APPROVAL of 401 Water Quality Certification and ADDTPIONAL CONDUIONS

} Dear Mr. Bryan:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 108 feet
of stream and relocate 476 feet of stream for the purpose of improving SR 1302 as, described in your application dated 12 October
1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers
3102 and 3108. These certifications allow you to use Nationwide Permit Numbers 14 and 26 when the Corps of Engineers issues
it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not
limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This
approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. The stream channel shall be constructed in the dry to match existing dimension, pattern and profile.
2. Woody vegetation shall be planted in the newly established riparian zone. Planting in the channel shall include black willow, silky
dogwood and tag alder at 6,727 stems per hectare while plantings in the riparian zone shall include black cherry, sycamore, river
birch and red maple at 1,680 stems per hectare.
3. New culverts or extensions shall be installed in the streambed so as not to impede fish movement.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

Dear Mr. Lund:
I have enclosed a straight line diagram with erosion control plan, a PCN application for
NWP #26, and a location map relative to the paving project on SR 1302, Sweet Creek
Road, Mitchell County, NC.
Sweet Creek Road is currently a 14-16 feet wide gravel road. Division of Highways
plans to pave the road 18 feet wide and increase the typical section. Grading will be light
to moderate. The project starts at the end of pavement on SR 1300 and proceeds north
for a distance of 0.91 miles.
We propose to extend four culverts on Sweet Creek at survey stations 12+73, 31+50,
34+25, and 35+93. The total linear feet of culvert extensions will be 108 feet. Existing
channel morphology will be maintained upstream and downstream of the culvert.
Riparian vegetation will be reestablished along disturbed areas associated with the culvert
extensions. Natural substrates will be placed in disturbed channels following placement
of the culvert.
Stream channel relocation is also proposed for 476 linear feet of Sweet Creek. The
proposed relocations are necessary due to location of existing residences adjacent to road
alignment. The proposed stream channel will be constructed according to existing
pattern, profile, and dimensions of Sweet Creek. Stream construction will be performed
in the dry and natural stream substrates and riparian vegetation will be reestablished
along the new channel.

concerning the permit request.
By copy of this letter, we are asking W. Neil Trivette, Area Roadside Environmental
Engineer, to comment on the above project. A buffer variance will be required temporary
encroachment into the 25-foot buffer zone from stations 2+46 to 9+50, 14+00 to 23+20,
and 27+28 to 45+00.
By copy of this letter, I am forwarding seven (7) copies of the application package to
John Dorney, NC DENR, Division of Water Quality, 401/Wetland Unit for review. A
'$475.00 check (#6443) is enclosed for application processing. Please forward comments
directly to the Corps with copy to Division 13 Environmental Officer.

We DroDose to erade, drain base. Dave, and install erosion control measures for SR 1302 (Sweet Creek
Road). The proiect will involve extension of four existing culverts on Sweet Creek and tributaries at
survey stations 12+73. 31+50, 34+25, and 35+93 (see attached culvert sheet). The total linear extension
will be 108 feet. Stream channel relocation is proposed from survey station 21+50 to 23+20 and from
27+38 to 30+44. A total of 476 linear feet of stream will be relocated. The relocated channel will be
constructed with similar pattern, profile, and dimensions to the existing channel (plan and cross-sections
attached). Mechanical eauiDment will include backhoe, eraders, trucks, and Davine machinerv.

NOTES AND PROVISIONS PERTAINING TO STRAIGHT LINE DIAGRAM
1. Assigned right of way agent needs to verify all property owners. Property owners shown on
the straight line diagram are taken from tax maps only.
2. Fences to be moved off the right of way and reset off right of way by the Department of
Transportation crews. Any new materials, posts, wire, etc.. to be supplied by the property
owner.
3.,; Existing asphalt or concrete drives to be tied in with asphalt if the existing driveway is
within 20 feet of proposed centerline. See any exceptions on straight line diagram.
4. Driveway pipes to be furnished and installed as needed by Department of Transportation
crews in existing driveways.

EROSION CONTROL PLAN SHEET
Generally,; the order of installation of the erosion control measures will be as
follows:
Temporary silt basins shall be installed before clearing and
grubbing begins.
Silt fences and temporary silt ditches shall be installed after
clearing and before grading.
Temporary stone ditch checks shall be installed as soon as
ditch line is established.
Ripe outlet and inlet protection will be done as soon as the
pipe is installed.
Seeding and other permanent erosion control measures are
to be implemented as soon as practical.
Temporary rock silt checks (type B) will be spaced as required
by percent of grade as described on page VI-16 in the Erosion
And Sedimentation Guidelines.
No. 5 stone, or equivalent, will be used in conjunction with
temporary rock silt check Type-B in locations where water is
leaving the project or entering a pipe.
Silt basin size is 12'x3'x2' for 100 feet of disturbed ditch line unless otherwise
noted.
Silt basin (Type B) are designed for 1200 cubic feet per acre every storm event
and cleaned out when half full.
