Dear Sir: Please find attached the Type II(B) Categorical Exclusion for the referenced project. The North Carolina Department of Transportation (NCDOT) proposes to widen and rehabilitate Bridge Nos. 48 and 50 over the North Pacolet River and SR 1516, respectively. The new bridges will have 24-foot travelways with 40-foot clear roadways (widening to provide 8 feet of lateral clearance on each side). Bridge Nos. 48 and 50 carry Interstate 26 over the North Pacolet River and SR 1516, respectively, in Polk County. The existing right-of-way is 260 feet, which includes 24-foot travelways and 24-foot clear roadway widths over the bridges. During widening and rehabilitation, the only part of the existing structure that will be removed will be the bridge rail. It will be removed in such a way that no components of the railing will fall into Waters of the United States. Construction plans detailing the proposed causeway are depicted in the attached drawings. The North Pacolet River [DEM index number 9-55-1-(10), 3/1/1963] is the only jurisdictional surface water resource that will be impacted. It has a DEM best usage classification of C, waters suitable for aquatic life propagation and survival, fishing, wildlife, secondary recreation, and agriculture. Although Polk County is classified as supporting trout waters, the NC Wildlife Resources Commission has stated that the North Pacolet River is not a trout stream. In addition, no waters that are classified as High Quality Waters (HQW), Water Supplies (WS-1 or WS-H) nor Outstanding Resource Waters (ORW) occur within 1.6 km (1.0 mi) of the project study area. 01 A temporary work pad will be required for this project. Temporary impacts to the surface waters from the temporary causeway may total up to 0.13 acres. The temporary causeway will be constructed of clean rock and will be removed from the streambed to the greatest extent practical without extensive disturbance of the existing streambed after construction. Some residual may remain. Construction plans detailing the proposed causeway are depicted in the attached drawings. No wetlands will be impacted by the proposed construction. The project is being processed by the Federal Highway Administration as a "Categorical Exclusion" (CE) in accordance with 23 CFR 771.115(b). Therefore, we do not anticipate requesting an individual permit but propose to proceed under a Nationwide Permit in accordance with 61 Federal Register 65874, 65916, issued December 13, 1996 by the Corps of Engineers. The NCDOT is also requesting a Section 404 Nationwide Permit 33 (Temporary Construction Access and Dewatering) authorizing the construction of the causeway. The provisions of Section 330.4 and Appendix A (C) of these regulations will be followed in the construction of the project. We anticipate that 401 General Water Quality Certification No. 2734 (Categorical Exclusion) will apply to this project, and are providing one copy of the CE document to the North Carolina Department of Environment and Natural Resources, Division of Water Quality, for their review. The NCDOT will adhere to the general conditions of the 401 Water Quality Certification; therefore, written authorization from the NC Division of Water Quality is not required. 335. These types of land acquisition qualify for a CE only where the acquisition will not limit the evaluation of alternatives, including shifts in alignment for planned construction projects, which may be required in the NEPA process. A temporary causeway will be constructed to do the necessary pier work. Consequently, a Section 404 Nationwide 33 Permit from the U.S. Army Corps'of Engineers and a Section 401 Water Quality Certification from the N.C. Division of Water Quality will be required. 3 E. Habitat for the species exists in the project area in the form of north-facing slopes underneath the bridge. A survey for the plant was conducted in August 1999, and no plants were found to exist in the project area. 6. A temporary causeway will be required to do the necessary pier work. This will have an effect on the water quality of adjacent waters. The NCDOT Highway Design Branch will coordinate with the N.C. Wildlife Resource Commission (WRC) to insure that the causeway design and implementation meets with the WRC's approval. 8. Polk County is a designated trout county; however, the Pacolet River is not a Designated Public Mountain Trout Water in the project area. 6 G.
