Bell, PWS NCDOT Coordinator 0 0 0 Dear Sir: SUBJECT: Department of the Army Permit Application for the Proposed Relocation of US 64 from SR 1138, South of Everetts, to US 13-17, North Side of Williamston; Martin County; TIP No. R-211213; Project No. 6.099002T, DWO Project No. 960214, USACE Action ID Number 199601404. The North Carolina Department of Transportation is proposing to relocate 8.9 miles of US 64 between Everetts and Williamston in Martin County (Figure 1). The department has broken the project into two sections (for funding and construction scheduling purposes), identified as R-2112BA (Everetts to US 17, south of Williamston) and R-2112BB (US 17, south of Williamston, to US 13-17, north side of Williamston). However, a single permit was issued for both sections. Please reference the Department of the Army Permit issued July 2, 1996 and the subsequent application for renewal made January 25, 2000. Since that time, the NCDOT has been informed by telephone that the referenced certification had expired and that a new application would be required in order to construct the BB section of R-2112. PAYMENT RECEIVED Additionally, the NCDOT has been notified that North Carolina Power will need to relocate several utility lines before construction can begin. No relocations will be conducted in jurisdictional areas. However, N. C. Power will need to clear a 30-foot right-of-way corridor through a small amount of jurisdictional wetlands. All trees will be hand cut using chain saws at or near 6" of the ground. No stumps will be removed. All wood and debris will be removed from the site. This work is detailed in the attached letter from N. C. Power. It is also depicted in the attached permit drawings. Additionally, a full size plan sheet is included for informational purposes. The Department has previously received authorization to impact 5.43 acres of 404 wetlands for the BB section. Mitigation for the 5.43 acres of riverine impacts has been provided by debiting 27.15 acres (5:1) from the Huskanaw Swamp Mitigation Site. However, mitigation requirements have changed since the original permit was issued. The NCDOT is now required to meet the 1:1 restoration requirement. Therefore, to provide 5.43 acres of restoration the NCDOT offers the following proposals: Debit 5.43 acres from Vann Swamp Mitgation Bank. The NCDOT is currently developing the prospectus for the MBI for this site located near Plymouth in the Roanoke Basin Coastal Plain. It is approximately 4500 acres with about 1500 acres of potential wetland restoration. The site has been purchased by the Nature Conservancy and will be managed by the WRC. The objective will be to restore the area from non- ??r:?#? -? pine plantation to a hardwood wetland community by removal of the extensive drainage system and replanting of appropriate tree species. Y Debit 5.43 acres from Riverbend Mitigation Site. The Riverbend site will provide approximately 60 acres of riverine restoration in the Piedmont Region of the Roanoke Basin. A hydrologic analysis is being conducted, to be followed by a mitigation plan. Debit 5.43 acres from the Grimesiand Mitigation site is located in the Tar-Pamlico Coastal Plain region near the Pitt and Beaufort County line. It will provide approximately 50 Lo acres of riverine restoration/creation and 300+ acres of preservation cypress-gum swamp on the Tar River. About 8 acres have been constructed with a mitigation plan available for the entire site. 1-3, dependent upon distance to closest stream system, or inputs from adjacent agricultural lands). 2. Water Quality Mitigation: Is wetland positioned in the landscape to intercept surface runoff from agricultural lands, highways or other development, and does it display suitable topography and vegetation to hold and trap particles and retain toxins ? (score, WQ 3-5, depending on positioning, shape and vegetation) Or, is wetland a flat expanse without opportunity to receive and without topographic relief to hold particles and toxins ? (score, WQ 1-3, depending upon the proximity to drainage ditches from farms, etc.) 3. Wildlife Corridor/Habitat: Is wetland part of a larger, unbroken, riparian corridor which provides opportunity for the movement of wildlife species ? (score, WH 3-5, depending on how much fragmentation exists and the composition of the canopy and understory) or, is wetland part of a non-riparian system? (score WH 1-3, depending on whether community is fragmented and to what extent) The Department of Transportation is planning to let this project to contract as soon as all necessary permits are received. Therefore, there is a sense of urgency in this request. Reacquiring the necessary permits is critical. By copy of this letter, application is also made to the North Carolina Division of Water Quality for a Section 401 Water Quality Certification. A check in the amount of $475.00 is attached to cover the processing fee. The NCDOT appreciates any assistance in this matter. If you have questions or concerns, please don't hesitate to call me. The NCDOT asks that careful consideration be given to each potential mitigation option. There are no other clear mitigation options. Furthermore, additional delays will deny the public the use of a facility that is still expected to be built on a reasonable schedule. The previous authorization also included the R-2112BA section. Impacts to wetlands in the R-2112BA section totaled 34.53 acres. All work has been completed in these areas and Section BA is now complete. Table 1 details impacts associated with R-21121313. Box 850 Edenton, NC 27932 Dear Mr. Riddick : Re: State Project 6.099010T (R-2112BB) North Carolina Power has been asked to relocate its facilities that are in conflict with the above mentioned State Highway Project. Part of the requested relocation involves areas designated as 'Wetlands". In those areas, North Carolina Power needs to know what if any requirements the US Army Corps of Engineers will place upon us. After discussing this project with Henry Wicker of the Corps office, he indicated all requests must be from the Department of Transportation. North Carolina Power can not begin any work on this project until we know what the Corp will require. I have attached copies of the NC DOT plan sheets for the areas that may impact "wetlands" and copies of North Carolina Power's construction sketches detailing our work in these areas. North Carolina Power will be removing its overhead facilities on sheets 9 and 12 and replacing them with underground. There will be two underground road crossings from existing poles . These crossings will be guide drilled. The underground cables installed in PVC conduit. North Carolina Power will also guide drill the underground cables from Station 25+00 to Station 31+00 and from Station 36+00 to Station 45+50. These guide drillings will be 45 feet to the left of the proposed centerline of the new US 64. The underground cables between the conduit runs will be direct buried using a backhoe. The minimum depths of the underground cables are shown on the attached construction sketches. No construction will take place in the areas designated as'Wetlands" on the NC DOT plan sheet 9. On NC DOT plan sheet 10, North Carolina Power will be installing overhead facilities to maintain service to the Martin Plaza Shopping Center and to Police Paris that will go through the areas designated on this sheet as 'Wetlands". No poles will be set in the designated "Wetlands" area but North Carolina Power will have to dear trees within a 30 foot right-cf-way corridor that is 15 feet each side of the centerline of the proposed powerlines. All trees will be hand cut using chainsaws at or near 6" of the ground. No stumps will be removed. All wood and debris will be removed from the site. North Carolina Power crews or its contractors will do all work. All trees will be hand cut using chain saws at or near 6" of the ground. No stumps will be removed. All wood and debris will be removed from the site. This work is detailed in the attached letter from N. C. Power. It is also depicted in the attached permit drawings. Additionally, a full size plan sheet is included for informational purposes. The Department has previously received authorization to impact 5.43 acres of 404 wetlands for the BB section. Mitigation for the 5.43 acres of riverine impacts has been provided by debiting 27.15 acres (5:1) from the Huskanaw Swamp Mitigation Site. However, mitigation requirements have changed since the original permit was issued. The NCDOT is now required to meet the 1:1 restoration requirement. Therefore, to provide 5.43 acres of restoration the NCDOT offers the following proposals: • Debit 5.43 acres from Vann Swamp Mitgation Bank. The NCDOT is currently developing the prospectus for the MBI for this site located near Plymouth in the Roanoke Basin Coastal Plain. It is approximately 4500 acres with about 1500 acres of potential wetland restoration. The site has been purchased by the Nature Conservancy and will be managed by the WRC. The objective will be to restore the area from pine plantation to a hardwood wetland community by removal of the extensive drainage system and replanting of appropriate tree species. • Debit 5.43 acres from Riverbend Mitigation Site. The Riverbend site will provide approximately 60 acres of fe??'? riverine restoration in the Piedmont Region of the Roanoke Basin. A hydrologic analysis is being conducted, to be followed by a mitigation plan. • Debit 5.43 acres from the Grimesland Mitigation site is located in the Tar-Pamlico Coastal Plain region near the Pitt and Beaufort County line. It will provide approximately 50 acres of riverine restoration/creation and 300+ acres of preservation cypress-gum swamp on the Tar River. It is approximately 4500 acres with about 1500 acres of potential wetland restoration. The site has been purchased by the Nature Conservancy and will be managed by the WRC. The objective will be to restore the area from pine plantation to a hardwood wetland community by removal of the extensive drainage system and replanting of appropriate tree species. Debit 5.43 acres from Riverbend Mitigation Site. The Riverbend site will provide approximately 60 acres of riverine restoration in the Piedmont Region of the Roanoke Basin. A hydrologic analysis is being conducted, to be followed by a mitigation plan. Debit 5.43 acres from the Grimesland Mitigation site is located in the Tar-Pamlico Coastal Plain region near the Pitt and Beaufort County line. It will provide approximately 50 acres of riverine restoration/creation and 300+ acres of preservation cypress-gum swamp on the Tar River. About 8 acres have been constructed with a mitigation plan available for the entire site. • Purchase credits from WRP for770.0 feet of stream impact and 5.43 acres of wetland impact. The NCDOT asks that careful consideration be given to each potential mitigation option. There are no other clear mitigation options. The following description of the work is taken from data provided by the applicant and from observations made during a site visit by a representative of the Corps of Engineers. Plans submitted with the application show that the NCDOT proposes to relocate 2.4 miles of US Highway 64 and construct a four-lane divided freeway from US 17, south of Williamston, to US 13-17, on the north side of Williamston, between Everetts and Williamston. Adverse impacts to these wetlands located in the Roanoke River Basin result from mechanized landclearing and the discharge of fill material into 5.43 acres of riverine, palustrine, broad-leaved deciduous wetlands and 770 linear feet of perennial stream channel. These wetlands are adjacent to unnamed tributaries of Sweetwater Creek. The median width for the highway will generally be 60 feet, except through certain wetland crossings where the median width will be reduced to 46 feet in order to minimize jurisdictional impacts to surface waters and adjacent wetlands. NCDOT debited 27.15 acres of riverine bottomland hardwood wetlands (5:1 preservation ratio) from Huskanaw Swamp Mitigation site when the project was initially authorized on July 2, 1996. In order to compensate for the unavoidable impacts to jurisdictional wetlands described in this Public Notice, NCDOT has proposed two options. The first involves debiting 5.43 acres from the Grimesland Mitigation site located in the Tar-Pamlico Coastal Plain region near the Pitt and Beaufort county line and submit payment to the Wetland Restoration Program (WRP) for the 770 linear feet of stream channel impacts. The Grimesland Mitigation site will provide approximately 50 acres of riverine restoration/creation and 300+ acres of preservation cypress- gum swamp on the Tar River. About 8 acres have been constructed with a mitigation plan available for the entire site. The decision whether to issue this permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the L' 4 national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. Immediately west of the subject projects, improvements to US 64 from Tarboro to Everetts (R-2111 and R- 2112A) were previously permitted (Permit # 199400662) and are under construction. Purpose and Need In 1989, the North Carolina General Assembly passed House Bill 399, establishing the North Carolina Highway Trust Fund. A portion of the funding allocated through the Highway Trust Fund was designated for the establishment of an Intrastate Highway System in North Carolina. Noting the importance of US 64 to regional travel, commerce and overall economic development of northeastern North Carolina, the General Assembly mandated that US 64 be included in the intrastate highway system, and that the corridor be upgraded to a four-lane facility from Raleigh to the coast. The General Assembly further specified that the new US 64 facility must be constructed as a freeway with control of access between 1-95 and US 17 (DEIS, Sections S.1 and 1.0). Furthermore, the project will fulfill the need identified in the thoroughfare plans of both Robersonville (1984) and Williamston (1976) for a major east-west thoroughfare outside of their respective city limits. Projected Level of Service (LOS) for most of the existing US 64 roadway for the year 2010 is E or F (FEIS, Section 1.6.3): Page 2 February 29, 1996 Mr. Smith NEPA Documentation. An EIS study was initiated by the department in July 1988 for the proposed improvements to US 64 from SR 1302, west of Robersonville, to US 13-17 on the north side of Williamston, a distance of approximately 17 miles. The project was designated as R-2112. The DEIS was circulated for review on February 7, 1990 and the FEIS was completed on April 30, 1992. The Record of Decision was approved October 30, 1992. Alternatives Analysis Preliminary Alternatives: The original study area (R-2112) was defined as approximately 3+ miles wide by 16+ miles long from west of Robersonville to Williamston (Figure 2). The DEIS for R-2112 identified five major preliminary build alternatives (with numerous cross-over connectors) distributed north and south of existing US 64 within this study area (Figure 3). Several non-construction Alternatives, including the No-Build, the Transportation System Management Alternative, and a Multi-Modal concept were also studied. Neither the Widen Existing, nor the non-construction alternatives were found to be reasonable or feasible. No-Build: While the No-Build concept would result in the least damage to the environment, it could not accomplish the mandated objective of providing a multilane freeway (full control of access) facility. It was found that under the No- Build scenario, Level of Service (LOS) would consistently decline until, by year 2010, nearly all segments of existing US 64 would experience LOS of E or F. Since the stated purpose and need of the project is the establishment of a multilane intrastate highway for improved traffic capacity and increased economic potential for northeastern North Carolina, this alternative was eliminated from further study (DEIS, Section 2.1). Transportation System Management (TSM): This alternative evaluated low-cost attempts to maximize the efficiency of the existing highway by examining the potential for upgrading intersections, improved signalization and upgrading of parallel and/or circumferential routes. It was determined that the lack of existing potential circumferential routes precluded further consideration of a TSM remedy (DEIS, Section 2.2). • Multi-Modal Alternatives: Transportation concepts such as ride-sharing, satellite parking, high occupancy vehicle lanes on existing roads and mass transit were addressed, but since the proposed project is highly rural and such concepts have been found to be effective only in urbanized areas with populations over 200,000, this alternative was dismissed early in the DEIS study (DEIS, Sect!cn 2.3). Page 3 February 29, 1996 Mr. Smith Widen Existing: The widen existing alternative would result in large numbers of relocated residences and businesses (100 and 20, respectively). In addition, parking lots, a park, one cemetery and at least one historic structure would be impacted by attempts to upgrade the existing roadway to a freeway design. In order to maintain ingress and egress for homes and businesses along the freeway, lengthy servile roads paralleling the existing facility would result in large disruptions to communities and the environment. Widening of the existing facility to freeway standards, even including bypasses of Everetts and Williamston would result in additional impacts to the environment and would be highly expensive. (FEIS, Section 2.4.1). 2. Reasonable and Feasible Alternatives: The five preliminary study corridors, when paired with study connectors, resulted in a total of 46 preliminary study routes. Public hearings, steering committee guidance and further engineering study resulted id narrowing these preliminary corridors to four major reasonable and feasible alternatives with three connectors, which provide for variations to two of the four basic corridors (Figure 4). The reasonable and feasible alternatives include Northern (Segments A-A1), Middle (Segments B-B1-A1), Southern (Segments C-B3-C1) and Composite (Segments B-B2-B3-B4). Specific details on how these corridors were chosen for further study, and why other corridors were rejected, can be found on pages 2-1 to 2-31 in the DEIS and Section 2 of the FEIS. Recommended Alternative: Corridor Segments A-A3-B-B2-B3-C1-C2 were selected as the preferred corridor for project R-2112 (Figure 5). Since R-2112A has been permitted and is under construction, it is essential for the purposes of this application to focus on the corridor segments from south of Everetts (east terminus of R-21 12A) to US 13-17 in Williamston that would be feasible given the constraints imposed by the permitted alignment of R-2112A. The recommended alternative passes south of Everetts (B) and parallels existing US 64 to SR 1140, where the corridor turns southward (132). South of SR 1126 the corridor turns eastward (133) until it crosses US 17 where it turns northeastvrard (C1/C2), crossing US 64 enroute to the project terminus at US 13-17. The reasons for selecting the preferred over the other reasonable and feasible alternatives relate to: compatibility with purpose and need, connectivity with R-2111 (and R-2112A), local preferences related to improved access to the Martin County Municipal Airport, residential and business relocations, wetlands and projected accident rates and noise (See Table 1 for raw comparison). Specifics for these comparisons are presented in FEIS, Section 2.62. Preliminary Design During the development of a preliminary design, the roadway design team used available knowledge, including EIS data to locate an alignment which would result in the least damage to the human and/or natural environment, with particular emphasis on avoiding and minimizing wetland impacts. This alignment was staked in the field and wetland delineations were subsequently performed by NCDOT biologist, M. Randall Turner during the hydraulic design phase of work. These delineations were confirmed by the Corps of Engineers (Mr. Mike Bell) on November 13, 1995. The alignment essentially requires +/- 250 ft of right of way and provides for four lanes of traffic divided by a grassed median which is 60 ft wide, except through wetland continuums where a 46 ft median is specified. Three grade-separated interchanges are planned at SR 1138, south of Everetts; US 17, south of Williamston; and US 64, east of Williamston. Impacts To Waters of the U.S. Impacts to wetlands will occur at 20 sites and surface water impacts will,occur at an additional 13 sites. Impacts to wetlands will result from footprint fills, and as a result of grading in cut sections (wetland sites 7 and 14) and installation of drainage ditches (wetland sites 2, 3, 7 and 14). The estimated collateral impacts to adjacent wetlands from the grading and/or installation of drainage ditches has been calculated. The calculated perimeter of the zone of influence, which is dependent to a large extent upon soil conductivity (permeability) and depth of proposed ditch, was used to estimate an areal quantity to record as a presumptive impact. Rains soils are mapped at all four sites. A site-by-site inventory of wetlands to be impacted by the project, including community type and relative quality is provided in Table 2. February 29, 1996 Mr. Smith Quality Index: Each wetland was evaluated and was given a composite score based upon its opportunity to-perform each of the functional attributes and its presumed effectiveness (based upon field and map assessments) in fulfilling each attribute. Functional attributes selected are those which are widely viewed as the most important among resource agencies (flood storage, water quality and wildlife habitat). 1. Flood Storage: Is wetland part of a larger system which is positioned in the landscape to receive surface flows from the adjoining landscape or from overbank flooding of adjacent streams and is wetland characterized by topographic depression ? (score, FS 3-5, dependent upon size, positioning and topography of site) Or is wetland located in an interstream flat, dependent upon ground water (and rainfall) sources of hydrology ? (score, FS 1-3, dependent upon distance to closest stream system, or inputs from adjacent agricultural lands). 2. Water Quality Mitigation: Is wetland positioned in the landscape to intercept surface runoff from agricultural lands, highways or other development, and does it display suitable topography and vegetation to hold and trap particles and retain toxins ? (score, WQ 3-5, depending on positioning, shape and vegetation) Or, is wetland a flat expanse without opportunity to receive and without topographic relief to hold particles and toxins ? (score, WQ 1-3, depending upon the proximity to drainage ditches from farms, etc.) 3. Wildlife Corridor/Habitat: Is wetland part of a larger, unbroken, riparian corridor which provides opportunity for the movement of wildlife species ? (score, WH 3-5, depending on how much fragmentation exists and the composition of the canopy and understory) Or, is wetland part of a non-riparian system ? (score WH 1-3, depending on whether community is fragmented and to what extent) Effect of Grading/Excavation on Wetlands: As indicated, four wetland sites will be impacted by grading and/or excavation. The zone of influence by the grading and/or excavation to adjacent wetlands through draining has been calculated by local soil specialists with the US Natural Resource Conservation Service to be approximately 75' laterally from any point of the ditch. This estimation has been confirmed independently by a hydrogeologist with ESI, Inc, utilizing best judgment approximation. Therefore, the results provided in Table 2 reflect the following impacts to wetlands from earth fill and from draining due to excavation: Wetland Site Impact by Fill Impact by Draining* Toth Impact 2 1.85 0.52 3 0.55 0.22 0.77 7 8.29 1.21 9.50 14 6.64 0.59 7.23 ' Note: * Value based upon length of exc avation (or grading) multi plied by 75 Page 7 February 29, 1996 Mr. Smith Mitigation Based upon the Memorandum of Agreement between the Department of the Army and the U.S. Environmental Protection Agency, which was executed on February 6, 1990, a process of verification and accountability for impacts to wetlands has been put in place. Essentially, the process demands that a proposal must be able to demonstrate that all reasonable steps have been taken to avoid impacts to wetlands (and waters) to the maximum extent practicable, and, where prospective impacts have been demonstrated to be unavoidable, evidence that all reasonable steps have been taken to minimize impacts to these wetlands (and waters) must be demonstrated; and, where applicable, compensation for the unavoidable loss of wetlands is required. Avoidance: Given that approximately 50 % of the land within Martin County is mapped as hydric soil and the preponderance of natural stream drainages that blanket the landscape, it is unrealistic to expect that a 9-mile section of highway can be built on new location without impacting wetlands and jurisdictional waters. In point of fact, one of the early tasks undertaken by the environmental planners was to map likely wetland areas and to attempt to establish study corridors which would avoid, if possible, such areas. Of the corridors selected as reasonable and feasible, the recommended alternative was estimated to impact the second lowest amount of wetlands (among several alternatives, including composite alternatives). The alternative with the least estimated wetland impacts is.expected to have the highest number of relocations and the highest projected annual accident rate. In summary, if the project is to be built, impacts to wetlands and waters are unavoidable. Minimization: In part, selection of the preferred corridor minimizes wetland impacts when compared to several other practicable alternatives. Furthermore, attempts to minimize impacts to unavoidable wetlands have been undertaken during the preliminary design. Evidence of this effort was demonstrated during field review of the alignment by state and federal agencies on November 13, 1995 and January 10, 1996. During this field review numerous questions were asked of the NCDOT by agency staff concerning potential minimization efforts. These questions and issues were subsequently addressed in a letter dated January 19, 1996 and is included as an attachment. Fill sections in all wetland areas have been steepened to 2:1 slopes. Median sections have been reduced in all wetland areas from 60 ft to 46 ft. Where possible, perpendicular, or near-perpendicular crossings of stream channels have been the rule, rather than the exception. Compensation: In spite of all efforts to avoid and minimize impacts to wetlands and waters, a total of 40.01 acres of wetlands and 1.00 acre of surface waters will be impacted by the proposed relocation of US 64 from Everetts to Williamston. Wetland impacts include 17.59 acres of forested riverine wetlands and 22.42 acres of forested non-riverine wetlands. The major portion of the project (Sites 8-33) lies Page 8 February 29, 1996 Mr. Smith in the Roanoke River Basin, but a small section near Everetts (Sites 1-7) is located in the Tar-Pamlico River Basin. The community breakdown, by River Basin, reveals that 6.70 acres of riverine and 14.24 acres of non-riverine wetland impacts occur in the Tar-Pamlico River Basin, while 10.89 acres of riverine and 8.18 acres of non- riverine wetland impacts occur in the Roanoke River Basin. The department acknowledges its responsibility to provide suitable compensatory mitigation and therefore makes the following mitigation proposal. The impacted wetlands which lie in the Tar-Pamlico River Basin (Sites 1-7) are to be debited from the Mildred Woods Mitigation site. Construction of the Mildred Woods Mitigation Site, including planting, has been completed. Monitoring wells were installed in February 1996. Monitoring will have been underway 4-5 months prior to initiation of construction on R-2112BA (contractor availability: July-August 1996), and +/- 3 years prior to initiation of construction on R-2112BB. According to a November 15, 1995 letter from the U.S. Army Corps of Engineers, 115 credit acres are available at the Mildred Woods Mitigation Site. The department therefore proposes that 21 acres of riverine (6.70 acres) and non-riverine (14.24 acres) be debited from the creditable balance of 115 acres. This debit will leave a balance of 94 credit acres at the Mildred Woods site for future project debits. 2. The impacted wetlands which lie in the Roanoke River Basin (Sites 8-33) are to be debited from the Company Swamp Mitigation Bank. This batik was established as a cooperative effort among several state, federal and private conservation agencies, including the N.C. Wildlife Resources Commission, the North Carolina Department of Transportation, the (U.S.) Fish and Wildlife Service, and the Nature Conservancy. The department therefore proposes that 19.07 acres, including riverine (10.89 acres) and non-riverine (8.18 acres), of wetland impacts be debited from the Company Swamp Mitigation Bank using a ratio of 5:1. It should be noted that MCCrain (Journal of Environmental Management, 1991, 35:153), using HEP analysis to evaluate numerous wetlands to be impacted by the NCDOT, concluded that a ratio of 3.4:1 was a defensible replacement ratio when applied to the Company Swamp Mitigation Bank. Some of the proposed debits (8.18 acres) are out-of-kind* (non-riverine); however, it is important to point out that the wetland . systems at the Company Swamp Mitigation Bank are of a higher functional value than the small non-riverine flatwoods for which mitigation credits are proposed. The 5:1 ratio would result in an overall proposed debit of 95.35 acres (equivalent to 4,567.27 habitat units). This debit, if approved, would result in a balance of 778.03 acres (equivalent to 37,267.64 habitat units) at the Company Swamp Mitigation *ARhough, out-of-kind mitigation at the Company Swamp Mitigation Bank was not seen as the most desirable apprcation of mitigation credits, it is not expressly prohibited. In fact, the Memorandum of Understanding explicitly permits the application of out-of-kind credits if all signatory agencies agree beforehand. An informal poll of each of the three MOU principles, conducted on February 23, 1996 revealed that none objected to the out-of-kind mitigation proposal. Those contacted included Ms. Katherine Doak (Fish and Wildlife Service), Mr. David Cox (Wildlife Resources Commission) and Ms. Este Stiefel (Nature Conservancy). Attendees were given an oppcnunlty to inspect the proposed alignment and sites of anticipated impacts to wetlands and surface waters. During this inspection a number of relevant queries vrere made by one or more agency staff, including Mr. Cavid Cox (Wildlife Resources Commission), Mr. Eric Galamb (Division of Environmental Management) and Mr. Mike Bell (Corps of Engineers). A letter, which summarized and listed the concerns expressed by the representative state and federal agencies, was circulated among the attendees of the field inspection on December 8, 1995. The contents of this letter were reported and discussed at an interagency (permit) meeting, which was held in Raleigh on December 14, 1995. In addition to Messrs. Cox, Galamb and Beil, the Raleigh meeting was attenoeo oy representatives from the r=isn and Wildlife Service and the Division of Coastal Management. During the discussion at the December 14 meeting, one additional agency concern was raised. 0 Page 2 January 31, 1996 Mr. Bell The purpose of this letter is to provide responses to each of the five substantive concerns raised by state and federal agencies during the field review and during the subsequent discussion at the December 14 permit meeting. Each issue and the NCDOT response is presented below. • Question (1): Why can't the alignment be shitted to (adjacent to) the utility corridor which lies immediately south of existing US-64 (between presect's western termin '.:s and Meadow Road-SR 1140) ? [The underlying premise to this question is that a disturbed utility corridor may exhibit less wetlands/waters than are part of forested (relatively undisturbed) wetland continuums.] Response: The North Carolina Department of Transportation initiated an EIS study for R-2112 in 1987; the DEIS was circulated for review on February 7, 1990, the FEIS on April 30, 1992. The Record of Decision was completed on October 30, 1992. A Preferred Alternative was selected and a preliminary design was created within the preferred corridor. This fact notwithstanding, shifting the alignment northward to a position adjacent to the existing powerline corridor,,-vould result in moving the alignment well outside any of the EiS study corridors. However, to adequately address the concerns of the agencies, an analysis of potential wetland impacts was undertaken for the area adjacent to the utility corridor (between a point approximately 3;000 feet west of SR 1138 and Meadows Road-SR 1140). Figure 1 contrasts the alignment selected within the EIS-Preferred Corridor (SPCA) with an hypothetical alignment adjacent to the utility corridor (UCA), which lies immediately south of existing US 64. Note that all floodplains to elevation 20 ft (above mean sea level) have been highlighted to contrast each alignment's potential impacts to Waters of the U.S. Sites identified and delineated by the NCDOT (and verified by the Corps of Engineers) are depicted for the SPCA. Although no delineation of wetland sites along the UCA were conducted, a field visit revealed that large wetland systems are !coated along the north- and south-sides of the UCA. This was predicted based upon the large floodplain encroachment (approximately 10,000 linear feet vs. approximately 8;000 linear feet for the EPCA). Furthermore, note that the UCA undergoes parallel encroachment through the Collie Swamp floodplain (south of Everetts), requiring multiple channel crossings either north n- a?., aL. aiCL n? Finally, Figure 1 also reveals that the UCA crosses the largest expanse of the Beaverdam Creek floodplains in an area where the floodplains of two major tributaries overlap, while the EPCA crosses much narrower and separate floodpains of the same two tributaries. Based upon an analysis of both alignments, including a cursory field examination of the UCA, there is little question that the EPCA minimizes impacts to Waters of the U.S., when compared with the UCA. • Question (2): Why can't the aiignment be shined to (aajacent to) the utility corridor which lies immediately south of existing US-64 (between project's western terminus Page 3 January 31, 1996 Mr. Bell . and Meadow Rcad-SR 1140) ? [The underlying premise to this question is that construction of a highway adjacent to a disturbed utility corridor (a previous fragmentation) would result in wildlife habitat reduction, but not fragmentation.] Note: This question was raised at the November 14 Raleigh meeting. Response: Development in an "undisturbed" habitat continuum, which results in segregating portions of natural communities on either side of the development is routinely considered to be habitat "fragmentation", while development along the boundaries of a previous fragmentation may be construed to be habitat reduction. However, the development which resulted in separating habitat parcels in this instance is a powerline corridor, not a structural entity like a shopping strip mail, or a highway. i ne major difference is that the powerline corridor serves as a valuable and ecologically relevant ecotone, in which foraging, nesting and migratory practices are carried out by a very diverse assemblage of species. This area is neither an ecologically sterile environment, nor is it a barrier to the movement of wildlife. The NC-COT does not concur that its alternative would result in fragmentation to habitats that could be avoided by re!ccoting the alignment to (adjacent to) the utility corridor. !n fact, it would ;e reasonable to consider the herbaceous and scrub-shrub dominated poweriine corridor to be a functional ecotone within a larger ecological continuum. • Question (3):Why is a ditch proposed at wetland site 97 (Stations 620+50 to 528+50)? Response: Due to low-lying contours in this area. there is no other practicable wav to drain the subgrade of the roadbed except by creating a drainage ditch. Elevation of the roadbed would result In excessive costs and would further result in increased wetiand losses to adjacent wetlands due to enlargement of the footprint. Question (4): Why is a service road proposed in the vicinity of wetland sites #10 and 11 ? According to the CCE, this service road must be shifted to an upland landscape. Response. The prepcsea service maa pmvices access to four parcels which are being landlocked by the new roadway. The proposed service road extends an existing service road and lies adjacent to the proposed highway relocation. An examination of the landscape in the vicinity of the proposed service road alignment confirms that any northward shift of the service road alignment must cross wetlands and surface waters, because the stream system encircles the forested area through which the service road must pass. A southward shift of the service road cannot be accomplished without crossing over or under the new highway alignment. An examination of the wetland boundaries at wetland site # 11 reveals that the wetland expands to the east and west as you move north of the project area. There are no realistic alternatives to the existing service road alignment, which would minimize impacts to wetlands and/or waters. Page 4 January 31, 1996 Mr. Bell • Issue (5): The proposed crossing of Dog Branch (wetland site # 23) should be bridged; wetland. at this site is a high quality bottomland system. Response: A comparison of the costs to construct a spanning structure across wetland site # 23 vs. a reinforced concrete box culvert, as proposed, reveals that a typical spanning. structure would add approximately +/- S 2.0 million to the cost of the culvert crossing. The estimated cost differential accounts for the cost of the culvert and the associated fill work. Two parallel bridges approximately 550 feet long would be required. Approximately 2.5 acres of wetlar:d would be filled by the proposed box culvert, while only approximately 0.3 acre would be filled/impacted by the spanning structure, resulting in an avoidance cost of +/- S 0.9 million per wetland acre. The additional cost of S 2.0 million represents approximately 8.2 % of the total estimated construction costs of the project (S 24.5 million). The NCDOT concludes that the extraordinary costs do not constitute a practicable avoidance and/or minimization expenditure. R-2112BB An interagency fie!d review of the subject project was conducted on January 10. 1996 Attendees were given an opportunity to inspect the proposed alignment and sites of anticipated impacts to wetlands and surface waters. During this inspection relevant queries were made by review agency staff, including Mr. David Cox (Wildlife Resources Commission) and Mr. Eric Galamb (Division of Environmental Management). The purpose of this letter is to provide responses to each of the substantive concerns raised by state and federal agencies during the field review and during any subsequent discussions with NCDOT staff. Each question/issue and the NCDOT response is presented below. • Question (1): Why can't alignment be shifted to the west (at the southern end of the project) in order to avoid fragmenting the forested area at Station 796+00 ? Response, Augnment is mating a tignt shift to the north-northeast on the east side of US-17 from an almost due eastward alignment west of US-17. It would be impossible to tighten this radius further in order to miss the wooded tract at Station 796+00. (A shin to the east of the forested tract would simply result in fragmentation of a larger forested tract and would potentially involve additional wetland impacts. • Question (2): Can NCDOT provide some form of energy dissipation at the interface between the proposed drainage ditch (Station 831+50 to 835+00) and the adjacent wetland (Station 835+00) ? Page 5 January 31, 1996 Mr. Bell Response: Yes. The NCDOT will install rip-rap to insure that storm water flows do not erode soils in the vicinity of the wetland. • Question (3): Can't the proposed fly-over ramp (Ramp 3A) from existing westbound US-64 to the new alignment be shifted to avoid impacting the small bottomland wetland site at Station (+/-) 4+00 ? Response: As can be observed in the field, this bottomland system parallels existing US-64 for a considerable distance and is interrupted by uplands at only one site. It was this site that Ramp 3A crosses as its alignment diverges from existing US-64. Unfortunately, only a tighter radius has any chance of missing the bottomland pocket. The radius must be held at the existing design parameter in order to affect a safe divergence pattern from one principal travelway to another at safe design speeds. Question (4): Can the NCDOT insure that isolated pockets of woody vegetation on the interior of interchange ramps will be left undisturbed during construction, and will not be subjected to vegetation management in the future ? Response: Zones of woody vegetation (forest fragments) which lie outside the construction limits and/or drainage easements of the project will be left in-tact. The only vegetation management which will occur in these areas will be dictated by safety concerns as the vegetation matures. If vegetation does not impede sight distance and does not pose as a safety hazard to the traveling public, no further action is required by the NCDOT.
