Dear Mr. Moore:
You have our approval, in accordance with the attached conditions, for the purpose of road improvement; as you
described in your application dated May 28, 1999. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3099. This Certification allows you to use Nationwide Permit
Number 030 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater,
Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or
CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This
approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

SECRETARY
I am attaching a straight line diagram with erosion control plan, a completed
Division of Water Quality application form, and a county map section relative to
the paving of SR 1359, Carpenter Road in Rutherford County.
Carpenter Road is presently 16-18 feet wide. We plan to pave the road 18
feet wide and increase the typical section. The typical section is also attached.
Grading will be moderate to heavy. The project begins at SR 1351 and
continues in a northerly direction for a distance of 2.34 miles to SR 1331.
We propose to extend six culverts (1) extend 36" culvert 20 feet at survey
station 17+25, (2) extend 72" culvert 30 feet at survey station 44+70, (3) extend
the 36" culvert 20 feet at survey station 62+10, (4) extend the 60" culvert 31 feet
at survey station 77+90, (5) extend 48" culvert 21 feet at survey station 98+28
and (6) extend the 60" culvert 26 feet at survey station 122+35.
At these locations, we will maintain upstream and down stream pre-
construction channel widths and depths for bedload self-scouring and aquatic
life migration. We will preserve indigenous plants where practical for planting
along the stream banks. We will utilize mats to line the disturbed stream banks.
We will also use natural substrate to line the bed of the disturbed channel.

NOTES AND PROVISIONS PERTAINING TO STRAIGHT LINE DIAGRAM
1. Assigned right of way agent needs to verify all property owners. Property owners shown on
the straight line diagram are taken from tax maps only.
2. Fences to be moved off the right of way and reset off right of way by the Department of
Transportation crews. Any new materials, posts, wire, etc.. to be supplied by the property
owner.
3. Existing asphalt or concrete drives to be tied in with asphalt if the existing driveway is
within 20 feet of proposed centerline. See any exceptions on straight line diagram.
4. Driveway pipes to be furnished and installed as needed by Department of Transportatio

EROSION CONTROL PLAN SHEET
Generally, the order of installation of the erosion control measures will be
as follows:
Temporary silt basins shall be installed before clearing and
grubbing begins.
Silt fences and temporary silt ditches shall be installed after
clearing and before grading.
Temporary stone ditch checks shall be installed as soon as
ditch line is established.
Pipe outlet and inlet protection will be done as soon as the
pipe is installed.
Seeding and other permanent erosion control measures are
to be implemented as soon as practical.
Temporary rock silt checks (type B) will be spaced as required
by percent of grade as described on page VI-16 in the Erosion
and Sedimentation Guidelines.
No. 5 stone, or equivalent, will be used in conjunction with
temporary rock silt check Type-B in locations where water is
leaving the project or entering a pipe.
