Box 25201 Raleigh, NC, 27611-5201 Dear Mr. Gilmore: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 24.6 linear feet of stream and excavate in 85.3 linear feet of streams (an unnamed tributary to Bolin Creek) for the purpose of constructing a bicycle lane and left turning lanes along SR 1009 (Hillsborough Road) in Orange County. The project should be constructed in accordance with your application dated July 28, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3289. This certification corresponds to the General Permit 198200031 issued by the Corps of Engineers. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit, unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the conditions listed in the attached certification. l.) Upon completion of the project, the NCDOT shall complete and return the enclosed "Certification of Completion Form" to notify DWQ when all work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of Water Quality upon completion of the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Stevens, Director 1 ? • NC ENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES ROAD CROSSING CERTIFICATIONGENERAL CERTIFICATION FOR PROJECTS ELIGIBLE FOR CORPS OF ENGINEERS NATIONWIDE PERMIT NUMBER 14 (ROAD CROSSINGS), REGIONAL GENERAL PERMIT 198200031 AND NEUSE/TAR-PAMLICO/RANDLEMAN BUFFER RULES This General Certification is issued in conformity with the requirements of Section 401, Public Laws 92- 500 and 95-217 of the United States and subject to the North Carolina Division of Water Quality (DWQ) Regulations in 15A NCAC 2H, Section .0500 and 15A NCAC 2B .0200 for the discharge of fill material to waters and wetland areas as described in 33 CFR 330 Appendix A (B) (14) of the Corps of Engineers regulations (i.e., Nationwide Permit No. 14 and Regional General Permit 198200031) and for the Neuse, Tar-Pamlico and Randleman Buffer Rules (15A NCAC 2B .0233, .0259 and .0250). The category of activities shall include any till activity for road crossing and is limited to fill less than one-third of an acre. This Certification replaces Water Quality Certification Number 2177 issued on November 5, 1987, Water Quality Certification Number 2666 issued on January 21, 1992, Water Quality Certification Number 2732 issued on May 1, 1992 and Water Quality Certification Number 3103 issued on February 11, 1997. This WQC is rescinded when the Corps of Engineers re-authorizes Nationwide Permit 14 or Regional General Permit 198200031 when deemed appropriate by the Director of the DWQ. The State of North Carolina certifies that the specified category of activity will not violate applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217 if conducted in accordance with the conditions hereinafter set forth. Conditions of Certification: 1. Proposed fill or substantial modification of wetlands or waters (including streams) under this General Certification requires application to and prior written concurrence from the Division of Water Quality; 2. In accordance with North Carolina General Statute Section 143-215.3D(e), any application for a 401 Water Quality Certification must include the appropriate fee. If a project also requires a CAMA Permit, one payment to both agencies shall be submitted and will be the higher of the two fees; 3. In accordance with 15A NCAC 2H .0506 (h) compensatory mitigation may be required for impacts to streams and/or wetlands. In addition, buffer mitigation may be required for any project with Buffer Rules in effect at the time of application. A determination of buffer, wetland and stream mitigation requirements shall be made for any Certification for this Nationwide Permit. The most current design and monitoring protocols from DWQ shall be followed and written plans submitted for DWQ approval as required in those protocols; 4. For any project involving a stream re-alignment, a stream relocation plan must be included with the 401 application for written DWQ approval. Relocated stream designs should include the same dimensions, patterns and profiles as the existing channel, to the maximum extent practical. The new channel should be constructed in the dry and water shall not be turned into the new channel until the banks are stabilized. Vegetation used for bank stabilization shall be limited to native woody species, and should include establishment of a 30 foot wide wooded and an adjacent 20 foot wide vegetated buffer on both sides of the relocated channel to the maximum extent practical. Also, rip-rap may be allowed if it is necessary to maintain the physical integrity of the stream, but the applicant must provide written justification and any calculations used to determine the extent of rip-rap coverage requested. If suitable stream mitigation is not practical on-site, then stream impact will need to be mitigated elsewhere; Impacts to any stream length in the Neuse, Tar-Pamlico and Randleman River Basins requires written concurrence from DWQ in accordance with 15A NCAC 2B.0233, 15A NCAC 2B .0259 and.0250 and 15A NCAC 2H .0500. New development activities located in the protected 50-foot wide riparian areas (whether jurisdictional wetlands or not) within the Neuse, Tar-Pamlico and Randleman River Basins shall be limited to "uses" identified within and constructed in accordance with 15A NCAC 2B .0233, 15A NCAC 213 .0259 and .0250. All new development shall be located, designed, constructed, and maintained to have minimal disturbance to protect water quality to the maximum extent practicable through the use of best management practices. Activities listed as "exempt" from these rules do not need to apply for written concurrence under this Certification; 6. Placement of culverts and other structures in waters, streams, and wetlands must be placed below the elevation of the streambed to allow low flow passage of water and aquatic life unless it can be shown to DWQ that providing passage would be impractical. Design and placement of culverts and other structures including temporary erosion control measures shall not be conducted in a manner that may result in dis-equilibrium of wetlands or stream beds or banks, adjacent to or upstream and down stream of the above structures. The applicant is required to provide evidence that the equilibrium shall be maintained if requested in writing by DWQ. Additionally, when roadways, causeways or other fill projects are constructed across FEMA-designated floodways or wetlands, openings such as culverts or bridges must be provided to maintain the natural hydrology of the system as well as prevent constriction of the floodway that may result in destabilization of streams or wetlands; 7. If this Certification is used to access building sites, all lots owned by the applicant must be buildable without additional fill beyond that allowed under other General Certifications. Deed restrictions must be placed on the remaining wetlands and streams on these lots to restrict future wetland and stream fill. DWQ shall be sent copies of all deed restrictions applied to these lots; That appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" whichever is more appropriate (available from the Division of Land Resources (DLR) in the DENR Regional or Central Offices) shall be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to assure compliance with the appropriate turbidity water quality standard; 9. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural grade restored within two months after the Division of Land Resources has released the project; 10. This Certification shall be utilized for roads from natural high ground to natural high ground. The Certification for Nationwide Permit 18 may not be used in conjunction with this Certification to create high ground for road access; 12. If an environmental document is required, this Certification is not valid until a Finding of No Significant Impact (FONSI) or Record of Decision (ROD) is issued by the State Clearinghouse. All water quality- related conditions of the FONSI or ROD shall become conditions of this Certification; 13. That additional site-specific conditions may be added to projects proposed under this Certification in order to ensure compliance with all applicable water quality and effluent standards; 14. When written concurrence is required, the applicant is required to use the enclosed "Certification of Completion Form" to notify DWQ when all work included in the 401 Certification has been completed; 15. Concurrence from DWQ that this Certification applies to an individual project shall expire three years from the date of the cover letter from DWQ or on the same day as the expiration date of the corresponding Nationwide Permit 14 and Regional General Permit 198200031 whichever is sooner. Non-compliance with or violation of the conditions herein set forth by a specific fill project may result in revocation of this Certification for the project and may also result in criminal and/or civil penalties. The Director of the North Carolina Division of Water Quality may require submission of a formal application for individual certification for any project in this category of activity, if it is determined that the project is likely to have a significant adverse effect upon water quality or degrade the waters so that existing uses of the wetland, stream or downstream waters are precluded. Public hearings may be held for specific applications or group of applications prior to a Certification decision if deemed in the public's best interest by the Director of the North Carolina Division of Water Quality. NCDOT proposes to construct a is le a along the east side of SR 1009 (Hillsborough Road) from Lorraine Street to SR 1107 (Old Fayetteville Road). The project will also add left turn lanes at four intersections along the project. The project is approximately 1.1 mi in length. The construction of bicycle lanes is listed as a non-major action in Minimum Criteria for State Funded Highway Projects. Due to the type of activity involved, an environmental document was not prepared for this project. The attached environmental review provides additional details about the project. At this time the project is scheduled to be let in November, 2000 and completed near July 2001. ENVIRONMENTAL IMPACTS Waters of the U.S. The project will impact one intermittent surface water located in the Cape Fear River Basin. This channel was evaluated by using the U. S. Army Corps of Engineers (USACE) Intermittent Channel Evaluation Form. Two channels within the project area were evaluated while only one was determined to be an intermittent stream. The other was determined to be a stormwater grass-lined ditch. One small jurisdictional wetland is located adjacent to the project area. Since the wetland is small and somewhat degraded due to its location adjacent to the road. it was not field verified by the USACE. Nor was it classified according to the North Carolina Natural Heritage Program Natural Community Classification (Schafale and Weakley. 1990). The wetland was classified as PFO1 C (Palustrine Forested Broad-Leaved Deciduous Seasonally Flooded) according to the United States Fish and Wildlife Service wetland classification (Cowardin. 1979) system. A small portion (242 sq ft) of the wetland is located within a temporary drainage easement. However, a note will be placed on the plans for the contractor to work from the opposite side of the channel therefore not impacting the wetland. There will be no fill or excavation in this wetland. Table 1 itemizes the surface water impacts. Table 1. Two property owners have land adjacent to or within the project area where impacts to jurisdictional surface waters will occur. Each property is designated by a number which is labeled on the attached permit drawing. Table 2 below provides the property owners' names as well as their addresses. Table 2. The following species are listed as threatened or endangered in the respective counties: A Biological Conclusion of No Effect has been reached for all species. • Red-cockaded woodpecker (Picoides borealis). Endangered. • Dwarf wedge mussel (Alsmidonta heterodon). Endangered. • Michaux's sumac (Rhus michauxii). Endangered. • Smooth coneflower (Echinacea laevigata). Endangered. • Small-whorled pogania (Isotria medeloides). Threatened. Cultural Resources. There are no known historic sites or archaeological sites within the project area. During the scoping meeting for this meeting, Debbie Beven of the State Historic Preservation Office stated that neither an architectural historic survey nor an archaeological survey was necessary for this project. Mitigation: Avoidance. The NCDOT is committed to incorporating all reasonable and practicable design features to avoid and minimize wetland impacts, and to provide full compensatory mitigation of all remaining wetland impacts. All wetland areas not affected by the project will be protected from unnecessary encroachment. No staging of construction equipment or storage of construction supplies will be allowed in wetlands or near surface waters. Minimization: Minimization includes the examination of appropriate and practicable steps to reduce the adverse impacts. Minimization techniques were implemented as follows: 1. Best Management Practices: Strict enforcement of sedimentation and erosion control Best Management Practices (BMP) for the protection of surface waters and wetlands will be enforced. 2. Ditchin : It is the policy of the NCDOT to eliminate lateral ditching in wetlands as much as possible, thus preserving the hydrology of adjacent wetlands. No lateral ditches will be constructed in wetlands. 3. Clearing: Clearing Method II will be used. Compensation: Mitigation - Jurisdictional Wetlands. The project will not impact jurisdictional wetlands. Therefore no compensatory wetland mitigation is proposed for this project. Mitigation - Surface Waters. The project will not impact more than 150 ft of jurisdictional surface waters. Therefore, no compensatory mitigation is proposed for this project. It is requested that these activities be permitted under a Section 404 General Permit (19820003 1). The primary purpose of the proposed project is to construct bicycle lanes along SR 1009 (Hillsborough Road) from Lorraine Street to SR 1107 (Old Fayetteville Road). The construction of bicyle lanes is listed as a non-major action in Minimum Criteria for State Funded Highway Projects (July 12, 1993). In addition, the area of land impacted is less than the threshold established by those same guidelines. Therefore, this project does not require an environmental document pursuant to the North Carolina Environmental Policy Act. The North Carolina Department of Transportation proposes to symmetrically widen SR 1009 (Hillsborough Road) to accommodate bicycle lanes from Lorraine Street to just north of SR 1107 (Old Fayetteville Road), a distance of 1.69 km (1.05 miles)(see Figure 1). A curb and gutter facility with 11 m (36 feet) between its curb faces will be constructed, except in locations where left turn lanes are proposed. The 11 m (36-foot) typical section will provide a 3.6 m (12-foot) lane and a 1.2 m (4-foot) bicycle lane in each direction of travel. At locations where left turn lanes currently exist and will continue to be provided, a curb and gutter facility with 14.6 m (48 feet) between its curb faces will be constructed. This typical section will provide a through lane and a bicycle lane in each direction of travel, as well as a left turn lane. Left turn lanes will be located at McDougle Middle School's back entrance, Cates Farm Road, Parkview Avenue, and SR 1107 (Old Fayetteville Road). The proposed typical sections for the project are shown in Figure 2. The proposed project will also improve Hillsborough Road's intersection with SR 1107 (Old Fayetteville Rofid). As shown in Figure 1, SR 1009 (Hillsborough Road) will be realigned to intersect SR 1107 (Old Fayetteville Road). No environmentally sensitive features were discovered in the project vicinity through field surveys and searches of environmental data bases of the Planning and 9 Environmental Branch. Anticipated Permit or Consultation Requirements: No permits are anticipated to be needed to construct the proposed project. Special Project Information: Sidewalks The Town of Can:boro requested NCDOT to consider participating in the funding of sidewalks along the east side of the proposed project. Their request has been reviewed and it has been determined that NCDOT will provide 70 percent of the funds required to construct sidewalk along the east side of SR 1009 (Hillsborough Road). The northern project terminal is the intersection of SR 1009 (Hillsborough Road) and SR 1107 (Old Fayetteville Road). The intersection will be realigned as a part of the project so that SR 1009 (Hillsborough Road) will "T" into SR 1107 (Old Fayetteville Road). A traffic signal will be provided at the intersection. During the planning process, the To,.Nn of Carrboro asked NCDOT to consider N idenilh, a short segment of SR 1107 (Old Fayetteville Road) so that the proposed project would tie into an existing widened segment of roadway. The SR 1107 segment of interest lies between the northern terminal of the proposed project and the widened segment of SR 1 107 located in front of McDougle Middle School (SR 1107 (Old Fayetteville Road) in front of McDougle Middle School was widened to accommodate bicycle lanes by Chapel Hill - Carrboro Schools). As a part of the improvements to the intersection of SR 1009 and SR 1107, a right turn lane will be constructed along northbound SR 1107. The taper for this right turn lane begins approximately 10 m (33 feet) north of the existing widened segment of SR 1107. The limits of the intersection improvements at the northern terminal of TIP Project U-3100 A will be extended to tie into the existing widened typical section located on SR 1107 (Old Fayetteville Road). Intersection of SR 1009 (Hillsborough Road) James Street and Quail Ridge Road As a part of TIP Project U-3100 A, a concrete island will be constructed on James Street that will convert Quail Ridge Road into a right-in / right-out access. The Town of Carrboro asked that residents living on Quail Ridge Road be notified prior to the public hearing and informed of this proposed improvement. Current Cost Estimates and Pro-Ject Status Construction and right of way cost estimates were updated during the planning process. The current right of way cost estimate is $ 575.000. The construction cost estimate is $ 2,250,000. The total estimated cost of the proposed project is $ 2,825,000. The 1998-2004 Transportation Improvement Program (TIP) includes $ 550,000 for right of way acquisition in fiscal year 1998 and $ 2,250,000 for construction in fiscal year 1999. Thus, the TIP includes $ 2,800,000 in total funding for TIP Project U-3100 A. A verified construction cost estimate will be requested by the Planning and Environmental Branch and forwarded to the Program Development Branch prior to the public hearing for the proposed project. Public Involvement Proposed improvements to SR 1009 (Hillsborough Road) between Lorraine Street and SR 1107 (Old Fayetteville Road) were presented and discussed at a Citizens Informational Workshop held on November 14, 1996 from 5:00 P.M. to 8:00 P.M. in the Carrboro Town Hall Board Room located at 301 West Main Street. At the workshop, conceptual plans to widen the subject section of SR 1009 (Hillsborough Road) and realign the intersection of SR 1009 and SR 1107 were displayed on aerial photographs. The mapping presented to the citizens did not show specific right of way impacts. NCDOT representatives explained that once environmental studies and preliminary designs are completed, a public hearing will be held to present these impacts. In addition to the mapping on display, citizens were given a handout that included information about the proposed project. Approximately 32 citizens attended the workshop. Most citizens recognized the need for the subject section of SR 1009 (Hi! orough Road) to be widened to accommodate bicycle lanes, but were concerned about poccntial impacts to their properties. Many residents asked that the project limits be extended down SR 1107 (Old Fayetteville Road) to tie into the widened section of that road in front of McDougle School. Many residents also recognized that improvements needed to be done to the intersection of SR 1009 and SR 1107 as well as the intersection of James Street, Quail Roost Drive, and Hillsborough Road. At the intersection of SR 1009 and SR 1107 residents asked NCDOT to provide adequate turning lanes and radii. Residents also suggested that the degree of curve of the existing horizontal curve just north of the intersection be reduced. At the intersection of James Street and Quail Roost Drive, citizens expressed concern regarding the intersection configuration. One resident suggested prohibiting access to Quail Roost Drive during certain times of the day. An alternative that would provide an island along James Street that would turn Quail Roost Drive into a right-in / right -out access received mixed reviews. Residents opposed turning Quail Roost Drive into a cul-de-sac. If any work is to be done to the intersection, residents who regularly use the intersection will be contacted prior to the public hearing for the project. The Town of Carrboro's Board of Alderman provided similar comments at the local officials meeting held to discuss the proposed project. The local officials meeting was also held on November 14, 1996 in the Carrboro Town Hall Board Room. A public hearing will be scheduled for the proposed project once this document is approved. NCDOT proposes to construct a bicycle lane along the east side of SR 1009 (Hillsborough Road) from Lorraine Street to SR 1107 (Old Fayetteville Road). The project will also add left turn lanes at four intersections along the project. The project is approximately 1.1 mi in length. The construction of bicycle lanes is listed as a non-major action in Minimum Criteria for State Funded Highway Projects. Due to the type of activity involved, an environmental document was not prepared for this project. The attached environmental review provides additional details about the project. At this time the project is scheduled to be let in November, 2000 and completed near July 2001. ENVIRONMENTAL IMPACTS Waters of the U.S. The project will impact one intermittent surface water located in the Cape Fear River Basin. This channel was evaluated by using the U. S. Army Corps of Engineers (USAGE) Intermittent Channel Evaluation Form. Two channels within the project area were evaluated while only one was determined to be an intermittent stream. The other was determined to be a stormwater grass-lined ditch. One small jurisdictional wetland is located adjacent to the project area. Since the wetland is small and somewhat degraded due to its location adjacent to the road. it was not field verified by the USACE. Nor was it classified according to the North Carolina Natural Heritage Program Natural Community Classification (Schafale and Weakley. 1990). The wetland was classified as PFO1 C (Palustrine Forested Broad-Leaved Deciduous Seasonally Flooded) according to the United States Fish and Wildlife Service wetland classification (Cowardin. 1979) system. A small portion (242 sq ft) of the wetland is located within a temporary drainage easement. However, a note will be placed on the plans for the contractor to work from the opposite side of the channel therefore not impacting the wetland. There will be no fill or excavation in this wetland. Table 1 itemizes the surface water impacts. Table 1. The NCDOT is committed to incorporating all reasonable and practicable design features to avoid and minimize wetland impacts. and to provide full compensatory mitigation of all remaining wetland impacts. All wetland areas not affected by the project will be protected from unnecessary encroachment. No staging of construction equipment or storage of construction supplies will be allowed in wetlands or near surface waters. Minimization: Minimization includes the examination of appropriate and practicable steps to reduce the adverse impacts. Minimization techniques were implemented as follows: 1. Best Management Practices: Strict enforcement of sedimentation and erosion control Best Management Practices (BMP) for the protection of surface waters and wetlands will be enforced. 2. Ditchin : It is the policy of the NCDOT to eliminate lateral ditching in wetlands as much as possible, thus preserving the hydrology of adjacent wetlands. No lateral ditches will be constructed in wetlands. 3. Clearing: Clearing Method II will be used. Compensation: Mitigation - Jurisdictional Wetlands. The project will not impact jurisdictional wetlands. Therefore no compensatory wetland mitigation is proposed for this project. Mitigation - Surface Waters. The project will not impact more than 150 ft of jurisdictional surface waters. Therefore, no compensatory mitigation is proposed for this project. It is requested that these activities be permitted under a Section 404 General Permit (198200031). The primary purpose of the proposed project is to construct bicycle lanes along SR 1009 (Hillsborough Road) from Lorraine Street to SR 1107 (Old Fayetteville Road). The construction of bicyle lanes is listed as a non-major action in Minimum Criteria for State Funded Highway Projects (July 12, 1993). In addition, the area of land impacted is less than the threshold established by those same guidelines. Therefore, this project does not require an environmental document pursuant to the North Carolina Environmental Policy Act. The North Carolina Department of Transportation proposes to symmetrically widen SR 1009 (Hillsborough Road) to accommodate bicycle lanes from Lorraine Street to just north of SR 1107 (Old Fayetteville Road), a distance of 1.69 km (1.05 miles)(see Figure 1). A curb and gutter facility with 11 in (36 feet) between its curb faces will be constructed, except in locations where left turn lanes are proposed. The 11 m (36-foot) typical section will provide a 3.6 m (12-foot) lane and a 1.2 m (4-foot) bicycle lane in each direction of travel. At locations where left turn lanes currently exist and will continue to be provided, a curb and gutter facility with 14.6 m (48 feet) between its curb faces will be constructed. This typical section will provide a through lane and a bicycle lane in each direction of travel, as well as a left turn lane. Left turn lanes will be located at McDougle Middle School's back entrance, Cates Farm Road, Parkview Avenue, and SR 1107 (Old Fayetteville Road). The proposed typical sections for the project are shown in Figure 2. The proposed project will also improve Hillsborough Road's intersection with SR 1107 (Old Fayetteville Road). Special Project Information: Sidewalks The Town of Can boro requested NCDOT to consider participating in the funding of sidewalks along the east side of the proposed project. Their request has been reviewed and it has been determined that NCDOT will provide 70 percent of the funds required to construct sidewalk along the east side of SR 1009 (Hillsborough Road). The northern project terminal is the intersection of SR 1009 (Hillsborough Road) and SR 1107 (Old Fayetteville Road). The intersection will be realigned as a part of the project so that SR 1009 (Hillsborough Road) will "T" into SR 1107 (Old Fayetteville Road). A traffic signal will be provided at the intersection. During the planning process. the Town of Carrboro asked NCDOT to consider ,N ideninU a short segment of SR 1107 (Old Fayetteville Road) so that the proposed project would tie into an existing widened segment of roadway. The SR 1107 segment of interest lies between the northern terminal of the proposed project and the widened segment of SR 1107 located in front of McDougle Middle School (SR 1107 (Old Fayetteville Road) in front of McDougle Middle School was widened to accommodate bicycle lanes by Chapel Hill - Carrboro Schools). As a part of the improvements to the intersection of SR 1009 and SR 1107, a right turn lane will be constructed along northbound SR 1107. The taper for this right turn lane begins approximately 10 m (33 feet) north of the existing widened segment of SR 1107. The limits of the intersection improvements at the northern terminal of TIP Project U-3100 A will be extended to tie into the existing widened typical section located on SR 1 l 07 (Old Fayetteville Road). Intersection of SR 1009 (Hillsborough Road)James Street and Quail Ridge Road As a part of TIP Project U-3100 A, a concrete island will be constructed on James Street that will convert Quail Ridge Road into a right-in / right-out access. The Town of Carrboro asked that residents living on Quail Ridge Road be notified prior to the public hearing and informed of this proposed improvement. Current Cost Estimates and ProJe t tatu Construction and right of way cost estimates were updated during the planning process. The current right of way cost estimate is $ 575.000. The construction cost estimate is $ 2,250,000. The total estimated cost of the proposed project is $ 2,825,000. The 1998-2004 Transportation Improvement Program (TIP) includes $ 550,000 for right of way acquisition in fiscal year 1998 and $ 2,250,000 for construction in fiscal year 1999. Thus, the TIP includes $ 2,800,000 in total funding for TIP Project U-3100 A. A verified construction cost estimate will be requested by the Planning and Environmental Branch and forwarded to the Program Development Branch prior to the public hearing for the proposed project. Public Involvement Proposed improvements to SR 1009 (Hillsborough Road) between Lorraine Street and SR 1107 (Old Fayetteville Road) ,vere presented and discussed at a Citizens Informational Workshop held on November 14, 1996 from 5:00 P.M. to 8:00 P.M. in the Carrboro Town Hall Board Room located at 301 West Main Street. At the workshop, conceptual plans to widen the subject section of SR 1009 (Hillsborough Road) and realign the intersection of SR 1009 and SR 1107 were displayed on aerial photographs. The mapping presented to the citizens did not show specific right of way impacts. NCDOT representatives explained that once environmental studies and preliminary designs are completed, a public hearing will be held to present these impacts. In addition to the mapping on display, citizens were given a handout that included information about the proposed project. Approximately 32 citizens attended the workshop. Most citizens recognized the need for the subject section of SR 1009 (Hillsborough Road) to be widened to accommodate bicycle lanes. but were concerned about potential impacts to their properties. Many residents asked that the project limits be extended down SR 1107 (Old Fayetteville Road) to tie into the widened section of that road in front of McDougle School. Many residents also recognized that improvements needed to be done to the intersection of SR 1009 and SR 1107 as well as the intersection of James Street, Quail Roost Drive, and Hillsborough Road. At the intersection of SR 1009 and SR 1107 residents asked NCDOT to provide adequate turning lanes and radii. Residents also suggested that the degree of curve of the existing horizontal curve just north of the intersection be reduced. At the intersection of James Street and Quail Roost Drive, citizens expressed concern regarding the intersection configuration. One resident suggested prohibiting access to Quail Roost Drive during certain times of the day. An alternative that would provide an island along James Street that would turn Quail Roost Drive into a right-in / right -out access received mixed reviews. Residents opposed turning Quail Roost Drive into a cul-de-sac. If any work is to be done to the intersection, residents who regularly use the intersection will be contacted prior to the public hearing for the project. The Town of Carrboro's Board of Alderman provided similar comments at the local officials meeting held to discuss the proposed project. The local officials meeting was also held on November 14, 1996 in the Carrboro Town Hall Board Room. A public hewing will be scheduled for the proposed project once this document is approved. ENVIRONMENTAL IMPACTS Waters of the U.S. The project will impact one intermittent surface water located in the Cape Fear River Basin. This channel was evaluated by using the U. S. Army Corps of Engineers (USAGE) Intermittent Channel Evaluation Form. Two channels within the project area were evaluated while only one was determined to be an intermittent stream. The other was determined to be a stormwater grass-lined ditch. One small jurisdictional wetland is located adjacent to the project area. WWW.DOH.DOT.STATE.NC.US RALEIGH, NC specified in the 1987 Corps of Engineers Wetland Delineation Manual. Since the wetland is small and somewhat degraded due to its location adjacent to the road, it was not field verified by the USACE. Nor was it classified according to the North Carolina Natural Heritage Program Natural Community Classification (Schafale and Weakley, 1990). The wetland was classified as PFO 1 C (Palustrine Forested Broad-Leaved Deciduous Seasonally Flooded) according to the United States Fish and Wildlife Service wetland classification (Cowardin, 1979) system. A small portion (242 sq ft) of the wetland is located within a temporary drainage easement. However, a note will be placed on the plans for the contractor to work from the opposite side of the channel therefore not impacting the wetland. There will be no fill or excavation in this wetland. Table 1 itemizes the surface water impacts. Table 1. Two property owners have land adjacent to or within the project area where impacts to jurisdictional surface waters will occur. Each property is designated by a number which is labeled on the attached permit drawing. Table 2 below provides the property owners' names as well as their addresses. Table 2. The following species are listed as threatened or endangered in the respective counties: A Biological Conclusion of No Effect has been reached for all species. • Red-cockaded woodpecker (Picoides borealis). Endangered. • Dwarf wedge mussel (Alsmidonta heterodon). Endangered. • Michaux's sumac (Rhus michauxii). Endangered. • Smooth coneflower (Echinacea laevigata). Endangered. • Small-whorled pogania (Isotria medeloides). Threatened. Cultural Resources. There are no known historic sites or archaeological sites within the project area. During the scoping meeting for this meeting, Debbie Beven of the State Historic Preservation Office stated that neither an architectural historic survey nor an archaeological survey was necessary for this project. Mitigation: Avoidance. The NCDOT is committed to incorporating all reasonable and practicable design features to avoid and minimize wetland impacts, and to provide full compensatory mitigation of all remaining wetland impacts. All wetland areas not affected by the project will be protected from unnecessary encroachment. No staging of construction equipment or storage of construction supplies will be allowed in wetlands or near surface waters. Minimization: Minimization includes the examination of appropriate and practicable steps to reduce the adverse impacts. Minimization techniques were implemented as follows: 1. Best Management Practices: Strict enforcement of sedimentation and erosion control Best Management Practices (BMP) for the protection of surface waters and wetlands will be enforced. 2. Ditching: It is the policy of the NCDOT to eliminate lateral ditching in wetlands as much as possible, thus preserving the hydrology of adjacent wetlands. No lateral ditches will be constructed in wetlands. 3. Clearing: Clearing Method II will be used. Compensation: Mitigation - Jurisdictional Wetlands. The project will not impact jurisdictional wetlands. Therefore no compensatory wetland mitigation is proposed for this project. Mitigation - Surface Waters. The project will not impact more than 150 ft of jurisdictional surface waters. Therefore, no compensatory mitigation is proposed for this project. It is requested that these activities be permitted under a Section 404 General Permit (198200031). The primary purpose of the proposed project is to construct bicycle lanes along SR 1009 (Hillsborough Road) from Lorraine Street to SR 1107 (Old Fayetteville Road). The construction of bicyle lanes is listed as a non-major action in Minimum Criteria for State Funded Highway Projects (July 12, 1993). In addition, the area of land impacted is less than the threshold established by those same guidelines. Therefore, this project does not require an environmental document pursuant to the North Carolina Environmental Policy Act. The North Carolina Department of Transportation proposes to symmetrically widen SR 1009 (Hillsborough Road) to accommodate bicycle lanes from Lorraine Street to just north of SR 1107 (Old Fayetteville Road), a distance of 1.69 km (1.05 miles)(see Figure 1). A curb and gutter facility with 11 m (36 feet) between its curb faces will be constructed, except in locations where left turn lanes are proposed. The 11 m (36-foot) typical section will provide a 3.6 m (12-foot) lane and a 1.2 m (4-foot) bicycle lane in each direction of travel. At locations where left turn lanes currently exist and will continue to be provided, a curb and gutter facility with 14.6 m (48 feet) between its curb faces will be constructed. This typical section will provide a through lane and a bicycle lane in each direction of travel, as well as a left turn lane. Left turn lanes will be located at McDougle Middle School's back entrance, Cates Farm Road. Parkview Avenue, and SR 1107 (Old Fayetteville Road). The proposed typical sections for the project are shown in Figure 2. The proposed project will also improve Hillsborough Road's intersection with SR 1107 (Old Fayetteville Road). As shown in Figure 1, SR 1009 (Hillsborough Road) will be realigned to intersect SR 1107 (Old Fayetteville Road). No environmentally sensitive features were discovered in the project vicinity through field surveys and searches of environmental data bases of the Planning and G) Environmental Branch. As shown in Figure 1, SR 1009 (Hillsborough Road) will be realigned to intersect SR 1107 (Old Fayetteville Road). Anticipated Permit or Consultation Requirements: No permits are anticipated to be needed to construct the proposed project. Special Project Information: Sidewalks The Town of Carrboro requested NCDOT to consider participating in the funding of sidewalks along the east side of the proposed project. Their request has been reviewed and it has been determined that NCDOT will provide 70 percent of the funds required to construct sidewalk along the east side of SR 1009 (Hillsborough Road). Northern Project Terminal The northern project terminal is the intersection of SR 1009 (Hillsborough Road) and SR 1107 (Old Fayetteville Road). The intersection will be realigned as a part of the project so that SR 1009 (Hillsborough Road) will "T" into SR 1107 (Old Fayetteville Road). A traffic signal will be provided at the intersection. During the planning process. the Town of Carrboro asked NCDOT to consider ?videnin a short segment of SR 1107 (Old Fayetteville Road) so that the proposed project would tie into an existing widened segment of roadway. The SR 1107 segment of interest lies between the northern terminal of the proposed project and the widened segment of SR 1107 located in front of McDougle Middle School (SR 1107 (Old Fayetteville Road) in front of McDougle Middle School was widened to accommodate bicycle lanes by Chapel Hill - Carrboro Schools). As a part of the improvements to the intersection of SR 1009 and SR 1107, a right turn lane will be constructed along northbound SR 1107. The taper for this right turn lane begins approximately 10 m (33 feet) north of the existing widened segment of SR 1107. The limits of the intersection improvements at the northern terminal of TIP Project U-3100 A 'vvill be extended to tie into the existing widened typical section located on SR 1107 (Old Fayetteville Road). Intersection of SR 1009 (Hillsborough Road) James Street, and Quail Ridge Road As a part of TIP Project U-3100 A, a concrete island will be constructed on James Street that will convert Quail Ridge Road into a right-in / right-out access. The Town of Carrboro asked that residents living on Quail Ridge Road be notified prior to the public hearing and informed of this proposed improvement. Current Cost Estimates and Project Status Construction and right of way cost estimates were updated during the planning process. The current right of way cost estimate is $ 575.000. The construction cost estimate is $ 2,250,000. The total estimated cost of the proposed project is $ 2,825,000. The 1998-2004 Transportation Improvement Program (TIP) includes $ 550,000 for right of way acquisition in fiscal year 1998 and $ 2,250,000 for construction in fiscal year 1999. Thus, the TIP includes $ 2,800,000 in total funding for TIP Project U-3100 A. A verified construction cost estimate will be requested by the Planning and Environmental Branch and forwarded to the Program Development Branch prior to the public hearing for the proposed project. Public Involvement Proposed improvements to SR 1009 (Hillsborough Road) between Lorraine Street and SR 1107 (Old Fayetteville Road) were presented and discussed at a Citizens Informational Workshop held on November 14, 1996 from 5:00 P.M. to 8:00 P.M. in the Carrboro Town Hall Board Room located at 301 West Main Street. At the workshop, conceptual plans to widen the subject section of SR 1009 (Hillsborough Road) and realign the intersection of SR 1009 and SR 1107 were displayed on aerial photographs. The mapping presented to the citizens did not show specific right of way impacts. NCDOT representatives explained that once environmental studies and preliminary designs are completed, a public hearing will be held to present these impacts. In addition to the mapping on display, citizens were given a handout that included information about the proposed project. I Approximately 32 citizens attended the workshop. Most citizens recognized the need for the subject section of SR 1009 (Hillsborough Road) to be widened to accommodate bicycle lanes, but were concerned about potential impacts to their properties. Many residents asked that the project limits be extended down SR 1107 (Old Fayetteville Road) to tie into the widened section of that road in front of McDouQle School. Many residents also recognized that improvements needed to be done to the intersection of SR 1009 and SR 1107 as well as the intersection of James Street, Quail Roost Drive, and Hillsborough Road. At the intersection of SR 1009 and SR 1107 residents asked NCDOT to provide adequate turning lanes and radii. Residents also suggested that the degree of curve of the existing horizontal curve just north of the intersection be reduced. At the intersection of James Street and Quail Roost Drive, citizens expressed concern regarding the intersection configuration. One resident suggested prohibiting access to Quail Roost Drive during certain times of the day. An alternative that would provide an island along James Street that would turn Quail Roost Drive into a right-in / right -out access received mixed reviews. Residents opposed turning Quail Roost Drive into a cul-de-sac. If any work is to be done to the intersection, residents who regularly use the intersection will be contacted prior to the public hearing for the project. The Town of Carrboro's Board of Alderman provided similar comments at the local officials meeting held to discuss the proposed project. The local officials meeting was also held on November 14, 1996 in the Carrboro Town Hall Board Room. A public hearing will be scheduled for the proposed project once this document is approved. According to the 1996-2002 Transportation Improvment Program (TIP), TIP Project U-3100 will widen SR 1009 (Hillsborough Road), from Lorraine Street to SR 1107 (Old Fayetteville Road), and SR 1107, from SR 1009 to NC 54, to 36-foot (11 m) wide curb and gutter facilities. The purpose of the project is to provide bicycle facilities along these roadways. If the project is constructed as described in the TIP, each of the widened facilities will have two 12-foot (3.6 m) travel lanes and two 4-foot (1..2 m) bicycle lanes. In the 1996-2002 TIP, $ 400,000 is appropriated for right of way acquistion and $ 1,700,000 is appropriated for construction of the proposed project. Right of way acquisition is scheduled to begin in fiscal year 1997 and construction is scheduled to begin in fiscal year 1999. Existing Conditions Both SR 1009 (Hillsborough Road) and SR 1107 (Old Fayetteville Road) are shown as major thoroughfares on the Chapel Hill / Carrboro Thoroughfare Plan. SR 1009 is classified as a minor arterial and SR 1107 is classified as a collector. Both are predominantly two-lane roadways with 22 feet (6.7 m) of pavement. Shoulder widths vary along these roadways between 3 feet (0.9 m) and 8 feet (2.4 m). Left turning lanes have been constructed on SR 1107 at NC 54 and McDougle Middle School. Left turning lanes have been constructed on SR 1009 at McDougle Middle School's back entrance, Cates Farm Road, and Parkview Avenue. The speed limit of SR 1107 is currently 45 mph. The current speed limit on SR 1009 is 35 mph. In 1999, traffic volumes along SR 1107 and SR 1009 are anticipated to vary from 6024 vehicles per day (vpd) (on SR 1009 just south of SR 1107) to 7368 vpd (on SR 1107 just north of NC 54). In 2019, traffic volumes along SR 1107 and SR 1009 are anticipated to vary from 10,716 vpd (on SR 1107, north of Carol Street) to 11,344 vpd (on SR 1009 between Cates Farm Road and Lorraine Street). South of the proposed project, SR 1009 is a 36-foot (11 m) face to face curb and gutter facility with two 12-foot (3.6 m) lanes and two 4-foot (1.2 m) bicycle lanes. North of the proposed project, SR 1009 is a two lane roadway. At NC 54, SR 1107 has a through-right lane and a left turn lane. The existing right of way along the proposed project varies in width from 40 feet (12.2 m) to 60 feet (18.3 m). Along SR 1107, NCDOT owns 60 feet (18.3 m) of right of way. Along SR 1009, NCDOT maintains approximately 40 feet (12.2 m) of right of way. Proposed Improvements Bicycle Accommodations Providing bicycle lanes along SR 1107 and SR 1009 is shown as an incidental project in the 1996 - 2002 Transportation Improvement Program. Since the primary purpose of the proposed project is the construction of bicycle lanes, the Office of Bicycle and Pedestrian Transportation and representatives from the Town of Carrboro were given the opportunity to express their ideas and concerns about the proposed project. The Bicycle Unit and the Town of Carrboro expressed concern about the intersection of SR 1009 and SR 1107. Both of these roadways will have bicycle lanes south of this intersection. North of the intersection, the roadway will still be a narrow, two-lane facility. The bicycle lanes are currently anticipated to be dropped at the SR 1107/SR 1009 intersection. Appropriate signing warning bicyclists and motorists of the end of the bicycle lanes will need to be provided. Next, the Town of Carrboro and the Bicycle Unit highlighted locations along the proposed project expected to draw bicycle and pedestrian traffic: McDougle Middle School (located on SR 1107), a public library (located on the McDougle Middle School Property), and a community park (located just west of SR 1107). In addition, an elementary school is currently being constructed at McDougle Middle School. The elementary school will be accessed via SR 1009. The Town of Carrboro desires the speed limit to be reduced to 35 mph on SR 1009 and to 35 mph during school hours on SR 1107. 2. Typical Section The 36-foot (11 m) face to face curb and gutter typical section described in the TIP, which provides two 12-foot (3.6 m) through lanes and two 4-foot (1.2 m) bicycle lanes, does not accommodate left turn lanes. Ideally, if left turn lanes were provided at intersections, the roadway would widen to a 48-foot (14.6 m) face to face curb and gutter typical section. This typical section would provide for two 12-foot (3.6 m) through lanes, a 12-foot (3.6 m) left turn lane, and two 4-foot (1.2 m) bicycle lanes. Note, that at the intersections, the bicycle lanes would be striped with a dashed line rather than a solid one. This would signal bicyclists that they should be aware of vehicles turning into their path. If a high number of left turn lanes were provided, the typical section for the entire project would, in effect, become a three lane roadway with bicycle lanes. A second typical section suggested at the scoping meeting was a 44-foot (13.4 m) face to face curb and gutter facility. This typical section would have a 12-foot (3.6 m) wide center turn lane and 14-foot (4.2 m) travel lanes that would accommodate both motorists and bicyclists. The Town of Carrboro thinks that the community would oppose providing three lanes along the entire project and suggested NCDOT limit the width of pavement as much as possible. In the design year, the roadways are expected to operate at level of service D if left turn lanes are constructed to remove turning traffic from the through lanes. Several attendees were concerned that if turn lanes are not provided, the level of service of the roadways will drop significantly. Additional coordination with the Town of Carrboro, the Office of Bicycle and Pedestrian Transportation, Roadway Design, and Traffic Engineering will be done before a proposed typical section is selected. 3. Sidewalks Next, the construction of sidewalks along the proposed project was discussed. The construction of sidewalks along these roadways is included as an incidental project in the 1996 - 2002 TIP. According to NCDOT's current pedestrian policy, the Town of Carrboro qualifies for an 80 / 20 funding ratio; NCDOT will fund 80 percent of the cost of constructing warranted sidewalks and Carrboro will fund 20 percent. As stated in the current guidelines, NCDOT expenditures on sidewalk construction cannot exceed two percent of the total project construction cost. The Town of Carrboro only wants sidewalks to be constructed on one side of the roadways. The Town wants sidewalks on the east side of SR 1107 and on the west side of SR 1009. Normally, NCDOT provides standard 10-foot (3 m) berms on both sides of the roadway so, if desired, sidewalk can be added in the future. The Town of Carrboro does not anticipate future sidewalk construction on either the west side of SR 1107 or the east side of SR 1009. Therefore, the Town of Carrboro suggested that a minimal berm width be provided where sidewalks aren't constructed as a part of the project. The Town of Carrboro will need to formally request that NCDOT (1) participate in sidewalk funding and (2) consider a minimal berm width on these roadways. 4. Miscellaneous The Town of Carrboro had a few more concerns about the project. The Town was concerned about possible grade changes along SR 1009 and SR 1107. Since several parcels along the proposed project are already lower than the roadways, additional grade changes could cause drainage problems. Roland Robinson said that no significant grade changes are anticipated as a part of this project. The Town also would like to have the existing intersection of Quail Roost Drive, James Street, and SR 1009 realigned. Quail Roost Drive is anticipated to be paved by the Town prior to the construction of this project. The Town of Carrboro also discussed several developments that are either under construction or planned for the project area. Sunset Creek is located just north of the proposed project. Plans for the Sunset Creek subdivision have been forwarded to NCDOT. Another planned development is Hogan Farm. The Hogan Farm subdivision is anticipated to draw traffic through the Cates Farm subdivision on SR 1009. The Town is currently trying to add a new road to their thoroughfare plan that will reduce through traffic in the Cates Farm subdivision. The presence of this new thoroughfare may influence the configuration of the intersection of SR 1107 and SR 1009. The Traffic Engineering Branch recommended that a signal be installed at the intersection of SR 1 107 and SR 1009 and at the main entrance to McDougle Middle School on SR 1107. Utilities in the vicintty of the project were discussed. The project is anticipated to have a medium impact on utilities. Most of the utility relocation is anticipated to be routine. However, a pump station is located at the north end of the proposed project on the east side of SR 1009, and a cable television satellite downlink site is located on the west side of SR 1107, south of SR 1009. Impacts to these two sites will be avoided, if possible. Environmental Concerns Debbie Beven of the State Historic Preservation Office stated that one property in the project vicinity is potentially eligible for the National Register of Historic Places. This property, a bungalow located on the east side of SR 1009 north of the project terminal, is currently anticipated to be outside the area of potential effect of the proposed project. No properties within the project area are on the National Register of Historic Places. Ms. Beven said that neither an architectural historic survey nor an archaeological survey needs to be completed by NCDOT for the proposed project. Tile proposed project lies within two watersheds. The ridge line between the watersheds lies between SR 1107 and SR 1009. SR 1009 is in the Bolin Creek watershed. Bolin Creek is classified as C NSW. Normal soil and erosion control measures will suffice. SR 1107 lies within the Morgan Creek watershed. Morgan Creek feeds University Lake, which supplies water for Chapel Hill and Carrboro, and is classified as WS 11 NSW. This watershed is classified as high quality water; therefore, high quality water soil and erosion control measures must be provided. An additional concern on SR 1107 is the current proposal to provide curb and gutter. Curb and gutter allows pollutants and toxins to reach creeks faster, before they can filter out of the water. Eric Galamb of the Division of Environmenatal Management suggested that a shoulder section be considered on the west side of SR 1107. If shoulder is provided on the west side of SR 1107, impurities can filter out of the runoff before it reaches the watershed's streams. Since the Town wants sidewalk only on the east side of SR 1107, providing a shoulder on the west side of SR 1107 is a possibility. Eric Galamb also suggested draining the curb and gutter of the east side of SR 1107 into McDougle Middle School's drainage system. Jerry Snead of the Hydraulics Unit and staff from the Town of Carrboro were concerned about draining the project into the school's system; the Hydraulics Unit will consider these drainage alternatives during the planning process. Cost Estimates and Current Project Status As a part of the scoping process, an updated construction cost estimate was compiled for the proposed project ($ 4.2 million). The scoping sheets provided prior to the scoping meeting presented this estimate. Since this figure was significantly higher than the $ 1.7 million appropriated in the TIP, the Program Development Branch asked Doug Lane to verify his estimate. The construction cost estimate was revised to $ 3.8 million. Due to this significant cost increase, the proposed project has been broken into two sections. TIP Project U-3100 A includes improvements to SR 1009 from Lorraine Street to SR 1107. TIP Project U-3100 A is currently scheduled for right of way acquisition in fiscal year 1998 and construction in fiscal year 1999. TIP Project U-3100 B includes improvements to SR 1107 from NC 54 to SR 1009. Right of way acquisition and construction for TIP Project U-3100 B are anticipated to be scheduled for post year (after the year 2003) in the new Transportaton Improvement Program. The Program Development Branch requested that the Planning and Environmental Branch and the Roadway Design Unit prepare the planning document and plans for TIP Project U-3100 A only. Interested individuals may attend this informal hearing at their convenience during the above stated hours. Department of Transportation representatives will be available to answer questions and receive comments relative to the proposed project. There will be no formal session held. Additional materials may be submitted for a period of 15 days from the date of the hearing to: L. T. Dudley, P.E. at P. 0. Box 25201, Raleigh, NC 27611. Under this project, it is proposed to symmetrically widen Hillsborough Road to accommodate bicycle lanes from Lorraine Street to Old Fayetteville Road, a distance of approximately one mile. A curb and gutter facility with 36 feet between its curb faces will be constructed except in locations where left turn lanes are proposed. The 36-ft. typical section will provide a 12 ft: lane and a 4-ft. bicycle in each direction of travel. At locations where left turn lanes currently exist and will continue to be provided, a curb and gutter facility with 48 feet between its curb faces will be constructed. This typical section will provide a through lane and a bicycle lane in each direction, as well as a left turn lane. Left turn lanes will be located at McDougle Middle School's back entrance, Cates Farm Road, Parkview Avenue, and Old Fayetteville Road. It is proposed to cul- de-sac Quail Roost Drive and eliminate its existing three-way intersection with James Street and Hillsborough Road. Also, alignment improvements to Hillsborough Road are proposed at the Old Fayetteville Road intersection. A copy of the map showing the location and design of the improvements and a copy of the environmental document describing the project are available-for public review at the Carrboro Town Hall. Box 25201 Raleigh, NC 27611-5201 4rD-Q /a rob Subject: Improvements to SR 1009 (Hillsborough Road), TIP No. U- 3100A, Orange County, North Carolina Dear Mr. Vick: This responds to your letter of August 26, 1996 requesting information from the U.S. Fish and Wildlife Service (Service) for evaluating the potential environmental impacts of the above- referenced project. This report provides scoping information and is provided in accordance with provisions of the Fish and Wildlife Coordination Act (16 U.S.C. 661-667d) and Section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). This report also serves as initial scoping comments to federal and state resource agencies for use in their permitting and/or certification processes for this project. Your letter indicates that the proposed widening SR 1009 to accommodate bicycle Lorraine Street to just north of SR 110 The facility would primarily consist of facility with a 12-foot lane and 4-foot direction. project would consist of lanes from just south of 7 (Old Fayetteville Road) a curb-and-gutter bicycle lane in each The Service's mission is to provide the leadership to conserve, protect, and enhance fish and wildlife and their habitats for the continuing benefit of all people. Due to staffing limitations, we are unable to provide you with site-specific comments at this time. However, the following recommendations should help guide the planning process and facilitate our review of the project. Generally, the Service recommends that wetland impacts be avoided and minimized to the maximum extent practical as outlined in the Clean Water Act Section 404(b)(1) Guidelines. If unavoidable wetland impacts are proposed, we recommend that every effort be made to identify compensatory mitigation sites in advance. . Opportunities to protect target areas in perpetuity, preferably via conservation easement, should be explored at the outset. Regarding avoidance and minimization of impacts, we generally recommend that proposed highway projects be aligned along or adjacent to existing roadways, utility corridors, or previously developed areas in order to minimize habitat fragmentation and encroachment. Areas exhibiting high biodiversity or ecological value important to the watershed and/or region should be avoided. Crossings of streams and associated wetland systems should use existing crossings and/or occur on structure wherever feasible. Where bridging is not feasible, culvert structures that maintain natural water flows and circulation regimes without scouring or impeding fish and wildlife passage should be employed. Highway shoulder and median width should be reduced through wetland areas. Roadway embankments and fill areas should be stabilized by using appropriate erosion control devices and/or techniques. Wherever appropriate, construction in sensitive areas should occur outside the seasons of fish spawning and migratory bird nesting. We reserve the right to review any required Federal or State permits at the time of public notice issuance. Resource agency coordination should occur early in the planning process to resolve land use conflicts and minimize delays. In addition to the above guidance, we recommend that the environmental documentation for this project include the following (the level of detail should be commensurate with the degree of environmental impacts): 1. 2. 3. A clearly defined purpose and need for the proposed project including a discussion of the project's independent utility; An analysis of the alternatives to the proposed project that were considered, including a no action alternative; A description of the fishery and wildlife resources within the action area of the proposed project which may be directly or indirectly affected; 4. The extent and acreage of waters of the U.S., including wetlands, that are to be impacted by filling, dredging, clearing, ditching, and/or draining. Wetland impact acreages should be differentiated by habitat type based on the wetland classification scheme of the National Wetlands Inventory. Wetland boundaries should be determined by using the 1987 Corps of Engineers Wetlands Delineation Manual and verified by the U.S. Army Corps of Engineers; P 5. The anticipated environmental impacts, both temporary and permanent, that would be likely to occur as a direct result of the proposed project. Also, an assessment should be included regarding the extent to which the proposed project would result in secondary impacts to natural resources and how this and similar projects contribute to cumulative adverse effects; 6. Techniques which would be employed to design and construct wetland crossings, relocate stream channels, and restore, enhance, or create wetlands for compensatory mitigation; and, 7. Mitigation measures which would be employed to avoid, minimize, rectify, reduce, or compensate for habitat value losses associated with the project. These measures should include a detailed compensatory mitigation plan for offsetting unavoidable wetland impacts. The attached page identifies the Federally-listed endangered, threatened, and candidate species that are known to occur in Orange County. Habitat requirements for the Federally-listed species in the project area should be compared with the available habitat at the project site. If suitable habitat is present within the action area of the project, field surveys for the species should be performed, and survey methodologies and results included in the environmental documentation for this project. In addition to this guidance, the following information should be included in the environmental document regarding protected species (the level of detail should be commensurate with the degree of environmental impacts): 1. A specific description of the proposed action to be considered; 2. A description and accompanying map of the specific area used in the analysis of direct, indirect, and cumulative impacts; 3. A description of the biology and status of the listed species and of the associated habitat that may be affected by the action, including the results of an onsite inspection; 4. An analysis of the "effects of the action" on the listed species and associated habitat: a. Direct and indirect impacts of the project on listed species. Indirect effects are those that are caused by the proposed action and are later in time but are still reasonably certain to occur; b. A discussion of the environmental baseline which includes interrelated, interdependent, past and present impacts of Federal, State, and private activities in the project and cumulative effects area; C. Interrelated actions are those that are part of a larger action and depend on the larger action for their justification; d. Cumulative impacts of future State and private activities (not requiring Federal agency involvement) that will be considered as part of future Section 7 consultation; 5. Summary of evaluation criteria used as a measurement of potential effects; 6. A description of the manner in which the action may affect any listed species or associated habitat including project proposals to reduce/eliminate adverse effects; and, 7. Based on evaluation criteria, a determination of whether the project is not likely to adversely affect or may affect threatened and endangered species. Candidate species are those plant and animal species for which the Service has sufficient information on their biological status and threats to their survival to propose them as endangered or threatened under the ESA. Although candidate species receive no statutory protection under the ESA, Federal agencies are required to informally confer with the Service on actions likely to jeopardize the continued existence of these species or that may destroy or modify proposed critical habitat. Species of concern include those species for which the Service does not have enough scientific information to support a listing proposal or species which do not warrant listing at the present time. Species of Concern receive no statutory protection under the ESA, but could become candidates in the future if additional scientific information becomes available indicating that they are endangered or threatened. Formal listing places the species under the full protection of the ESA, and necessitates a new survey if its status in the project corridor is unknown. Therefore, it would be prudent for the project to avoid any adverse impact to candidate species or their habitat. The North Carolina Natural Heritage Program should be contacted for information on species under State protection. The Service appreciates the opportunity to comment on this project.
