Dear Daniel:
As a result of a site visit earlier this year, this Office transmitted a letter detailing the buffer requirements
in place at that time on the unnamed tributary to Sycamore Creek. This stream feature was subject to the
Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing
Riparian Areas, Administrative Code T15A:02B.0233.
NCAC.0233 now states that "a surface water shall be present if the feature is approximately shown on either
the most recent version of the soil map prepared by the Natural Resources Conservation Service.... or the
most recent version of the 1:24,000 scale quadrangle topographic maps prepared by the United States
Geological Survey. Riparian buffers adjacent to surface waters that do not appear on either of the maps shall
not be subject to this Rule.
This Office has received your request for an appeal of the original determination that delineated the required
buffer along the periphery of the unnamed tributary and reviewed the subject maps. It has been determined
that the feature originally determined to be a stream, is not represented on either of the two maps and
therefore not subject to the Riparian Buffer Rule.
