This certification authorizes the NCDOT to place fill material in 0.26 acres of jurisdictional wetlands and 3524 linear feet of streams in Wilkes County. The project shall be constructed pursuant to the application filed on the 23N day of August 1999 to construct the Widening of US 421 from east of Maple Springs to east of NC 268. . The application provides adequate assurance that the discharge of fill material into the waters of the Yadkin River Basin in conjunction with the proposed development will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95- 217 if conducted in accordance with the application and conditions hereinafter set forth. This approval is only valid for the purpose and design that you submitted in your application, as described in the Public Notice. Should your project change, you are required to notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to remain valid, you are required to comply with all the conditions listed below. In addition, you should obtain all other federal, state or local permits before proceeding with your project including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations. Condition(s) of Certification: Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR Regional or Central Offices) shall be utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTUs in all fresh water streams and rivers not designated as trout waters; 25 NTUs in all lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters); 2. All sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored after the Division of Land Resources has released the project; 3. If an environmental document is required, this Certification is not valid until a FONSI or ROD is issued by the State Clearinghouse; 4. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 5. There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this permit without appropriate modification of this permit. Should waste or borrow sites be located in wetlands or stream, compensatory mitigation will be required since it is a direct impact from road construction activities. 6. Compensatory mitigation shall be done for 3524 linear feet of streams. We understand that you have chosen to perform mitigation through an in lieu payment to the North Carolina Wetland Restoration Program (NCWRP), and that the WRP has agreed to implement mitigation for the project. In accordance with 15A NCAC 2R.0500, the contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H.0506(h). Until the Wetland Restoration Program receives and clears your check (made payable to DENR - Wetland Restoration Program), wetland payable to DENR - Wetland Restoration Program), wetland or stream fill shall not occur. The payment to NCWRP shall be sent within two months of issuance of the 404 permit. Violations of any condition herein set forth shall result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon the expiration of the 404 or CAMA permit. If this Certification is unacceptable to you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. If modifications are made to an original Certification, you have the right to an adjudicatory hearing on the modifications upon written request within sixty (60) days following receipt of the Certification. Unless such demands are made, this Certification shall be final and binding. The North Carolina Department of Transportation (NCDOT) proposes to widen US 421 in Wilkes County. The NCDOT requests Section 404 permits for Sections A and B of TIP No. R-2240, from east of Maple Springs to east of NC 268 near Wilkesboro. The 11.1 mile project consists of widening US 421 to a four lane roadway. Permanent and temporary surface water and wetland impacts associated with the project include 3524 linear feet of surface waters and 0.126 acres of fill in wetlands. The project is located in the Yadkin River basin Cataloguing Unit 03040101. The current let schedule for both sections of the project is August 2000. Project plans involve widening the existing two lane roadway to a four lane facility. All widening will be to the south of the existing roadway. Additional bridges will be constructed over the Yadkin River, Lewis Creek and the South Prong of Lewis Creek, resulting in dual bridges at these locations. NEPA Documentation The scope of this project was described in an Environmental Assessment (EA), which was approved on November 22, 1995. This document includes studies pertaining to impacts to natural systems and protected species for the project. The Finding of No Significant Impact (FONSI) was signed on July 15, 1996. Copies of the EA and FONSI have been provided to regulatory agencies involved in the project review process. PHONE (919) 733-2520 FAX (919) 733-9150 ?F 2 Historic structures and archeological sites were addressed in the EA and FONSI for the project. Attached are letters of concurrence from the NC State Historic Preservation Office regarding the Johnson Farm Complex and the Montford Stokes house. There are no other outstanding issues regarding historic structures or archeological sites. Section 7 of the Endangered Species Act documentation for the project is as follows. In the original EA and FONSI for this project the peregrine falcon (Falco peregrinus) was listed as Endangered by the US Fish and Wildlife Service (USFWS). A biological conclusion of no effect was rendered for this species. Since the submission of the EA and FONSI, the peregrine falcon has been removed from the USFWS list of protected species for Wilkes County As of May 14, 1999, the USFWS does not list any species for Wilkes County, which are subject to protection in accordance with Section 7 of the Endangered Species Act. The bog turtle (Clemmys muhlenbergii) has been upgraded from a Federal Species of Concern to Threatened due to Similarity of Appearance (T S/A). The threatened due to Similarity of Appearance status is due to the bog turtle's similarity of appearance to another rare specie that is listed for protection. T S/A species are not biologically endangered or threatened and are not subject to Section 7 consultation (USFWS, May 14, 1999). Information contained within the EA and FONSI indicate that habitat for the bog turtle is not present within the project study area. Additionally, a review of the NC Natural Heritage Program database of rare species and unique habitats on August 10, 1999 revealed no listings of federally protected species within three miles of the project area. Project Impacts to Waters of the United States The proposed action of widening US 421 for Sections A and B cannot be accomplished without impacts to waters of the United States. Project area wetlands and surface waters were delineated on January 21 and February 26 1998 by NCDOT biologist Chris Murray, PWS. Jurisdictional surface waters and wetlands were verified during an agency field review on August 4 1998 by Eric Alsmeyer USACE, with Cyndi Bell NCDWQ, and Joe Mickey NCWRC. Total impacts to jurisdictional surface waters and wetlands include, 3523.6 ft of channel impacts, 0.416 ac of fill in surface waters, 0.074 ac of temporary fill in surface waters, 0.126 ac of fill in wetlands and 0.005 ac of excavation in wetlands. All wetlands impacted by the proposed project are adjacent to perennial streams. Dominant vegetation contained within the scrub shrub wetlands includes saplings of red maple (Ater rubrum), and sycamore (Platanus occidentalis), Chinese privet (Ligustrum sinense), and tag alder (Alnus serrulata). Canopy species found in forested wetlands includes sweetgum (Liquidambar styraciflua), red maple, and tulip poplar (Liriodendron tulipifera). The emergent wetland consisted of a monotypic stand of Japanese grass (Microstegium vimineum). Wetland data sheets for impacted wetlands are on file with the USAGE. Section A of R-2240 extends from east of Maple Springs to SR 1146 west of Wilkesboro. Jurisdictional impacts for this section include; 2839.2 linear feet of channel impacts, 0.263 acres of fill in surface waters, and 0.099 acres of fill in wetlands. Section B of R-2240 extends from east of SR 1374 to east of NC 268 near Wilkesboro. Jurisdictional impacts for this section include; 684.4 linear feet of channel impacts, 0.153 acres of fill in surface waters, 0.074 acres of temporary fill in surface waters, 0.027 acres of fill in wetlands and 0.005 acres of excavation in wetlands. The temporary fill in surface waters (0.074 acres) associated with Section B is the result of the proposed placement of temporary platforms (causeways) in the Yadkin River for the construction of the Yadkin River bridge. Both platforms will consist of washed, Class II Rip Rap. Their estimated combined volume is 233 cubic feet. Upon completion of construction the rip rap will be removed from the river to the extent practicable without disturbing the river bottom. It is expected some residual will remain. Details concerning the placement of temporary platforms are included on Site 7 of the Section B permit drawings. Mitigation The Corps of Engineers has adopted, through the Council on Environmental Quality (CEQ), a wetland mitigation policy that embraces the concept of "no net loss of wetlands" and sequencing. The purpose of this policy is to restore and maintain the 4? chemical, biological, and physical integrity of the Waters of the United States. Mitigation of wetland and surface water impacts has been defined by the CEQ to include: avoiding impacts, minimizing impacts, rectifying impacts, reducing impacts over time and compensating for impacts (40 CFR 1508.20). Executive Order 11990 (Protection of Wetlands) and DOT Order 5660.1A (Preservation of the Nations Wetlands), emphasize protection of the functions and values provided by wetlands. These directives require that new construction in wetlands be avoided as much as possible, and that all practicable measures are taken to minimize or mitigate impacts to wetlands surface waters. The NCDOT is committed to incorporating reasonable and practicable design features to avoid and minimize wetland and surface water impacts, and to provide full compensatory mitigation of remaining wetland and surface water impacts. Avoidance measures were taken during the planning and EA phases; minimization measures were incorporated as part of the project design. AVOIDANCE: Selection of the alternative of widening US 421 on existing location significantly reduced wetland and surface water impacts as compared to the bypass alternatives which were on new location. All wetland areas not affected by the project will be protected from unnecessary encroachment. No staging of construction equipment, or storage of construction supplies will be allowed in wetlands or near surface waters. MINIMIZATION: Minimization includes the examination of appropriate and practicable steps to reduce the adverse impacts. Minimization techniques were implemented as follows: Slopes: Fill slopes in wetlands and near surface waters are at 2:1. 2. Best Management Practices: Strict enforcement of sedimentation and erosion control Best Management Practices (BMP) for the protection of surface waters and wetlands. 3. Ditching: It is the policy of the NCDOT to eliminate lateral ditching in wetlands as much as possible, thus preserving the hydrology of adjacent wetlands. 4. Wetland and surface water impacts were minimized on all of R-2240 during the preliminary designs by placing the alignment in the most environmentally friendly area, resulting in the minimal amount of wetland and surface water impacts for this project. COMPENSATION: The NCDOT has requested that the NC Wetlands Restoration Program (WRP) provide stream mitigation for the proposed project. In a letter dated August 11, 1999 the NCDOT requested that the WRP provide for mitigation for 3524 linear feet of stream impacts at a ratio of two to one. This results in 7048 linear 6 feet of stream restoration. Since total wetland impacts for both Sections A and B are less than 1.0 acres, no wetland mitigation is proposed. In summary, the NCDOT requests authorization under a Section 404 Individual Permit, and a Section 401 water quality certification. The NCDOT proposes to mitigate for stream impacts by paying $881,000 to the WRP. The following description of the work is taken from data provided by the applicant. Plans submitted with the application show the placement of fill material impacting a total of 0.6 acre of waters of the United States, including wetlands, in the upper Yadkin River basin, between Maple Springs and Wilkesboro, in Wilkes County, North Carolina. These impacts are necessary for the construction of the widening of US 421 (T.I.P. No. R-2240). The proposed highway will extend 11.1 miles. The project involves widening the existing two lane roadway to a four lane facility. All widening will be to the south of the existing road. The project will involve fill impacts to 0.5 acre of unvegetated waters of the United States. Stream channel crossings (3,524 linear feet of impacts) occur at 24 locations throughout the project. At stream crossings, bridges, culverts or pipes will be used to allow for adequate hydrological flow underneath the roadway. The proposed construction will also impact 0.1 acre of vegetated wetlands by filling. The impacted wetlands include palustrine forested, marsh, and scrub/shrub areas. The project impacts include a temporary fill in the surface waters of the Yadkin River for the placement of two temporary riprap platforms (causeways). The platforms will be used for access for construction of the bridge over the river. There will be one platform on each bank of the river, with a total surface area of less than 0.1 acre, and a total volume of 233 cubic feet. Both I platforms will consist of washed, Class II riprap. Upon completion of construction, the riprap will be removed from the river to the extent practicable without disturbing the river bottom. NCDOT is proposing payment to the North Carolina Wetland Restoration Program to provide compensatory mitigation for the stream impacts from this project, at a 2:1 ratio. NCDOT has not proposed any wetland mitigation. The purpose of the work is to improve this portion of the existing US 421 corridor, to serve the growing transportation needs of the area, at an acceptable level of service. The applicant has considered alternatives to the proposed project, including the no-build alternative, widening to the north side of the existing road, and bypass alternatives. In addition, the applicant has committed to measures to avoid and minimize wetland and stream impacts, including increased slopes at stream and wetland crossings, and eliminating lateral ditching in wetlands. Overall plans showing the proposed construction are included with this public notice. Additional detailed plans may be reviewed at the U.S. Army Corps of Engineers Regulatory Field Office at 6508 Falls of Neuse Road, Suite 120, Raleigh, North Carolina 27615-6846, or at the North Carolina DENR, Division of Water Quality, 4401 Reedy Creek Road, Raleigh, North Carolina. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina Division of Water Quality has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and the project does not impact any registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer. NCDOT has conducted surveys for architectural and archaeological resources, and has coordinated with the North Carolina State Historic Preservation Officer (SHPO). SHPO has concurred that the project will not have any effect on architectural or archaeological resource properties eligible for f 3 inclusion in the Register. The District Engineer is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistoric, or historical data may be lost or destroyed by work under the requested permit. The District Engineer is not aware, based on available information, that the activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State, and local agencies and officials; Indian Tribes, and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition, or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in preparation of an Environmental Assessment and/or Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. 4 4 Generally, the decision whether to issue this DA permit will not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serves as application to the NCDWQ for certification. No. R-2240), CROSSING LEWIS FORK CREEK, SMITHEY'S CREEK, FISH DAM CREEK, MILLERS CREEK, THE YADKIN RIVER, UNNAMED TRIBUTARIES, AND ADJACENT WETLANDS, FROM EAST OF MAPLE SPRINGS, TO EAST OF NC 268, WEST OF WILKESBORO, IN WILKES COUNTY, NORTH CAROLINA. The following description of the work is taken from data provided by the applicant. Plans submitted with the application show the placement of fill material impacting a total of 0.6 acre of waters of the United States, including wetlands, in the upper Yadkin River basin, between Maple Springs and Wilkesboro, in Wilkes County, North Carolina. These impacts are necessary for the construction of the widening of US 421 (T.I.P. No. R-2240). The proposed highway will extend 11.1 miles. The project involves widening the existing two lane roadway to a four lane facility. All widening will be to the south of the existing road. The project will involve fill impacts to 0.5 acre of unvegetated waters of the United States. Stream channel crossings (3,524 linear feet of impacts) occur at 24 locations throughout the project. At stream crossings, bridges, culverts or pipes will be used to allow for adequate hydrological flow underneath the roadway. The proposed construction will also impact 0.1 acre of vegetated wetlands by filling. The impacted wetlands include palustrine forested, marsh, and scrub/shrub areas. The project impacts include a temporary fill in the surface waters of the Yadkin River for the placement of two temporary riprap platforms (causeways). The platforms will be used for access for construction of the bridge over the river. There will be one platform on each bank of the river, with a total surface area of less than 0.1 acre, and a total volume of 233 cubic feet. Both 2 platforms will consist of washed, Class II riprap. Upon completion of construction, the riprap will be removed from the river to the extent practicable without disturbing the river bottom. NCDOT is proposing payment to the North Carolina Wetland Restoration Program to provide compensatory mitigation for the stream impacts from this project, at a 2:1 ratio. NCDOT has not proposed any wetland mitigation. The purpose of the work is to improve this portion of the existing US 421 corridor, to serve the growing transportation needs of the area, at an acceptable level of service. The applicant has considered alternatives to the proposed project, including the no-build alternative, widening to the north side of the existing road, and bypass alternatives. In addition, the applicant has committed to measures to avoid and minimize wetland and stream impacts, including increased slopes at stream and wetland crossings, and eliminating lateral ditching in wetlands. Overall plans showing the proposed construction are included with this public notice. Additional detailed plans may be reviewed at the U.S. Army Corps of Engineers Regulatory Field Office at 6508 Falls of Neuse Road, Suite 120, Raleigh, North Carolina 27615-6846, or at the North Carolina DENR, Division of Water Quality, 4401 Reedy Creek Road, Raleigh, North Carolina. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina Division of Water Quality has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and the project does not impact any registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer. NCDOT has conducted surveys for architectural and archaeological resources, and has coordinated with the North Carolina State Historic Preservation Officer (SHPO). SHPO has concurred that the project will not have any effect on architectural or archaeological resource properties eligible for 3 inclusion in the Register. The District Engineer is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistoric, or historical data may be lost or destroyed by work under the requested permit. The District Engineer is not aware, based on available information, that the activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State, and local agencies and officials; Indian Tribes, and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition, or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in preparation of an Environmental Assessment and/or Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Mickey, Jr., Stream Restoration Coordinator Habitat Conservation Program DATE: September 15, 1999 SUBJECT: Review of an application by NCDOT for the proposed widening of US 421 from East of Maple Springs to East of NC 268 near Wilkesboro, State Project # 6.769002T, TIP No. R-2240 Sections A & B, Wilkes County. The North Carolina Department of Transportation (NCDOT) is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff have made several site visits and are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The NCDOT proposes to widen the existing two lane roadway to a four lane facility. All widening will be to the south of the existing roadway. Additional bridges will be constructed over the Yadkin River, Lewis Fork, and the South Prong of Lewis Fork. Total impacts to jurisdictional surface waters and wetlands include, 3523.6 ft. of channel impacts, 0.416 ac of fill in surface waters, 0.074 ac of temporary fill in surface waters, 0.126 ac of fill in wetlands, and 0.005 ac of excavation in wetlands. This project will not impact trout waters. The NCDOT has requested that the NC Wetlands Restoration Program (WW) provide stream mitigation at a ratio of 2:1 for the proposed project. This results in 7048 linear feet of stream restoration. Since total wetland impacts for both Sections A and B are less than 1.0 acre (0.126 acres), no wetland mitigation is proposed. The NCDOT proposes to mitigate for stream impacts by paying $881,000 to the WRP. Based on several site visits and information provided by NCDOT, we have no objection to the project as proposed provided the following recommendations are implemented: 1. Mitigation money paid to the WRP is used for stream restoration projects in the Yadkin River drainage in Wilkes County. .e- 2. Culverts (CMP or RCB) should placed a minimum of 12" inches below the normal streambed or have baffle systems installed through them. Natural streambed materials should be able to fill this 12" and remain in the culvert during flood events without being flushed out. If the culvert is installed properly, drop outlets will be eliminated and the culvert bottom should not be visible but covered by natural streambed materials. These materials can be salvaged during culvert installation and then placed back in the culvert. This type of construction will allow for the movement of aquatic species and terrestrial species through the culvert. 3. Disturbance of the stream channel must be limited to only what is necessary to install the crossings. Culvert installations should maintain above and below stream conditions at pre- construction widths and depths for bedload self-souring and aquatic life migration. To achieve this goal, multiple culverts may require that one cell maintain normal stream flows while other cells are dry except during storm events reaching bankfull flows or greater. 4. Use of riprap to annor the inlet and outlet ends of culverts should be kept to a minimum. Natural bank sloping and native plant revegetation should be used to stabilize disturbed banks where practical to minimize thermal impacts (stream warming due to loss of riparian vegetation). Clearing and grubbing along stream channels within the project corridor should not occur within a minimum of 50 feet of either side of the stream channel (measured from the top of the bank) until 72 hours before work begins in that area. Stream channels and buffer zones along other sections of US 421 currently under construction were cleared far in advance of construction activities at the stream site. This practice has caused excessive sedimentation and warming of stream waters at these locations, often lasting for months before actual construction begins. There is no need to clear and grub areas adjacent to streams until immediately before construction commences in that area. The construction sequence needs to be better timed to avoid this poor practice. 6. Erosion controls must be properly installed and maintained during the life of the project. Other sections of 421 currently under construction have had inadequate erosion controls to protect receiving waters from off-site sedimentation, especially at stream crossing sites (visual observations).
