Dear Mr. Gilmore:
You have our approval, in accordance with the attached conditions, for the purpose of replacing bridge 273 in
Rutherford County, as you described in your application dated January 1/7/99. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3107. This Certification allows you to
use Nationwide Permit Number 23 when the Corps of Engineers issues it. In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Subject: Rutherford County, Replacement of Bridge No. 273 over the Broad River on
SR 1106, Federal Aid Project No. BRZ-1106 (2), State Project No. 8.2890501.
T.I.P. No. B-3041. Action I.D. 199702359.
On January 15, 1997 the North Carolina Department of Transportation distributed a
Categorical Exclusion document for the above referenced project proposing to proceed
under a Nationwide Permit in accordance with 33 CFR Appendix A (B-23). On May 9,
1997, the Corps of Engineers verified the issue of a Nationwide 23 permit. The project
now requires the construction of a temporary rock causeway to provide construction
access. Construction of the proposed temporary rock causeway is depicted in the
attached drawings (Sheets 1 to 5 of 5). The causeway will facilitate the construction of
the drilled shafts and placement of the structural steel. Temporary fill in surface waters
will be 0.08 acres.
Restoration Plan: The temporary fill will consist of Class I riprap. No permanent fill will
result from the subject activity. Reference elevations are available for the area of
proposed construction of the temporary causeways. The equipment to be used will be
rotary track backhoe or Grade-All. Following construction of the causeways, all material
used in the construction of the temporary causeways will be removed. The temporary fill
area will subsequently be restored to its original contour and rough surface texture. The
temporary impact area is expected to recover naturally, since the natural streambed and
plant material will not removed.
Schedule: The project schedule calls for letting in January 1999 with a date of
availability of March 1, 1999. It is expected that the contractor will choose to start
construction of the causeway at that time. We expect that the construction will be
completed by December 2000. The causeways will stay in place for 12 to 18 months and
should be removed between March and September 2000.
Disposal: The fill will be disposed of in non jurisdictional, upland locations. The exact
site and use of the material will be determined by the Resident Engineer and the
Contractor. The material will not be side cast into the water.
It is anticipated that the above mentioned activities will be authorized under Section 404
Nationwide Permit 33 (Temporary Construction Access and Dewatering). We are,
therefore, requesting the issuance of a nationwide permit authorizing construction of the
causeway. We anticipate a 401 General Certification will apply to this project, and are
providing one copy of the application to the North Carolina Department of
Environmental and Natural Resources, Division of Water Quality, for their review.
