Dear Mr. Winslow:
On December 12, 2005, the Division of Water Quality (DWQ) received your application dated
December 12, 2005, to impact 1161inear feet of streams; 0.119 acres of wetlands; 5,040 square
feet (ft2) of permanent and 1,265 temporary impacts to Zone 1; and 4,161 square feet (ft2) of
permanent impacts and 10,028 square feet (ft2) of temporary impacts to Zone 2 of the protected
riparian buffer. The DWQ has determined that your application was incomplete. Unless we
receive the additional information requested below, we will have to move toward denial of your
application as required by 15A NCAC 2H .0506:
Additional Information Requested:
1. Please provide a complete set of legible site plans (as detailed in the Addendum to the
PCN including the existing conditions, site plan with impacts and topography, drainage
map, etc.) at either 1" = 50' scale or 1" = 100' scale.
2. The purpose of level spreaders is to intercept stormwater runoff prior to reaching
protected riparian buffers and to provide diffuse flow will it traverses through these
buffers. The level spreaders on your plans sheets labeled as, "level spreader #2, level
spreader #3, level spreader #5, level spreader #6, level spreader #7, and level spreader
#8", are all in Zone 2 of the protected riparian buffers and must be removed. Please
redesign your site plan to provide for diffuse flow measures [for all discharge points] that
are situated outside the protected riparian buffers.
3. Please provide worksheets for all of the level spreaders on your plan sheets.

4. Please provide an original and 4 copies of a signed and notarized Operation and
Maintenance Agreement for the level spreaders.
5. Mitigation will be required for permanent road crossings that impact greater than 150
linear feet of the protected riparian buffers. Please submit documentation exhibiting how
mitigation will be achieved for the road crossing shown on the plan sheet labeled,
"Impact Map #2".
Please respond within five (5) days of the date of this letter by sending five (5) copies of this
information to the attention of the Express Review Program. The Express Review Program is a
process that requires all parties to participate in a timely manner. If the DWQ feels the Express
Review Program is the incorrect review program for your project, then we may have to return
your application and have it reviewed through our regular 401 Water Quality Certification
Program.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your application
