Gilmore PO Box 25201 Raleigh, NC 27611 Dear Sirs: You have our approval, in accordance with the attached conditions and those listed below, to impact 0.09 acres of wetlands and 471 feet of stream channel in Rutherford County, for the purpose of road widening on SR 2241/2179 as you described in your application received by the Division of Water Quality on July 17, 2000. After reviewing your application, we have decided that this till is covered by General Water Quality Certification Number 3289. This certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Dear Sir: This permit application serves to replace the previously submitted application, dated 28 January 2000. Due to an update in stream information, a new permit application was necessary. The North Carolina Department of Transportation (NCDOT) proposes to widen SR 2241/2179 (Oak Street) to a multi-lane section from west of the intersection with US 74 Alt. to Young Street in Forest City. The 2.4 km (1.5 mi) long project will widen the existing roadway to a five-lane curb and gutter. The proposed cross section will consist of two 3.6 m (12.0 ft) travel lanes in each direction and one 3.6 m (12.0 ft) center turn lane. The analysis of alternatives and the environmental impacts are discussed in a State Environmental Assessment (EA) and Finding 01' No Significant Impact (FONSI) signed June 26, 1996 and May 28, 1997, respectively. US LOCATION: TRANSPORTATION BUILDING 1 SOUTH WILMINGTON STREET RALEIGH NC IMPACTS TO WATERS OF THE U.S. Jurisdictional Surface Waters: Impacts to jurisdictional surface waters have been separated from jurisdictional wetlands. This project will impact jurisdictional streams at five sites as well as a small pond (Table 1). These impacts to surface waters are listed on the summary sheet with the permit drawings. Mitigation requirements were determined during a field review meeting on 04 April 2000 with the Army Corps of Engineers representative Steve Lund. However, since the site visit impacts have been reduced. Site 3 involves a surface water pond being filled, totaling 0.005 ha (0.01 ac) of impact. Site 4 is a highly degraded intermittent stream lacking biological significance. This stream will be relocated south of the existing stream for a total of 55.0 m (180.4 ft). The last 19.0 m (62.3 ft) will be piped due to stabilization problems resulting from the steep slope. Table 1. Wetland delineations were conducted by NCDOT biologists using the criteria specified in the 1987 Corps of Engineers Wetland Delineation Manual. Jurisdictional wetland impacts will occur from the placement of road shoulder fill and mechanized clearing, resulting in permanent wetland impacts of 0.09 acre Y- X (0.034 ha). These impacts are identified on Sheet 4 of 10 of the permit drawings. ?5 3 4, The wetland vegetation includes black willow (Salix nigra), tag alder (Alnus serrulata), 1-70 elderberry (Sambucus canadensis), silky dogwood (Cornus amomum), southern arrowwood (Viburnum dentatum), soft rush (Juncus spp.), sedges (Carex sp.), jewelweed (Impatiens (21 ''0 capensis), multiflora rose (rosa multiflora), grape (Vitis sp.), and poison ivy (Toxicodendron I? I radicans). / AVOIDANCE AND MINIMIZATION The COE has adopted through the Council on Environmental Quality (CEQ), a wetland mitigation policy which embraces the concept of "no net loss of wetlands" and sequencing. The purpose of this policy is to restore and maintain the chemical, biological and physical integrity of Waters of the United States. Mitigation of wetland impacts has been defined by the CEQ to include: avoiding impacts, minimizing impacts, rectifying impacts, reducing impacts over time and compensating for impacts (40 CFR 1508.20). Executive Order 11990 (Protection of Wetlands) and Department of Transportation Order 5660.1 A (Preservation of the Nation's Wetlands), emphasize protection of the functions and values provided by wetlands. These directives require that new construction in wetlands be avoided as much as possible and that all practicable measures were taken to minimize or mitigate impacts to wetlands. The NCDOT is committed to incorporating all reasonable and practicable design features to avoid and minimize wetland impacts, and to provide full compensatory mitigation of all remaining wetland impacts. Many avoidance and minimization measures were made during the planning stages and are discussed in detail in the planning documents (EA and FONSI). In addition, the following measures will also be implemented to minimize jurisdictional impacts: • Installation of temporary silt fences, earth berms, and temporary ground cover during construction. Strict enforcement of sedimentation and erosion control Best Management Practices for the protection of surface waters and wetlands. • Reduction of clearing and grubbing activity in and adjacent to water bodies and wetlands. • Minimization of "in-stream" activities. • All wetland areas not directly affected by the project will be protected from unnecessary encroachment. • NCDOT reduced the length of culverts by increasing the steepness of the slopes, therefore decreasing the length of channel impacts. Since this is a widening project, NCDOT will be extending existing structures along the water bodies, thereby reducing stream impacts. COMPENSATORY MITIGATION Stream impacts have decreased since the original permit application was sent. One individual stream crossing, a UT to Bracketts Creek at Site 4, will impact 53.0 m (173.9 ft). However, during the field review meeting, Mr. Lund determined this stream is a highly degraded intermittent stream lacking biological significance and not requiring mitigation. All other individual stream crossings impact less than 45.7 m (150.0 ft), therefore no stream mitigation is proposed. Wetland impacts do not exceed 1/10 of an acre, therefore no wetland mitigation is proposed. THREATENED AND ENDANGERED SPECIES Plants and animals with federal classification of Endangered (E), Threatened (T), Proposed Endangered (PE), and Proposed Threatened (PT) are protected under provisions of Section 7 and Section 9 of the Endangered Species Act of 1973, as amended. As of 16 June 2000, the Fish and Wildlife Service (FWS) lists four federally protected species for Rutherford County, the Indiana bat, (Myotis sodalis), dwarf-flowered heartleaf (Hexastylis naniflora), white irisette (Sisyrinchium dichotomum) and rock gnome lichen (Gymnoderma lineare). The NCDOT evaluation of these species resulted in Biological Conclusions of "No Effect" for all of these species. An additional review of the NC Natural Heritage Program database of rare species and unique habitats on 01 June 2000 revealed that no known occurrences of any federally protected species occur within one mile of the project area. Therefore, project construction will not affect these species. CULTURAL RESOURCES Archaeological Resources: The State Historic Preservation Office (SHPO) has stated by letter dated June 23, 1995 that "there are no known archaeological sites within the proposed project area. Based on our present knowledge of the area, it is unlikely that any archaeological resources which may be eligible for inclusion in the National Register of Historic Places will be affected by the project construction." Therefore, no archaeological investigation was conducted in connection with this project. Please see Appendix A of the EA for a copy of this letter. Historic Architectural Resources: The area of potential effect for historic architectural properties was delineated and the maps and files of the SHPO were consulted. This search revealed no properties listed in the National Register of Historic Places or on the State Study List. In addition, none of the properties over fifty years old are eligible for the National Register. The SHPO has concurred with these determinations (see Appendix A of the EA). REGULATORY APPROVALS Attached is a copy of the permit drawings and Pre-construction Notification (PCN) for the subject project. We anticipate the project will be authorized via a Nationwide Permit 14. We are also hereby requesting a 401 Water Quality Certification from the Division of Water Quality. A check for $475.00 for processing the Section 401 permit application, has already been issued to the Division of Water Quality for this project. We are also requesting a letter of concurrence from the N.C. Wildlife Resources Commission during the project permitting process since Rutherford County is a designated "trout" county. Ferrell, Program Manager North Carolina Wetland Restoration Program Division of Water Quality Mail Service Center 1619 Raleigh, NC 27699-1619 Dear Sir: i Subject: Stream mitigation in Rutherford County, SR 2241/2179 (Oak Street) from west of US 74 Alt. to Young Street, State Project No. 8.2890401, I.I.P. No. U-271 IA., The North Carolina Department of Transportation proposes to widen SR 2241/2179 (Oak Street) to a multi-lane facility just west of US 74 Alt. to Young Street in Rutherford County, a distance of 2.4 km (1.5 mi.). The project will involve impacts to Bracketts Creek and four of its tributaries in the Broad River Basin. The purpose of this letter is to request that the WRP provide confirmation that you are willing to accept payment for the compensatory mitigation requirements. The project is located in the Mountain Province of Rutherford County in the Broad River basin in Cataloguing Unit 03050105. Bracketts Creek (DWQ # 9-37-2) and its tributaries are classified as Class C waters and is not a designated trout stream. Bracketts Creek is a second order stream and considered a warm water fishery. We will need to mitigate 388.8 feet of stream impact at a ratio of 2:1 by using 777.6 feet of stream mitigation credit from the N.C. Wetland Restoration Program. Please send the letter of confirmation to Steve Lund at U.S. Army Corps of Engineers Asheville Regulatory Field Office, 151 Patton Avenue, Room 143, Asheville, North Carolina 28801-5006 as well as John Dorney at the Division of Water Quality.
