The 2010 EIS we completed identified 20 borrow sites. The 2014 EA addressed refinement of those sites and addressed new information on sediment compatibility. Since 2014 we have done much more work and have eliminated many of the borrow sites due to hardbottoms, poor sediment quality, or both, so now we are down to 8 borrow areas (shown on the attached file — areas marked "yes"), which were all covered in the 2010 EIS and 2014 EA. For this first contract, only portions of the remaining borrow areas within 3 miles will be used since we don't have BOEM leases yet for areas beyond 3 miles. We were attempting to get 401s for the entire 50-year project life, but if DWR would feel more comfortable issuing 401s (beach and intertidal) forjust this first contract, that's fine. We're working on an EA to expand the environmental windows, to update borrow area information and to obtain the BOEM leases for use of borrow areas beyond 3 miles and could certainly apply for new, updated 401s, if that will help with this initial request. That new EA is scheduled to go out for review in November 2020. So, the bottom line is we've been deleting borrow areas since the 2010 EIS as we get new information and have not added any new ones. It's a large project, with a lot of moving parts. It will take about 3 years to construct, so our plan is to do this first contract in accordance with the window and commitments made in the 2010 EIS and 2014 EA with follow- on contracts to be done in accordance with the new EA and any permits/commitments made as part of that NEPA process. The issue we have is certifying a project that includes borrow areas that were not previously used and do not have an environmental assessment. As Robb clarified: the 401 would only be for the borrow areas and open water fill (intertidal) templates that were previously impacted by the Surf City/North Topsail Beach projects until we can confirm that the and EIS has been completed for the "new" (previously un-impacted) borrow areas. As I understand it, a SEIS was completed in 2014 to refine the borrow areas for this project broadly, but it's unclear if that assessment covered the "new' borrow areas. I think there are about currently 20 small borrow areas for the project with 13 partially or wholly in the state's 3 mile limit. We are working with our SEPA state clearing house staff to get the 2014 SEIS and associated documents to review what they covered and will confirm with you as soon as we do. We are sensitive to the time schedules for contracts/bids and are working to quickly resolve. Please let us know if you have questions. Turns out that Borrow Area Q, which we will NOT be using for this contract, was the only borrow area used by any entity previously. However, the borrow areas that we will use within 3 miles were surveyed in the past and in 2020 (except Borrow Area A last surveyed in 2011). That being said, we will still dredge within the established footprints of the borrow areas as shown in the plans. I apologize for the confusion on my part. Please let me know if this will change the 401 WQC.
