TIP No. B-2969, State Project No. 8.2623801, Federal Aid Project No. BRZ-2019(1). USACOE Action ID: 199920151 Dear Sir: This letter acts as a renewal request for U.S. Army Corps of Engineers Nationwide Permit No. 23 and the Division of Water Quality 401 Certifications issued on December 22, 1998. The North Carolina Department of Transportation (NCDOT) proposes to replace Bridge No. 169 on the existing alignment with a double-barreled reinforced concrete box culvert over Belews Creek. Each barrel will measure 2.7 meter (9-foot) by 2.1 meter (7- foot) and will be approximately 18.3 meters (60.0 feet) in length. The new approach roadway will be a 7.2-meter (24-foot) travelway with shoulder widths of at least 2.4 meters (8 feet). Traffic will be detoured on existing secondary roads during construction. Bridge No. 169 is located on SR 2019 over East Belews Creek in Forsyth County. The bridge has one span totaling 31 feet in length. The entire bridge is composed of timber and steel with the exception of concrete sills on the end bents. The concrete sills are not located in Waters of the United States. Therefore, Bridge No. 169 will be removed without dropping any of its components into Waters of the United States. A - East Belews Creek is the only jurisdictional surface water resource that will be impacted. The recommended alternative includes no impacts to jurisdictional wetlands and up to 18.3 meters (60.0 feet) of linear stream channel or 0.004 hectare (0.01 acre) of jurisdictional surface water impacts. The project is being processed by the Federal Highway Administration as a "Categorical Exclusion" (CE) in accordance with 23 CFR 771.115(b). Therefore, we do not anticipate requesting an individual permit but propose to proceed under a Nationwide Permit in accordance with 61 Federal Register 65874, 65916 (December 13, 1996). The Water Resource Classification of East Belews Creek has not changed since the 1996 Categorical Exclusion document. Three federally protected species are listed for Forsyth County: the bog turtle (T S/A), the red-cockaded woodpecker (endangered), and small-anthered bittercress (endangered). One of the protected species listed in 1996, is no longer listed (white irisette). Biological Conclusions of No Effect have been issued for the three federally protected species. We anticipate that 401 General Water Quality Certification No. 2734 (Categorical Exclusion) will apply to this project, and are providing one copy of the CE document to the North Carolina Department of Environment and Natural Resources, Division of Water Quality, for their review. The NCDOT will adhere to the general conditions of the 401 Water Quality Certification; therefore, written authorization from the NC Division of Water Quality is not required.
