Division of Water Quality. The Division will begin to review the project for eventual decision. However, please be aware that beginning January 1, 1999 that the N.C. General Assembly passed legislation requiring payment of a fee of $200.00 for this project. The 401 Certification cannot be issued until this fee is paid. Presently the Department of Transportation and Environment and Natural Resources are developing a process so these fees will not have to be paid separately for each project. We anticipate that this agreement will be finalized early. in 1999. However until this agreement is completed we will not be able to complete our action on your request. TIP R-3619. The subject project proposes to construct a two mile, multi-lane urban thoroughfare between the intersection of US 70 and ACC Boulevard and the relocated Aviation Parkway. The project has been documented as a state funded Environmental Assessment and Finding of No Significant Impact (SEA/FONSI). On December 3, 1997, a Nationwide Permit (NWP) 14, action ID 199700179 and 199820153, was issued for the subject project and on March 26, 1998, a 401 Water Quality Certification (WQC # 970964) was issued. The original permits authorized 0.54 acre of fill in wetlands and 1177 linear feet of fill in surface waters. Of the 1177 linear feet of stream impacts, only 202 feet were found tobeperennial and required mitigation by the DWQ. Payment was sent to the Wetland Restoration Program to compensate for these impacts. Since that time, additional adjustments have been made in the alignment that have reduced the wetland impacts to 0.194 acre and the stream impacts to 495 linear feet. The mitigable stream impacts are still 202 feet, so no change to the wetland mitigation is anticipated. Attached are maps that show the new alignment as well as a summary table itemizing the impacts by site. 2 It is requested that these activities will be permitted under a Section 404 NWP 14. By copy of this letter, we are also requesting a 401 General Water Quality Certification from the NC Division of Water Quality. The project has been documented as a state funded Environmental Assessment and Finding of No Significant Impact (SEA/FONSI). On December 3, 1997, a Nationwide Permit (NWP) 14, action ID 199700179 and 199820153, was issued for the subject project and on March 26, 1998, a 401 Water Quality Certification (WQC # 970964) was issued. The original permits authorized 0.54 acre of fill in wetlands and 1177 linear feet of fill in surface waters. Of the 1177 linear feet of stream impacts, only 202 feet were found to be perennial and required mitigation by the DWQ. Payment was sent to the Wetland Restoration Program to compensate for these impacts. Since that time, additional adjustments have been made in the alignment that have reduced the wetland impacts to 0.194 acre and the stream impacts to 495 linear feet. The mitigable stream impacts are still 202 feet, so no change to the wetland mitigation is anticipated. Attached are maps that show the new alignment as well as a summary table itemizing the impacts by site. 2 It is requested that these activities will be permitted under a Section 404 NWP 14. TIP R-3619. The subject project proposes to construct a two mile, multi-lane urban thoroughfare between the intersection of US 70 and ACC Boulevard and the relocated Aviation Parkway. The project has been documented as a state funded Environmental Assessment and Finding of No Significant Impact (SEA/FONSI). On December 3, 1997, a Nationwide Permit (NWP) 14, action ID 199700179 and 199820153, was issued for the subject project and on March 26, 1998, a 401 Water Quality Certification (WQC # 970964) was issued. The original permits authorized 0.54 acre of fill in wetlands and 1177 linear feet of fill in surface waters. Of the 1177 linear feet of stream impacts, only 202 feet were found to be perennial and required mitigation by the DWQ. Payment was sent to the Wetland Restoration Program to compensate for these impacts. Since that time, additional adjustments have been made in the alignment that have reduced the wetland impacts to 0.194 acre and the stream impacts to 495 linear feet. The mitigable stream impacts are still 202 feet, so no change to the wetland mitigation is anticipated. Attached are maps that show the new alignment as well as a summary table itemizing the impacts by site. 2 It is requested that these activities will be permitted under a Section 404 NWP 14.
