Hi Jeffrey,
I'm following up again on my April 17th email regarding the O&M Plan and Agreement for Four
Sierra Ranch. That's the only item currently missing from the application. In accordance with
15A NCAC 02H .1042(3)(a)(ii), the Division can return the application as incomplete if the
requested information is not provided within 30 days. However, because the application is so
close to being complete, I wanted to provide you with one more reminder that we still need this
information. If the O&M Plan and Agreement are not submitted within 30 days of today (August
6th), we will return the application as incomplete and the applicant will be required to resubmit
and pay another $505 fee. You can upload a signed and scanned copy of the application at this
link using permit number SW6190802.

I apologize for the delay in getting back to you about this project. I reviewed everything that you
sent and I believe that the design looks acceptable. The only thing that I haven't seen come
through is the signed and notarized maintenance agreement and plan for the infiltration system.
Was that ever completed?

Each of the items you mention in the second review comments letter were either addressed on the
revised documents or I added a comment to the pdf of your original letter. It made me wonder if I actually
sent that document back to you with our second submittal. I have attached a pdf of your original letter
with my comments to address each specific comment. I will summarize on those listed as outstanding
below.
1. From what I can tell from our records we sent the original signed copy of the application with the
initial submittal. I don't think any changes have been made to the documentation within the
application to warrant a new app. Please correct me if I am wrong.
I sent the other documents off to the owner for their signatures. They are out of state and it takes
some time to get the documents back. I will upload the pdf's of the signed docs as soon as I have
them and forward the originals along as well.
2. The project was initially intended to be low density by virtue of the lots/acre and impervious area.
However, the site topography makes it impossible to daylight a drainage swale to an outlet point.
Our only alternative was to install an infiltration basin to disperse the runoff. This will also act as
our SCM for stormwater treatment. It has been my understanding in the past that if you install an
SCM a project automatically has to be permitted as High Density. All documents included with the

second submittal were updated to reflect a high density. Some of the submittal documents were
filled out near the onset of our design work as low density and was overlooked at time of submittal.
3. The roadside ditches were graded with the intent to accept runoff from the low point you reference.
4. We have permitted infil basins in the past that did not have overflow devices. The basin itself is
designed to hold an infil up to the 100-year storm. Topography makes it difficult to have any type of
overflow. However, I will add an overflow weir on the south corner of the basin.
5. We originally felt that since the pond lot was a separate lot with frontage to the right of way that it
provided the access that was necessary. However, a 20' maintenance easement was added with
the second submittal within the street right of way as well as an easement that allows access all
the way around the infil basin.
I will submit everything that I have to online hopefully Monday morning with the hard copies to follow in
the mail.
