This certification authorizes a modification to the proposed mitigation plan. 0.036 acres of previously identified cypress-gum swamp will be restored as emergent marsh to facilitate the construction of public utilities through the site. The project shall be constructed pursuant to the Certification issued on June 16, 1999. All the authorized activities and conditions of certification associated with the original Water Quality Certification dated June 16, 1999 still apply. If total wetland fills for this project (now or in the future exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to remain valid, you are required to comply with all the conditions listed below. In addition, you should obtain all other federal, state or local permits before proceeding with your project including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations. Condition(s) of Certification: 1. Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of two manuals. Either the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR Regional or Central Offices). The control practices shall be utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTUs in all fresh water streams and rivers not designated as trout waters; 25 NTUs in all lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters); 2. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural grade restored after the Division of Land Resources has released the project; 3. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 4. There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this permit without appropriate modification of this permit. Should waste or borrow sites be located in wetlands or stream, compensatory mitigation will be required since it is a direct impact from road construction activities; 5. Compensatory mitigation shall be done in accordance with the Mitigation Proposal submitted with your modification request and attached hereto. DWQ shall be copied on a detailed mitigation and monitoring plans as well as the annual reports for the entire length of the monitoring period. The draft mitigation plan shall be sent to DQW within one month of issuance of the 404 Permit. 6. All other conditions written into previous Water Quality Certifications for this project still apply. Violations of any condition herein set forth shall result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. If this Certification is unacceptable to you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. If modifications are made to an original Certification, you have the right to an adjudicatory hearing on the modifications upon written request within sixty (60) days following receipt of the Certification. No. B-2225. AID 1995005645. The North Carolina Department of Transportation (NCDOT) proposes to replace bridge number 411 in its existing location with a new two-lane bridge that will accommodate northbound traffic. Pitt Street will be extended across the Tar River with a second two- lane bridge 330 feet upstream of Bridge 411 and will accommodate southbound traffic. Section 404 and 401 permits were issued June 30, 1999. On August 25, 1999 we submitted a letter to you describing work to be done by the Greenville Utilities Commission (GUC) and Carolina Power and Light (CP&L) and a request that the permit be modified to include the utility work. As we described in the August 25 letter, the work will result in a minor change to the Greene Street Mitigation site. Specifically, 0.036 acres of the Green Street Mitigation Site located within the transmission line right-of-way will become emergent marsh instead of cypress swamp. This area will be graded as described in the Mitigation Plan. In keeping with the needs of keeping the utility lines clear, the area will be planted with marsh vegetation and the area will become 0.036 acres of emergent wetland. The mitigation site will still provide more than a 2:1 ratio of cypress swamp and bottomland hardwood restoration for mitigation of the impacts from project B-2225. Please be advised that the acreage of impacts and mitigation has not changed from the original application. The only change was to convert a 0.036 acre area of cypress swamp restoration to emergent marsh. The Greene Street Mitigation site provided more cypress swamp restoration than needed by project B-2225 a A `y S for a 2:1 restoration ratio. The following paragraphs, excerpted from the original permit application, summarize the impacts from the construction of B-2225 and the proposed mitigation. Summary of project impacts: Impacts to jurisdictional wetlands were determined to be 0.66 acres which consisted of 0.11 acres of impacts from mechanized clearing and 0.55 acres of fill. In addition, there will be 0.50 acres of temporary fill in jurisdictional wetlands and 0.04 acres of temporary fill in surface waters from the causeways that will provide access for the construction equipment. There will be no permanent impact to streams. Mitigation: In addition to the avoidance and minimization measures implemented in the design of the project, we are proposing compensatory mitigation from the Greene Street Mitigation Site. This mitigation site will provide approximately 1.75 acres of creation/restoration, 0.40 acres of enhancement, and 0.95 acres of preservation of upland levee forest and adjacent bottomlands. The Greene Street Site is located adjacent to and within the right-of-way ofthe proposed project. Mr. John Hennessy of the North Carolina Division of Water Quality stated on October 1, 1999 that the DWQ must issue a revised Section 401 permit. Further he stated that the processing of the permit application would require payment of a fee of $200.00 in compliance with Section 143-215.3D(e) of the NCAA. In compliance with this request, we are herewith transmitting the check for $200.00 attached to a copy of the original permit modification request. Two utility companies, Greenville Utilities Commission (GUC) and Carolina Power and Light (CP&L) have now informed us that the relocation of the utility lines will impact jurisdictional wetlands. There will be two types of impacts. L The first will result from hand clearing less than 0.05 acres of wetlands. We understand that this activity is not jurisdictional and therefore would not require approval by either the USACE or the NC Division of Water Quality (DWQ). We are providing this information as a courtesy for your information and because the hand clearing will take place adjacent to our bridge construction zone. 2. The second impact will be from the placement of structures in jurisdictional wetlands. The structures will be concrete in tightly sealed forms and the material will be used as structural members for a standard support for the transmission line footings. These are the types of structures permitted under Nationwide permit number 25, a permit that does not require notification to the USACE nor to the DWQ. The CP&L line will not have any structures in jurisdictional water of the United States. The GUC line will have three poles placed in jurisdictional waters of the United States as shown on the attached drawings. Further, it has come to our attention that 0.036 acres of the Green Street Mitigation Site is located within the transmission line right-of-way. This area will be graded as described in the Mitigation Plan. In keeping with the needs of keeping the utility lines clear, the area will be planted with marsh vegetation and the area will become 0.036 acres of emergent wetland. The North Carolina Department of Transportation (NCDOT) proposes to replace bridge number 411 in its existing location with a new two-lane bridge that will accommodate northbound traffic. Pitt Street will be extended across the Tar River with a second two- lane bridge 330 feet upstream of Bridge 411 and will accommodate southbound traffic. Section 404 and 401 permits were issued June 30, 1999. On August 25, 1999 we submitted a letter to you describing work to be done by the Greenville Utilities Commission (GUC) and Carolina Power and Light (CP&L) and a request that the permit be modified to include the utility work. As we described in the August 25 letter, the work will result in a minor change to the Greene Street Mitigation site. Specifically, 0.036 acres of the Green Street Mitigation Site located within the transmission line right-of-way will become emergent marsh instead of cypress swamp. This area will be graded as described in the Mitigation Plan. In keeping with the needs of keeping the utility lines clear, the area will be planted with marsh vegetation and the area will become 0.036 acres of emergent wetland. The mitigation site will still provide more than a 2:1 ratio of cypress swamp and bottomland hardwood restoration for mitigation of the impacts from project B-2225. Please be advised that the acreage of impacts and mitigation has not changed from the original application. The only change was to convert a 0.036 acre area of cypress swamp restoration to emergent marsh. The Greene Street Mitigation site provided more cypress swamp restoration than needed by project B-2225 for a 2:1 restoration ratio. The following paragraphs, excerpted from the original permit ft application, summarize the impacts from the construction of B-2225 and the proposed mitigation. Summary of project impacts: Impacts to jurisdictional wetlands were determined to be 0.66 acres which consisted of 0.11 acres of impacts from mechanized clearing and 0.55 acres of fill. In addition, there will be 0.50 acres of temporary fill in jurisdictional wetlands and 0.04 acres of temporary fill in surface waters from the causeways that will provide access for the construction equipment. There will be no permanent impact to streams. Mitigation: In addition to the avoidance and minimization measures implemented in the design of the project, we are proposing compensatory mitigation from the Greene Street Mitigation Site. This mitigation site will provide approximately 1.75 acres of creation/restoration, 0.40 acres of enhancement, and 0.95 acres of preservation of upland levee forest and adjacent bottomlands. The Greene Street Site is located adjacent to and within the right-of-way of the proposed project. Mr. John Hennessy of the North Carolina Division of Water Quality stated on October 1, 1999 that the DWQ must issue a revised Section 401 permit. Further he stated that the processing of the permit application would require payment of a fee of $200.00 in compliance with Section 143-215.3D(e) of the NCAA. We understand that this activity is not jurisdictional and therefore would not require approval by either the USACE or the NC Division of Water Quality (DWQ). We are providing this information as a courtesy for your information and because the hand clearing will take place adjacent to our bridge construction zone. 2. The second impact will be from the placement of structures in jurisdictional wetlands. The structures will be concrete in tightly sealed forms and the material will be used as structural members for a standard support for the transmission line footings. These are the types of structures permitted under Nationwide permit number 25, a permit that does not require notification to the USACE nor to the DWQ. The CP&L line will not have any structures in jurisdictional water of the United States. The GUC line will have three poles placed in jurisdictional waters of the United States as shown on the attached drawings. The North Carolina Department of Transportation (NCDOT) proposes to replace bridge number 411 in its existing location with a new two-lane bridge that will accommodate northbound traffic. Pitt Street will be extended across the Tar River with a second two- lane bridge 330 feet upstream of Bridge 411 and will accommodate southbound traffic. Section 404 and 401 permits were issued June 30, 1999. On August 25, 1999 we submitted a letter to you describing work to be done by the Greenville Utilities Commission (GUC) and Carolina Power and Light (CP&L) and a request that the permit be modified to include the utility work. As we described in the August 25 letter, the work will result in a minor change to the Greene Street Mitigation site. Specifically, 0.036 acres of the Green Street Mitigation Site located within the transmission line right-of-way will become emergent marsh instead of cypress swamp. This area will be graded as described in the Mitigation Plan. In keeping with the needs of keeping the utility lines clear, the area will be planted with marsh vegetation and the area will become 0.036 acres of emergent wetland. The mitigation site will still provide more than a 2:1 ratio of cypress swamp and bottomland hardwood restoration for mitigation of the impacts from project B-2225. Please be advised that the acreage of impacts and mitigation has not changed from the original application. The only change was to convert a 0.036 acre area of cypress swamp restoration to emergent marsh. The Greene Street Mitigation site provided more cypress swamp restoration than needed by project B-2225 for a 2:1 restoration ratio. The following paragraphs, excerpted from the original permit 4 application, summarize the impacts from the construction of B-2225 and the proposed mitigation. Summary of project impacts: Impacts to jurisdictional wetlands were determined to be 0.66 acres which consisted of 0.11 acres of impacts from mechanized clearing and 0.55 acres of fill. In addition, there will be 0.50 acres of temporary fill in jurisdictional wetlands and 0.04 acres of temporary fill in surface waters from the causeways that will provide access for the construction equipment. There will be no permanent impact to streams. Mitigation: In addition to the avoidance and minimization measures implemented in the design of the project, we are proposing compensatory mitigation from the Greene Street Mitigation Site. This mitigation site will provide approximately 1.75 acres of creation/restoration, 0.40 acres of enhancement, and 0.95 acres of preservation of upland levee forest and adjacent bottomlands. The Greene Street Site is located adjacent to and within the right-of-way of the proposed project. Mr. John Hennessy of the North Carolina Division of Water Quality stated on October 1, 1999 that the DWQ must issue a revised Section 401 permit. Further he stated that the processing of the permit application would require payment of a fee of $200.00 in compliance with Section 143-215.31)(e) of the NCAA. Two utility companies, Greenville Utilities Commission (GUC) and Carolina Power and Light (CP&L) have now informed us that the relocation of the utility lines will impact jurisdictional wetlands. There will be two types of impacts. 1 The first will result from hand clearing less than 0.05 acres of wetlands. We understand that this activity is not jurisdictional and therefore would not require approval by either the USACE or the NC Division of Water Quality (DWQ). We are providing this information as a courtesy for your information and because the hand clearing will take place adjacent to our bridge construction zone. 2. The second impact will be from the placement of structures in jurisdictional wetlands. The structures will be concrete in tightly sealed forms and the material will be used as structural members for a standard support for the transmission line footings. These are the types of structures permitted under I Nationwide permit number 25, a permit that does not require notification to the USACE nor to the DWQ. The CP&L line will not have any structures in jurisdictional water of the United States. The GUC line will have three poles placed in jurisdictional waters of the United States as shown on the attached drawings. Further, it has come to our attention that 0.036 acres of the Green Street Mitigation Site is located within the transmission line right-of-way. This area will be graded as described in the Mitigation Plan. Section 404 and 401 permits were issued June 30, 1999. Two utility companies, Greenville Utilities Commission (GUC) and Carolina Power and Light (CP&L) have now informed us that the relocation of the utility lines will impact jurisdictional wetlands. There will be two types of impacts. 1. The first will result from hand clearing less than 0.05 acres of wetlands. We understand that this activity is not jurisdictional and therefore would not require approval by either the USACE or the NC Division of Water Quality (DWQ). We are providing this information as a courtesy for your information and because the hand clearing will take place adjacent to our bridge construction zone. 2. The second impact will be from the placement of structures in jurisdictional wetlands. The structures will be concrete in tightly sealed forms and the material will be used as structural members for a standard support for the transmission line footings. These are the types of structures permitted under i Nationwide permit number 25, a permit that does not require notification to the USACE nor to the DWQ. The CP&L line will not have any structures in jurisdictional water of the United States. The GUC line will have three poles placed in jurisdictional waters of the United States as shown on the attached drawings. Further, it has come to our attention that 0.036 acres of the Green Street Mitigation Site is located within the transmission line right-of-way. This area will be graded as described in the Mitigation Plan. In keeping with the needs of keeping the utility lines clear, the area will be planted with marsh vegetation and the area will become 0.036 acres of emergent wetland. The mitigation site will still provide more than a 2:1 ratio of cypress swamp and bottomland hardwood restoration for mitigation of the impacts from project B-2225. On August 25, 1999 we submitted a letter to you describing work to be done by the Greenville Utilities Commission (GUC) and Carolina Power and Light (CP&L) and a request that the permit be modified to include the utility work. As we described in the August 25 letter, the work will result in a minor change to the Greene Street Mitigation site. Specifically, 0.036 acres of the Green Street Mitigation Site located within the transmission line right-of-way will become emergent marsh instead of cypress swamp. This area will be graded as described in the Mitigation Plan. In keeping with the needs of keeping the utility lines clear, the area will be planted with marsh vegetation and the area will become 0.036 acres of emergent wetland. The mitigation site will still provide more than a 2:1 ratio of cypress swamp and bottomland hardwood restoration for mitigation of the impacts from project B-2225. Please be advised that the acreage of impacts and mitigation has not changed from the original application. The only change was to convert a 0.036 acre area of cypress swamp restoration to emergent marsh. The Greene Street Mitigation site provided more cypress swamp restoration than needed by project B-2225 for a 2:1 restoration ratio. The following paragraphs, excerpted from the original permit application, summarize the impacts from the construction of B-2225 and the proposed mitigation. SummM of project impacts: Impacts to jurisdictional wetlands were determined to be 0.66 acres which consisted of 0.11 acres of impacts from mechanized clearing and 0.55 acres of fill. In addition, there will be 0.50 acres of temporary fill in jurisdictional wetlands and 0.04 acres of temporary fill in surface waters from the causeways that will provide access for the construction equipment. There will be no permanent impact to streams. Miti ation: In addition to the avoidance and minimization measures implemented in the design of the project, we are proposing compensatory mitigation from the Greene Street Mitigation Site. This mitigation site will provide approximately 1.75 acres of creation/restoration, 0.40 acres of enhancement, and 0.95 acres of preservation of upland levee forest and adjacent bottomlands. The Greene Street Site is located adjacent to and within the right-of-way of the proposed project. The North Carolina Department of Transportation (NCDOT) proposes to replace bridge number 411 in its existing location with a new two-lane bridge that will accommodate northbound traffic. Pitt Street will be extended across the Tar River with a second two- lane bridge 330 feet upstream of Bridge 411 and will accommodate southbound traffic. Section 404 and 401 permits were issued June 30, 1999. On August 25, 1999 we submitted a letter to you describing work to be done by the Greenville Utilities Commission (GUC) and Carolina Power and Light (CP&L) and a request that the permit be modified to include the utility work. As we described in the August 25 letter, the work will result in a minor change to the Greene Street Mitigation site. Specifically, 0.036 acres of the Green Street Mitigation Site located within the transmission line right-of-way will become emergent marsh instead of cypress swamp. This area will be graded as described in the Mitigation Plan. In keeping with the needs of keeping the utility lines clear, the area will be planted with marsh vegetation and the area will become 0.036 acres of emergent wetland. The mitigation site will still provide more than a 2:1 ratio of cypress swamp and bottomland hardwood restoration for mitigation of the impacts from project B-2225. Please be advised that the acreage of impacts and mitigation has not changed from the original application. The only change was to convert a 0.036 acre area of cypress swamp restoration to emergent marsh. The Greene Street Mitigation site provided more cypress swamp restoration than needed by project B-2225 r for a 2:1 restoration ratio. The following paragraphs, excerpted from the original permit application, summarize the impacts from the construction of B-2225 and the proposed mitigation. SummM of project impacts: Impacts to jurisdictional wetlands were determined to be 0.66 acres which consisted of 0.11 acres of impacts from mechanized clearing and 0.55 acres of fill. In addition, there will be 0.50 acres of temporary fill in jurisdictional wetlands and 0.04 acres of temporary fill in surface waters from the causeways that will provide access for the construction equipment. There will be no permanent impact to streams. Mitigation: In addition to the avoidance and minimization measures implemented in the design of the project, we are proposing compensatory mitigation from the Greene Street Mitigation Site. This mitigation site will provide approximately 1.75 acres of creation/restoration, 0.40 acres of enhancement, and 0.95 acres of preservation of upland levee forest and adjacent bottomlands. The Greene Street Site is located adjacent to and within the right-of-way of the proposed project. Mr. John Hennessy of the North Carolina Division of Water Quality stated on October 1, 1999 that the DWQ must issue a revised Section 401 permit. Further he stated that the processing of the permit application would require payment of a fee of $200.00 in compliance with Section 143-215.30(e) of the NCAA. We understand that this activity is not jurisdictional and therefore would not require approval by either the USACE or the NC Division of Water Quality (DWQ). We are providing this information as a courtesy for your information and because the hand clearing will take place adjacent to our bridge construction zone. 2. The second impact will be from the placement of structures in jurisdictional wetlands. The structures will be concrete in tightly sealed forms and the material will be used as structural members for a standard support for the transmission line footings. These are the types of structures permitted under s Nationwide permit number 25, a permit that does not require notification to the USACE nor to the DWQ. The CP&L line will not have any structures in jurisdictional water of the United States. The GUC line will have three poles placed in jurisdictional waters of the United States as shown on the attached drawings. As mentioned in Item D, the DWQ "has concerns -about the proposed success criteria for the restoration of the cypress-guru swamp..: " and. "that the site would have an insufficient quantity of water to prevent the establishment of invasive tree species, resulting in the restoration. of a bottomland hardwood.: forest in lieu of a cypress-gum swamp." The existing cypress swamp was found to be at.an. elevation of about 1 meter above mean sea level with pockets of microtepography. When the mitigation (CADD) plans were sent to NCDOT Roadway besign Group, they were notified to grade the proposed cypress swamp to 1.0 meter, leaving areas of microtopography. This grading plan allows the mitigated wetland area to be at the same elevation as the existing cypress swamp. At this elevation, the existing cypress swamp receives frequent flooding for prolonged periods of time. In areas of prolonged flooding, typically only obligate wetland species survive. Consequently, this flooding regime will not allow invasive species to thrive. After conferring with Mike Bell (USACElE). and John Hennessy (DWQ), we have changed the criteria for successful hydrologic restoration for the newly created/restored cypress swamp. In the cypress swamp area to'be crcated/restored, success will be determined using data from monitoring wells to -dewnstrate that inundation or saturation within 12 inches of the ground has existed. consecutively for at least 25% of the growing season- Should either community fail to meet,their criieria (12.5% for bottomlands as stated in the mitigation plan and 25% for swamp forest), a.comparative analysis of the hydraulic data from the restoration/creation area and corresponding reference area will be performed to determine whether the data are statistically different. Success will be achieved if one of the. abovecriteria-(percentage of growing season or statistically similar water levels between',wells) is met and if the planted vegetation are successful. We will amend the original mitigation plan to change the location of well #3 (labeled #3 in the mitigation plan). Another set of wells, already proposed for the bottoniland area (#2 in the plan) will be left in place. Duplicate surface water wells (#3a) will be placed in between the bridges in the existing swam} forest, two years prior to mitigation implementation. The hydrologic information obtained from: this well could be beneficial for future mitigation projects- Two additional.s?face water wells (#3b) will be placed in the restored /created swamp forest. Duplicate wells are being placed in the swamp forest areas to reduce the chance of failure due to vandalism, malfunction or inundation. Item E states that "The DWQ is concerned about the proposed success criteria for the species diversity and composition for the cypress gum-swamp restoration site. The application proposes that no one species should compose greater than 20% of the total density. However, a cypress-gum swamp,systern.is characterized by the dominance of primarily cypress and gum species," Cypress-gum swamps may be do, minated.by either cypress or gum species or both species (Schafale 1990*). The particular cypress=swamp for which we arc-mitigating is dominated by cypress (Taxodiunr distichum), along.with cottonwood (Populus heterophylla), water hickory (Carya aquatica) and ash (Frayin:us spp.). We propose to plant other species such as tupelo gum. (Nyssa aquatiea) which is highly beneficial for wildlife. Since many cypress-guru, swamps contain predominately these two species, we would prefer to plant a mixture of trees with cypress and tupelo gum comprising 40% each of the total species. We proposethat the remaining 20% of the tree species consist of two or more of the following trees species: green.ash (Fraxinus pennsylvanica), water ash (F. caroliniana), ? toa d (Populus heterophylla), or water hickory (Carya aqualica), depending on availability. The cover letter dated January 14, 1997, which requested the Coast Guard's concurrence with the proposed minimum vertical clearance of 20.7 feet between the normal water surface elevation and the low chord in the channel for the proposed bridge has also been reviewed. You state in your letter that this request is based on the railroad bridge, mile 59.1, located upstream of Bridge No. 411 which has an underclearance of 20.7 feet. According to the case file for this railroad bridge, the U.S. Army Corps of Engineers approved a minimum vertical clearance of 24 feet in 1951. If the present vertical clearance of the railroad bridge is 20.7 feet, then we concur with the proposed 20.7-foot vertical clearance for the replacement of Bridge No. 411. Should it be revealed during the preliminary stages and public review that the vertical clearance for the railroad bridge is greater than 20.7 feet, we may have to rescind this concurrence. The Coast Guard's procedures and policies are published in a Commandant Instruction entitled "National Environmental Policy Act Implementing Procedures and Policy for Considering Environmental Impacts" (COMDTINST M16475.1B). Under section 2.B.2.e.(32)(a) of Commandant Instruction M16475.12.(as amended,. 59 FR 38654, 29 July 1994), Categorical Exclusions can be used for modifications or replacements of an existing bridge on essentially the same alignment or location. Excluded are bridges with historic significance or bridges providing access to undeveloped barrier islands and beaches. Section 2.B.2.e.(32)(g) of this section states that another Department of Transportation agency acting as lead agency can classify a bridge program action as a CE; however, in referring back to section 2.B.2.e.(32)(a), historic bridges are excluded. Since a CE will not be accepted, you will need to provide us with a Finding of No Significant Impact for this project. In the meantime, your application for a bridge permit will be held in abeyance. Based on the information you have submitted, and our knowledge of this site, we have determined that your proposed project would cause greater than minimal adverse impacts to the environment and cannot be authorized under nationwide permit as presently proposed. Should you wish to further pursue Department of the Army permit authorization, you have the options of either applying for an individual Department of the Army permit, or modifying your present proposal to reduce impacts. A second bridge, extending Pitt Street across the Tar River, will be located 330 feet upstream of Bridge 411. The Greene Street bridge and the Pitt Street bridge will operate as a one-way pair circulating northbound and southbound traffic through the central business district of Greenville. We have provided a channel span with minimum vertical clearance of 7.018 meters (23.025 feet) above the O.H.W. for the Greene Street bridge and 8.685 meters (28.494 feet) above the O.H.W. for the Pitt Street bridge. The minimum horizontal clearance is 25.609 meters (84.019 feet) for the Greene Street bridge and 25.570 meters (83.891 feet) for the Pitt Street bridge. This vertical clearance is in compliance with the 20.7-foot clearance that you concurred with in a January 30, 1997 letter from your agency (copy of letter enclosed). These bridges do not have fender guide systems nor have they been designed for Vessel Collision. Navigational lights will be provided if required by the USCG. 2 Legal authority for the bridge is found in the General Bridge Act of 1946. Federal funds will be utilized for this project. However, the U.S. Army Corps of Engineers must approve this project under Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act. The N.C. Division of Water Quality (DWQ) must approve this project under Section 401 of the Clean Water Act. The NCDOT is preparing and will submit a Joint Permit Application (JPA) for both State and Federal Permits. The NCDOT analyzed the potential environmental impacts of the project in an Environmental Assessment and Programmatic Section 4(f) evaluation (EA) that was. signed by the. Federal Highway Administration (FHWA) on December 17, 1996. The FHWA has determined that this project will not have a significant effect on the human environment (FONSI signed February 27, 1997). The environmental impacts of the project are listed on pages 35`-38. of the EA. The bridge project over Tar River is designated as B-2225, and the impacts are given on Sheets 3 and 4. NoRRIs TOLSON SECRETARY SUBJECT: Pitt County, Replacement of Bridge No. 411 SR 1531 (Green Street) and Construction of Parallel Structure on Extension of Pitt Street, over the Tar River, Federal Project No. BRM-6964(1), State Project No. 8.222060 1, T.I.P. No. B-2225. Please reference the October 9, 1998 application made by the North Carolina Department of Transportation (NCDOT) for approval by the Commandant, U.S. Coast Guard, of the location and plans of two bridges to be constructed across the Tar River in Greenville, North Carolina. The bridges are located roughly 59 miles above the mouth of the waterway as shown on the attached plans. We propose to replace the existing Greene Street bridge over the Tar River with a new bridge on the same location. A second bridge, extending Pitt Street across the Tar River, will be located 330 feet upstream of Bridge 411. The Greene Street bridge and the Pitt Street bridge will operate as a one-way pair circulating northbound and southbound traffic through the central business district of Greenville. The NCDOT is in receipt of your letter dated October 26, 1998 requesting additional information on the subject project. Ms. Gail Grimes, P. E., of our Consulting Engineering Unit, has indicated that through conversations with Ms. Linda Gilliam of your staff it has been determined the following information will be sufficient to continue processing the permit application. 1) Wetland impact report detailing the exact amount of impact to jurisdictional wetlands. 4 2) Structure information detailing the proposed horizontal span lengths, vertical clearance distances and the approximate normal water surface elevation for bridges up and downstream of the Green Street bridge over the Tar River. Please find attached the above listed information. The NCODT requests that review of the proposed project for authorization under an U.S. Coast Guard Permit be continued. It is also requested that any correspondence from your office regarding this project include the NCDOT TIP Number (B-2225).
