Box 1551 Andrews, NC, 28901 Dear Mr. Burch: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 250 linear feet of streams for the purpose of paving SR 1342 (Penland Road) in the Shooting Creek community, Clay County. The project should be constructed in accordance with your revised application dated 30 May 2000 (received 8 June 2000). After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3103. This certification corresponds to the Nationwide Permit Number 14 issued, by the Corps of Engineers. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit, unless otherwise specified in the Water Quality Certification. The following additional conditions will be required: 1. The arch pipe shall be installed in such a manner that the original stream profile is not altered (i.e. the depth of the channel should not be reduced by a widening of the stream bed). 2. All culverts shall be installed at least one foot below the channel bed so as to allow passage of water and aquatic life. 3. All work shall be performed during low flow conditions. 4. Care must be utilized such that live (wet) concrete does not enter the stream channel. 5. The presence of equipment in the channels must be minimized. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or if total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447; Raleigh, N.C. 27611-7447. Several pipe extensions at stream crossings, which were not in the initial application are included along with a revision of the Lynch Branch stream crossing. Due to concerns expressed by the Division of Water Quality, the Department of Transportation has reduced the 150 linear feet required to 145 linear feet at the Lynch Branch crossing. This crossing was necessary due to lack of right of way available on the existing location. We would like to begin construction as soon as possible. It is made of permeable filter fabric buried at the bottom, stretched and supported by steel posts. The silt fence reduces the water flow while retaining the sediment. They may also be used to divert water flow to protected outlets. Silt fences need to be checked after each significant rainfall to ensure there effectiveness. They must be maintained on a regular basis. Silt fences shall not be installed across streams, ditches, or waterways. The silt basin is built at the base of the ditch with its length being at least 2 times the width of the basin. Rock silt screens shall be used to trap sediment transported by running water and shall be placed in the stream below the construction site within the right-of- way or easement boundary. The rock silt screen utilizes class B stone lined with #5 or #57 stone to produce a ripple-effect in the stream to settle the larger sediment particles transported in the stream from the construction site. The trapped sediment shall be cleaned out before the device is removed from the stream. I have asked Mr. Burch to provide this information. I am certain that more than 150 feet of stream will be affected if these other culvert extensions are taken into consideration. Also, I asked Mr. Burch v tAter 'or hot it-was ixnperative?, P road hazard-,, heavy traffic usatge, to straighten the V ,Tgad?. The curve is not sharp but rather a long sweep and according to Mr. Burch and Mr. Woody maybe fifty cars a day use this road. Their problem lay in obtaining the right of way. A property owner gave a right of way at the lower end of his property. it was to his benefit to relocate the road there since the current road divides his property. By relocating the road, his property is united into one large tract. T have asked Mr. Burch and Mr. Woody to speak with the property owner concerning the problem they are encountering with the stream crossing. They are of the opinion that he really wants the road to be paved. C. 28801-5006 Dear Mr. Johnson: YMENT EIVED 10 DAVID MCCOY SECRETARY The North Carolina Department of Transportation is proposing to widen and pave SR 1342, Penland Road, in Clay County to conform to our current secondary road standards. A new horizontal and vertical alignment is proposed across Lynch Branch (DEM Class C) instead of following the existing alignment of Penland Road near Survey Station 34 + 15. This is illustrated on the attached Shooting Creek Quadrangle and the erosion control site plan. In order to accomplish this, 150 linear feet of 58" x 36" corrugated steel pipe arch will need to be installed at the Lynch Branch crossing. Due to the nature of our proposed work, we are requesting authorization to proceed under Section 404 of the Clean Water Act. We intend to exercise every reasonable precaution to protect the environment on this project. I am sending a straight-line diagram, with the proposed erosion control measures, stream, stream bank, and construction limits at the site where we will be in conflict with the stream. In addition, I am sending a typical section of the road, a cross- section at the stream crossing, general notes and standards on erosion control measures, and a marked map. We propose to install the new culvert slightly below the existing streambed elevations where bedrock is not encountered to minimize impacts to wildlife habitats and allow the existing steam gradients to remain as unchanged as is physically possible. The construction foreman will review all erosion control measures daily to ensure sedimentation and erosion are being effectively controlled. If the planned devices are not functioning as intended, they will immediately be replaced with better devices. The rock silt screens and other erosion control devices will be in place prior to pipe culvert construction and will remain in place until the project is stabilized. Temporary silt ditches shall be used at the toe of fill slopes to divert runoff into sediment basins, temporary rock sediment dams, temporary rock silt checks and/or other sedimentation control measures. Temporary silt ditches are approximately 1 ft. deep, 2:1 side slopes with an optional earth berm. It is made of permeable filter fabric buried at the bottom, stretched and supported by steel posts. The silt fence reduces the water flow while retaining the sediment. They may also be used to divert water flow to protected outlets. Silt fences need to be checked after each significant rainfall to ensure there effectiveness. They must be maintained on a regular basis. Silt fences shall not be installed across streams, ditches, or waterways. These type-B rock silt checks help reduce the flow velocity and are generally made of class-B stone. They are used in ditches during construction where the grade meets and/or exceeds 3%. AREAS OF USE: • In channels, roadside ditch outlets, temporary silt ditches, and temporary diversions. • In conjunction with type-B silt basins. Rock silt screens shall be used to trap sediment transported by running water and shall be placed in the stream below the construction site within the right-of- way or easement boundary. The rock silt screen utilizes class B stone lined with #5 or #57 stone to produce a ripple-effect in the stream to settle the larger sediment particles transported in the stream from the construction site. The trapped sediment shall be cleaned out before the device is removed from the stream. AREAS OF USE: • In live streams below construction sites where construction occurs in or adjacent to the stream. • In live streams below a culvert construction site. • Where it can be cleaned before it is removed from stream.
