APPROVAL of 401 Water Quality Certification
Dear Mr. Gilmore
You have our approval, in accordance with the attached conditions, to relocate a utility line in conujunction with the
proposed highway improvements, as you described in your application received by the Division of Water Quality on November
5, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification
Number 3101. This Certification allows to use Nationwide Permit Number 12 when the Corps of Engineers issues it. In
addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited
to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this
approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions.
If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached
certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

to SR 1117 Fowler Mountain Road, State Project No. 6.841027, T.I.P. R-2116A.

The North Carolina Department of Transportation (NCDOT) proposes to improve NC 151 from
SR 1110, Warren Creek Road, at South Hominy to SR 1117, Fowler Mountain Road. The
project will widen the existing pavement to a 32-foot pavement, including two 12-foot lanes and
four-foot paved shoulder. Usable shoulders will be eight feet wide including the four foot paved
shoulders. Project design now requires the relocation of waterlines under the creeks at three
jurisdictional sites. We expect that the utility line relocation will be authorized under Nationwide
Permit 12.
JURISDICTIONAL STATUS
There are seven jurisdictional sites on R-2116A as labeled as sites 1, 2, 3, 4, 5, 5a, and 6 in the
previous permit application. At sites 4, 5, and 5a there will be the additional impacts from the
waterline relocations. The jurisdictional status and the impacts of the waterline relocations are
depicted on Table 1. All sites are impacts associated with crossings of unnamed tributaries to
South Hominy Creek.

RESOURCE STATUS
Stream delineations: A jurisdictional surface water investigation was performed on October 6,
1998 by NCDOT biologist Bruce Ellis. Surface waters were investigated in accordance with
guidance provided by the USACE and the N.C. Division of Water Quality. NCDOT project plan
sheets were used to locate and record surface waters. Six perennial and one intermittent
jurisdictional surface waters were identified and characterized as shown in Table 2. Please note
that the waterline will impact only sites 4, 5 and 5a.

Site 4 located at Station 21+48-L is a double barrel culvert. Because of the need to relocate and
upgrade an existing aged waterline, a new water line is proposed which will be installed beneath
the stream bed downstream of the proposed box culvert and constructed in accordance with the
City of Asheville requirements (Sheet 2 of 8). The trench will be 4.4 meters wide and 12 meters
long affecting an area of 52.8 square meters. Trench slopes for waterline installation on streams is
at a 2:1 ratio. See Sheets 3 and 4 of 8.
Site 5 located at Station 29+67-L is a double barrel culvert. The waterline will be placed in the
shoulder of the road. Therefore there will not be any additional impact to jurisdictional waters at
this site. Trench slopes for waterline installation on streams is at a 2:1 ratio. See Sheets 5 and 6
of 8.
Site Sa located at Station 38+73-L is a double barrel culvert. The relocated waterline will be
upstream of another culvert extension and also laid beneath the stream, constructed in accordance
with the City of Asheville requirements (Sheet 2 of 8) and overlaid with stone. The trench will be
4.4 meters wide and 6 meters long affecting an area of 26.4 square meters. Trench slopes for
waterline installation on streams is at a 2:1 ratio. See Sheets 7 and d of 8.
REGULATORY APPROVALS
The NCDOT hereby requests the issuance of Nationwide 12 permit authorizing relocation of the
utility lines. We anticipate the 401 General Certification will apply to this project, and are
providing seven copies of these documents to the North Carolina Department of Environment and
Natural Resources, Division of Water Quality, for their review. In addition, in compliance with
Section 143-215.3D(e) of the NCAA we have enclosed a check to the DWQ for $200.00 to act as
payment for processing the Section 401 permit application. This package of information consists of
this cover letter, a PCN, and project drawings.
This project will take place in a mountain trout county. Thus we anticipate that comments from
the North Carolina Wildlife Resources Commission (NCWRC) will be required. By copy of this
letter and attachment, NCDOT hereby requests NCWRC review.
