REGAN Secretary BRIAN WRENN Acting Director Kevin Varnell Stocks Engineering PO Box 1108 Nashville, NC 27856 NORTH CAROLINA Environmental Quality July 29, 2020 Subject: Request for Additional Information Stormwater Permit No. SW5200701 Bojangles at Spring Hope, NC Nash County Dear Mr. Varnell: The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater Management Permit Application for the subject project on July 6, 2020. A review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. Please complete Part II.2 of the SWU-101 application form specifying the type of project. 2. The project density in Part IV.8 of the SWU-101 application form does not match the project density shown in the table under Part IV.10. 3. Please submit a Supplement EZ form for the project. The Supplement EZ form can be found here: hgps:Hdeq.nc.gov/about/divisions/energy-mineral-land-resources/energy mineral-land-permit-guidance/stormwater-bmp-manual. 4. 15A NCAC 02H .1042(2)(b)(ii) requires documentation from the NC Secretary of State or other official documentation showing the titles and positions held by the person who signed the application. Because the individual who signed the application is not listed on the Secretary of State's website, further verification that this person is authorized to sign the application is required. This could be either a signed letter from one of the individuals listed by the Secretary of State confirming that this person is authorized or other official documentation from the LLC. 5. The project does not meet the goals of the low density regulations, which are to spread out built upon area and promote sheet flow over pervious areas. Although the project density over the whole property is less than 24%, most of the pervious area is outside of the project area. Also, very little flow over pervious surfaces is provided. The Division will consider the project high density. 6. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other documents. Pdfs must be uploaded using the form at: https://edocs.deg.nc.gov/Forms/SW_Project Submittal Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to August 28, 2020, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. Please reference the State assigned project number SW5200701 on all correspondence. If you need additional time to submit the information, please submit your request for a time extension to the Division at the contact below. The request must indicate the date by which you expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application to issue the permit. The construction of any impervious surfaces, other than a construction entrance under an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS 143-215.6A.
