Box 1551 Andrews N.C. 28901 Dear Mr. Anderson: You have our approval, in accordance with the attached conditions, to place fill material in 225 Linear feet of streams for the purpose of widening and paving SRI 375, as you described in your application dated 1 March, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This Certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N C ~2a-7447. This certification and its conditions are final and binding unless you ask for a hearing. 4-h1 letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. NoRRis TOLSON SECRETARY The North Carolina Department of Transportation is proposing to widen and pave SR 1375, Boga Memory Lane, in Macon County to conform to our current secondary road standards. To construct this project, it will be necessary to extend a 72-inch corrugated steel pipe culvert located on Camp Branch (DEM Class C, Trout Water) and relocate 225 feet of stream channel which is a small unnamed tributary to Camp Branch. Due to the nature of our proposed work, we are requesting authorization under Section 404 of the Clean Water Act. We"intend to exercise every reasonable precaution to protect the environmental integrity of these valuable natural resources. The channel change will be constructed before stream flow is permanently diverted. By doing this under dry conditions, the downstream movement of silt will be greatly minimized thereby protecting Camp Branch as much as possible from the effects of our construction work. I am sending a straight-line diagram, with the proposed erosion control, stream, stream bank, and construction limits at various sites along the project where we will be in conflict with the streams. In addition, I am sending a typical section of the road, cross- sections, drawings for pipe culvert extensions, general notes, and standards on some erosion control measures, and a marked map. We propose to install all the new culverts slightly below the existing streambed elevations where bedrock is not encountered to minimize impacts to wildlife habitats and allow the existing steam gradients to remain as unchanged as is physically possible. The construction foreman will review all erosion control measures daily to ensure sedimentation and erosion are being effectively controlled. If the planned devices are not functioning as intended, they will immediately be replaced with better devices. The rock silt screens and other erosion control devices will be in place prior to pipe culvert and channel change construction and will remain in place until the project is stabilized. By copy of this letter I am asking Mr. Mark Davis, North Carolina Wildlife Resources Commission (NCWRC) Western Mountain Region Coordinator, to comment directly to you concerning this 404 Nationwide Permit request. A request will be made for a temporary encroachment in the Trout Water Buffer Zone of the unnamed tributary to Camp Branch on this project and I am asking Mr. Davis and Mr. Ed Ingle, Area Roadside Environmental Engineer (NCDOT) to comment directly to me concerning the Trout Water Buffer Zone Encroachment. Also, by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. It is made of permeable filter fabric buried at the bottom, stretched and supported by steel posts. The silt fence reduces the water flow while retaining the sediment. They may also be used to divert water flow to protected outlets. Silt fences need to be checked after each significant rainfall to ensure there effectiveness. The silt basin is built at the base of the ditch with its length being at least 2 times the width of the basin. The type-B silt basin is generally built in conjunction with temporary rock silt checks and other devices that control or slow down water flow. This device must be monitored closely and cleaned out on a regular basis until grass is established along the ditch line and sedimentation is no longer a problem. Nowus TOLSON SECRETARY The North Carolina Department of Transportation is proposing to widen and pave SR 1375, Boga Memory Lane, in Macon County to conform to our current secondary road standards. To construct this project, it will be necessary to extend a 72-inch corrugated steel pipe culvert located on Camp Branch (DEM Class C, Trout Water) and relocate 225 feet of stream channel which is a small unnamed tributary to Camp Branch. Due to the nature of our proposed work, we are requesting authorization under Section 404 of the Clean Water Act. We intend to exercise every reasonable precaution to protect the environmental integrity of these valuable natural resources. The channel change will be constructed before stream flow is permanently diverted. By doing this under dry conditions, the downstream movement of silt will be greatly minimized thereby protecting Camp Branch as much as possible from the effects of our construction work. I am sending a straight-line diagram, with the proposed erosion control, stream, stream bank, and construction limits at various sites along the project where we will be in conflict with the streams. In addition, I am sending a typical section of the road, cross- sections, drawings for pipe culvert extensions, general notes, and standards on some erosion control measures, and a marked map. We propose to install all the new culverts slightly below the existing streambed elevations where bedrock is not encountered to minimize impacts to wildlife habitats and allow the existing steam gradients to remain as unchanged as is physically possible. The rock silt screens and other erosion control devices will be in place prior to pipe culvert and channel change construction and will remain in place until the project is stabilized. The silt basin is built at the base of the ditch with its length being at least 2 times the width of the basin. The type-B silt basin is generally built in conjunction with temporary rock silt checks and other devices that control or slow down water flow. This device must be monitored closely and cleaned out on a regular basis until grass is established along the ditch line and sedimentation is no longer a problem. AREAS OF USE: In conjunction with temporary rock silt checks and other devices used in drainage ditches. These type-B rock silt checks help reduce the flow velocity and are generally made of class-B stone. They are used in ditches during construction where the grade meets and/or exceeds 3%. AREAS OF USE: In channels, roadside ditch outlets, temporary silt ditches, and temporary diversions. In conjunction with type-B silt basins. DESIGN CRITERIA: Center of rock silt check shall be at least 1 (top of channel sides) The spacing (ft.) _ (3 / % of ditch grade) X VI-16 foot lower than the outer edges 100 ft. N VI-17 March, 1993 ROCK SILT SCREEN: 7 A rock silt screen is a low-level dam structure to be used in streams below culvert sites. Rock silt screens shall be used to trap sediment transported by running water and shall be placed in the stream below the construction site within the right-of- way or easement boundary. The rock silt screen utilizes class B stone lined with #5 or #57 stone to produce a ripple-effect in the stream to settle the larger sediment particles transported in the stream from the construction site. The trapped sediment shall be cleaned out before the device is removed from the stream. AREAS OF USE: • In live streams below construction sites where construction occurs in or adjacent to the stream. • In live streams below a culvert construction site. • Where it can be cleaned before it is removed from stream.
