Attached to this letter is the final NPDES permit for Lake Lure wastewater treatment plant,
NPDES Permit No. NC0025381. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the U.S. Environmental Protection Agency dated May 9, 1994.
There have been no significant changes to this permit from the draft permit dated October
22, 2003.
If any parts, measurement frequencies, or sampling requirements contained in this permit
are unacceptable to you, you have the right to an adjudicatory hearing upon written request
within thirty (30) days following receipt of this letter. This request must be in the form of a
written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the office of Administrative Hearings, Mail Service Center 6714, Raleigh, North Carolina
27699-6714. Unless such a demand is made, this permit shall be final and binding. .
Please take notice that this permit is not transferable except after notice to the Division of
Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the permit.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality, the Division of Land Resources, the Coastal Area Management Act, or
any other federal or local governmental permit.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge, are hereby
revoked. [The exclusive authority to operate this facility arises under this permit. The authority to
operate the facility under previously issued permits bearing this number is no longer effective.] The
conditions, requirements, terms and provisions of this permit authorizing discharge under the
NPDES govern discharges from this facility.
The Town of Lake Lure is hereby authorized to:
1. Continue to operate a 0.995 MGD wastewater treatment facility consisting of
an influent pump station, aluminum sulfate and chlorine addition, a
mechanical bar screen, a flash mixer, a settling basin, a secondary clarifier, a
filtration unit (not currently in use), final chlorination, dechlorination, sludge
pumps, and an aerobic sludge digester located at the Town of Lake Lure
WWTP, US Highway 64/74 in Lake Lure, Rutherford County.
2. Discharge from said treatment works at the location specified on the attached
map into the Broad River, which is classified C waters in the Broad River
Basin.

BACKGROUND
The Town of Lake Lure WWTP is a Grade II physical/chemical plant with 0.995 MGD design flow. The
permit was originally issued on November 4, 1998 and expired on August 31, 2003. The Permittee
submitted EPA Form 2A on December 12, 2002 in order to request renewal of the permit. Since the flow
of this plant is below 1.0 MGD and consists entirely of domestic flow, the extended effluent testing and
second species toxicity tests do not apply. The Permittee was, however, missing data for dissolved
oxygen, TKN, nitrate and nitrite, oil and grease, total phosphorus and total dissolved solids. These will
be requested in the draft permit cover letter.
The regional office notes that the Town has severe problems with inflow/infiltration (1/I); this is
attributed to the fact that a large portion of the collection system is below full pool of the lake. The
Town has an ongoing I/I program to address these problems.
The Permittee has not requested any changes to the existing permit nor does the regional office note any
changes of significance in the previous permit term. Due to problems with Total Suspended Solids
(TSS)compliance, the Town will be undertaking a project to improve solids removal. An Authorization
to Construct for this project has not yet been issued.
Instream Monitoring, Verification of Existing Conditions and DMR Data Review
This facility discharges to the Broad River in subbasin 03-08-01. The Broad River is classified C waters
at the discharge point and is not on the 2002-303(d) list. The facility is not required to collect instream
data, so no instream review was performed for this renewal.
DMR data from January 2001 through July 2003 were reviewed. Data for conventional parameters are
summarized in Table 1.

This facility is also required to collect data for total residual chlorine, total nitrogen, total phosphorus,
and ammonia nitrogen (NH3-N). In DMRs reviewed for this renewal, no total nitrogen and total
phosphorus data were reported, a violation of the permit. The ARO was notified (and this omission was
noted in the draft cover letter). Total residual chlorine and NH3-N are summarized in Table 2.

Correspondence
The Asheville Regional Office (ARO) conducted several site visits during this permit term to evaluate
compliance. Operational deficiencies, particularly relating to solids management, are noted in these
compliance evaluation inspection reports.
A review of the two-year correspondence history for the Town of Lake Lure revealed that six NOVs
were issued for TSS effluent limit violations. An August 2002 compliance inspection report and a July
2003 Notice of Violation both noted that the Permittee needs to implement a more aggressive solids
management plan. The regional office attributes solids problems to a lack of solids management, solids
removal equipment, and having only one final clarifier.
The region also notes that the Town's severe inflow/infiltration (I/1) problems result in a low strength
wastewater that is difficult to treat with an activated sludge system.
PERMITTING STRATEGY
Waste Load Allocation (WLA)
The Division prepared the last WLA for the previous permit renewal. The previous and current effluent
limits were based on guidelines and water quality standards. The Division has judged previous
parameters and limits to be appropriate for renewal with some exceptions. Weekly average ammonia
limits based on a 3:1 ratio with the monthly average will be implemented in this permit. This is a new
statewide policy that resulted from EPA requirements. The resulting summer weekly average limit will
be 12.9 mg/L.

Aluminum Sulfate and chlorine are added, next is a mechanical
bar screen, followed by a flash mixer, then to the settling
basin, followed by a secondary clarifier and de -chlorination.
Solids are removed as necessary to the digester. Waste solids
are contract removed and land applied by Southern Soil
Builders. Southern soil Builders holds the permit.

PART IV - EVALUATION AND RECOMMENDATIONS
A large percentage of the collection system is below full pool
of the lake. Consequently, the Town's untreated wastewater
lacks sufficient strength to allow for typical activated
sludge wastewater treatment. The treatment process is
aluminum chloride and chlorine addition at the head of the
treatment facility. It is recommended the permit be renewed
as a Grade II Physical/Chemical.
The filtration unit shown on the schematic is not in service.
This equipment has never operated efficiently and has not been
in service for many years. Otherwise, the flow schematic is
correct as submitted in the application package.

Dear Mrs. Stephens:
The Town of Lake Lure is hereby requesting renewal of our existing NPDES Permit No.
NCO025381 for the Town's existing wastewater treatment. plant. Please find enclosed one original.
and two. copies of a completed NPDES permit application for this renewal, including a narrative
describing the sludge management plan for the facility. There have been no additions or
improvements at the WWTP since the last renewal was issued.
Based on our engineer's conversation with your agency, it is our understanding that the testing
requirements described in Mr. Charles Weaver's letter dated July 2, 2002 regarding the permit
renewal do not apply to our facility because the permitted capacity of the plant is less than one
million gallons per day. We are, therefore, not enclosing the Priority Pollutant :Analyses or toxicity
tests requested in the letter.

The Town of Lake Lure is located in Rutherford County, North Carolina, and operates a
wastewater treatment facility with a design capacity of 0.995 MGD. Sludge at the facility
is collected in the existing sedimentation basin and existing clarifier unit, and pumped
using a sludge pump station to an aerobic digester. Sludge is currently removed from the
digester by a private company through a contract with the Town, and disposed of by the
contract operator.
