Box 3136 Greensboro, NC 27402-3136 Subject: Notice of Violation and Recommendation for Enforcement Sodium Hypochlorite Spill - City of Greensboro Mitchell WTP NPDES Permit No. NCO081426 Guilford County Dear Mr. Drew: On May 4, 2015 at approximately U:31. pm the Mitchell WTP had an unreported spill of sodium hypochlotite, whi`-S.was washed irito a floor: drain that is connected to the waste clarifier. Excessive chlorine was subsequently discharged from the waste clarifier through outfall # 001 causing a fish kill in North Buffalo Creek, class "C-NSW" waters in the Cape Fear River Basin. Below is a summary of the specific NPDES permit conditions that were violated and the North Carolina water quality standard that was violated due to the event (see attachment for complete wording of permit conditions and the water quality standard). o Failure to take all reasonable steps to prevent any discharge with a reasonable likelihood of adversely affecting the environment. ® Failure to properly operate and maintain all facilities and systems of treatment to achieve compliance with the conditions of the permit. • Failure to report any noncompliance orally to the Division within 24 hours and file a written report within 5 days following the occurrence of an event that potentially threatens the environment. v Failure to notify the Division with 24 hours and file a written report within 5 days following the occurrence at a water pollution control facility which results in the discharge of significant amounts of wastes which are abnormal in quantity or characteristic. e Rendering North Buffalo Creek unsuitable for aquatic life propagation and the maintenance of biological integrity. 450 West Hanes Mill Road, Suite 300, Winston-Salem, NC 27105 Phone: 336-776-9800 \ Internet: www.ncwaterguality.org An Equal Opportunity \Affirmative Action Employer — Made in part by recycled paper Mr. Steven Drew Page # 2 June 3, 2015 A Notice of Violation/Notice of Recommendation for Enforcement (NOV/NRE) is being issued for the noted violations of North Carolina General Statute (G.S.) 143-215.1 and NPDES Permit No. NC0081426. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143- 215.1. If you wish to provide additional information regarding the noted violation please respond in writing within ten (10) days after receipt of this Notice. A review of your response will be considered along with any information provided in the previous response from the City of Greensboro dated May 28, 2015. You will then be notified of any civil penalties that may be assessed regarding the violations. If no response is received in this Office within the 10 day period, a civil penalty assessment may be prepared. Remedial actions, if not already implemented, should be taken to correct any problems. Section B), Condition (2) — Duty to Mitigate: The Permittee shall take all reasonable steps to minimize or prevent any discharge or sludgeuse or disposal in violation of this permit with a reasonable likelihood of adversely affecting human health or the environment [40 CFR 122.41(d)]. Part II. Section (C), Condition (2) — Proper Operation and. Maintenance: The Permittee shall at all times .properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the Permittee to achieve compliance with 'the conditions of this permit. Proper operation and maintenance also includes adequate laboratory controls and appropriate quality assurance procedures. This provision requires the Permittee to install and operate backup or auxiliary facilities only when necessary to achieve compliance with the conditions of the permit [40 CFR 122.41(e)]. Part II. Section (E), Condition (6a) — Twenty-four Hour Reporting: The Permittee shall report to the Director or the appropriate Regional Office any noncompliance that potentially threatens public health or the environment. Any information shall be provided orally within 24 hours from the time the Permittee -became aware of the circumstances. A written submission shall also be provided within 5 days of the time the Permittee becomes aware of the circumstances. The written submission shall contain a description of the noncompliance, and its cause; the period of noncompliance, including exact dates and times, and if the noncompliance has not been corrected, the anticipated time it is expected to continue; and steps taken or planned to reduce, eliminate, and prevent reoccurrence of the noncompliance [40 CFR 122.41(1)(6)]. Part H. Section (E), Condition (9) — Noncompliance Notification: The Permittee shall report by telephone to either the central office or the appropriate regional office of the Division as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the water pollution control facility which results in the discharge of significant amounts of wastes which are abnormal. in quantity or characteristic, such as the dumping of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass without treatment of all or any portion of the influent to such station or facility. Persons reporting such occurrences by telephone shall also file a written report within 5 days following first knowledge of the occurrence. Water Quality Standard Violated: 15A NCAC 2B .0211 (2) - Conditions Related to Best Usage - the waters shall be suitable for aquatic life propagation and maintenance of biological integrity, wildlife, secondary recreation, and agriculture. Sources of water pollution that preclude any of these uses on either a short-term or long-term basis shall be considered to be violating a water quality standard. ,4City of Greensboro 6,,j North Carolina May 28, 2015 NC DENR Winston-Salem Regional Office Div. of Water Resources - Water Quality Programs 450 West Hanes Mill Road, Suite 300 Winston-Salem, NC 27105 ATTN: Mike Mickey RE: Sodium Hypochlorite Spill Mitchell Filter Plant North Buffalo Creek Water Shed GREENSBORO, NC (May 11, 2015) — On Wednesday evening the City's Water Resources was notified by a citizen that dead fish was seen floating in North Buffalo Creek near Latham Park. The Water Resources Storm Water Division immediately started their investigation with our state regulatory agency. Their investigation revealed the impaired aquatic life was noticed at or near the Mitchell Water Plant dischargecontinuing to the Latham Park area. However upstream, the water was not impaired and aquatic life appeared normal. The Water Resources Water Supply Division was contacted to inquire if any treatment chemicals have been released into North Buffalo Creek. At the time they were unaware of any discharges into the creek. Further investigation by Water Supply Management revealed an unreported chlorine spill by a night shift operator early Tuesday morning. Unfortunately, management did not find out about the nature of the spill until early Friday morning. The operator stated, he "opened the wrong valve and discharged some liquid chlorine bleach into the building drainage system". The operator quickly discovered the error and closed the valve not realizing he released more than his estimation. This system is constantly being monitored and chlorine is always removed or neutralized before being allowed to enter the North Buffalo Creek. Unfortunately this very rare occurrence happened and is not condoned by the State, City, or Department. Corrective action and strict process control has been implemented by the Division and Department to ensure this accident does not happen again. Since the incident: Both operators have been briefed on proper protocol when any chemicals are spilled. The drain in the basement has been plugged to prevent a reoccurrence. All valves are properly tagged and a SOP is in place to ensure procedures for filling day tanks are strictly adhered to. A spill prevention class and discussion will be conducted by Pete D'Adamo for all management staff from Water Supply and TZO on June 5th, 2015. In addition, Peter Schneider from Storm Water will provide a summary and consequences of the hypo spill in North Buffalo Creek. Additional training classes will be scheduled for all employees at a later date. The contractors worked on the lines / valves earlier but did not change the labels. •Operator noticed that day tank wasn't being filled so he opened valve 8 (labeled out of service) and nothing came out. At that point he heard hypo hitting the floor. •He then shut off valve A and B. *He then figured out that the labels on the valves were wrong. •This was Ondrez first time filling the day tanks in this configuration. Everyone prior had no issues. •Approx 113 gallons were unaccounted for. •ORC was not notified until the following morning. *We currently have valve A locked out. This valve should have been locked out sooner. *I'll continue to put systems in place to insure that nothing like this happens again. I did not put two and two together until David Phlegar told me that the fish kill ended at our discharge point in North Buffalo Creek. He was perplexed why it ended there. I immediately asked the Treatment Superintendent and ORC to investigate further. Once they did SCADA revealed that there was over 100 gallons spilled into our waste clarifier through the building drain system. A report was sent to our PR person on May 11th for a draft press release. The first two paragraphs is what I sent to our PR person. We will do everything in our power for this type of incident not happen in the future by educating all our staff and being more vigilant. Buffalo Fish Kill Timeline of Investigation by the Stormwater Management Division 5/7/15 @ 10 am Sewer maintenance received call about dead fish and sewer smell. Sewer crew did not notice any odor other than decaying fish and water was clear. They continued to walk upstream and called us to assist with possible identification of cause of fish kill. 5/7/15 @ 10:30 am Citizen that called in dead fish states that fish were alive Tuesday evening and dead Wednesday evening. He didn't report to the city until Thursday morning. Observed numerous fish various sizes and species (at least 100), noted several crayfish as well. Tracked dead up to water treatment plant outfall. Noted live fish upstream of pipe. 5/7/15 @ 2:30 pm Started at the site of the SSO (400 Montrose) approximately 4.5 miles upstream of fish kill and continued downstream eliminating various branches. This event happened on Tuesday morning and received media attention yesterday. There is no longer chlorine present in the creek. The facility was found to be compliant with the NPDES permit. The inspection findings are detailed below and an inspection checklist is attached for your. records. I. Permit The NPDES. permit expires on June 30, 2016. Please be aware that at the next renewal, the permit will require that the monthly self -monitoring reports (DMRs) for the Mitchell WTP be submitted electronically per new EPA rules. H. Self -Monitoring Program The DMRs were reviewed for the period January 2014 through December 2014. The facility was found to be compliant with all effluent limits and monitoring requirements of the NPDES permit (see data summary attached). It was noted that. the effluent did not pass the chronic toxicity tests conducted in March, September and December. It is our understanding that a consultant is evaluating the toxicity issue. M. Flow Measurement The NPDES permit requires continuous flow recording and annual calibration of the flow measuring device. The daily effluent flow values reported on the DMRs are measured using an in -line totalizirig'met r on the decant line. The meter was last calibrated by City of Greensboro staff on August 12, 2014. IV. Sludge Handling and Disposal Solids that collect in the settling basin/waste clarifier are removed on a daily basis by pumping directly to the Greensboro North Buffalo POTW with final disposal occurring by incineration at the T.Z. Osborne POTW. V. Operations and Maintenance The facility. was competently operated and maintained. It's about 20 feet down to the bottom of the vault in a very tight space. Our operations division is looking for some internal parts for the valve to make it operational again. So far there has been no luck since the valve is about 40 years old. Worse comes to worse we will have to dig down outside the vault and cut in a new valve. All of this will take time. For the most part we can decant most of the water being discharged into the stream. However, there will be times we will have to pump the basin down like we did before to make room for filter backwashes. The water is relatively clear and he turbidities are low. Our sludge remains in the clarifier. It will take about two to three weeks to repair the valve and get things back to normal. We are monitoring closely and foresee no turbidity issues. Thank you. Mitchell Water Treatment Plant — City of Greensboro NPDES Permit No. NCO081426 Guilford County Dear Mr. Drew: On February 7, 2012, Mike Mickey of this office met with Barry Parsons and the staff of the Mitchell Water Treatment Plant (WTP) to perform a Compliance Evaluation Inspection on the NPDES wastewater discharge. This type of inspection consists of two basic parts: an in office file review and an on -site inspection of the treatment facility. The Mitchell WTP was found to be in compliance with the NPDES permit. The attached EPA inspection form notes the eight (8) areas that were evaluated. The findings and observations are outlined below: I. Permit The NPDES permit was recently reissued with an effective date of August 1, 2011. 11. Self -Monitoring Program The monthly self-moriitoring reports (DMR's) were reviewed for the period January 2011 through December 2011. The facility was found to be consistently in compliance with final NPDES effluent limits for the above period (See data summary attached). The only violation noted involved a single pH value that was below the permit minimum of 6.0 S.U. In regards to the permit monitoring requirements, it was noted that all sampling was performed per the frequencies specified in the permit. 111. Flow Measurement r The NPDES permit requires continuous flow recording. The daily effluent flow values reported on the DMR are measured by an in -line totalizing meter. The meter is calibrated by City of Greensboro staff. IV. Sludge Handling and Disposal Solids collected in the settling basin/waste clarifier are drawn off the bottom of the basin on a daily basis and are pumped directly to Greensboro's North Buffalo POTW with final disposal by incineration. Operations and Maintenance The facility appeared to be competently operated and maintained. No problems or concerns were noted. VI. Facility Site Review The existing treatment components for the filter backwash wastewater consist of the following: liquid dechlorination and lime addition at the transfer pump station; a single settling basin/waste clarifier with four floating decanters; an in -line totalizing flow meter; and effluent discharge line. VII. Records/Reports A review of the facility files indicates that all records are being maintained according to the permit. A comparison of the December 2011 self -monitoring report with the corresponding laboratory data sheets showed that all values were transcribed onto the DMR correctly. VIII. EffluentlReceiving Waters The system discharges into North Buffalo Creek, class "C-NSW' waters in the Cape Fear River Basin. None of the finished water sampling sites of the water delivered to Greensboro was affected. The City of Greensboro finished water results for HAAs were compliant throughout the year 2009 to the current date. Although this is not an emergency, as our customers, you have a right to know what happened, what you should do, and what is being done to correct the situation. We routinely monitor for the presence of drinking water contaminants. Testing is conducted on a quarterly basis and compliance is based on the annual running average. The MCL for HAAs is 0.0600 milligrams per liter (mg/L). For the period ending March 2010 and June 2010, the annual running average level of HAAs for the Reidsville coverage area were marginally over this limit at a concentration of 0.0786 mg/L, 0.0795 mg/L, respectively. What should I do? You do not need to use an alternative (e.g., bottled) water supply. However, if you have specific health concerns, consult your doctor. What does this mean? This is not an immediate risk. If it had been, you would have been notified immediately. However, some people who drink the water containing haloacetic acids in excess of the MCL over many years may have an increased risk of getting cancer. What happened? What is being done? When will the problem be corrected? The City of Reidsville exceedance resulted from elevated levels in the third and fourth quarter of 2009, and the second quarter of 2010. The formation of the HAAs are affected by the organic matter in Lake Reidsville, the amount of chlorine in the water, and the contact time of the chlorine with the organic matter. Reidsville has begun evaluating the use of an additional pre-treatment chemical to aid with the removal of the organic matter from the raw water supply Please share this information with all the other persons who drink this water, especially those who may not have received this notice directly (for example; individuals in apartments, nursing homes, schools, businesses, etc). There is no way the turbidity could flow upstream from our point of discharge. They have been doing some grading and landscaping atthe High School up the street for the past couple months. Our Mitchell ORC said the contractors were washing down the road Sunday. When our water is released to the stream it goes through decanters and is clear. Rarely do we discharge high turbidities. Please note that I incorrectly mentioned that a toxicity test failure for two consecutive quarters would result in the monitoring increasing to monthly. That is not correct. The water produced by the facility meets all applicable State and Federal standards. The current average daily production at the facility is 14 MGD. All filter backwash wastewater from the facility flows to a settling basin on the plant site. Filter backwash flow is intermittent based on plant treatment rate and raw water quality conditions. The wastewater -settling basin allows for gravity settling of captured solids and is equipped with four floating decanters, which removes fine solids prior to discharge. As filter backwash flows through the settling basin, solids removed during the treatment process (consisting primarily of Ferric Sulfate precipitate and the captured turbidity causing materials from the untreated raw water) settle to the bottom of the basin leaving a clear supernatant which meets the NPDES permit requirements. Sludge solids generated from the treatment process are drawn off the settling basin bottom on a daily basis and discharged directly to the City's North Buffalo/Metro system of wastewater reclamation plants via sanitary sewer. At the wastewater reclamation plant, sludge solids from the water plant are blended with other wastewater solids and then thickened, dewatered, and incinerated. P.O. The inspection consisted of two parts: an on -site inspection of the treatment facility and a file review. The following are the findings from the subject inspection. I. Permit The NPDES permit for the City of Greensboro's N. L. Mitchell WTP became effective July 1, 2006 and expires on June30, .2011. This permit is for the discharge of filter backwash wastewater. II. Records/Reports A review of the laboratory reports and Discharge Monitoring Reports (DMRs) for the City of Greensboro's N. L. Mitchell WTP revealed only a minor discrepancy between the generated data and the data submitted to the Division. The DMRs for December 2008 and June 2009 will be amended and resubmitted to the Division. A copy of the laboratory data is kept on file at the water plant. Calibration records were evaluated and deemed compliant. The records/reports were very comprehensive and well organized. III: Facility Site Review The facility site review indicated that the. treatment facility is consistent with the permitted components. The subject facility discharges filter backwash wastewater. All components were operating satisfactorily on the date of the subject inspection. IV. Effluent / Receiving Stream The WTP discharges to North Buffalo Creek (Class C-NSW in the Cape Fear River Basin). The receiving waters appeared clear of solids and debris on the date of the subject inspection. V. Flow Measurement The flow meter is calibrated by WTP staff at least once a year.
