Hollowell Bank Parcel Credit Release — Tasks 1,2 & 7
Dear Mr. McIntyre:
On April 8, 2019, the Division of Water Resources (DWR) approved a Bank Parcel Development
Package (BPDP) from Water & Land Solutions, LLC (WLS) for the above -referenced site under the
terms and conditions of the Hollowell Buffer Mitigation & Nutrient Offset Mitigation Banking
Instrument (MBI). On November 22, 2019, the DWR received a recorded conservation easement
and corresponding plat for the subject site. Additionally, WLS provided confirmation that the
conservation easement for the site has been successfully assigned to Unique Places to Save. Unique
Places to Save is a 501(c)(3) non-profit corporation and has been approved by DWR as a long-term
steward for this mitigation bank.
On May 18, 2020, DWR received documentation from WLS that the subject site had been
constructed in its entirety and monitoring plots had been installed. On June 10, 2020, Katie Merritt
with DWR, with assistance from Cara Conder with WLS, inspected the site and confirmed that all
the subject site had been completely planted, all monitoring plots were installed, sufficient
conservation easement placards had been installed along the entire easement boundary, and all
stream mitigation activities appeared to be completed. Riparian areas, including the stream banks,
were seeded and stabilized. On August 4, 2020, DWR received correspondence from the Army
Corps of Engineers that the stream restoration efforts were satisfactory.
Lastly, on July 20, 2020, DWR received a performance bond (#SUR2002426) in the amount of
$100,000 issued to WLS from Frankenmuth Mutual Insurance Company. The term of this bond
begins July 15, 2020 and ends with the approval of the Year 1 Monitoring Report by DWR.
In accordance with the MBI, signed on April 4, 2019, the following Project Milestones have been
met and the corresponding credits shall be released:

By copy of this correspondence, DWR confirms that you have satisfied the above requirements for
the above -referenced tract and 45% of your Nitrogen nutrient offset credits
(0.45 x 63,978.69 lb-N = 28,790.41 lb-N) are now available for sale. Additionally, 45% of your
Neuse buffer Restoration credits (0.45 x 216,188 ft2 = 97,284.60 ft2) and 45% of your Neuse buffer
Preservation credits (0.45 x 16,326 ft2 = 7,346.70 ft2) are now available for sale. Please note that the
Neuse buffer Restoration credits being released do not include areas adjacent to Coastal Headwater
Stream Mitigation. These credits will be released upon completion of Task 3 per the MBI.
Please note that nutrient offset credits generated at this site must be used for impacts in HUC
03020201 of the Neuse River Basin excluding the Falls Lake Watershed pursuant to 15A NCAC
02B .0703, which became effective on April 1, 2020. Additionally, the riparian buffer credits
must be used for impacts in the Neuse River Basin in accordance with guidelines in the
Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on
November 1, 2015.
Please use the Credit Ledger Templates provided on our website at:
http://portal.ncdenr.ora/web/wq/nutrientbuffertemplates to track and report credit availability for the
Hollowell Mitigation Bank. Upon receiving this correspondence, please submit three credit ledgers to
DWR reflecting the available credits released for each mitigation type (Buffer Restoration, Buffer
Preservation, Nitrogen Nutrient Offset).
