Dear Mr. Gilmore:
You have our approval, in accordance with the attached conditions and those listed
below, to construct the interchange at the intersection of US 264 and NC 222 in Wilson
County. The project can be constructed as you described in your application dated 20
January 1999 (received 21 January 1999). After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3108.
This certification is issued in conjunction with the Nationwide Permit Number 26 upon
the Corps of Engineers issuance. In addition, you should obtain all other federal, state or
local permits before proceeding with your project, including (but not limited to) Sediment
and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This
approval will expire with the accompanying 404 permit unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your
application. If modifications to the project occur, you must notify us and submit a new
permit application. If the property is sold, the new owner must be given a copy of this
Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6)
and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification.

Using a mitigation ratio of 2:1 for the proposed project, 3.76 acres of wetland mitigation
will be required for the proposed 1.58 acres of impact. We understand that you have
chosen to fulfill the mitigation requirement by debiting the Gurley Mitigation Site in
Greene County. You have informed us that the Corps of Engineers has agreed to accept
this method of mitigation. In accordance with 15A NCAC 2H.0506(h), this debit will
satisfy our compensatory mitigation requirements.
If you do not accept any of the conditions of this certification, you may ask for
an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition that conforms to
Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This
certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section

FOR CORPS OF ENGINEERS NATIONWIDE PERMIT NUMBER 26
(HEADWATERS AND ISOLATED WETLANDS)
This General Certification is issued in conformity with the
requirements of Section 401, Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of Water
Quality Regulations in 15A NCAC 2H, Section .0500 and 15A NCAC 2B
.0200 for the discharge of fill material to waters and adjacent
wetland areas which are above --the. headwaters or to- wetland areas that
are not a part of the surface tributary system to interstate waters or
navigable waters-of the United States (i.e., isolated wetlands) as
described in 33 CF-R. 330 Appendix A (B) (26) of the Corps of Engineers
regulations (i.e., Nationwide Permit No. 26). This Certification
replaces Water Quality Certification Number 2671 issued on January 21,
1992. This WQC is rescinded when the Corps of Engineers reauthorizes
Nationwide 26 or when deemed appropriate by the Director of DWQ.
The State of North Carolina certifies that the specified category
of activity will not violate applicable portions of Sections 301, 302,
303, 306 and 307 of the Public Laws 92-500 and 95-217 'if conducted in
accordance with the conditions hereinafter'set forth. -
Conditions of Certification:
1. Proposed fill or substantial modification of greater than
one-third acre (0.135 ha) of wetlands or waters for a
project requires a.written concurrence from the Division of
Water Quality;
2. Proposed fill or substantial mod'ification' of equal to or
less than one-third acre (0.135 ha): of--wetlands for a
project does-not require written concurrence from the
Division of Water Quality as long as the project is in
compliance with all conditions of this General
Certification;
3. Proposed fill or substantial modification of.any amount of
wetlands classified in accordance-with 15A NCAC 2B
.0101(e)(7) as Unique Wetlands (UWL) shall require written
concurrence from the Division of Water Quality in accordance
with 15A NCAC 2H .0506(e);
4. Proposed fill or substantial modification of greater than
150 linear feet (45.7 m) of streams for a project requires a
written concurrence with the Division of Water Quality. For
the purpose of this Certification, streams are defined as
blue or purple lines for permanent or intermittent streams
as shown on the most recent version of-the USGS 1:24,000
topographic map or other site-specific data;
_ 5. Proposed fill or substantial modification of less than or
e ual to 150 linear feet (45.7 m) of streams for a project
does not require a written concurrence from the Division of
Water Quality as long as the project is in compliance with
all conditions of this General Certification. For the
Dun-oose of this Certification, streams are defined as blue
or purple-lines--for permanent or intermittent streams as
shown on the most recent version of the USGS 1:24,000
topographic map or other site-specific data;
6. That appropriate sediment and erosion control practices
which equal or exceed those outlined inthe most recent
edition of the -,North CarolinaSediment and Erosion Control _
Planning.and-Design Manual- or the -North-Carolina Surface
Mining Manual- (available:-from the Division of Land
Resources in the DEHNR Regional or Central Offices)- must be
utilized to prevent exceedances of the appropriate turbidity
water quality standard (50 NTUs in streams and rivers not
designated as trout waters by DWQ; 25 NTUs in all saltwater
classes, and all lakes and reservoirs; 10 NTUs.in trout
waters); Y
7. All sediment and erosion control measures placed in wetlands
and waters shall be removed and the natural grade restored
after the Division of Land Resources has released the
project;
8. Additional site-specific conditions may be added to projects
with greater than one-third acre impact to wetlands or 150
linear feet of streams which are proposed under this
Certification in order to ensure compliance with all
applicable water quality and effluent standards;
9. Measures shall be taken to prevent live or fresh concrete
from coming into contact with waters of the state until the
concrete has hardened;
10. If an environmental document is required, this Certification
is not valid until a FONSI or ROD is issued by the State
Clearinghouse;
11. Concurrence from DWQ that this Certification applies to an
individual project shall expire on 13 December 1998 to
coincide with the expiration date of Nationwide Permit 26.
Non-compliance with or violation of the conditions herein set
forth by a specific fill project shall result in revocation of this
Certification for the project 'and may also _result :in criminal and/or
civil penalties. -- - -=
The Director of the North-Carolina Division of Water Quality may
require submission of a formal application for individual-
Certification for any. project in this category of activity, if it is
determined that the project is'likely to have a significant adverse
effect upon water quality or degrade the waters so that existing uses
of the wetland or downstream waters are precluded.
Public hearings may be held for specific applications or group-of
applications prior to a Certification decision if deemed in the
public's best interest by.the Director of the North Carolina Division
of Environmental Management.

On January 27, 1999, your application for a 401 Water Quality Certification for
adding to an interchange at the intersection of US 264 and NC 222 in Wilson County was
received by the N.C. Division of Water Quality. The Division will begin to review the
project for eventual decision. However, please be aware that beginning January 1, 1999
that the N.C. General Assembly passed legislation requiring payment of a fee of $475.00
for this project. The 401 Certification cannot be issued until this fee is paid. Presently
the Department of Transportation and Environment and Natural Resources are developing
a process so these fees will not have to be paid separately for each project. We anticipate
that this agreement will be finalized early in 1999. However until this agreement is
completed we will not be able to complete our action on your request. Until that time,
your application will remain on hold as incomplete.

Aid Project No. 1~-38-1(63).
Attached for your information is a copy of the State Environmental Assessment/ Finding
of No Significant Impact for the subject project- The North Carolina Department
Transportation proposes to consauct a diamond interchange at the existing intersection of
US 264 and NC 222. An overpass will be constructed to carry NC 222 over US 264.
Improvements will be made almost entirely in the existing right-of-way. Jurisdictional
wetland iinpacts total 1.58 acres (0.64 ha) of permanent fill in wetlands, Temporary
impacts from mechanized clearing total 0.247 acres (0.10 ha). A total of 36 linear feet
(I I. meters) of stream channel will be lost. Bridge to ramp distance and ramp lengths were
minimized to reduce wetland impacts. Guardrail and 2:1 slopes were also used on the
exterior slopes of the ramps to minimize wetland impacts.
Additionally, the NCDOT has evaluated shifting the interchange from the proposed
alignment to avoid wetland impacts. However, it is recommended that the interchange
remain in the location described in the referenced CE document, Shifting the interchange
-to the east would 1) require additional right of way, 2) lengthen the -X- line (INC 222)
construction, 3) impact wetlands beyond the existing right of way in the northeast and
southeast quadrants of the interchange, 4) conflict with SR 1571 (southeast of the

interchange), which is currently proposed as a detour route for NC 222 traffic while the
historic interchange is landrn?rkunder construction , 5) impact the Scarborough Louse, which is a local
.
Shifting the interchange to the west would lengthen the NC 222 construction
considerably. NC: 222 curves to the east just north of the interchange. A shift to the west
would require a considerable distance on the north side to tie back to existing NC 222.
Also, 14C 111 construction limits would be. increased because the grade falls away from
NC 222. The increase in length of NC I I I construction could result in additional
residential impacts. A shift to the west would also impact wetlands beyond the existing
right of way in the southwest quadrant of the interchange. A westward shift beyond the
existing right of way would require a revision to the letting date to allow for right of way
acquisition and relocation of impacted property owners.
In summary, impacts to waters of the United States total 1.88 acres of jurisdictional
wetlands and 36.0 linear feet of stream due to roadway rill, pipes and culverts. Enclosed
is a completed notification form and drawings that depict impacts to waters of the United
States as well as the wetland delineation report. The NCDOT proposes to mitigate for
these impacts at the Gurley mitigation site in Green County. As stipulated in the
approved mitigation plan for this Site, the impacts will be debited at a 2:1 ratio.
Therefore, a total of 3.76 acres of bottomland hardwood restoration will debited from this
site- Rased on the discussed impacts to waters of the United States, the department
requests authori2ation under a. Nationwide Permit 26 to construct the project. By copy of
this letter and application, the department also requests that the DWQ review this project
for 401 Water Quality Certification.
