Dear Mr. Johnson:
The Washington Regional Office has reviewed your project at N.C. 33 and
Mumford Rd. to the Fairgrounds in Pitt County for the removal of riparian buffer
and a "no practical alternatives" determination has been granted. Your project as
proposed meets the three criteria for "no practical Alternatives" as described in
15A NCAC 213.0259 (8)(a). The project involves ditch clean out of approximately
3000 feet of a modified natural stream. The Division feels that this activity would
be covered under "periodic maintenance of modified natural streams" described in
the table of uses.
Be advised any deviation from the original request for a "no practical
alternatives" determination will be considered work outside the Authorization
Certificate and subject to an enforcement action. This authorization will expire
three (3) years from the date of issuance.

Dear Mr. Shaver,
The North Carolina Department Of Transportation requests a determination of "No
Practical Alternatives" and written authorization to proceed on a Blueline stream clean
out and buffer disturbance at N.C. 33 and Mumford Rd. to the Fairgrounds in Pitt Co.
The stream has been filling up with sediments to the point where the crossline at N.C. 33
is nearly blocked. This blockage and the large rainfall events from Hurricanes Dennis and
Floyd have been backing up flow at subdivisions upstream. The project proposes to clean
out approximately 3000 feet of stream. The enclosed sketch/plan indicates minimal
disturbance to the 50 foot buffer areas by removing sediment into a dump truck from the
open sides of the stream. No trees will need to be removed along these areas. Any ground
disturbance within the buffer will be reseeded and mulched. The following information is
enclosed for your review:
