Styles NC DOT PO Box 250 Bryson City, NC 28713 Dear Mr. Styles: You have our approval, in accordance with the attached conditions and those listed below, for the purpose of widening SR 1129, as you described in your application dated August 10, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3103. This certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. An additional condition is that stormwater shall be directed to sheetflow at non-erosive velocities through the protected stream buffers. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Field Office Room 75, Grove Park Ave. Asheville, NC 28801-2714 Dear Mr. Johnson: 401'SS( E DAVID MCCOY SECRETARY The North Carolina Department of Transportation is proposing to grade, drain, base and pave primarily along the existing roadway of SR 1129, Little East Fork Road in Haywood County. In order to construct this project in accordance with our current secondary road standards, and due to the replacement and extension of three (3) pipe culverts in three unnamed tributaries of the Little East Fork of the Pigeon River (DEM Class WS-III, Tr), we are requesting authorization under Section 404 of the Clean Water Act. I am sending a straight-line diagram with our proposed erosion control and construction limits at various sites along this project. In addition, a typical section of the road, drawings for the pipe replacements/extensions in the unnamed tributaries of the Little East Fork-of the Pigeon River, general notes and standards on erosion control measures, and a marked County Map are enclosed. We propose to install the new culverts slightly below the existing stream bed elevation where bedrock is not encountered to minimize impact to Wildlife habitat and allow the existing stream gradients to remain as unchanged as physically possible. The best management practices will be used to minimize and control sedimentation and erosion on this project. The construction foreman will review all erosion control measures daily to ensure sedimentation and erosion controls are being effectively controlled. If the planned devices are not functioning as intended, they will immediately be replaced with better devices. The silt fences and other erosion control devices will be in place prior to pipe construction and wily remain in place until the project is stabilized. P.O. The type-B silt basin is generally built in conjunction with temporary rock silt checks and other devices that control or slow down water flow. This device must be monitored closely and cleaned out on a regular basis until grass is established along the ditch line and sedimentation is no longer a problem. AREAS OF USE: • In conjunction with temporary rock silt checks and other devices used in drainage ditches. Pock silt screens shall be used to trap sediment transported by running water and shall be placed in the stream below the construction site within the right-of- way or easement boundary. The rock silt screen utilizes class B stone lined with #5 or #57 stone to produce a ripple-effect in the stream to settle the larger sediment particles transported in the stream from the construction site. The trapped sediment shall be cleaned out before the device is removed from the stream.
