Stormwater Permit No. SW3200702
316 South Main Street Townhomes
Rowan County
Dear Mr. Carter:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Application for the subject project on July 20, 2020. A review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
1. In Part III.4 of the SWU-101 application, please add the information for the local
jurisdiction for building permits.
2. Documentation from the NC Secretary of State or other official documentation showing
the title and position held by the person who signed the application is required [I 5A
NCAC 02H .1042(2)(b)(ii)]. Because the individual who signed the application is not
listed on the Secretary of State's website, other documentation is required to show that
they have the authority to apply for the permit on behalf of the LLC. This can be in the
form of a letter signed by the registered agent or other official documentation from the
LLC.
3. Please upload the following electronic documents:
a. Supporting calculations showing that the sand filter is designed to meet the MDC
[15A NCAC 02H .1042(2)(f)].
b. A soils report showing that the separation between the bottom of the sand filter
and the seasonal high water table is at least one foot [15A NCAC 02H .1056(1)].
c. A copy of the signed and notarized operation and maintenance agreement [15A
NCAC 02H .10420)].
d. A copy of the signed and notarized deed restriction form [15A NCAC
02H .1042(k)].
e. A copy of the property deed.

4. Please complete the sand filter summary page of the Supplement EZ form.
5. The Supplement EZ form states that the vegetated setback is 15 feet. The required
vegetated setback from all water bodies is a minimum of 30 feet [I 5A NCAC
02H .1017(10)].
6. The Supplement EZ form lists the calculation method as HydroCAD. The calculation
method should be either the NRCS method or the Simple Method as required by Part B of
the Stormwater Design Manual.
7. The stormwater narrative does not address the stormwater requirements, calculation
methodology, or stormwater treatment design. Please revise the narrative to provide
information regarding the stormwater management design.
8. Please delineate all onsite wetlands or add a note to the plans stating that none exist on
site [15A NCAC 02H .1042(g)(iii)].
9. The maintenance access and stormwater easement must extend to the nearest public right
of way [ 15A NCAC 02H .1050(8) & (9)]. Please revise the maintenance access and
easement to meet this requirement.
10. The sand filter detail should specify that the sand media shall meet ASTM C33 or the
equivalent [15A NCAC 02H .1056(6)].
11. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other
documents. Pdfs must be uploaded using the form at:
https:Hedocs.deq.nc.gov/Forms/SW_Project Submittal
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to September 3, 2020, or
the application will be returned as incomplete. The return of a project will necessitate
resubmittal of all required items, including the application fee. Please reference the State
assigned project number SW3200702 on all correspondence.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
