Officer Post Office Box 1587 Greenville, NC 27835 Dear Mr. Johnson: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.09 acres of wetlands for the purpose of improving SR 1235 (Pelletier Road), as you described in your application dated August 15, 2000. 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3106. This certification allows you to use Nationwide Permit Number 18 when the Corps of Engineers issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Stormwater shall be directed to flow at non-erosive velocities across the entire protected stream buffers. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. SR 1306 Greene County is on the NCDOT 1999-2000 (SRIP) Secondary Road Improvement Program. Work commenced on this project somewhere around the time I started my position (August 99) as NCDOT Division 2 Environmental Officer. Prior to Environmental Officers conducting Environmental Reviews on all the Secondary Roads each District Engineer was responsible for completing a (MCS) Minimum Criteria Sheet for every Secondary Road that was to be widened and paved in their counties. Having just assumed this task I began working with this Environmental Review process by early September and was able to conduct only a few reviews in my eastern counties before being confronted by Hurricanes Dennis, Floyd and Irene. This was a major setback for the Secondary Road Improvement Program in having to put everything on hold and concentrate all of my efforts with emergency road repairs until early spring 2000. By the later part of March I was conducting Environmental Reviews and completing (MCS) Minimum Criteria Sheets for Secondary Roads. On March 31, 2000 while conducting environmental reviews for Greene County I noted the violations found on SR 1306 with photographs and subsequent memo to Mr. Neil Lassiter (enclosed). From what information I could gather it had been a best management practice in this district to contain stormwater from entering wetlands by creating a "false ditch" (See Photos) and channeling the runoff through a checkdam prior to entering a stream. I reported the violation that day to Mr. Mike Bell (USACE NCDOT Project Coordinator) leaving a message with his voicemail. I also made contact with Ms. Mary Gardner (USACE Regulatory Program Assitant) to relay my message to Mr. Bell. I coordinated with Mr. Brad Shaver (N.C. Division of Water Quality -Washington Office) and scheduled an onsite visit for April 18, 2000. (Refer to April 18, 2000 Notice of Violation Letter) Mr. Division Two • P.O. Box 1587 9 Greenville, N.C. 27835 Shaver and I discussed an acceptable plan to abate the violation (Refer to May 9 letter to Mr. Mulligan) and work began immediately to: Survey 404 Wetlands / Impacts for a permit drawing and Pre-construction Notification, Stop runoff directly into Contentnea Creek by resloping the "false ditch" and, Creating sediment basins on the upland areas prior to sheetflow over vegetated uplands into wetlands. Restoration work was completed and stabilized by June 2000. Consequently, Environmental Training sessions were conducted throughout Division 2 encompassing Division Environmental Officer coordination/communication, Air, Land, and Water Quality permits/compliance, Wetlands, Buffer Rules and, Best Management Practices. The final details were added to the permit application and drawing and were received by your office on July 12, 2000. Ms. Karoly responded with a request for information on July 18, 2000 and forwarded the application to you. Please find enclosed the new site plan of the site and, the accompanying correspondence from my files. The project ends at the Contentnea Creek Bridge. The pavement will stop at the bridge. No bridgework will be conducted in conjunction with paving of SR 1306. In reference to the Neuse Buffer Rules all work is confined under 40 feet of linear stream impacts. If I have interpreted this correctly this is an allowable activity with notification and a determination of "No Practical Alternatives". With the restoration work complete the road is ready to be paved pending permit approvals from the U.S. Army Corps of Engineers and the N.C. Division of Water Quality. During the inspection, Mr. Shaver documented unauthorized Wetland and Neuse River Basin Buffer impacts. First, the inspector noted that approximately 0.10 acres of wetlands have been filled for secondary road improvements. Furthermore, new drainage ditches and temporary sedimentation control measures were installed within Zone 1 and Zone 2 of the Neuse River Basin Buffer Area. These activities require a 401 Water Quality Certification as well as an Authorization Certificate from the North Carolina Division of Water Quality (DWQ) in accordance with 15A NCAC 2H .0500 and 15A NCAC 2H.0233. However, authorization for these impacts has not been issued by the Division. This Office requires that the violations, as detailed above, be abated immediately. These violations and any further violations are subject to civil penalty assessments of up to S 10,000 per day for every day violations continue. This Office requests that you respond in writing within 15 days of receipt of this Notice. Your written response should detail why these unauthorized impacts occurred and what restoration measures you plan to implement to bring this project into compliance. If you plan on applying for a 401 Water Quality Certification and or an Authorization Certificate please indicate the date your applications will be received by the Division. Your project will be reviewed in a matter consistent to other projects. Accordingly, avoidance, minimization, and/or mitigation may be required for impacts to wetlands or buffers. Thank you for your attention to this matter. The Washington Regional Office is considering recommending an Enforcement action to the Director regarding the described violations. The new false ditch created to channel runoff to the Contentnea Creek will be omitted. The new fill will be resloped and reseeded. Roadside ditches will dissipate in settling basins and sheet flow over vegetated uplands before entering 404 wetlands and no runoff will be directly channeled into the Contentnea Creek. Hopefully, this will avoid the need for any enforcement action.
