After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the 1. Mitigation shall be credited for 0.6 acres from the Scuppernong Mitigation Bank. If you do not accept any of the conditions of this certification, you may ask for an hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Prior to paving the road, minor changes in the X-section will be accomplished to provide for minimal safety allowances. The proposed work will impact 0.29 acre of Section 404 jurisdictional wetlands located along the fringe of a mixed deciduous palustrine forested wetland. This action requires authorization from the U.S. Army Corps of Engineers (USACE) as well as a Section 401 Water Quality Certificate from the N.C. Division of Water Quality. The Department has proposed to offset the loss of 0.29 acre of palustrine forested nonriverine wetland by providing compensatory mitigation at the Scuppernong Mitigation Bank in Tyrrell County. The Department has agreed to offer 0.6 credit (based upon a 2:1 restoration ratio) at the subject mitigation site. The enclosed Pre-Construction Notification, a check for $200.00 and site drawings are submitted for your consideration. Please issue the Water Quality Certificate at your earliest opportunity. PROJECT SUMMARY: Applicant proposes to upgrade and pave an existing unpaved secondary road. The upgrading will require clearing, grubbing and filling in adjacent highground and 404 wetland. Project setting Virginia Lee Beach road is a 30'x 3,300' unpaved secondary road maintained by the North Carolina Department of Transportation (NC DOT) located in Tyrrell County off SR 1209 in the Soundside Community on the south side of Albemarle Sound. This road provides access to residences located at Virginia Lee Beach. The road runs north-south adjacent an agriculture ditch and field on the east side, and a forested tract on the west side, for 1,650', then turns west-east across 700' of wooded wetland before reaching residences of Virgina Lee Beach. The forested tract is predominately vegetated with loblolly pine (Pinus taeda) while the wooded wetland consist of mixed softwoods including bald cypress (Taxodium distichum), red maple(Acer rubrum), sweet gum (Liquidambar stvracflua) and black gum (Nyssa y s l vatica). The agricultural ditch is 1,850' long and 8' wide and has a flood gate installed prior to entering the wooded wetland. CAMA juristiction begins at the flood gate. The ditch bisecs the wetland and empties into an existing canal that empties to the Albemarle Sound which is classified as SB waters by the Environmental Managment Commission and Coastal Waters by the Marine Fisheries Commission. A Major CAMA Permit (5-92) was issued in January 1992 to do maintenance excavation in the agricultural ditch through the wooded wetland. The maintenace excavation was completed in May 1992. The road bisecs the wetland before reaching home sites located at Virginia Lee Beach adjacent the Albemarle Sound. Project description NC DOT is proposing to reroute the first 200' of Virgina Lee Beach adjacent SR 1209 through an agricultural field connecting it to the existing road, then upgrade and pave the entire road. The upgading will include widening the existing road by approximately 12' to accommodate 18' of pavement with 6' of. shoulder on each side. The project will result in the disturbance of 2.71 acres and the filling of 0.29 acre of wooded wetland. NC DOT is proposing to mitigate for the wetland impacts with a 2:1 ratio utilizing 0.6 acres of the existing balance in the Scuppernong Mitigation Bank located on NC 94 south of Columbia in Tyrrell County. Anticipated impacts The project as proposed would result in the loss of 0.29 acre of wooded wetland. Impervious surfaces resulting from the ugraded road would increase surface runoff into the exiting ditch and connecting water bodies as well as the adjacent wooded wetland areas. The project will improve driving conditions for residences of Virgina Lee Beach traveling to and from their residences.
