Dear Ms. Allden:
This correspondence is in reference to the Cripple Creek Stream and Wetland Mitigation
Bank you are developing located east of Roney-Lineberry Road, north of Woodbrooke Drive,
south of Deep Creek Church Road and west of North Fonville Road, in northeast Alamance
County, North Carolina, within the Cape Fear River Basin, Hydrologic Unit Code (HUC)
03030002. The purpose of this letter is to confirm the initial release of credits from this Bank.
Pursuant to the Mitigation Banking Instrument (MBI) entitled, Cripple Creek Stream and
Wetland Mitigation Bank, dated December 1, 2009, fifteen percent (15%) of the Bank's total
restoration credits shall be available for sale immediately upon completion of all of the
following:

a. Execution of the MBI by the Sponsor, the Corps, and other agencies eligible for
membership in the IRT who chose to execute the agreement;
b. Approval of the final mitigation plan;
c. Delivery of the financial assurance described in paragraph 22 of the MBI;
d. Recordation of the preservation mechanism described in paragraph 21 of the MBI, as
well as a title opinion covering the property acceptable to the Corps;
By copy of this correspondence, we confirm that you have satisfied the above
requirements and 677.7 linear feet of stream credits, 0.96 riparian wetland credits and 0.2175
non-riparian wetland credits constituting 15% of the Bank's total restoration credits are now
available for sale. Please be reminded that you must also complete the initial physical and

biological improvements to the bank site pursuant to the mitigation plan no later than the first
full growing season following initial debiting of the Bank.
Additionally, for your records, we have included a copy of signatures for all parties that
have executed the agreement to establish the Cripple Creek Stream and Wetland Mitigation Bank
in Alamance County, North Carolina.
