Horton, we are requesting modification to the previously issued USACE NWP 29 for authorization of 0.08 acres of temporary wetland impacts and 40 If of temporary stream impacts. We are also requesting modification of the 401 WQC for the above referenced impacts. Please note that there are no proposed changes to the previously authorized 17,086 SF (Zone 1: 10,192 SF; Zone 2: 6,894) of permanent riparian buffer impacts and 418 SF of temporary riparian buffer impacts (Zone 1: N/A; Zone 2: 418 SF), and therefore modification of the Neuse River Riparian Buffer Authorization is not being requested. The project is ±65.52 acres in size and is located at 508 Schnapps Lane, southeast of the intersection of N. Broad Street and Hilltop Needmore Road in Fuquay-Varina, Wake County (Latitude: 35.619396°N; Longitude:-78.812874°W). The project is located in the Neuse River basin and onsite waters drain to Basal Creek [Bass Lake, (Mills Pond)]. The Water Quality Classification for Basal Creek [Bass Lake, (Mills Pond)] is B; NSW and the Stream Index Number is: 27-43-15-3. The cataloging unit for the site is 03020201. Proposed Proiect The purpose of the proposed project is to construct a townhome residential subdivision to meet the existing demand for housing in the Fuquay-Varina area. The proposed project consists of 236 townhome lots, an amenity site, and associated infrastructure, including roads, utilities, greenway and stormwater management. Standard commercial construction equipment and techniques will be used to construct the proposed project. We are requesting modification to the existing 404/401 permits due to a change in construction of the onsite sewer. Your Success. Stream 3 via jack and bore to avoid impacts to Stream 3. However, the contractor has found that there is dense bedrock at very shallow depths, making boring this crossing unfeasible and nearly impossible. Therefore, we are requesting modification to the 404/401 permits to authorize the additional 40 If of temporary stream impacts (Impact 8A) for installation of the sewer line across Stream 3 using traditional open cut methods, in addition to the 0.08 acres of temporary wetland impacts previously authorized. Please note that there are no changes to the buffer impacts, as the buffer impacts associated with the sewer crossing at Stream 3 were previously permitted and the previously authorized 17,086 SF of permanent riparian buffer impacts and 418 SF of temporary riparian buffer impacts will not change, and we are not requesting modification of the previously issued Neuse River Riparian Buffer Authorization. Please also note that the connection to Westec Way is not part of the proposed project and was permitted separately by the Town of Fuquay Varina (USACE AID: SAW-2019-01374/NCDWR Proj #20190923). Proiect History NCDWR issued a Buffer Determination (NBRRO #17-248) for the project area on 09/01/2017. A copy of the Buffer Determination Letter has been provided as an appendix. A Preliminary & Approved Jurisdictional Determination (SAW-2008-00354) was submitted on 07/17/2017 and USACE regulatory project manager James Lastinger field verified WR's delineation and jurisdictional status on 08/03/2017. WR is requesting issuance of the approved Jurisdictional Determination in conjunction with issuance of the NWP 29. The USACE previously issued a NWP 29 for the project (AID: SAW-2008-00354) on 7/26/2018, which has been attached to this application. NCDWR previously issued a 401 WQC & Buffer Authorization for the project (DWR #18-1004) on 8/31/2018, which has been attached to this application. Proposed Impacts The proposed impacts consist of 0.08 acres of temporary wetland impacts, 40 If of temporary stream impacts and 17,086 SF of permanent riparian buffer impacts and 418 SF of temporary riparian buffer impacts. The proposed 0.08 acres of temporary wetland impacts (Impacts 1, 2, 3, 4, 5, 6 & 7) and 40 If of temporary stream impacts (Impact 8A) will occur from sewer main installation and sewer easement construction. The proposed sewer easement will be constructed at grade and will not include any additional fill within the wetlands resulting in 0.08 acres of temporary impacts. Your Success. permanent conversion impacts as a result of permanent conversion from forested wetlands to herbaceous wetlands. The proposed 4,637 SF (Zone 1: 2,436 SF; Zone 2: 2,201 SF) of permanent riparian buffer impacts (Impacts 8 & 9) will result from construction of a sewer line/easement within the riparian buffers. The proposed 12,449 SF (Zone 1: 7,756 SF; Zone 2: 4,693 SF) of permanent riparian buffer impacts (Impacts 10 & 16) will occur from construction of a greenway trail across the existing pond dam to provide pedestrian access to the open space in the eastern portion of the project. The proposed 418 SF (Zone 1: 0 SF; Zone 2: 418 SF) of temporary riparian buffer impacts (Impacts 11, 12, 13, 14 & 15) are required for temporary construction access during construction for the retaining walls along the rear of Lots 89 & 90. Please note that the proposed retaining walls will be constructed outside of the riparian buffers. Avoidance and Minimization Wetlands and Streams Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. The proposed project avoids stream impacts entirely and minimized wetland impact to only those necessary for construction of the gravity sewer main/easement to service the project. The sewer main was designed along the northern edge of the development in order to tie into existing sewer north of the property boundary. The location of the proposed sewer main was designed to avoid wetland impacts to the maximum extent possible but could not completely avoid wetland impacts (Impacts 1, 2, 3, 4, 5, 6 & 7) due to the slopes associate with SCM#1, the amenity site and parking. The sewer main could not be realigned within these slopes to avoid the wetland impacts because the Town of Fuquay-Varina would not approve the alignment. The Town will take over ownership for the sewer main, and the sewer main being located within the steep slope creates major logistical issues within future maintenance of the sewer main and maintenance the easement. Upon completion of the installation of the proposed sewer line, the disturbed wetlands areas will be returned to natural grade and seeded with a wetlands seed mix to restore wetland vegetation. The proposed stream crossing (Impact 8) has been designed to cross the stream perpendicularly to minimize impacts. Upon completion of construction, the stream channel will be restored to pre - construction contours and the banks will be stabilized with biodegradable matting and seeded with a riparian seed mix to provide temporary stabilization until natural recruitment permanently stabilizes the disturbed stream banks. Additionally, the proposed greenway has been designed to utilize pedestrian bridges to avoid stream impacts. The proposed project avoids riparian buffers with the exception of permanent impacts from the sewer main, permanent impacts from the greenway and temporary impacts from construction of retaining walls. The proposed sewer main was designed to avoid buffer impacts to the maximum practical extent. The sewer main was designed along the northern edge of the development in order to tie into existing sewer north of the property boundary. The proposed sewer main avoided riparian buffers with the exception of one stream crossing (Impact 9) and one parallel impact (Impact 8). Impact 9 could not be avoided due to the dam and outfall pipe associated with the large pond to the north, as well as the large wetlands and additional buffers to the south. Impact 9 has been designed to cross riparian buffers at a perpendicular angle to minimize impacts to buffers. As previously discussed, the sewer easement cannot be located on the proposed slope and therefore was designed at the toe of slope, resulting in Impact 8. The proposed greenway avoided all riparian buffers with the exception of a parallel impact on the dam of the pond (Impact 10) and a perpendicular crossing of a beaver impoundment (Impact 16) which is necessary to provide pedestrian access to the eastern portion of the project. The greenway running north/south in the eastern part of the project is part of the larger greenway master plan, which will connect the existing and future development to the existing greenway trail to the north. The greenway crossing over the beaver impoundment has been designed to cross riparian buffers at a perpendicular angle to minimize impacts to buffers. The proposed site requires retaining walls to stabilize the steep slopes from adjacent site fill. The proposed retaining walls throughout the proposed site were designed outside of buffers. The temporary buffer impacts (Impacts 12, 13, 14 & 15) have been limited to only those necessary for temporary access for equipment and labor during construction of the retaining wall. The temporary buffer impacts are considered a "temporary road impacting less than 2500 SF", and therefore is classified as "Exempt". Silt fencing will be installed around all disturbed areas to prevent sediment from escaping into adjacent wetlands and waters during construction. During construction, all equipment will access construction areas from high ground. Mitigation Wetland & Stream Mitigation All proposed wetland and stream impacts are temporary, and therefore mitigation is not proposed. Please not that the perpetual mowing/maintenance of the entire 20' easement will result in 0.08 acres of permanent conversion impacts. Since the proposed permanent conversation impacts are less than 0.10 acres, mitigation is not proposed. The proposed permanent buffer impacts from construction of the greenway is considered "allowable"; therefore, mitigation is not required. The proposed permanent buffer impacts from clearing and maintaining vegetation within the proposed sewer easement is considered "allowable"; therefore, mitigation is not required. The proposed temporary buffer impacts for access during construction of the retaining walls is considered "Temporary roads impacting less than 2500 SF", which is "Exempt". Therefore, buffer mitigation is not proposed. Stormwater Management Plan The stormwater management plan consists of a wet pond stormwater control measure (SCM). The SCM has been designed to remove 85% TSS and TN removal rate of 30%, and therefore diffuse flow is not required. The stormwater management plan will be reviewed and approved by the Town of Fuquay-Varina as the certified municipality. The current permit modification request is for 0.08 acres of temporary wetland impacts, 40 If of temporary stream impacts, 17,086 SF of permanent riparian buffer impacts (Zone 1: 10,192 SF; Zone 2: 6,894) and 418 SF of temporary riparian buffer impacts (Zone 1: N/A; Zone 2: 418 SF) (see the attached maps and PCN for details). Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Wetlands and Streams Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. The proposed project avoids stream impacts entirely and minimized wetland impact to only those necessary for construction of the gravity sewer main/easement to service the project. The sewer main was designed along the northern edge of the development in order to tie into existing sewer north of the property boundary. The location of the proposed sewer main was designed to avoid wetland impacts to the maximum extent possible but could not completely avoid wetland impacts (Impacts 1, 2, 3, 4, 5, 6 & 7) due to the slopes associate with SCN91, the amenity site and parking. The sewer main could not be realigned within these slopes to avoid the wetland impacts because the Town of Fuquay-Varina would not approve the alignment. The Town will take over ownership for the sewer main, and the sewer main being located within the steep slope creates major logistical issues within future maintenance of the sewer main and maintenance the easement. Upon completion of the installation of the proposed sewer line, the disturbed wetlands areas will be returned to natural grade and seeded with a wetlands seed mix to restore wetland vegetation. The proposed stream crossing (Impact 8) has been designed to cross the stream perpendicularly to minimize impacts. Upon completion of construction, the stream channel will be restored to pre -construction contours and the banks will be stabilized with biodegradable matting and seeded with a riparian seed mix to provide temporary stabilization until natural recruitment permanently stabilizes the disturbed stream banks. Additionally, the proposed greenway has been designed to utilize pedestrian bridges to avoid stream impacts. Neuse River Riparian Buffers The proposed project avoids riparian buffers with the exception of permanent impacts from the sewer main, permanent impacts from the greenway and temporary impacts from construction of retaining wells. The proposed sewer main was designed to avoid buffer impacts to the maximum practical extent. The sewer main was designed along the northern edge of the development in order to tie into existing sewer north of the property boundary. The proposed sewer main avoided riparian buffers with the exception of one stream crossing (Impact 9) and one parallel impact (Impact 8). Impact 9 could not be avoided due to the dam and outfall pipe associated with the large pond to the north, as well as the large wetlands and additional buffers to the south. Impact 9 has been designed to cross riparian buffers at a perpendicular angle to minimize impacts to buffers. As previously discussed, the sewer easement cannot be located on the proposed slope and therefore was designed at the toe of slope, resulting in Impact 8. The proposed greenway avoided all riparian buffers with the exception of a parallel impact on the dam of the pond (Impact 10) and a perpendicular crossing of a beaver impoundment (Impact 16) which is necessary to provide pedestrian access to the eastern portion of the project. The greenway running north/south in the eastern part of the project is part of the larger greenway master plan, which will connect the existing and future development to the existing greenway trail to the north. The greenway crossing over the beaver impoundment has been designed to cross riparian buffers at a perpendicular angle to minimize impacts to buffers The proposed site requires retaining walls to stabilize the steep slopes from adjacent site fill. The proposed retaining wells throughout the proposed site were designed outside of buffers. The temporary buffer impacts (Impacts 12, 13, 14 & 15) have been limited to only those necessary for temporary access for equipment and labor during construction of the retaining wall. The temporary buffer impacts are considered a "temporary road impacting less than 2500 SF", and therefore is classified as "Exempt'. Silt fencing will be installed around all disturbed areas to prevent sediment from escaping into adjacent wetlands and waters during construction. During construction, all equipment will access construction areas from high ground. 1b.
