Hunt, Jr., Governor Bill Holman, Secretary Kerr T. Stevens, Director won% 1100 NC ENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES September 1, 2000 Jackson County DWQ Project # 001123 APPROVAL of 401 Water Quality Certification Mr. C.R. Styles District Engineer, NCDOT Post Office Box 250 Bryson, NC 28713 Dear Mr. Styles: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 90 linear feet of streams for the purpose of renovating SR 1160 including extensions of existing pipes as described in your application dated August 18, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3290. This certification allows you to use Nationwide Permit Number 3 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh. N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-9646. HUNT JR. GOVERNOR Jackson County SR 1160 Mr. Steve Lund, NCDOT Coordinator U. S. Army Corps of Engineers Regulatory Branch 151 Patton Avenue, Room 143 Asheville, NC 28801-5006 Dear Mr. Lund: STOLSON SECRETARY 001123 The North Carolina Department of Transportation is proposing to grade, drain, base and pave primarily along the existing roadway of SR 1160, Little Pine Creek Road in Jackson County. In order to construct this project in accordance with our current secondary road standards, and due to the replacement and extension of one pipe culvert in Gem Creek (DEM Class WS-III) and four (4) pipe culverts in four unnamed tributaries of Little Pine Creek (DEM Class WS-III), we are requesting authorization under Section 404 of the Clean Water Act. I am sending a straight-line diagram with our proposed erosion control and construction limits at various sites along this project. In addition, a typical section of the road, drawings for the pipe replacement/extension in Gem Creek and in the unnamed tributaries of Little Pine Creek, general notes and standards on erosion control measures, and a marked County Map are enclosed. We propose to install the new culverts slightly below the existing stream bed elevation where bedrock is not encountered to minimize impact to Wildlife habitat and allow the existing stream gradient to remain as unchanged as physically possible. The best management practices will be used to minimize and control sedimentation and erosion on this project. The construction foreman will review all erosion control measures daily to ensure sedimentation and erosion controls are being effectively controlled. If the planned devices are not functioning as intended, they will immediately be replaced with better devices. The silt fences and other erosion control devices will be in place prior to pipe construction and will remain in place until the project is stabilized. Augustl8,2000 PAYMENT RECEIVED P.O. It is made of permeable filter fabric buried at the bottom, stretched and supported by steel posts. The silt fence reduces the water flowwhile retaining the sediment. They may also be used to divert water flow to protected outlets. Silt fences need to be checked after each significant rainfall to ensure there effectiveness. They must be maintained on a regular basis. Silt fences shall not be installed across streams, ditches, or waterways.
