The project should be constructed in accordance with your application dated 31 March 2000 (received 14 April 2000). After reviewing your application, we have decided that this fill is covered by the General Water Quality Certification corresponding to the Corps of Engineers Regional (General) Permit Number 198200031. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. Church Road, Cabarrus County; State Project No. 8.1661001, Federal Aid Project No. NHF-28-1(5), State TIP No. R-2533AS Dear Ms. Manuele: The North Carolina Department of Transportation (NCDOT) proposes to widen NC 49 from approximately 1000 feet east of SR 1300 in Harrisburg to east of SR 1155 (Zion Church Road) in Cabarrus County. The proposed roadway consists of a four-lane divided facility on the existing alignment with a 46-foot wide grass median in most areas. A five-lane, curb and gutter freeway will be provided in within the city of Harrisburg. The project extends approximately 5.8 miles; the project's let date is July 2000. This segment is the first section of a 30.4-mile project that extends from Harrisburg to the Yadkin River; the entire widening project is set to be let in five stages. During a February 10, 2000 conversation with you, it was agreed that this project could be permitted in sections. A map of the entire widening project is included in the attached permit drawings. An analysis of various alternatives and the explanation of the preferred alignment for the entire widening project is detailed in the Environmental Assessment (EA) signed March 28, 1994 and the Finding of No Significant Impact (FONSI) signed October 21, 1994 by the Federal Highway Administration (FHWA). Copies of the EA and FONSI have been provided to regulatory review agencies involved in the approval process. Additional copies will be provided upon request. ENVIRONMENTAL IMPACTS Wetland delineations were conducted using the criteria specified in the -1987 Corps of Engineers Wetland Delineation Manual in May 1996. Steve Chapin of the U.S. Army Corps of Engineers verified the delineated areas in January 1997. Four jurisdictional wetland sites, totaling 1.47 acres, will be impacted. The project will also impact five jurisdictional surface waters due to the placement of hydraulic structures and/ or channel modifications. The total impact to jurisdictional streams is 682 linear feet. The Division of Water Quality;(DWQ) rating system was applied to each wetland site. Each wetland was also classified according to the United States Fish and Wildlife Service wetland classification (Cowardin, 1979) system and the North Carolina Department of Environment, Health, and Natural Resources, Division of Environmental Management Field Guide to North Carolina Wetlands (Report No. 96-01, 1996). Table 1 describes the wetland and stream classification for each impact site. Table 1. The project will have no effect on the Matthew Franklin Teeter House, which is potentially eligible for the National Register of Historic Places. Temporary construction easements will be required within the National Register boundaries of the Stonewall Jackson Training School Historic District. The project will have no adverse effect on the Stonewall Jackson Training School if NCDOT replaces, in-kind, plant materials within the historic boundaries damaged or lost due to the project, and if NCDOT utilizes shallow side slopes for the ditch within the historic property on the west side of Old Charlotte Road (SR 1157). These findings have been coordinated with the North Carolina Department of Cultural Resources and the State Historic Officer has concurred with the proposed eligibility and boundaries. There are no archaeological sites of significance within the project area. JURISDICTIONAL STATUS Impacts: The eight jurisdictional sites located along the proposed alignment of R-2533A are listed in Table 3. The project is located in the Yadkin River Basin within the Rocky River Sub- basin. Table 3. The stream impacted is a jurisdictional stream for which mitigation will be provided. Site 4: The impacts to 167 linear feet of jurisdictional stream are due to the extension of a 2.7 x 2.4-meter concrete box culvert. Mitigation will be provided for all stream impacts. Site 5: The fill associated with roadway construction will impact approximately 0.67-acres of wetlands; all activities extend to the cut/fill line within the project boundary on the south side of the alignment. Wetland mitigation will be provided. Site 6: This site involves both the fill of wetlands and the extension of a 1.82 x 2.13 meter box culvert in an existing stream channel. Mitigation is provided for all impacts to both jurisdictional streams and wetlands. Site 7: Work at this site involves the fill of approximately 0.05 acres of wetlands. Mitigation will be provided for all wetland impacts. Site 8: This site involves the relocation of an existing stream channel in order to extend an existing pipe. Additional stream impacts are due to the placement of rip rap in order to account for the additional flow from both the existing pipe and a grass-lined drainage ditch which will tie into the stream. Mitigation will be provided for all stream impacts. Bridge Demolition and Removal: The removal of existing bridges over both Rocky River and Coddle Creek is necessary in order to upgrade the structures to meet the new roadway. Each existing structure will be replaced with a new structure in the same location; an additional bridge is to be constructed for the two new lanes north of the existing alignment. The construction sequence will proceed as follows: the new structure and approaching lanes will be built adjacent to the existing structure; traffic will be shifted to the new structure; the existing bridge will be removed, and the remainder of the new bridge will be constructed. Site 2: This site involves the replacement of Bridge No. 31 on NC 49 over the Rocky River. The existing bridge is 31.4 feet in width and 119.0 feet in length, composed of three spans. The bridge deck is composed of concrete with reinforced concrete deck girders. Because of the bridge's composition, a potential of 192 cubic yards of material could be dropped into Rocky River. A temporary rock causeway will be required for both the replacement of the existing bridge and the construction of the new structure just north of the existing alignment. The causeway will provide construction access and facilitate the construction of drilled shafts and the placement of prestressed concrete girders. The causeway will consist of Class II rip rap. Site 3: Bridge No. 46 on NC 49 over Coddle Creek. The existing bridge is 31.4 feet in width and 83.7 feet in length and consists of two spans. The bridge deck is composed of concrete with reinforced concrete deck girders. Because of the bridge's composition, a potential of 180 cubic yards of material could be dropped into Coddle Creek during demolition. A temporary rock causeway will be required for the replacement of the existing bridge as well as the construction of the new structure. The causeway will provide construction access and facilitate the construction of drilled shafts and the placement of prestressed concrete girders. The causeway will consist of Class II rip rap. At the completion of bridge construction, the contractor will remove the temporary causeways. All material placed in both Rocky River and Coddle Creek will be removed. NCDOT's Best Management Practices for Bridge Demolition and Removal will be adhered to during the life of the project. These practices establish a consistent, environmentally sound approach to the demolition and removal of bridges from North Carolina's public road systems. These guidelines are an addendum to (and not a replacement for) NCDOT's Best Management Practices for the Protection of Surface Waters. These guidelines are designed to protect the water quality and aquatic life of the affected environment in the vicinity of the project. MITIGATION Avoidance & Minimization: Because this project involves the widening of an existing road, wetland impacts were minimized to small wetland sites found along the existing alignment. All wetland areas not affected by the project will be protected from unnecessary encroachment. No staging of construction equipment or storage of construction supplies will be allowed in wetlands or near surface waters. Wetland impacts were avoided by shifting the widening location from one side of the existing road to the other to the extent possible in consideration of historic sites and densely populated land use. Some wetlands cannot be avoided due to their location on both sides of the road. However, all wetland impacts are minimized along the existing roadway where much of the adjacent property has already been disturbed by agricultural, residential, and commercial development. Minimization involves taking appropriate and practicable steps to reduce the adverse impacts. Strict enforcement of sedimentation and erosion control Best Management Practices (BMP) for the protection of surface waters and wetlands is practiced. It is the policy of NCDOT to eliminate lateral ditching in wetlands as much as possible, thus preserving the hydrology of adjacent wetlands. Additionally, the NCDOT Hydraulics Unit has minimized stream impacts by both reducing the amount of channel work as well as the amount of rip rap in all stretches of relocated channel. Compensation: A total of 682 linear feet of existing channel will be impacted by project construction; 1.47 acres of wetlands will also be impacted. Each of the four wetland impact sites are classified as headwater forest wetlands. No on-site stream or wetland mitigation opportunities were identified. Therefore, NCDOT plans crediting all stream and wetland mitigation requirements to the Shepherds Tree Mitigation Site located in Iredell County. Proposed mitigation ratios include 2:1 for stream impacts and 2:1 for wetland impacts. Therefore, 1364 linear feet of streams and 2.94 acres of wetlands have been debited from the Shepherds Tree Mitigation Site. Copies of the draft mitigation plan have been forwarded to the permitting agencies; however, further information can be provided upon request. It is anticipated that the described activities will be authorized through a series of Section 404 Nationwide Permits, as specified in Table 3.
