Explain the purpose of the proposed project:* The purpose of the proposed project is to develop an emergency operations center on property owned by Chatham County in order to provide a central location for emergency management operations during emergencies such as natural disasters. The proposed facility will house the Emergency Management and 911 Communications departments. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The proposed project consists of the construction of the Emergency Operations Center, access road, parking, stormwater management and utilities (water, sewer, etc). A total of 35,000 sf of building space is proposed in order to house the Emergency Management and 911 Communications departments, as well as provide ancillary space to accommodate additional staff and equipment during large scale emergencies operations and training events. Chatham County purchased the 269-acre parcel for the specific purpose of constructing the proposed Emergency Operations Center. While there may be future Chatham County facilities relocated to the subject property, there are no current plans or design for future phases beyond the Emergency Operations Center, and the project as proposed is a single and complete project. All impacts necessary for the construction of the proposed Emergency Operations Center are addressed in this application. E. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project The proposed impacts consist of 136 If of permanent stream impacts and 27 If of temporary stream impacts. The installation of the proposed 114-ft long, 60-inch RCP culvert will result in 118 If of permanent stream impact with functional loss (Impact 2) as well as 27 If of temporary stream impacts (Impact 1) for installation of the culvert and construction of the temporary coffer dam for dewatering during construction. The culvert will be embedded 12 inches below the stream bed to allow for passage of aquatic life. The installation of the rip -rap dissipator below the culvert will result in 18 If of permanent stream impacts (no functional loss) (Impact 3). The installation of the rip -rap dissipater will result in 27 If of permanent stream impacts. The rip -rap will be installed by burying the rip -rap such that the top of the rip -rap matches the preconstruction contours of the streams, allowing for the passage of aquatic life and preventing a function loss of this section of stream. Headwalls will be constructed on both ends of the culverts to stabilize greenway fill and minimize stream impacts. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Access during construction will occur from uplands. Silt fencing will be installed around all disturbed areas to prevent loss of sediment into adjacent waters. Sediment basins will be installed per the S&EC permit. 2. WR reviewed the NC Natural Heritage Program database, located at http://www.ncnhp.org/web/nhp/home, as well as NCNHP GIS data to identify if there were any known occurrences of endangered species on or near the proposed project. The review of the NHP data did not identify any recent occurrences of federally listed threatened or endangered species or critical habitat on the subject property or within 1.0 miles of the project, see attached NCNHP project review letter. Furthermore, site reviews did not identify any potential habitat for any federally protected species known to occur in Chatham County. Therefore, the proposed project Will have No Effect on federally protected species. While the proposed project is located within the USFWS known range of Atlantic pigtoe, Stream 1 is a small perennial stream (approx 5-ft wide) with very shallow flow and was not considered potential habitat for Atlantic pigtoe. The database review did not identified the Apen Hall site (Site ID CH0009) located on the parcel adjacent to the south of the proposed project. Apen Hall is described as a 1790's Georgian 2-story frame house, Greek Revival expansion, and was listed on the National Register of Historic Places in 1982. Apen Hail is located on a large parcel, and there will be a very wide vegetated buffer between Apen Hall and the proposed project. This delisting took effect August 8,2007. After delisting, the Bald and Golden Eagle Protection Act (Eagle Act) (16 U.S.C. 668-668d) becomes the primary law protecting bald eagles. The Eagle Act prohibits take of bald and golden eagles and provides a statutory definition of "take" that includes "disturb". The USFWS has developed National Bald Eagle Management Guidelines to provide guidance to land managers, landowners, and others as to how to avoid disturbing bald eagles. The T(S/A) designation bans the collection and interstate and international commercial trade of bog turtles from the southern population. The T(S/A) designation has no effect on land management activities by private landowners in North Carolina, part of the southern population of the species. In addition to its official status as T(S/A), the U.S. Fish and Wildlife Service considers the southern population of the bog turtle as a Federal species of concern due to habitat loss.
