Box 25201 Raleigh, NC, 27611-5201 Dear Mr. Gilmore: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.19 acres of wetlands and 908 linear feet of streams for the purpose of constructing improvements to US 25 from SR 1528 to SR 1361. The project should be constructed in accordance with your application dated 25 May 1999 (received 21 June 1999). After reviewing your application, we have decided your application is covered by General Water Quality Certification Numbers 3108 and 3103. These certifications correspond to the Nationwide Permit Numbers 26 and 14, respectively issued by the Corps of Engineers. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetl9nd fills for the project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). For this approval to remain valid, you must adhere to all the conditions listed in the attached certification. Compensatory mitigation shall be done for 872 linear feet of stream impact. We understand that you have chosen to perform mitigation through an in lieu payment to the North Carolina Wetland Restoration Program (NCWRP), and that the WRP has agreed to implement mitigation for the project. In accordance with 15A NCAC 2R.0500, the contribution will satisfy our compensatory mitigation requirements under 15A NCAC 211.0506(h). Until the Wetland Restoration Program receives and clears your check (made payable to DENR - Wetland Restoration Program), wetland or stream fill shall not occur. The payment to NCWRP shall be sent within two months of issuance of the 404 permit. The project begins at the intersection of US 25 and SR 1361 in the township of Fletcher in Henderson County and ends at the intersection of US 25 and US 25A/NC 280 south of Asheville in Buncombe County. Impacts associated with this project were evaluated in an Environmental Assessment dated March 29, 1996 and a Finding of No Significant Impact dated March 18, 1997. US 25 will be widened on existing alignment to a five-lane, 66.0 foot curb and gutter section. This width includes 14.0 foot outside lanes to accommodate bicycle traffic, 11.0 foot inside through lanes and a 12.0 foot inside turning lane. The bridge over I-26 will be restriped to accommodate six lanes. Two left-turn lanes will replace the existing single left-turn lane shared by each direction. The widening will be asymmetrical as described on page 9 of the referenced Environmental Assessment. Enclosed please find a project site map, and a pre-construction notification form. This project will impact approximately 0.14 acre of jurisdictional wetlands and approximately 741.0 linear feet of jurisdictional surface waters. It is anticipated that construction of this project will be authorized under a Department of the Army Nationwide Permit No. 14. The project begins at the intersection of US 25 and SR 1361 in the township of Fletcher in Henderson County and ends at the intersection of US 25 and US 25A/NC 280 south of Asheville in Buncombe County. Impacts associated with this project were evaluated in an Environmental Assessment dated March 29, 1996 and a Finding of No Significant Impact dated March 18, 1997. US 25 will be widened on existing alignment to a five-lane, 66.0 foot curb and gutter section. This width includes 14.0 foot outside lanes to accommodate bicycle traffic, 11.0 foot inside through lanes and a 12.0 foot inside turning lane. The bridge over I-26 will be restriped to accommodate six lanes. Two left-turn lanes will replace the existing single left-turn lane shared by each direction. The widening will be asymmetrical as described on page 9 of the referenced Environmental Assessment. Enclosed please find a project site map, and a pre-construction notification form. This project will impact approximately 0.14 acre of jurisdictional wetlands and approximately 741.0 linear feet of jurisdictional surface waters. It is anticipated that construction of this project will be authorized under a Department of the Army Nationwide Permit No. 14. The project begins at the intersection of US 25 and SR 1361 in the township of Fletcher in Henderson County and ends at the intersection of US 25 and US 25A/NC 280 south of Asheville in Buncombe County. Impacts associated with this project were evaluated in an Environmental Assessment dated March 29, 1996 and a Finding of No Significant Impact dated March 18, 1997. US 25 will be widened on existing alignment to a five-lane, 66.0 foot curb and gutter section. This width includes 14.0 foot outside lanes to accommodate bicycle traffic, 11.0 foot inside through lanes and a 12.0 foot inside turning lane. The bridge over I-26 will be restriped to accommodate six lanes. Two left-turn lanes will replace the existing single left-turn lane shared by each direction. The widening will be asymmetrical as described on page 9 of the referenced Environmental Assessment. Enclosed please find a project site map, and a pre-construction notification form. This project will impact approximately 0.14 acre of jurisdictional wetlands and approximately 741.0 linear feet of jurisdictional surface waters. It is anticipated that construction of this project will be authorized under a Department of the Army Nationwide Permit No. 14. No. STP-25(= The North Carolina Department of Transportation proposes to widen existing US 25 to five lanes to improve traffic flow and improve safety. The project begins at the intersection of US 25 and SR 1361 in the township of Fletcher in Henderson County and ends at the intersection of US 25 and US 25A/NC 280 south of Asheville in Buncombe County. Impacts associated with this project were evaluated in an Environmental Assessment dated March 29, 1996 and a Finding of No Significant Impact dated March 18, 1997. US 25 will be widened on existing alignment to a five-lane, 66.0 foot curb and gutter section. This width includes 14.0 foot outside lanes to accommodate bicycle traffic, 11.0 foot inside through lanes and a 12.0 foot inside turning lane. The bridge over I-26 will be. restriped to accommodate six lanes. Two left-turn lanes will replace the existing single left-turn lane shared by each direction. The widening will be asymmetrical as described on page 9 of the referenced Environmental Assessment. The USACE has expressed concern about the amount of tail ditching at permit sites 6 and 7 from the original permit application, dated August 20, 1998. In an October 27, 1998 memorandum, the USACE requested that the tail ditching be reduced at sites 6 and 7. Site 6 involves the piping of approximately 386 linear feet of perennial stream channel, as well as 98.4 linear feet of tail ditching. The total length of tail ditching was reduced from 141.0 linear feet to 98.4 linear feet. As requested, tail ditching at site 7 was reduced from 2 the originally proposed 551.0 linear feet to 150.0 linear feet. Plan sheets depicting the described revisions ark included for your review. Improvements to US 25 from SR 1528 to SR 1361, TIP No. R-2214B, State Project No. 8.1951101, Federal Aid Protect No. STP-25(3) The North Carolina Department of Transportation proposes to widen existing US 25 to five lanes to improve traffic flow and improve safety. The project begins at the intersection of US 25 and SR 1361 in the township of Fletcher in Henderson County and ends at the intersection of US 25 and US 25A/NC 280 south of Asheville in Buncombe County. Impacts associated with this project were evaluated in an Environmental Assessment dated March 29, 1996 and a Finding of No Significant Impact dated March 18, 1997. US 25 will be widened on existing alignment to a five-lane, 66.0 foot curb and gutter section. This width includes 14.0 foot outside lanes to accommodate bicycle traffic, 11.0 foot inside through lanes and a 12.0 foot inside turning lane. The bridge over 1-26 will be restriped to accommodate six lanes. Two left-turn lanes will replace the existing single left-turn lane shared by each direction. The widening will be asymmetrical as described on page 9 of the referenced Environmental Assessment. The USACE has expressed concern about the amount of tail ditching at permit sites 6 and 7 from the original permit application, dated August 20, 1998. In an October 27, 1998 memorandum, the USACE requested that the tail ditching be reduced at sites S and 7. Site 6 involves the piping of approximately 386 linear feet of perennial stream channel. as well as 98.4 linear feet of tail ditching. The total length of tail ditching was reduced from 141.0 linear feet to 98.4 linear feet. As requested, tail ditching at site 7 was reduced from A 'W s the originally proposed 551.0 linear feet to 150.0 linear feet. Plan sheets depicting the described revisions are included for your review. A revised table showing impacts to waters of the United States is shown as Table 1. Table I . The project begins at the intersection of US 25 and SR 1361 in the township of Fletcher in Henderson County and ends at the intersection of US 25 and US 25A/NC 280 south of Asheville in Buncombe County. Impacts associated with this project were evaluated in an Environmental Assessment dated March 29, 1996 and a Finding of No Significant Impact dated March 18; 1997. US 25 will be widened on existing alignment to a five-lane, 66.0 foot curb and gutter section. This width includes 14.0 foot outside lanes to accommodate bicycle traffic, l L' 'toot inside through lanes and a 12.0 foot inside turning lane. The bridge over I-26 will be restriped to accommodate six lanes. Two left-turn lanes will replace the existing single left=turn lane shared by each direction. The widening will be asymmetrical as described on palp 9 .of the referenced Environmental Assessment. The USACE has expressed concern about the amount of tail ditching at permit sites 6 and 7 from the original permit application, dated August 20, 1998. In an October 27, 1998 memorandum, the USACE requested that the tail ditching be reduced at sites 6 and 7. Site 6 involves the piping of approximately 386 linear feet of perennial stream channel ' as well as 98.4 linear feet of tail ditching. The total length of tail ditching was reduced from 141.0 linear feet to 98.4 linear feet. As requested, tail ditching at site 7 was reduced from • rr.. TIP No. R-2214B, State Proiect No. 8.195 Federal Aid Proie:;: No. STP-25(3) The North Carolina Department of Transportation proposes to widen existing US 25 to five lanes to improve traffic flow and improve safety. The project begins at the intersection of US 25 and SR 1361 in the township of Fletcher in Henderson County and F ends at the intersection of US 25 and US 25A/NC 280 south of Asheville in Buncombe .County. Impacts associated with this project were evaluated in an Environmental Assessment dated March 29, 1996 and a Finding of No Significant Impact dated March 19, 1997. US 25 .will, be widened on existing alignment to a five-lane, 66.0 foot curb and gutter section. This width includes 14.0 foot outside lanes to accommodate bicycle traffic, 11.0 foot inside through lanes and a 12.0 foot inside turning lane. The bridge over I-26 will be restriped to accommodate six lanes. Two left-turn lanes will replace the existing single left-turnlane shared by each direction. The widening will be asymmetrical as described on page 9 of the referenced Environmental Assessment. The1, has expressed concern about the amount of tail ditching at permit sites 6 and 7 from the original permit application, dated August 20, 1998. In an October 27, 1998 ,.the USACE'requested that the tail ditching be reduced at sites 6 and 7. memorandum Site 6 involves the piping of approximately 386 linear feet of perennial stream channel as well as 98.4 linear feet of tail ditching. The total length of tail ditching was reduced from 141.0 linear feet to 98.4 linear feet. As requested, tail ditching at site 7 was reduced from 0 2 the originally proposed 551.0 linear feet to 150.0 linear feet. Plan sheets depicting the described revisions are included for your review. A revised table showing impacts to waters of the United States is shown as Table 1. Table .a.
