TRENCH AFTER STAPLING. APPLY
SEED TO THE COMPACTED SOIL AND FOLD THE REMAINING 12-IN.
PORTION OF RECPS BACK OVER THE SEED AND COMPACTED SOIL.
SECURE RECPS OVER COMPACTED SOIL WITH A ROW OF
STAPLES/STAKES SPACED APPROXIMATELY 12-IN. APART ACROSS
THE WIDTH OF THE RECPS.
3.ROLL THE RECPS DOWN OR HORIZONTALLY ACROSS THE SLOPE
BASED ON ENVIRONMENT INSPECTOR. RECPS WILL UNROLL WITH
APPROPRIATE SIDE AGAINST THE SOIL SURFACE. ALL RECPS MUST
BE SECURELY FASTENED TO SOIL SURFACE BY PLACING
STAPLES/STAKES IN APPROPRIATE LOCATIONS AS SHOWN IN THE
STAPLE PATTERN GUIDE.
4.THE EDGES OF PARALLEL RECPS MUST BE STAPLED WITH
APPROXIMATELY 2 TO 5-IN. OVERLAP DEPENDING ON THE RECPS
TYPE.
5.CONSECUTIVE RECPS SPLICED DOWN THE SLOPE MUST BE END
OVER END (SHINGLE STYLE) WITH AN APPROXIMATE 3-IN.
OVERLAP. STAPLE THROUGH OVERLAPPED AREA, APPROXIMATELY
12-IN. APART ACROSS ENTIRE RECPS WIDTH.
6.IN LOOSE SOIL CONDITIONS, THE USE OF STAPLE OR STAKE
LENGTHS GREATER THAN 6-IN. MAY BE NECESSARY TO PROPERLY
SECURE THE RECP'S.
7.TEMPORARY MATTING SHALL BE NORTH AMERICAN GREEN
BIONET SC150BN OR ENGINEER APPROVED EQUIVALENT.
TEMPORARY SLOPE MATTING MAINTENANCE
1.INSPECT AT LEAST ONCE PER 7 CALENDAR DAYS AND WITHIN 24
HOURS OF A RAIN EVENT GREATER THAN OR EQUAL TO 1.0-IN IN
24 HOURS.
2.MAKE ANY NECESSARY REPAIRS IMMEDIATELY.
3.GOOD CONTACT WITH THE GROUND MUST BE MAINTAINED, AND
EROSION MUST NOT OCCUR BENEATH THE RECP.
4.ANY AREAS OF THE RECP THAT ARE DAMAGED OR NOT IN CLOSE
CONTACT WITH THE GROUND SHALL BE REPAIRED AND STAPLED.
5.IF EROSION OCCURS DUE TO POORLY CONTROLLED DRAINAGE,
THE PROBLEM SHALL BE FIXED AND THE ERODED AREA
PROTECTED.
6.MONITOR AND REPAIR THE RECP AS NECESSARY UNTIL GROUND
COVER IS ESTABLISHED.

CONSTRUCTION ENTRANCE MAINTENANCE
1.INSPECT TEMPORARY CONSTRUCTION ENTRANCES AT LEAST ONCE PER 7
CALENDAR DAYS AND WITHIN 24 HOURS OF A RAIN EVENT GREATER THAN
OR EQUAL TO 1.0-IN IN 24 HOURS. INSPECT MORE FREQUENTLY DURING
PERIODS OF HEAVY USE.
2.THE ENTRANCE WILL BE MAINTAINED IN A CONDITION THAT WILL PREVENT
TRACKING OR FLOWING OF SEDIMENT ONTO EXISTING ROADWAYS.
SEDIMENT TRACKED, SPILLED, DROPPED OR OTHERWISE DEPOSITED ONTO
ROADWAYS WILL BE SWEPT UP AS SOON AS PRACTICAL AND PLACED BACK
WITHIN THE APPROVED DISTURBED AREA.
3.IF EXCESS SEDIMENT HAS CLOGGED THE STONE, THE ENTRANCE WILL BE
TOPDRESSED WITH NEW STONE AS NEEDED. REPLACEMENT OF THE STONE
MAY BECOME NECESSARY WHEN THE STONE BECOMES ENTIRELY FILLED
WITH SEDIMENT AND MUD.
4.THE CONSTRUCTION ENTRANCE AND CULVERT (IF PRESENT), WILL BE
REMOVED WHEN CONSTRUCTION ACTIVITIES CEASE ON THE PROJECT. THE
REMOVED STONE AND SEDIMENT FROM THE ENTRANCE WILL BE HAULED
OFF-SITE AND DISPOSED OF PROPERLY.
5.UPON REMOVAL OF THE CONSTRUCTION ENTRANCE, THE CONTRACTOR
SHALL BRING THE AREA TO ORIGINAL GRADE AND STABILIZE IT. IF A
TEMPORARY CULVERT WAS UTILIZED IN CONJUNCTION WITH THE
CONSTRUCTION ENTRANCE, THE CONTRACTOR SHALL INSTALL TEMPORARY
MATTING AND/OR WATTLES WITHIN ROADSIDE SWALE/DITCH.

6.THE PUMP(S) SHALL BE OF SUFFICIENT SIZE TO CONVEY NORMAL STREAM FLOW. HAVE STANDBY PUMPS
AND GENERATORS CAPABLE OF HANDLING 100% OF ANTICIPATED FLOW ON-SITE IN CASE OF PUMP
FAILURE OR A RAIN EVENT. CONTINUOUSLY MONITOR THE DAM AND PUMPS TO ENSURE PROPER

8.BANK CONSTRUCTION SHOULD BE CONDUCTED "IN THE DRY" DURING LOW FLOW CONDITIONS. LOCAL
