I'm forwarding some correspondence relating to 09-0849. The Corps issued different
Nationwide permits than what was requested, and I had already issued the 401. So, I'm
having to re-issue the 401 with the correct WQC's. The official request came in this
week and I went ahead and processed it as 20090849 v.2. If you have any questions, give

I will need to re-issue the 401 with the correct GC's. The Water Quality Certification
that corresponds to the NW3 (3687) is different than the one that corresponds to the NW33
(3688). The GC for the NW 13 obviously will not change. As long as nothing else in the
application has changed, I don't see any reason to re-submit the whole package. Just
send a cover letter stating what you're requesting and why (basically what you've said in
this e-mail), along with page 1 of the PCN with section 1(b) and 1(c) revised with your
initials and date somewhere on it. I can turn this around in short order once I get you
request as nothing else in the 401 will change. Let me know if you have any questions. -

Hi. Garcy-
In preparation for distributing all the permits for this project I realize that there is
a discrepancy between the Sec. 401 and 404 permits. William Wescott of OSACE said in an
email (I'll send it right now) that this project would be covered under NWP 3 and 13 with
no notification to OSACE required. DWQ issued WQ Certs. based on what we asked for in
our cover letter, NWP 13 and 33.
We're not too sure how to proceed and if we need request a change of permits so that the
401's match the 404's. What do you think?
I realize now that I should have forwarded William's email to you initially to avoid this
in the first place. .
