Based on your submittal and signed certification of no exposure at the above referenced facility as well as observations made by Thad Valentine with the Raleigh Regional Office on July 30, 2020, the Division is granting your conditional exclusion from permitting as provided for under 40 CFR 122.26(g), which is incorporated by reference in North Carolina regulations. Please note that by our acceptance of your No Exposure Certification, you are obligated to maintain no exposure conditions at your facility. If conditions change such that your facility can no longer qualify for the No Exposure Certification, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. You must self re -certify annually using the enclosed form or obtain NPDES permit coverage for any stormwater discharges from your facility. Since this was a temporary facility and was activity for so short a duration that would not need a No Exposer the annual self re -certification needs no consideration. Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances. Hello Whitney, NC DENR was able to provide the below determination stating the temporary RDUS-RST would not require a SW Permit or NEC. You had also asked — Is there any exemption for temporary sites to not be subject to the city's recycling ordnance? The City Ordinance does not state any exemption from the recycling requirements for temporary sites. We have called the City today to verify, but the City has not been responsive in the few attempts. We can keep trying to connect with them. Concerning our conversation with the Amazon RDU5_RST site in Durham at 2119 NE Creek Parkway, DEQ will not require a no exposer certificate for the temporary site. After our discussion on what equipment will be located at the site and the short duration the area will be setup and active (6 months or less), no stormwater permits will be required from us. Please be sure the site is monitored to ensure no pollutants are discharged and the site is kept in good order. Good speaking with you and stay safe. Processing No Exposure (NCGNE) Certification Applications 1. Application received by Central Office (CO) 2. CO enters application in BIMS and tracks status on spreadsheet I CO scans and uploads application into Laserfiche 4. CO launches workflow to Regional Office (RO) 5. CO sends original signed application to RO for file 6. RO creates paper file for original signed application 7. RO inspects facility and verifies if eligible for NCGNE within 60 days of receipt of NCGNE Application 8. RO enters inspection report in BIMS c Type of inspection = Compliance Evaluation The purpose of this inspection is to determine if the facility complies with NEC requirements, that's why you use Compliance Evaluation in BIMS. 9. RO drafts and sends letter granting or denying eligibility for NCGNE 10. RO scans and uploads copy of letter into Laserf the 11. RO emails CO to notify whether NCGNE is granted or denied 12.
