APR 1220 WATER OUAz'; r The North Carolina Departmmt of Transportation (NCDOT) is proposing to replace an existing double pipeline on SR 1135 in Camden County. The existing 72"x 40' pipelines are in poor condition and function mainly as equalizer pipes. There is no defined channel. However, a cypress/gum swamp community exists on either side of the road in this area. In order to improve safety and stability of the shoulder area around the pipes, the NCDOT would like to extend each pipe by 10.0' to a 72" x 50'. Please fmd attached a -.-icinirr map along with a plan view of the proposed work. Wetland impacts will occur as a result of this work. Vegetation in the surrounding wetland is dominated by bald cypress (Taxodium distichum), (black gum (Nyssa syhvatica t and red maple (ricer rubrum) in the canopy. Herbaceous vegetation includes knotweed (Polygonum sp.) and lizard's tail (Saururus cernus). Wetland impacts total 130.0 square feet (0.003 acres). Impacts will be limited to those areas directly adjacent to the pipes. No mature trees will be removed. The NCDOT requests that tE--s work be authorized under the provisions of Regional General Permit No. 31. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3289. This Certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal. state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. DAVID McCOY SECRETARY ()®1451 SUBJECT: Request for Section 404 Authorization for Anticipated Impacts to Waters and wetlands Resulting From Improvements to SR 1112 in Camden County The Department of Transportation plans to improve SR 1112 in Camden County from a soil road to a wider paved surface and one pipe addition. A 40 foot 18 inches concrete metal pipe will replace an existing 30 foot 15 inch pipe within an intermittent stream of the Pasquotank River. Upgrading this road will include two 10-foot travel lanes and 6-foot shoulders, no ditches. The work will be contained within a limited right of way, up to 40-feet wide. The planned work is necessary to bring the existing facilities up to current design standards. To accomplish the proposed improvements, a small amount of wetlands (0.08 acres) will be filled during the upgrade of the roadway. Since wetland continuums occur along the boundaries of sections of the project, essentially up to the existing road toe and we would like to smooth out the present curve for safety reasons, it is not possible to avoid impacting these wetlands. We will minimize the anticipated impacts to wetlands by utilizing 2:1 fill slopes in these areas, a 40-foot right-of-way instead of the 50-foot, and no ditches in wetland areas. You will find included with the prior construction notification: • A map indicating the location of the work • Plans of the proposed work on three 8.5 x 11 inch paper • Brief description of the affected wetlands The wetland impacts associated with paving SR 1112 in Camden County (0.08 acres) is three narrow strips of Emergent wetlands adjoining a neighboring Palustrine wetland (PF01-6).
