DEPARTMENT OF THE ARMY WILMINGTON DISTRICT, CORPS OF ENGINEERS 69 DARLINGTON AVENUE WILMINGTON, NORTH CAROLINA 28403-1343 July 29, 2020 Regulatory Division Action ID: SAW-2018-00240 Re: Publix Super Markets and North Carolina Department of Transportation – Publix Greensboro Distribution Center and associated infrastructure [Transportation Improvement Program (TIP) U-2581BA] Mr. Randy Barber Publix Super Markets, Inc. 501 North Galloway Road Lakeland, Florida 33815 Dear Mr. Barber: Please reference the Department of the Army (DA) permit (SAW-2018-00240) issued to you for discharges of dredged or fill material into waters of the US associated with construction of the Publix Greensboro Distribution Center and associated infrastructure, on your property located off US Highway 70 near its intersection with Birch Creek Road, adjacent to unnamed tributaries to Little Alamance Creek, near Greensboro, in Guilford County, North Carolina. This correspondence also confirms the June 30, 2020, meeting of your agent, Mr. Kevin Wurschmidt of Gray Construction, with Mr. David E. Bailey of my staff to address activities you have undertaken that have been determined to be in noncompliance with the subject DA permit. My staff’s investigation revealed that you are responsible for non-compliance associated with Permit Special Conditions 1, 2, 8, 13b, 13d, and 19, that state: 1. Work Limits: All work authorized by this permit shall be performed in strict compliance with the attached permit plans entitled “Preliminary Jurisdictional Waters of the U.S. Impacts Map” Sheets 1 through 12, “Publix Greensboro Distribution Center” Sheets SW-100 though SW-107, and NCDOT “Wetland and Surface Water Impacts Permit” Permit Drawing Sheets 1 through 14. The Permittees shall ensure that the construction design plans for this project do not deviate from the permit plans attached to this authorization. Any modification to the attached permit plans must be approved by the U.S. Army Corps of Engineers (Corps) prior to any active construction in waters or wetlands. 2. Unauthorized Dredge and/or Fill: Except as authorized by this permit or any Corps-approved modification to this permit, no excavation, fill or mechanized land- - 2 - clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 8. Reporting Violations: Violation of these permit conditions or violation of Section 404 of the Clean Water Act shall be reported to the Corps in writing and by telephone at: 919-554-4884 Ext. 30 / David.E.Bailey2@usace.army.mil within 24 hours of the Permittee’s discovery of the violation. 13. Sediment and Erosion Control: b. No fill or excavation impacts for the purposes of sedimentation and erosion control shall occur within jurisdictional waters, including wetlands, unless the impacts are included on the plan drawings and specifically authorized by this permit. This includes, but is not limited to, sediment control fences and other barriers intended to catch sediment losses. d. The Permittees shall use appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the “North Carolina Sediment and Erosion Control Planning and Design Manual” to ensure compliance with the appropriate turbidity water quality standard. Erosion and sediment control practices shall be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to ensure compliance with the appropriate turbidity water quality standards. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project shall remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). Adequate sedimentation and erosion control measures shall be implemented prior to any ground disturbing activities to minimize impacts to downstream aquatic resources. These measures shall be inspected and maintained regularly, especially following rainfall events. All fill material shall be adequately stabilized at the earliest practicable date to prevent sediment from entering into adjacent waters or wetlands. 19. No discharges of dredged or fill material are authorized by this permit for the purposes of installation of utility lines. Stream impacts for the sewer line crossings of Streams A and J will be avoided through the use of trenchless techniques such as jack and bore or horizontal directional drill, as shown on the permitted plans. - 3 - This work, undertaken without the prior approval from this office in the form of a DA permit or a modification of the permit issued to you is a violation of Section 301 of the Clean Water Act (33 USC 1311). As your agent agreed, you should cease and desist from any further unauthorized work within waters of the United States. As detailed in an email dated July 7, 2020 (attached), several areas of permit non-compliance were noted during our site visit. Following receipt of this email, your agent agreed to remove sediment accumulated within wetlands and streams originating at authorized impact sites and further remediate areas of unauthorized fill material from streams and wetlands. Such areas of unauthorized fill material must either be restored to pre-project elevations and contours or proposed for after-the-fact authorization. The sediment removal and restoration work must be completed within 30 days from the date of your receipt of this correspondence; my staff will work with you on these time sensitive requirements. Your specific proposals for restoration or after-the-fact authorization of unauthorized fill material must also be submitted to my staff within 30 days from the date of your receipt of this correspondence. You are cautioned that failure to honor your commitment to cease and desist from additional unauthorized activities within waters of the United States may result in suspension and/or revocation of your permit. Failure to comply with this request may also result in referral of this matter to the United States Attorney with a recommendation for civil prosecution, and/or a civil penalty for a violation of permit conditions pursuant to 33 USC Section 1319(g). This email is being sent as a follow‐up to our compliance visit on 6/30/2020. In attendance were myself, Chris Hopper  and April Norton with the Corps, and Kevin Wurschmidt with Gray. We looked at the 5 locations where authorized fill  limits (per our Individual Permit dated 2/11/2020) intersected with streams/wetlands and other adjacent areas. This  email notes our findings. Please be aware that we will follow up with a letter in the coming weeks due to several areas  of documented permit non‐compliance.     The Sites referenced below correspond to the attached document:    Compliance Site 1 (see attached map with notes and pictures): The fill slope and sediment basin exceeded the  authorized fill limits, impacting an additional ~41 linear feet of stream. Further, 1 to 4” of sediment from loss events at  the permit site were observed along the extent of the stream from the existing rock check dam to the confluence with  the larger stream, approximately 470 linear feet downstream. On‐site we discussed removing the accumulated sediment  from the sides of the stream channel (rather than the portion of the channel with active flow) with rakes, flat shovels,  and buckets, down to where the sediment changes from construction silt/mud to the sandier natural stream bed  material, along the entire 470 lf reach of the stream channel. Also, options to resolve the ~41 linear feet of stream filled  in beyond permitted limits include restoring the original grade and contour of the stream using natural channel design,  or proposing an after‐the‐fact permit modification.    Also, just to the southwest of Compliance Site 1 it appears that a communications line was installed across the stream.  As our permit did not authorize any stream impacts in this location, please describe how this utility was installed.    Compliance Site 2: The fill slope in this location appeared to be installed approximately within the permitted fill limits.  Evidence of sediment loss events is apparent within and along the stream channel downstream of the impact footprint.  However, the sediment appears stable and within the permitted indirect impact reach of the stream. A large sediment  loss event appears to have occurred in the vicinity of the sewer crossing (not yet installed); it is our understanding that  Guilford Co. has addressed this issue from a sediment and erosion control perspective. Please note that the sewer  crossing in this location is to be installed via jack & bore, and no impacts to the stream are authorized in this location  (see permitted plans and Permit Special Condition 19).    Compliance Site 3: The permitted fill area has been cleared and a check dam has been installed at what appears to be  the permitted fill limits. No grading has occurred in this location and this site is currently in compliance.    Compliance Site 4 (see attached map with notes): Based on my GPS data from the field it is likely that the fill limits  extend approximately 15 linear feet past the authorized impact footprint. Please confirm the existing fill limits (i.e. the  stream‐ward edge of the rock check dam) vs. the permitted fill limits via as‐built survey and report the results to me.  Further, 1 to 4” of sediment from loss events at the permit site were observed along the extent of the stream and  adjacent wetlands from the existing rock check dam to the rip rap just upstream from the confluence with the larger  stream, approximately 573 linear feet downstream (combined with Compliance Site 5 below). On‐site we discussed  removing the accumulated sediment from the sides of the stream channel (rather than the portion of the channel with  2 active flow) and adjacent wetlands (where accumulation >1”) with rakes, flat shovels, and buckets, down to where the  sediment changes from construction silt/mud to the sandier natural stream bed material/natural wetland soil, along the  entire 573 lf reach of the stream channel. A native riparian/wetland seed mix should be spread in wetland areas where  accumulated sediment has been removed.    Compliance Site 5 (see attached map with notes and pictures): The section of sewer required to be installed by jack &  bore (see permitted plans and Permit Special Condition 19) was installed by trenching and the entirety of both stream  banks were subsequently rip rapped. Further, approximately 40 linear feet of the downstream‐most reach of Stream F  and its fringe of adjacent wetlands has been completely rip rapped, and the stream is flowing under the rip rap. All of  the above has occurred outside of the permitted fill limits of the project and is therefore an unauthorized discharge of  dredged and/or fill material. Also, as discussed above, 1 to 4” of sediment from loss events at the permit site were  observed along the extent of the stream and adjacent wetlands from the existing rock check dam to the rip rap just  upstream from the confluence with the larger stream, approximately 573 linear feet downstream (combined with  Compliance Site 4 above). On‐site we discussed removing the accumulated sediment from the sides of the stream  channel (rather than the portion of the channel with active flow) and adjacent wetlands (where accumulation >1”) with  rakes, flat shovels, and buckets, down to where the sediment changes from construction silt/mud to the sandier natural  stream bed material/natural wetland soil, along the entire 573 linear feet reach of the stream channel. A native  riparian/wetland seed mix should be spread in wetland areas where accumulated sediment has been removed. We also  discussed possible resolution of the rip rap discharge in Stream F involving removal of the rip rap and stepping the  stream down to the confluence of the larger stream via 1‐foot step downs using natural channel design – after‐the‐fact  approval of the rip rap in this small stream would be difficult as this material and installation method does not allow for  aquatic life passage, and the stream will likely headcut upstream under the rip rap. Resolution of the trenched sewer  line will be discussed in our forthcoming letter.    Compliance Site 6 (see attached map with notes and pictures): The fill slope in this location appeared to be installed  approximately within the permitted fill limits. Evidence of sediment approximately 1‐4” thick from loss events at the  permit site is apparent within the extent of wetlands downslope of the fill limits. On‐site we discussed removing the  accumulated sediment from the wetlands (where accumulation >1”) with rakes, flat shovels, and buckets, down to  where the sediment changes from construction silt/mud to natural wetland soil, within the entirety of the wetland. A  native riparian/wetland seed mix should be spread in wetland areas where accumulated sediment has been removed.
