APPROVAL of 401 Water Quality Certification with Additional Conditions

Dear Ms. Simon:
You have our approval, in accordance with the attached conditions and those listed below, to impact 80
linear feet of an unnamed tributary to South Yadkin River for the purpose of replacing Bridge No. 64 on
SR 1460 in Alexander County. The project should be constructed in accordance with your application
dated 5 February 2001 (and clarifications dated 27 March 2001). After reviewing your application, we
have decided that this fill is covered by General Water Quality Certification No. 3289 corresponding to
the U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you should acquire any
other federal, state or local permits before you proceed with your project including (but not limited to)
Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval
will expire with the accompanying 404 permit unless otherwise specified in the Water Quality
Certification.
This approval is valid solely for the purpose and design described in your application (unless modified
below). Should your project change, you must notify the DWQ and submit a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter, and is
thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in
the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
1. Any trout conditions as determined by the North Carolina Wildlife Resources Commission, to protect
the egg and fry stages of trout from sedimentation during construction.
2. Stormwater should be directed to buffer areas or retention basins and should not be routed directly
.into streams.
3. Sedimentation and Erosion Control Guidelines for Sensitive Watersheds (15a NCAC 4B .0024) must
be implemented prior to any ground-disturbing activities to minimize impacts to downstream aquatic
resources. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 5
days of ground-disturbing activities to provide long term erosion control.
4. The culverts required for this project shall be installed in such a manner that the original stream
profile is not altered (i.e. the depth of the channel should not be reduced by a widening of the
streambed). The pipes should be placed such that one is in line with the stream and below the stream
bed for low flow conditions, and the second one is placed offline and at a bankfull elevation for flood
flows. Existing stream dimensions are to be maintained above and below locations of culvert
extensions.

5. All work shall be performed during low flow conditions.
6. All mechanized equipment operated near surface waters should be regularly inspected and maintained
to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic
materials.
7. The presence of equipment in the channels must be minimized. Under no circumstances should rock,
sand or other materials be dredged from the wetted stream channel under authorization of this permit,
except in the immediate vicinity of the culverts.
8. Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for storm
water sheet flow.
9. Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be planted when
practical. If necessary, rip-rap should be limited to the stream bank below the high water mark, and
vegetation should be used for stabilization above high water.
10. Rock silt screens at culvert outlets should be removed at project completion.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a
hearing, send a written petition which conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C.
27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Comments:
NCDOT is proposing to replace an existing timber bridge over an unnamed tributary (W II) to the
South Yadkin River with two 84 inch pipes. The stream runs through adjacent wooded uplands
above and below the bridge. The stream is 4 to 5 feet wide with a rocky bed above the bridge and
more sand below the bridge. There is no bog turtle habitat within the p?ject area. The road serves
agricultural area of Alexander County. The pines are proposed to be set 12 inches below the
streambed with 18 inch high rip rap placed paced at the upstream end of one nine to concentrate the
low flow through the other pope.

Dear Mr. Lund:
The North Carolina Department of Transportation, Division of Highways, proposes the following
project for your issuance of a Section 404 Permit. We believe this project can be accomplished
under NWP #14, Linear Transportation Crossings.
COUNTY: Alexander
LOCATION: Bridge # 164, SR 1460
STREAM: Unnamed tributary to South Yadkin River
PROJECT DESCRIPTION: Replace existing 17' long x 20' wide timber bridge with a double
line 84 " CMP, 50 'long. No wetlands are involved. Less than 1/8 acre will be affected. The
installment of the CMP will impact 50 linear feet of the stream.
The stream is classified "WS-II" waters which automatically carries with it a supplemental
classification of "High Quality Waters" (HQW). Sedimentation and erosion control measures will
be those for HQW area.
SR 1460 has an average daily traffic (ADT) of 120 and a future ADT of 156 for 2010. The road
does not function as an arterial for this area. The proposed project site is approximately 3 miles
(straight-line miles) upstream of a water supply intake. Due to the road's low potential for hazard
relative to traffic use and volume and the distance from the water supply area, the Department of
Transportation feels that hazardous spill basins are not warranted for the proposed work at Bridge
# 164.
PAYMENT
RECEIVED
I have conducted a survey for the threatened species (due to similarity of appearance) listed for
Alexander County- the bog turtle (Clemmys muhlenbergii)- in the project area on January 3, 2001.
None were observed. The stream at the project area is entrenched and the surrounding area is
wooded. It was determined that neither the bog turtle nor suitable habitat was located in the
proposed project area. No significant effect on this species or its habitat is anticipated.
By copy of this letter, we are asking Edward L. Ingle, Area Roadside Environmental Engineer to
comment on the above project. By copy of this letter, we are also requesting a concurrence letter
from the Wildlife Resources Commission, US Fish & Wildlife Service, and State Historic
Preservation Office.
By copy of this letter, I am forwarding seven (7) copies of the application package to John Dorney,
NCDENR, Division of Water Quality, 401/Wetland Unit for review. A $200.00 check is enclosed
for application processing.
A site location map and a sketch of planned activities are attached. An erosion and sedimentation
control program will be implemented during the project construction, and every effort will be made
to complete the work in a timely manner.
Your earliest consideration for this request would be greatly appreciated. Our personnel are
available to assist with your evaluation of this project, if necessary. Should you have any questions,

Dear Mr. Dorney:
I am in receipt of your letter dated March 16, 2001 requesting additional information concerning DOT's
proposed plan to replace an existing 17' x 20' wide timber bridge (Bridge # 164) with a 50 foot long,
double line 84" CMP on SR 1460 in Alexander County.
The stream impacts for the proposed activity will result from the placement of the new pipe in the
stream and the placement of rip-rap on the inlet and outlet ends of the new pipe to stabilize the structure.
An 18" high rip-rap berm at the inlet end is also proposed to direct flow to only one line of the double
line pipe during periods of low flow. The proposed placement of riprap on the inlet and outlet ends of
the new pipe will result in an additional 30 feet of stream impacts. Therefore, the total linear footage of
stream impact for the proposed project is 80 feet.

Dear Ms. Simon:
The Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification for the
aforementioned project. Review of your application revealed it lacking necessary information required for
making an informed permit decision. The permit application was deficient in the following area:
The stream impacts for the proposed activity should be describe as linear feet (rip-rap to rip-rap) as per
question 10b on the PCN form.
Therefore, pursuant to 15A NCAC 2h .0507(a)(5), we will have to place the permit application on hold
until we are supplied the necessary information. Furthermore, until the information is received by the NC
Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place
the permit application on hold.
