Dear Mr. Braund:
Division (DWQ) personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.-S. Environmental Protection Agency dated October 15, 2007 (or as subsequently
amended).
On February 12, 2009, a public hearing was held regarding the DWQ's intent to renew the NPDES permit to
the Town of Lake Lure's WWTP. The two main concerns raised in the public hearing focused on the facility's
poor compliance history and the adverse affect the effluent discharge has had on the Broad River. These
concerns have been reviewed and have resulted in the following changes from the Draft permit mailed to you
on July 2, 2008:
1. Addition of influent monitoring for:
a. Flow, total iron and alkalinity.
2. Addition of effluent monitoring for:
a. Total iron and aluminum.
3. Addition of Instream monitoring - Upstream and Downstream for:
a. Fecal coliform, pH, temperature, dissolved oxygen.
4. Increase effluent monitoring frequencies to 3/week for:
a. BOD, TSS, NH3 as N, pH, fecal coliform, TRC and temperature,
5. Addition of Annual Wastewater Performance Report submittal.
a. Progress on planning and funding a connection to the City of Rutherfordton WWTP and
b. Progress on controlling infiltration of lake water into the collection system including cost.
6. Addition of effluent chronic toxicity quarterly monitoring requirement at IWC = 19%.

discharge are hereby revoked. As of this permit issuance, any previously
issued permit bearing this number is no longer effective. Therefore, the
exclusive authority to operate and discharge from this facility arises under the

A. (2) CHRONIC TOXICITY MONITORING (QUARTERLY)
The permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the
"North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or
subsequent versions.
The effluent concentration defined as treatment two in the procedure document is 19%. The testing
shall be performed as a Ceriodaphnia dubia 7day pass/fail test. The tests will be performed during
the months of January, April, July and October. Effluent sampling for this testing shall be
performed at the NPDES permitted final effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code
TGP3B. Additionally, DWQ Form AT-1 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual
chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the
report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to
the Environmental Sciences Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then
monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test
requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
If the Perrnittee monitors any pollutant more frequently then required by this permit, the results of
such monitoring shall be included in the calculation & reporting of the data submitted on the DMR &
all AT Forms submitted.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival, minimum control organism reproduction, and appropriate
environmental controls, shall constitute an invalid test and will require immediate follow-up
testing to be completed no later than the last day of the month following the month of the
initial monitoring.

A. (3) LAKE LURE DAM DISCHARGE
The Town of Lake Lure controls the discharge rate of impounded water from Lake Lure. The
Division has modeled the treatment plant's environmental impact based on flow parameters
assuming a minimum discharge of 6.6 cfs. Therefore, as a Special Condition of this permit,
the town shall record weekly (on the Upstream DMR) the Lake Lure Discharge to further
evaluate the validity of these flow -based assumptions.
A. (4) ANNUAL WASTEWATER PERFORMANCE REPORT
In addition to the current reporting requirements of the Facility Annual Wastewater Report,
the Town of Lake Lure is also required to annually report the status of these following
activities in the Facility Annual Wastewater Report beginning on December 31, 2009:
➢ Progress on planning and funding a connection to the City of Rutherfordton
WWTP.
➢ Progress on controlling infiltration of lake water into the collection system
including cost.

Introduction
A public hearing was held on February 12, 2009, at Isothermal Community College Library Auditorium in
Spindale, North Carolina regarding the Division's intent to renew the NPDES permit to The Town of Lake
Lure's WWTP. At that hearing the comment period was extended to February 20, 2009, which requires the
Division Director to render a decision on the permit by May 20, 2009. The two main concerns )wised in the
comments focused on the facility's poor compliance history and the adverse affect the effluent discharge has
had on the receiving stream, the Broad River (class C) within the Broad River Basin.
Background
On April 1, 2004, the Division renewed the Lake Lure NPDES permit which authorized the discharge of 0.995
MQD of treated wastewater from the Lake Lure WWTP to the Broad River. The 2008 Draft permit renewal
contains limits and monitoring requirements that have been carried over from the 2004 NPDES permit.
Compliance issues during the past permit cycle include chronic violations of fecal coliform bacteria, total
suspended solids, and ammonia. The facility entered into an SOC in 2007 to correct its noncompliant status.
The facility is also trying to reduce inflow of lake water into its sewer collection system, which runs under Lake
Lure.
Public Hearing
The public hearing was held at the request of numerous concerned citizens, landowners and public officials.
Written requests for the hearing are attached. An announcement of the hearing was published in a local paper
having general circulation within the area (see Attachments). Forty-one people, excluding DWQ staff, attended
the public hearing. The registration list is attached. Bob Guerra of the Western NPDES Program gave a brief
presentation on the permit's history and presented the facility's compliance history.

The Town of Lake Lure was represented by Mayor Jim Proctor and Town Manager Chris Braund. During the
public hearing, the Town Manager indicated that within this five year permit cycle, the Town of Lake Lure
plans. to connect to the Town of Rutherfordton WWTP, which would require 19 miles of sewer line.
Connection is dependent upon availability of funding sources.
Thirteen people spoke during the public hearing. The majority of speakers were against renewing the NPDES
permit without more stringent requirements on both the sewer collection system and the WWTP operations. The
primary issue raised by speakers was that inadequately treated wastewater was being discharged into the Broad
River. The second issue raised by speakers was that the Town has been operating a WWTP with a leaking
sewer collection system which has not been addressed.
There were some speakers that brought up issues not directly related to the permit including concerns regarding
malfunctioning septic systems along the shores of Lake Lure. This issue has been brought to the attention of the
Rutherford County Onsite Water Protection Program Coordinator, Mr. Vince Manzi.
Recommendations
It is the Hearing Officers recommendation that the following modifications be made to the permit prior to
issuance. These recommendations were developed based on public and division staff input. The additional
monitoring and reporting requirements will result in an upgrade to a Grade 2 Physical/Chemical operator, more
daily supervision of the facility, better data for determining if there are impacts, and more reporting on activities
to remove the discharge and improve lake water infiltration into the collection system.

NOTICE OF PUBLIC HEARING
TO BE HELD BY
THE NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION
SUBJECT: A public hearing has been scheduled concerning the proposed renewal
and issuance of the following NPDES permit:
Permit number NCO025381 Town of Lake Lure, Lake Lure Wastewater
Treatment Plant located at 182 Memorial Highway, Lake Lure,
Rutherford County, for the discharge of treated domestic wastewater into
the Broad River.
PURPOSE: This applicant has applied for renewal of the NPDES permit for the
discharge of treated industrial and domestic wastewater into waters of
the Broad River Basin. On the basis of preliminary staff review and
application of Article 21 of Chapter 143, General Statutes of North
Carolina, and other lawful standards and regulations, the North Carolina
Environmental Management Commission proposes to renew and issue
an NPDES permit for this facility subject to specific pollutant limitations
and special conditions. The Director of the Division of Water Quality
pursuant to NCGS 143-215. 1 (c)(3) and Regulation 15 NCAC 2H,
Section .0100 has determined that it is in the public interest that a
meeting be held to receive all pertinent public comment on whether to
issue, modify, or deny the permit.

The Western NPDES Program would like to present a summary and attached correspondence
received in response to the Public Notice for the draft renewal permit for the Town of Lake Lure
WWTP. The Public Notice period was extended as a courtesy, per public request from August 6,
2008 to August 15, 2008. Comments were received via letters, petition signatures and email all
requesting DWQ to facilitate a public hearing prior to the renewal of this permit. Public
comments and requests for a Public Hearing were received from the following groups:

3. Petition signatures (131 - some duplicates_ of signatures)
4. Form letters requesting hearing (20, with some duplicate from submitted letters and petitions)

LIST OF CONCERNS INCLUDED IN COMMENTS (SEE ATTACHED) FOR HEARING
REGARDING THE TOWN OF LAKE LURE PERMIT RENEWAL
I . Facility has been out of compliance for a number of years and continues to be out of
compliance —Nothing appears to have changed.
2. WWTP is old, obsolete, located in flood plain and has been overrun by floodwaters in past.
3. Perceived downstream impacts to drinking water withdrawal and usage.
4. Poor water quality for fish, mussels, and benthic community.
5. Poor water quality downstream of WWTP on continual basis, no longer safe to use river.
6. Civil penalties have not been escalated (for same violations) and Town simply pays
occasional Civil Penalty with nothing positive resulting from enforcement actions.
7. Town not spending money to improve WWTP.
8. WWTP undersized for population growth.
9. Current SOC only one of 3-4 issued to facility since original permit issuance.
10. Citizens do not feel that DWQ is protecting the river.
a. Broad River entering Lake Lure is Class B-Trout, below Lake Lure is Class C.
Public wants the Broad River, below Lake Lure to be reclassified to B waters.
b. Broad River Classification of "C" is not correct due to increased recreational
activity and more public contact in water.
Background
The Town of Lake Lure WWTP NCO025381 draft renewal permit was submitted for public
notice on 8-6-08. After a request from the public, the comment period was extended until 8-15-
08. The PSB has received numerous requests for a public hearing (see attached). On 10-18-07,
EMC SOC WQ S07-007 (see attached) was signed by the Town and the EMC (see attached).
Major components of the SOC are:
1. Compliance dates (with stipulated penalties) for:
a. Develop and adopt sewer use ordinance for addressing Fats, Oils, and
Grease (FOG).
b. Removal of accumulated sludge from the WWTP.
C. Installation of new process equipment and rehab of existing equipment.
d. Achieve compliance with final permit limits on or before 11-30-08.
2. Permit effluent limits for BOD, TSS and Fecal Coliform were relaxed.
3. Additional flows of 0.0048 MGD were granted after a 67(b) model -was performed.
Recommendation:
The NPDES Program received no comments upon public notice of the SOC. Although perhaps
more pertinent to have had a hearing on the SOC, based on the adverse comments and requests
for a public hearing on this permit, the NPDES program recommends that a hearing be held on
the permit renewal.
Upon recommendation of ARO, effluent monitoring of parameters of concern will be increased
from weekly to three times per week. The ARO believes this will be helpful with plant operations
and future compliance. Lake Lure is an atypical plant, currently classified under Grade II,
ChemicaLlPhysical.

Good evening. My name is Bob Guerra and I am an Environmental Specialist for the
North Carolina Division of Water Quality. I developed'the draft permit renewal for the
Lake Lure WWTP, permit Number NC0025381. We are here tonight because individuals
and organizations have submitted written comments and requested a public hearing
regarding the draft permit renewal, which allows the discharge of treated wastewater to
the Broad River.
I will begin with a brief overview of North Carolina's NPDES permitting program, and
then I will address some specific concerns raised during the public comment period.
First, some background
The Division's mission is to preserve, protect and enhance North Carolina's water
resources. All wastewater dischargers to surface waters of the state must apply for and
receive an NPDES permit. The Clean Water Act, via The National Pollutant Discharge
Elimination System, or NPDES program, applies to all surface water dischargers, from
the largest industrial facility to single family homes.
The NPDES permit sets effluent limits for each facility's discharge in order to protect
instream water quality standards and the designated uses of each specific receiving
stream. Permits require regular monitoring of the effluent to ensure that the discharge
does not violate water -quality standards, such as dissolved oxygen or fecal coliform
bacteria. To maintain compliance with the permit, the Division imposes Enforcement
Actions such as fines for exceeding limits or for violating monitoring conditions and
Consent Orders.
Now, to the specifics of the Lake Lure draft permit.
This facility treats wastewater from residents and local businesses and is currently
permitted to discharge 0.995 mullion gallons per day of treated wastewater to the Broad

River, a designated Class C waterbody. The Class C waterbody designation includes the
following uses: secondary recreation, boating, wading, fishing, and protection of aquatic
life. The draft permit is designed to protect for these designated uses. The.draft permit
includes limits for the following parameters: Flow, Biochemical Oxygen Demand or
BOD, Total Suspended Solids, Ammonia, pH, Fecal Coliform bacteria, and Total residual
chlorine. The permit also includes monitoring requirements for: Temperature, Total
nitrogen and Total phosphorus. Division employees review the Permittee's monthly
Discharge Monitoring Reports and any violations are subject to enforcement action such
as civil penalties.
I will now address some specific concerns raised in the public comment request.
Concern 41 - The WWTP has been out of compliance for a number of years and
continues to be out of compliance - Nothing appears to have changed.
Response: During the last five year permit cycle, the facility has been subject
to periodic inspections; both scheduled and unscheduled. The Asheville Regional Office
performs these inspections in order to view the plant, check records, and ensure that the
Permittee is properly operating and maintaining its facility. Since March 2004 the facility
has paid almost $20,000 in civil penalties for BOD, TSS and Fecal Coliform bacteria
violations. In August 2007, the facility entered into a consent.order with the division to
address compliance issues and necessary facility upgrades during this period. This
consent order requires upgrades to the facility and includes deadlines for these upgrades
as well as stipulated penalties for violations of discharge limits and completion dates.
The facility will also be required to upgrade to a Grade 2 Physical / Chemical operator to
insure the facility is properly operated for maximum treatment of the wastewater.
Concern #2 - The WWTP needs upgrades and improvements.
Response: The WWTP has upgraded structural and treatment components at the facility
since the last permit was issued in March 2004. These facility upgrades include: a new
bar screen, influent weir, improved hydraulics in the. entire plant, installation of a static
sludge removal system, upgraded chemical feed system, a new DO chamber, a 24-
composite sampler and a new effluent weir.

Concern #3 How can we be sure that compliance problems will be effectively handled?"
Response - As a requirement of the NPDES program, this facility will be required to
sample their wastewater every week or more frequently and report the results to the
Division. This data will be reviewed every month by an automated system and Asheville
regional staff for compliance. If the facility violates their permit limits, they can be fined,
relative to the severity of the violation.
In conclusion, the Division believes that this draft permit properly limits the Lake Lure
discharge, and if operated in compliance, will ensure that treated wastewater will not
detrimentally impact the health of the Broad River. We will continually evaluate the
facilities operation and compliance to ensure that we have an accurate picture of both the
discharge itself and its impacts on the receiving stream. This concludes my presentation.

that if customers and others who eat these vegetables, get a-coli, the Town of Lake Lure should
be held responsible.
o The permit should not be renewed which would force the Town of Lake Lure to do the right
thing. The state should fine the town at the highest extent of the law until the problem is solved.
➢ Delilah Fisher — Last summer the water at the beach area was stagnant and nasty ... with a "slick
bottom."

o Ongoing problem with "private sewer line" on his property overflowing. Lake Lure has offered
to fix it for a fee.

conduct by the Town of Lake Lure.

o Local Town officials do not concern themselves with WWTP that may create problems for the
Town.
o Several instances over thepast years have generated foul odors either from the discharge or the
WWTP. These odors are more prevalent during the high use of Lake Lure.
o This close location to the WWTP has devalued his property and he is not looking forward to
retiring next to a WWTP that smells.

o Major influx within past five years has had a great impact on the WWTP.
o. The plant has been failing for some time with recent improvements being seen as a "band -aid"

o After completion of the Green Line, it is equally important to insure that the sewage lines under

o If these things are not done we are in danger of losing one of the most beautiful lakes in North
Carolina and the world.

At Roger's request I am in responding to Lake Lure's exemption letter. We are in support the 85%
.requirement being removed from Lake Lures NPDES permit. Considering their waste water
characteristics, there should not be any influent requirements in their permit. Also, Lake Lure is a minor
facility so the 85% removal is not an EPA requirement.

The Town of Lake Lure respectfully requests that DWQ consider allowing an exemption from the
effluent limitations as proposed in the draft NPDES permit renewal. The specific requested exemptions
are as follows:
1. 85 % removal of BOD, 5-day
2. 85 % removal of Total Suspended Solids
While the proposed permitted limits of 30.0 mg/L - monthly and 45.0 mg/L — weekly for both BOD and
TSS are appropriate and achievable, the 85 % limitation reduces these limits considerably due to the fact
that excessive inflow from the lake into the sewer pipes has the effect on the actual influent of lowering
these incoming BOD and TSS numbers. 85 % of an extremely low BOD and TSS influent number
simply cannot be effectively achieved. For example, 85% of an inflow BOD of 50 mg/L yields a
limitation of effluent of 7.5 mg/L.
The Town is in process of an aggressive I & I reduction program that has already utilized side scan sonar,
hydrophones for leak (inflow) detection; then contracts with special divers to seal out the inflow utilizing
underwater sealing and wrapping material. Pilot trials utilizing this approach have yielded excellent
results.
The Town is agreeable to revisit this specific permit requirement annually, if DWQ will accommodate
this request.

The operator has a "Temporary" Grade 2 P/C issued by TACU, and has plans on getting
a permanent Grade 2. I was also approached by Don Byers, who works for Brown
Consultants
for the town regarding conducting another T/A regarding "tweaking" the chemical feed

The Town of Lake Lure's NPDES permit is coming up for renewal and a Public Hearing is
scheduled for February 12, 2009
at Isothermal Community College in Spindale, North Carolina. I believe the ARO has
sent comments to you previously
regarding this facility, but wanted to send an e-mail to confirm. The facility is
classified as a PC-2 (Physical
Chemical) WWTP requiring a Grade 2 P/C ORC, and a Grade 1 P/C Back-up ORC; the
facility is also permitted for
0.995 MGD (995,000 gallons per day) flow; 0ince the flaw is greater than 0.500 MGD
1(5.00, 000 gallons per day) , and
lass than 2.5 MGD (2,500,00-0 gallons per day), the facility should be conducting 3
tees per week monitoring. The
facility should also have monitoring for Iron and Aluminum added to permit, because
its a P/C facility and operates

level to be maintained in the discharge and improve de -chlorination, in addition to
improved sampling
capabilities. This comment is made to see if the Oxygen Chamber was removed,
postponed, or what?

Got your phone message regarding Lake Lure, and I have spoken with James Pugh at TACU
regarding the classification of the WWTP. The Lake Lure WWTP is a P/C 2 facility
because they are entirely"PHYSICAL/CHEMICAL" with a flow of 0.995 MGD and the only
treatment they have is screening, chemical feed, flocculation/coagulation, settling,
static re -aeration of effluent, then discharge to Broad River. There is NO Biological
in their treatment train. I have copied James at TACU with this also. If you have any

Due to the Permitted Flow limit for Lake Lure, it should not be classified below a
"PC-2".
Part of this reasoning is that it was Classified a grade 2 Bio., because it didn't
fit the
classification criteria at that time. The permitted flow limit is 0.995 MGD, which
now would
make the facility a grade 3 based upon that flow limit. With the current flow limit

July 28, 2008 UPDATE:
I talked to Mr. Byers, today Monday July 28. He asked if CG&L had made any kind of
determination on the Lake Lure Improvements.
I checked the email record and could not find a reply but have informally discussed this in the
section. Ken said he thought that they could proceed with the improvements and we might
allow an ATC after the fact. Also, I forwarded an email with the plans/drawings on June 20 to
each of you and have attached them again to this email.
Mr. Byers said he had talked to Roger Edwards, Asheville Regional Engineer who told him the
Regional office would go with whatever Gerald Horton was comfortable with. I don't have the
authority but believe they should proceed and we can handle paperwork without slowing the
process, especially since there are treatment problems and the WWTP is under an SOC.
Mr. Byers stated that Lake Lure intends to award the contract to Bill Hobson Constr. Co. this
evening at council meeting effective tomorrow. He will provide documentation. Award
amounts to — $230+ .. A needed new screen at head of plant may need an ATC but should
proceed in my opinion.
I am also uncertain what their intents are for the vital flash mixer.

FYI and for the record
Lake Lure is under an SOC. The WWTP is not a conventional biological WWTP but rather a
chemical/physical WWTP due to the wild seasonal swings in influent flow, specifically it is a
resort community.
I talked to Don Byers 828 350-7683, Brown Consultants, today (June 20, 2008). The Lake Lure
project was funded in 2007 via STAG Grant XP -974 785-03-0 and was completed in Dec.
2007 and remains disfunctional. As you may recall the final inspection report noted the plant as
not functioning properly in spite of the upgrades and improvements. In the final report i
recommended that DWQ regional office in Asheville and EPA require Lake Lure to resolve and

remedy the functional problems before the plant be accepted.
Since then, the Town has apparently relieved McGill Assocs. as their engineer and has retained
Brown Consultants to work on some of their operational problems. This activity it appears was
initiated by the Town due to the SOC.
Problems were experienced with the Polychem-Weda sludge removal equipment which was
intended to remove the chemical sludge from the settling tank, but does not work. Also, the
hydraulics from the sulphite removal chamber were causing surcharge to the clarifier and no
body knew the effluent pipe's route, location, size or particulars to the river. The flash mixer
was also eliminated from the recent (2007) improvements apparently due to budget constraints.
This flash mixer, it would appear, would be a vital piece of equipment/process at a
chemical/physical WWTP.
The engineer, Mr. Byers, said the Town is ready to proceed on abandoning the new
Polychem-Weda sludge removal equipment and implementing a replacement system designed
by Brown Consultants. The Regional office told him they could proceed with bidding because
the Town is under and SOC. When Mr. Byers talked to me i told him i thought a permit or
ATC may be needed and i would discuss this with plans review section's Ken Pohlig and Mark
Hubbard, Asst.Section Chief.
He also stated the Towns of Lake Lure and Rutherfordton and Rutherford County were
considering arrangements for. pumping Lake Lure's WW to Rutherfordton wwtp which now has
excess capacity. Incidentally, Rutherfordton was an SRL project completed in Jan 2007 which
improved the facility but "despanded" the capacity. The County is interested in helping
because it will open areas up for development. Lake Lure is interested because it may relieve
them of the burdens of the SOC, an NP.DES pen -nit, an inevitable upgrade, etc. and
Rutherfordton is interested in accepting Lake Lure's wastewater as a customer.
They are all in the process of obtaining some Clean Water Trust Fund moneys and other
funding.
